Recherche de nouvelles voies pour la Loi de pénalisation du
négationnisme du génocide arménien

Après le fiasco du 4 mai dernier au Sénat, une thérapie de groupe
devait se faire. Et si la soirée du CCAF Marseille-Provence mercredi
29 juin à Marseille a davantage vu des déclarations plus qu’un
véritable débat, cette séance collective était nécessaire pour
l’esprit arménien fortement marqué par l’échec du Sénat. Et même si
tous ceux qui attendaient des réponses précises à de nouvelles voies
d’avenir pour la Loi de pénalisation de la négation du génocide
arménien, n’eurent pour réponse que de vagues indications, l’important
était ailleurs : analyser les raisons de l’échec afin de rebondir sur
de nouvelles pistes dans une seconde étape.

Le public apprit que les ingrédients de cet « échec programmé »
étaient réunis bien avant la séance du 4 mai. Comment en est-on arrivé
là ? Julien Harounyan, vice-président du CCAF Marseille-Provence
appelait tout d’abord le président du CCAF-Marseille-Provence Jacques
Donabédian à prendre la parole et situer le débat (voir l’article
d’Armenews consacré à cette intervention. Puis, tour à tour,
sénateurs, députés et élus ont donné leur version qui accusent dans
leur grande majorité la « lcheté » ou le « désintérêt » de nombre de
politiques. Certains ont également jugé que le travail de « lobbying »
en faveur de la Loi de pénalisation qui n’a peut-être pas été
efficace.

Jean Noel Guérini (Sénateur PS), Sophie Joissains (Sénatrice UMP),
Samia Ghali (Sénatrice PS), Henri Jibrayel (Député PS), Richard Mallié
(Député UMP), Valérie Boyer (Député UMP représentant le Sénateur Jean
Claude Gaudin) et Christophe Masse (Ancien député, rapporteur à
l’Assemblée nationale de la loi en 2006) étaient au moins d’accord sur
un point : cette Loi de pénalisation dépassait le clivage politique
gauche-droite. Les politiques étaient également sans concession
vis-à-vis de leurs groupes politiques -à gauche comme à droite- qui
n’avaient pas soutenu cette Loi.

La tension était visible sur le visage des élus présents dans la –
Didier Parakian (Adjoint au maire), Pascal Chamassian (Conseiller
municipal), Colette Babouchian (Conseillère municipale) et Clément
Yana (Conseiller communautaire)- et le large public qui retenait à
peine sa colère. Parmi ce public, quelques intervenants tels que
Mooshegh Abrahamian exprimèrent leur indignation face à cette
situation de « lchage » des politiques face au droit et à la justice.
Armenag Abrahamian, représentant de l’Assemblée des Arméniens de
l’Arménie Occidentale appelait également les Etats aux droits des
Arméniens quant à leur mémoire. Intervention intéressante également
d’Hagop Telfizian qui évoquait le silence des médias et demandait «
comment faire pour intéresser les médias ? ». La réunion se terminait
sur une lueur d’espoir donnée par le président Jacques Donabédian avec
un rendez-vous avec le Sénateur-maire Jean-Claude Gaudin et la
possibilité d’une « piste nouvelle ».

Toujours est-il qu’après la déception et la colère, l’ère de l’espoir
et du travail avait déjà commencé dans les esprits.

PanARMENIAN.Net – `In Kazan, we really could make a breakthrough in
Nagorno Karabakh conflict settlement, but, regretfully, it did not
happen,’ Armenian President Serzh Sargsyan said.

He reminded that in the Parliamentary Assembly of the Council of
Europe, before the summit, he had stated that there may be a
breakthrough in Kazan, if Azerbaijan does not make new claims.

`Regretfully, in Kazan official Baku showed the same conduct as during
the last year and a half. Azerbaijan carried in about 10 new changes
to the existing document. All of us know that any alternation in the
document will require changes in other points and sub-points,’ The
Armenian leader said commenting on the Kazan meeting and presenting
his view on future of the process.

He reminded that this scenario has repeated at least 4 times within
the last 15 months. He thinks that this time the chance was omitted,
however, according to the President, `this does not mean the end of
negotiations, but it means that we have lost a period before a new
meeting.’ `The Russian President and Minsk Group co-chars asserted
their intention to continue efforts in this issue, and the President
of Russia told me yesterday on the phone that he had already addressed
his vision in a written form. I think we shall receive it soon, and
we’ll see how to move on,’ Mr.Sargsyan said.

