“Prior to filing a claim with the UN International Court of Justice, Armenia raised the issue of the trophy park in various international structures”, Deputy Foreign Minister of Azerbaijan Elnur Mammadov said in a briefing today.

Mammadov represented the interests of Azerbaijan during the hearings on the claims of the parties in the International Court of Justice.

According to him, the claim on the War Trophy Park did not come as a surprise to Azerbaijan.

“All confirmed violations committed by the Armenian side will be considered not only in the UN International Court of Justice but also in other international structures so that Armenia is brought to justice for violations of international law”, the Deputy Foreign Minister of Azerbaijan also stated.

He noted that Azerbaijan has filed several lawsuits against Armenia in various international courts since each of them considers complaints within the framework of a certain convention.

“The first claim of Azerbaijan to the European Court of Human Rights in February of this year was filed on the basis of the 1950 European Convention. It concerned the aggressive policy of Armenia towards Azerbaijan, the occupation of the territory of our country by the Armenians and the Armenian aggression during the Patriotic War.

In another lawsuit to the UN International Court of Justice, all the necessary evidence that Armenia is carrying out aggressive propaganda against Azerbaijan, calls for a new war against Azerbaijan, cultivates and incites hatred of Azerbaijan and the Azerbaijani people in its country, both at the level of the population and various organizations, has been presented. Unlike Armenia, Azerbaijan respects the cultural monuments of other countries and religions.

I would like to note that in its lawsuit, Armenia argued that the citizens of Armenian citizens of the Republic of Azerbaijan were detained only because they were Armenians and demanded their return. This demand is not accidental and is connected with the political situation in Armenia. We submitted all relevant court documents to the International Court of Justice with detailed explanations. In addition, there was a demand to treat the detained Armenians humanely, but Azerbaijan presented the court with all the evidence that, was, indeed, the case. According to the Deputy Minister, Azerbaijan will continue filing lawsuits to bring Armenia to justice:

Scandalous statements of Armenian MP spark protests from parents of Armenian prisoners held in Azerbaijan

Previously they were gathered at the building of the Armenian government demanding the return of their relatives but now they also demand an answer regarding the scandalous statements of the speaker of the parliament Alen Simonyan. In a secretly filmed video that circulated on social media, Simonyan said that “for him, these prisoners no longer exist”, these are the military who “threw down their weapons, fled and got lost, as a result of which they were captured”.

Parents of prisoners are outraged that, without trial and investigation, the speaker declared their sons deserters and criminals.

Residents of Armenia are monitoring the situation and actively discussing it on social media since the unresolved issue of the return of prisoners is painfully perceived by the whole society.

The protest of the relatives of the prisoners of war resumed immediately when the video with the scandalous statements of Alena Simonyan appeared on social media. On the evening of December 7, they tried to block the streets intersecting with the main square of Yerevan, where the government building is located. They spent the night in front of the parliament building, and in the morning the protest continued there.

The protesters blocked Baghramyan Avenue, where the main entrance to the parliament building is located, as well as Demirchyan Street, where another entrance is. The police have already detained ten protesters.

The demand of the protesters: either the speaker meets 20 of them, or he must go out and talk with all the protesters. Parents of prisoners believe that the speaker should apologize and clarify his statement.

They want to understand whether this is the personal opinion of Alain Simonyan or he expressed the opinion of the authorities as a whole.

Earlier, the Prime Minister of Armenia Nikol Pashinyan also said that all prisoners should not be declared heroes and the circumstances of their capture should be investigated.

During the protest, the parents have repeatedly said that they agree that after the return of the prisoners an investigation should be carried out, and if the fact of desertion is proved, the perpetrators must be tried.

At the same time, they share what they know about their loved ones and the circumstances in which they find themselves. The protesters are sure that the speaker’s statements are unfair to them and, of course, they still insist on the urgent return of their children from Azerbaijan.

The speaker has not yet met with the protesters.

But on December 7, he already expressed indignation at the fact that people who introduced themselves as comrades-in-arms and like-minded people asked him to answer questions and filmed this conversation, although he asked them not to record it. In addition, he stated that the recording has been edited and his statements were taken out of context.

