incident that took place at Yerevan State Economic University Sept 9.

The press service of the Police reports that during a squabble among
a group of students Karo A. fired at Taron G. and Gevorg G. from a
gas gun. Karo A. and Gevorg G. have been detained, the gun has been
sent for examination. Taron G. is wanted. Investigation is underway.

ArmInfo. In the matter of animation development, Armenia should base
itself on its rich history, Max Howard, a well-known producer, said
at today’s press conference in Yerevan.

He said that Armenia’s rich history and rich cultural heritage are
the gold reserve the animators should base themselves on. This is an
excellent basis for the history of animation films, which will by all
means cause the foreign spectators’ interest. Howard confessed that
he is considering possible cooperation with Armenian scriptwriters. He
added that within the frames of II ReAnimania international animation
film festival he will give several master classes and thereby find
talented animators with interesting projects.

Formerly producer Max Howard was the director of Warner Bros. Feature
Animation and the deputy director of Disney Feature Animation. He is
the author of the such world famous cartoons as “The Beauty and the
Beast”, “The Lion King”, “Aladdin”, “Pocahontas”, etc.

IV Yerevan International Festival Of Classical Music To Be Held From

IV YEREVAN INTERNATIONAL FESTIVAL OF CLASSICAL MUSIC TO BE HELD FROM SEPTEMBER 11 TILL OCTOBER 22

ArmInfo. The IV Yerevan International Festival of Classical Music
will be held from September 11 till October 22.

The chief conductor and art director of the State Philharmonic
Orchestra of Armenia, Eduard Topchyan, said at today’s press conference
that such well-known musicians as Julia Fischer, Isabelle Faust,
Anton Sorokov, Svyatoslav Moroz and others will take part in the
festival. A total of 22 musicians from 12 countries will participate
in the festival in Yerevan.

The French pianist Francois-Frederic Guy will open the festival on
September 11 with Brahms’ Piano Concerto No2 and Schostakovich’s
Symphony No 10. It is noteworthy that on September 11 the Armenian
audience will have an opportunity to assess the sound of the new
Steinway& Sons grand piano purchased with the support of Armenian
President Serzh Sargsyan, Prime Minister Tigran Sargsyan, and Culture
Minister Hasmik Poghosyan. Topchyan said that within the frames of
the festival master classes will be held for young musicians.

ArmInfo. Principal Conduction and Artistic Director of Armenian
Philharmonic Orchestra Edward Topchyan has lost his faith in young
talents.

During a press-conference today he said that today things in Armenia
are even worse than they were a year before. “If last year we had
one young musician, today, we have nobody at all as that musician
has already left the country. The key problem is the lack of normal
music schools. We could solve this problem if we stopped the practice
of protectionism at our music schools. As regards young talents,
we have no talents even at the Spivakov Foundation. Today, we are
experiencing even harder times: those who play badly are sure they
play well. And if this situation continues, we will have no good
musicians in some 5-6 years,” Topchyan said.

all types of loans.

The press service of the bank reports that the interest rates of AMD
mortgage loans have been reduced to 14%, USD mortgage loans – 12%,
AMD and USD repair loans – 15% and 13%, respectively, corporate loans
– 10%.

Areximbank-Gazprombank Group was set up in 1998. As of Aug 31 2010
the bank has issued loans worth a total of 39.317bln AMD, of which
28.978bln AMD were AMD loans given to legal entities, 10.338bln AMD –
individual loans.

ARMRUSGZPROM CARRIES OUT REGULAR CHARITABLE MISSION IN NAGORNO KARABAKH

ArmInfo. ArmRusgazprom has carried out a regular charitable mission
in the Nagorno Karabakh Republic within the frames of the social
programmes: a number of preschool and school establishments were
presented sports facilities, computers, TV sets, books, toys and
other necessary accessories, the Company press service reports.

Stepanakert school N1 suffered during the war. The gifts by
ArmRusgazprom turned out to be very desired for the new school
building, built by September 1. The new sports hall replenished with
an inventory and library.

The 5th general education school, named after the died azatamartic
Haik Balasanyan, presented many heroes to the Motherland, 15 of
them died. This school also suffered as a result of bombardments,
however, the lessons had not ever stopped. The repaired school also
needed gifts.

46 pupils of the school of Sarushen village were overenjoyed at the
gifts, and the school director is sure that this support will be
of great importance from the educational viewpoint. There is also a
computer class in Astghashen secondary school, which has replenished
with a new computer equipment.