The summit between Russia, Azerbaijan and Armenia in Kazan on June 24
completed without an agreement on basic principles of Nagorno Karabakh
conflict settlement. `The countries’ leaders registered mutual
understanding on a range of problems, the resolution of which boosts
creation of conditions for approving main principles. The meeting
participants considered the course of works carried out with the aim
of coordination of the project with basic principles,’ according to
the statement. The Presidents of Armenia and Azerbaijan expressed
gratitude to the Russian, French and U.S. leaders, the OSCE Minsk
group co-chairs, for `their constant attention to Nagorno-Karabakh
problem’ and highly praised personal efforts of the Russian President
in support of agreements.

Later on Minister of Foreign Affairs Edward Nalbanian noted that the
June 24 meeting was not a breakthrough, as Azerbaijan proved unready
to accept the final version of the basic principles suggested by the
OSCE Minsk Group Co-chairs. Instead, the Azerbaijani leader attempted
to impose 10 new proposals, thus precluding the possibility of any
agreement on the issue,’ he added.

Conflit du HK/ Sommet de Kazan Tout en reproduisant, pour la deuxième
journee consecutive, la declaration du porte-parole du MAEE francais
suite au sommet de Kazan (cf. la revue du 28.06), les quotidiens font
etat de la ” deception ” du Departement d’Etat americain quant aux
resultats de cette reunion.

Lors d’un point de presse, le porte-parole du Departement d’Etat a
ainsi fait part de la deception de Washington, estimant que, bien que
les deux Presidents aient affirme etre parvenus a un accord mutuel
sur un certain nombre de questions, les resultats du sommet sont ”
decevants “. / ” Le departement d’Etat americain est decu, tandis
que le MAEE francais non “- Aravot

Hayots Achkhar et Haykakan Jamanak relèvent que David Tonoyan,
premier vice-Ministre de la defense a commente l’acquisition par
l’Azerbaïdjan des missiles S-300, ce qui, selon lui, ne se repercutera
pas sur l’equilibre des forces armees. En cas d’une nouvelle guerre,
l’Azerbaïdjan sera oblige, poursuit-il, de mener des operations sur
son propre territoire et n’aura donc pas besoin de cet armement. ”
Du point de vue militaire, ces systèmes ne menacent pas l’Armenie
et la securite du Haut-Karabagh pour la simple raison que c’est une
arme anti-aerienne defensive, et ni l’Armenie, ni la Republique du
Haut-Karabagh n’ont le projet de mener une campagne militaire contre
l’Azerbaïdjan. D’ailleurs, ces missiles ne peuvent pas resoudre le
problème de la defense d’une partie de l’espace aerien de l’Azerbaïdjan
“, a-t-il explique.

RFE/RL relève que l’Armenie a officiellement confirme la fabrication
des drones militaires capables de voler en profondeur dans le
territoire ennemi. La confirmation a ete faite par le Colonel Armen
Mkrtchian, vice-commandant de l’armee de l’air. Malgre cela, le colonel
n’a pas exclu la possibilite d’acquerir des drones etrangers rien que
pour une simple comparaison. Armen Mkrtchian a refuse de donner le
moindre detail sur la fabrication des drones qui existe seulement dans
un nombre limite de pays. Il n’a pas dit si les drones armeniens sont
concus seulement pour des missions de surveillance ou des operations
aeriennes aussi. RFE/RL rappelle que l’Azerbaïdjan a recemment achete
des drones a Israël.

Affaires interieures Dans l’attente du rassemblement du Congrès
national armenien, le 30 juin, les quotidiens rendent compte de
la conference de presse de Stepan Demirtchian, president du parti
Populaire (membre du CNA), qui au nom du Congrès, espère toujours un
dialogue constructif avec le gouvernement. Tout en considerant que
l’organisation d’elections anticipees est indispensable et doit etre
imposee aux autorites par la societe, M. Demirtchian, ancien candidat
a la presidence en 2003, a reconnu que les autorites sont toutefois
peu susceptibles d’avancer le calendrier electoral. Il a aussi averti
que le CNA donnait encore du temps aux autorites [pour le dialogue]

” Heritage “, Stepan Safarian, dont il retient notamment l’annonce
excluant desormais toute alliance avec le Congrès national armenien,

le Congrès en vue du retablissement de l’ordre constitutionnel, mais

Armenie-UE Hayots Achkhar, Azg et Hayastani Hanrapetoutioun font
etat de la 6ème session du groupe consultatif de l’UE, presidee
par le secretaire du Conseil de securite nationale et le chef de
la Delegation de l’UE, Raul de Luzenberger au cours de laquelle a
ete presente le compte rendu trimestriel des activites du groupe des
experts de l’UE. Arthur Baghdassarian a exprime son satisfecit quant
a la mission du groupe d’experts largement impliques dans la mise en
oeuvre des reformes en Armenie.