Political observer Hakob Badalyan commented on the situation, assessing the disseminated video as “a blow to the chairman of the National Assembly or the government in general” and “a blow to the Republic of Armenia as a whole”. The expert asks a rhetorical question of whether the distribution of this video is accidental in parallel with the attempt to put pressure on Armenia, which is now being undertaken by Azerbaijan.

“At the same time, this in no way justifies the“ talkativeness ”of the NA Speaker. Let this assessment not seem harsh, as it is quite mild. […] The Speaker of the Parliament should be very attentive to where he speaks, on what topic and what words he uses”, Hakob Badalyan said.

As for the meaning of Alena Simonyan’s statements, the expert believes that “state policy and state interests cannot be hostages of the prisoner issue”. In his opinion, their problems will not be resolved in this way; instead, new problems will appear for the country’s authorities pursuing state policy.

He admits that “the return of prisoners is an undeniable priority for us, but “not at the expense of security, as painful as it sounds”.

Baku doubts the reliability of the Armenian maps of minefields

The last time such an exchange took place was on 4 December 2021. Azerbaijan handed over 10 military personnel captured during the armed clash on the border of Armenia and Azerbaijan on November 16, 2021. In exchange for its servicemen, Armenia handed over the maps of minefields in several regions which came under the control of Azerbaijan.

According to official information, between November 10, 2020, and November 22, 2021, 180 people were injured or killed by mines in the territories that came under the control of Azerbaijan.
ANAMA employees have cleared a total of 6,286 hectares of mines during this period.
10,455 antipersonnel and 4,640 anti-tank mines were found and neutralized.

Today, the head of the Azerbaijani Agency for Mine Action (ANAMA) Vugar Suleymanov made a statement about the minefield maps and forms handed over by the Armenian side.

“The minefield maps usually indicate the coordinates of the terrain, the types of mines placed, their number, the distance between them, information on the order of location, and camouflage. However, I would like to note that at first glance, the submitted maps create an impression that they are unreliable and inaccurate.

As you know, in order to evade responsibility within the framework of relevant international court cases, the Armenian side made a statement saying that the maps covering all minefields had been transferred. However, we doubt that the maps submitted by Armenia fully reflect the situation with mines in all territories liberated from occupation.

The Azerbaijan Mine Action Agency and the Ministry of Defense of Azerbaijan have already begun work on the analysis and processing of the maps. The data will then be checked for consistency and accuracy.

It should be noted that the accuracy of the data previously provided by Armenia on minefields in the Aghdam, Fizuli, and Zangilan regions is 25%.

UN court fails to order Azerbaijan to release Armenian PoWs

On Tuesday, the International Court of Justice, the principal judicial organ of the United Nations, delivered its Orders on the Request for the indication of provisional measures made by the Republic of Armenia in the case concerning Application of the International Convention on the Elimination of All Forms of Racial Discrimination submitted by Armenia and Azerbaijan.

In its application for indication of urgent measures, Armenia provided evidence of Azerbaijan’s continuing policy of racially motivated killings and torture of Armenian prisoners of war and other detainees, as well as racial hatred towards Armenians and the destruction of Armenian cultural heritage.

The court found that within the framework of the International Convention on the Elimination of All Forms of Racial Discrimination, there is an immediate danger of irreversible damage to the rights of ethnic Armenians and obliged Azerbaijan to do the following:

  • Protect from violence and bodily harm all persons captured in relation to the 2020 Conflict who remain in detention, and ensure their security and equality before the law;
  • Take all necessary measures to prevent the incitement and promotion of racial hatred and discrimination, including by its officials and public institutions, targeted at persons of Armenian national or ethnic origin;
  • Take all necessary measures to prevent and punish acts of vandalism and desecration affecting Armenian cultural heritage, including but not limited to churches and other places of worship, monuments, landmarks, cemeteries and artefacts.

The Foreign Ministry notes that during the oral hearing of the lawsuit filed by Armenia on the application of urgent measures, the Court referred to the official statement of the representative of Azerbaijan that the mannequins depicting Armenian soldiers were removed from the so-called “Trophy Park.”