OTAN La presse evoque la visite du representant special du Secretaire
general de l’OTAN pour la sud Caucase et l’Asie centrale, James
Appathurai, qui a ete recu en audience par le President Sarkissian, le
President de l’AN, les Ministres des AE et de la defense. Principaux
thèmes evoques lors de ces entretiens : partenariat entre l’Armenie
et l’Alliance dans le cadre de l’IPAP, questions relatives a la
participation de l’Armenie aux missions humanitaires en Afghanistan
et au Kosovo, prochaine session du Conseil Nordatlantique ” 28+1 ”
(OTAN+Armenie).

Armenie-Etats-Unis L’ensemble de la presse rend compte du rapport
annuel du Departement d’Etat americain sur la traite des etres humains,
qui, dans son chapitre consacre a l’Armenie, estime que bien qu’un
travail considerable ait ete accompli, les actions entreprises
par le Gouvernement armenien en vue de lutter contre ce fleau ne
correspondent pas aux critères minimaux de lutte contre la traite
des etres humains. Le rapport reconnait toutefois qu’en 2010 le
gouvernement armenien a partiellement finance les activites d’ONG
chargees de mener un travail avec les victimes de la traite des etres
humains. Les auteurs du rapport reconnaissent aussi qu’au cours des
dernières annees l’Armenie a ameliore sa legislation en la matière,
mais expriment le souci face a la diminution du nombre de victimes
de la traite devoilees en 2010. L’Armenie est consideree comme un
pays source pour la prostitution forcee (les femmes armeniennes
seraient principalement ” exportees ” vers la Turquie, les Emirats
et l’Allemagne) et un pays source et de destination finale pour le
travail force pour les hommes et les femmes.

telephone avec le president slovène Danilo Turk auquel il a presente

Georgia and Armenia has never had such good relations as today,
Georgian Foreign Minister Grigol Vashadze told journalists after
meeting with his Armenian counterpart Edward Nalbandian.

Although in the past, no special problems occurred in the relationship
between the two countries, he added.

Nalbandian is on a working visit to Georgia and the ministers held
one-to-one meeting. The ministers gave a short comment on their
meeting.

“We meet 3-4 times annually, and therefore do not allow the problems
in our relationship to pile up. We discussed all questions of mutual
interest this time,” Vashadze said.

In turn, Nalbandian said they mulled issues of the bilateral
cooperation that is expected to broaden and deepen, especially in
the economic sphere, as well as regional issues. However, he did not
specify exactly which issues of the regional character they discussed
at the meeting.

He also expressed satisfaction with the current level of relations
with Georgia. “There are no issues that we could not decide on a
bilateral basis,” Nalbandian said.

The coordinator of Fatah, Nabil Shaat told journalists that according
to their information 24 countries will recognize Palestine by
September. He expects among the firsts will be Armenia, AFP reports.

A Palestinian delegation headed by Nabil Shaat has recently visited
Armenia.

Azerbaijan will go on supporting Palestine in all international
organizations, stated the president of this country Ilham Aliyev.

This means Azerbaijan may be among those 24 countries to recognize
Palestine.

The leader of Palestine Mahmud Abbas stated in Baku that the Karabakh
issue should be solved too. True, he did not insist that Azerbaijan
must recognize Karabakh, like it demands the recognition of Palestine.

It is not ruled out that Armenia, in exchange for the recognition
of Palestine, will ask this country to be among the first in case a
“campaign’ of recognition of Karabakh starts. Against this background,
Karabakh may also recognize Palestine.

There is some synchronism in the Karabakh and Palestine issues. The
recognition of NKR is seen as a method of the settlement of the issue.

The problem is when this method will be considered appropriate.

called Armenian mania, Doctor of Philosophy Aidin Ali-Zadeh writes.

“In psychiatry there are diseases like megalomania, persecution mania
etc… We have mania of the Armenian conception,” as stated by the
Ali-Zadeh’s article on the kultura.az website.

“We do everything because Armenians did so. All contests and
competitions are conducted with the only aim to be ahead of the
Armenians. Armenians are like standard for Azeris. It is a center of
galaxy, a benchmark, we push off from. If we are said to have something
negative, we instead of improving it, say that Armenia is worse in
it. And if it is said that something is better in Armenia, hefty
resources are immediately being provided alongside with information
support, so that to make it better than in Armenia. It ended in tracing
Armenian criminal chronicles to find out if our criminal is less and
more humane,” the author writes.

“It is so nice that there are Armenian on earth. If not, so many people
would remain unemployed, so many people would not have something to
write, could not organize competitions and earn money.

People would not have something to talk about. We would not have
industry, agriculture, aircrafts would not fly, and trains would not
go. If Armenians have all this, we, too, must have it all, but in
larger quantities and of higher quality,” the article says.

It should be noted that access to kultura.az website was blocked
some hours after the publication. When trying to open the site you
encounter the error ‘Bandwidth Limit Exceeded’.

Raffi Hovhannisian Hasn’t Ordered To Criticize HAK, Says MP

An MP of the opposition party Heritage has dismissed claims that
the party leader Raffi Hovhannisian has instructed party members to
criticize the opposition alliance Armenian National Congress (HAK).

Speaking at a press conference on Wednesday, Zaruhi Postanjyan said
that those claims, according to which Raffi Hovhannisian gave his
party members such an instruction at a meeting in the resort town of
Tsakhkadzor, are simply untrue.

“To tell you the truth, Raffi Hovhannisian is not a person with ideas
of an authoritarian regime so that to give orders,” said she. “We
reach decisions at a collegial order and implement them.”

“We do not receive any orders, instructions,” she added.

Everyone has expectations before the presidents’ meeting and then
it turns out that the expectations were unsubstantiated. We didn’t
have any expectations from the meeting in Kazan,” politologist,
press speaker for “Heritage” Party Hovsep Khurshudyan told “A1+” today.

If there was confidence that no document would be signed, why did
Zaruhi Postanjyan make a call in Strasbourg? In response, Hovsep
Khurshudyan said:

“There is always fear because we know the Armenian authorities’
working style. They sign documents overnight and then present them to
the society without any broad public discourse. We still have doubts
that the Madrid Principles that envisage the dislocation of Armenian
forces from the liberated territories, which may provoke a war, is
a phenomenon that causes a threat to Armenia’s and Artsakh’s security.”

What should Armenia’s concession be?

“We must see what Azerbaijan is ready to concede, but Azerbaijan is
simply not ready for concessions. It says Armenia must be subject
to capitulation, liberate the territories and that there is no
way for Artsakh to be independent. This nonsensical approach in
the negotiations goes to show that Azerbaijan is not ready for a
resolution. If it isn’t ready, let’s consider the issue solved,” says
Hovsep Khurshudyan, adding that the Republic of Artsakh is independent
regardless of international recognition and that any nation has the
right to become self-determined in line with the Helsinki principles
and in accordance with international norms.”

According to Khurshudyan, the societies of neither Armenia nor
Azerbaijan are ready for concessions that are recorded in the Madrid
Principles, and this means that both sides should reject those
principles and start from a new point. The Republic of Artsakh should
be recognized and it should be recognized by Armenia so that the
mediators realize that there can be no other way.

Touching upon Serzh Sargsyan’s statement in the PACE that Armenia
hasn’t recognized the NKR’s independence because it recognizes
Azerbaijan’s territorial integrity, Hovsep Khurshudyan noted:

“It is painful and it is the continuation of the policy that all three
Armenian presidents have adopted, but we condemn that policy. Armenia
truly made a huge mistake by recognizing Azerbaijan’s territorial
integrity within the framework of the OSCE and the moment it signed
the CIS agreement. International law doesn’t require recognition
of territorial integrity with the current borders. Armenia could
recognize Azerbaijan’s territorial integrity without Artsakh and
Artsakh’s territorial integrity with today’s borders”.

The U.S. State Department Trafficking in Persons 2011 report ranks
Armenia among Tier 2 countries which is a source country for women and
girls subjected to sex trafficking, as well as a source and destination
country for women subjected to forced labor, and a source country
for men subjected to forced labor. Women and girls from Armenia are
subjected to sex trafficking in Germany, the United Arab Emirates, and
Turkey. Armenian men and women are subjected to forced labor in Russia,
while Armenian women are subjected to forced labor in Turkey. Armenian
boys are subjected to forced labor and Armenian women and girls are
found in sex trafficking within the country. Women from Russia are
subjected to forced labor in Armenia, the report informs.

Although in March 2011, the government enacted amendments to the
Criminal Code that further strengthened its anti-trafficking statutes
but Armenia does not fully comply with the international standards. Of
particular concern was a precipitous drop in the number of victims
identified during the year, as well as the absence of investigations
of forced labor offenses.