The Ministry calls attention to the fact that the Court, in its decision, obliged Azerbaijan to take all necessary measures to prevent discrimination and incitement, “including by its officials and public institutions.”

“The Armenophobic rhetoric consistently espoused by the highest leadership of Azerbaijan, the inhumane treatment of Armenians under Azerbaijan’s control or jurisdiction, and the destruction and desecration of the Armenian cultural and religious heritage are insurmountable obstacles to the de-escalation of the situation and peaceful development of the region,” the Ministry stated.

It noted that the Court rulings on the indication of provisional measures recognize these realities and create legally binding obligations under international law to address them.

The Foreign Ministry said Armenia will pursue the implementation of the UN Court’s decisions by Azerbaijan and will inform the Court of any violations, the Ministry of Foreign Affairs said in a statement.

“The Court decision once again reaffirms the legitimacy of the Armenian side’s alarms during this period regarding prisoners of war and other detainees, endangered Armenian historical and cultural heritage in the territories of Artsakh under Azerbaijani control, and anti-Armenian rhetoric voiced by Azerbaijan,” the Foreign Ministry stated.

It calls the attention of the OSCE Minsk Group Co-Chairs and other international partners to the decision of the UN International Court of Justice and urges them to continue their efforts to comprehensively address the identified issues.

Congressman Frank Pallone, Jr.’s (NJ-06) amendment to the National Defense Authorization Act (NDAA) passed the U.S. House of Representatives. The amendment would help advance human rights around the world by requiring the Department of Defense to review existing requirements for conducting human rights training of foreign national security forces participating in security cooperation programs like the Section 333 Building Partner Capacity Program. It also calls for a review to the current Department of Defense (DOD) data collection practices and procedures for accessing, monitoring, and evaluating human rights training programs. The amendment will ensure compliance with U.S. law that prohibits use of funds for assistance to foreign security forces that have committed gross human rights violations.

The NDAA also includes language from an amendment led by Congressman Adam Schiff (CA-28) that Congressman Pallone co-sponsored and calls for the immediate release of the prisoners of war, including civilians, who Azerbaijani President Ilham Aliyev continues to hold hostage as bargaining chips. This language further requires a report from DOD on the deadly 44-day war initiated by Azerbaijani and Turkish forces in the fall of 2020. The report will include an assessment of U.S. weapons systems or technology used in the conflict, a description of the involvement of foreign actors – which were heavily used by Azerbaijan – and any violations of the November 9, 2020 statement that ended most of the fighting.

“The United States has long stood as a beacon for the rights of every person, regardless of race, religion, ethnicity, or nationality. We must continue to lead by example and ensure that American tax dollars do not contradict our values at home or abroad,” Pallone said. “My amendment sends a clear signal that the United States takes seriously its democratic norms and commitment to peace by ensuring oversight of our security assistance. 

“Azerbaijan continues to threaten Armenia’s safety and sovereignty, which makes these amendments especially urgent. The United States should not be aiding and abetting reckless, autocratic states with appalling human rights records for any reason. Because of our efforts, the Department of Defense is now required to undergo a thorough investigation that will bring attention to the gross human rights abuses committed by Azerbaijan during last year’s war and focus on their deadly actions in Armenian territory that are still taking place to this day. Data from this report will help us to finally bring an end to U.S. funding for the murderous Aliyev regime and instead urge strong support of fellow democracies like Armenia,” Pallone concluded.

The amendment is an important step in creating oversight for the Defense Department’s Section 333 Building Partner Capacity Program that has sent enormous sums of money to human rights abusing regimes and dictators, including that of Azerbaijani President Ilham Aliyev, which has numerous documented human rights violations. The Department has spent nearly $4 billion over the last four years on the program. Even though the State Department has singled out Azerbaijani border units for committing human rights violations, those forces received over $100 million in security assistance in fiscal years 2018 and 2019 through the program.

Azerbaijani units open fire in the direction of Armenian positions, target water truck

On December 8, units of the Azerbaijani Armed Forces opened fire from different caliber firearms in the direction of the rear support vehicle (water truck) of a military unit of the Armenian Ministry of Defense located in the eastern direction of the Armenian-Azerbaijani border, the Ministry of Defense reported.