The government investigated 15 sex trafficking and no labor trafficking
cases in 2010, compared with nine sex trafficking and six labor
trafficking cases in 2009. During 2010, Armenian courts prosecuted four
new cases against six individuals for sex trafficking offenses and none
for labor trafficking offenses. Armenian courts continued to prosecute
an additional nine defendants whose cases had begun in previous years.

Five trafficking offenders were convicted in 2010, which is down
from 11 convictions in 2009. All five convicted offenders in 2010
were given sentences ranging from three to nine years’ imprisonment;
no traffickers received suspended sentences, and no traffickers were
granted early release from prison in 2010. An Armenian court convicted
and sentenced to nine years’ imprisonment a former deputy principal
of a state-run special needs school who, in 2008, forced two students
to beg.

The report holds that there were no new reports of government
officials’ complicity in trafficking during 2010.

Russian Experts Must Be Sent Off

During the Yerevan-Moscow television discussion on the results of the
three-party meeting for the Karabakh issue, held at the press hall
of Novosti Agency, the Russian political scientist Vladimir Zakharov
said the United States needs Nagorno-Karabakh to use its territory
for flying planes and bombing Iran. Vladimir Zakharov who says this
is the director of the institute of political and social studies for
the Black Sea- Caspian region.

His statement is almost similar to a recent pronouncement by an
Armenian political scientist on the Public Channel who said that only
Azerbaijan’s government needs the status quo.

Although one could argue which statement is more illogical!

Such statements on the Public Channel are news, whereas the hypothesis
of the Russian political scientist Vladimir Zakharov is not news. The
Russians have been trying to convince the society in Armenia that
Russia is not forcing Armenia to return territories to Azerbaijan to
settle the issue. The United States is interested in it, while they
want to maintain the status quo. Several months ago, another Russian,
Maxim Shevchenko, neither a political scientist, nor a TV host, visited
Yerevan and tried to persuade the Armenians that the west is interested
in changing the status quo because there is a problem with Iran.

In reality, this is a primitive trick which the Russians are playing
with the Armenians to convince them that the United States demands
our territories, while the Russians keep them. The point is that the
thesis of using the territory of Karabakh against Iran is invented.

First of all, if land use is meant, there are several problems with
it. Most importantly, the U.S. military and political leadership
is not so stupid to launch a land-based action against Iran,
especially compared to Iraq and Afghanistan. Iran is neither Iraq nor
Afghanistan. This war will mark the start of the global chaos in the
region, which is not in the interests of the United States because
a chain reaction may jeopardize the achievements which are reported
in the Arab states in the form of reforms.

At best the United States may use missiles or air force against Iran
not earlier than 2013 because the U.S. presidential election is in
November 2012. A pre-election war would hardly be helpful to the U.S.

President Barack Obama’s campaign, given the social and economic
problems and the immense military expenditure in Iraq and Afghanistan.

Certainly, the U.S. economy may stand this but the American voters
will hardly stand another costly war.

In this case, if the United States decides to hit Iran with missiles,
which would be done but in a large-scale international coalition, it
will hardly need the territory of Karabakh, perhaps a single aircraft
carrier would be enough to hit Iran.

The problem is that the Russian propaganda in Armenia gets enough
public resonance and even sufficiently intellectual layers of the
Armenian society are convinced that the United States needs Karabakh
for an offensive on Iran.

The problem is that the Americans do not have a distinct vision of
developments regarding Iran. In this context, they also lack a clear
vision of how they could use Karabakh against Iran. Maybe it needs
Karabakh together with the Armenians, and the Armenian force. In
other words, they may find that an effective solution of the Iranian
issue requires the current military and political balance in the
South Caucasus.

The issue is not that of Karabakh but that of the South Caucasus. And
the issue of the South Caucasus is complicated when the regional status
quo is changed in favor of Azerbaijan because the Caucasian region
with its ethnic and political peculiarities demands considerable
balance. The change of status quo means change of the balance. And
as long as the regional race continues, the change of this balance
is not in anyone’s strategic interests. At best, they may fight for
the right to change it but in this case both the United States and
Russia may be equally interested, and they may be equally interested
in keeping the status quo.

Apparently, Russia has also realized this, therefore it has been trying
to influence the Karabakh issue through the Armenian-Turkish process
and thereby gaining the right to change the status quo together with
all the emanating results. However, Medvedev realized in three years
that it was a great risk for Russia, and even if the United States
with its significant economic and political potential is not trying
to change the status quo, Russia must be limited to the effort of
maintaining the current situation.

Armenia is required to feel the importance of its mission rather
than feel unnecessary. After all, important military victories in
important regions make think about one’s mission but in Armenia most
people are obsessed with thoughts about being unnecessary.