The eldest girl entered a HEE this year, and only one among the
smallest children decided his future profession: he wants to become
a doctor. That’s why he has chosen just a box with medical supplies,
among the toys presented by ArmRusgazprom, and read a poem as an
expression of his gratitude. Stepanakert state kindergarten N 2 also
started working after an overhaul. The comfortable game rooms have
replenished with toys, children’s magazines, TV sets and DVD players.

ArmInfo. GeoProMining Group of companies will provide 108 mln drams
for reconstruction of the Culture Center in the town of Vardenis
of Armenia’s Gegharkunik region. Total cost of the reconstruction,
scheduled for 2010 – 2012, will make up 320 mln drams. Reconstruction
will be carried out within the frames of the Protocol on strategic
cooperation in social development of Gegharkunik region. The Protocol
was signed by President of GeoProMining LTD Roman Khudoliy, Executive
Director of the Armenian Social Investment Fund Ashot Kirakosyan and
Governor of Gegharkunik Nver Poghosyan.

“GeoProMining Company is one of the biggest employers of our region.

This circumstance attaches an invaluable significance to its work: you
know how much important employment is for our region. Along with it,
we are happy to see that the Company also carries out social projects,
and a lot of people become beneficiaries of these projects”, N.
Poghosyan said.

“Any big Russian company working in Armenia has also a social
constituent in its project. It is very important for both Armenia’s
residents and us”, Ambassador of Russia to Armenia Vyacheslav
Kovalenko, who arrived in Vardenis to the Protocol signing ceremony,
said. For its part, the Embassy gifted a distance learning equipment
to one of Vardenis secondary schools for the Russian class.

“We want to assist the Armenian schoolchildren to learn Russian. Let
the schoolchildren of Vardenis know fluently their native Armenian
language and good – the Russian language”, Kovalenko said.

ArmInfo. In Armenia violence is still considered as one of the key
methods to educate children, Save the Children Country Director in
Armenia Irina Saghoyan said today while presenting the children’s
rights protection situation in the country.

She said that surveys in Lori, Tavush and Gegharkunik regions have
shown that violence against children is widely spread in Armenian
families. Some parents still believe that physical punishment is the
most effective way to educate their children. But violence is present
not only in family but also at school.

“Violence against children is present in all countries and Armenia
is not an exception,” Saghoyan said.

The surveys have been held in the framework of a grant given to Save
the Children by the Council of Europe and Open Society Institute.

ARMENIAN PM ATTENDS OPENING OF REPUBLICAN VETERINARIAN CENTER IN YEREVAN

ArmInfo. Armenian Prime Minister Tigran Sargsyan has attended the
opening of Republican Anti-Epidemic and Diagnostic Veterinarian Center
in Yerevan.

The press service of the Government of Armenia reports that the center
has been re-equipped in the framework of the anti-bird flu program
financed by the World Bank, PHRD (Japan) and AHI Facility. The total
financing was $1.5mln.

World Bank Vice President for Europe and Central Asia Philippe Le
Houerou was also present at the ceremony.

After the opening Sargsyan and Le Houerou inspected the center.

Technical assistance and equipment have been provided by the Government
of Greece, USAID, FAO and DTRA.

OSCE Minsk Group format is insufficient for Karabakh conflict
settlement

Interview of political expert, international law specialist Vardan
Poghosyan with ArmInfo news agency

Mr.Poghosyan, are there any mechanisms to combine the two basic
principles of international law – people’s right to self-determination
and territorial integrity, and how can this combination be projected
on the Karabakh conflict?

>From the viewpoint of international law, these two principles are jus
cogens principles i.e. imperative laws having supreme legal force. And
all the treaties that violate the jus cogens principles are doomed to
denunciation. Now a logical question arises – how can these principles
be combined and applied to the Karabakh conflict if there is a conflict
or at least a seeming contrast between these principles?

Hence, there must be mechanisms to liquidate this contrast. I’d like to
recall that the UN International Court of Justice made certain steps
to liquidate the problem when it declared that Kosovo independence
does not contradict the international law. But the Court took only
a small step and, unfortunately, failed to present the details of
the two principles’ ratio. The Court declared that the principle of
territorial integrity is related to the relations of countries and
cannot be applied to the subjects inside a country i.e.

if part of the population wants to become separated from the state,
there is no territorial integrity principle for it.

Unfortunately, the Court’s verdict does not fully reflect the
situation. In particular, the court could touch on the question in
what preconditions one can fulfill the right of part of the population
to separate itself from the state. It is insufficient to state only
that the principles of people’s right to self-determination and
territorial integrity should not contradict each other. In order to
find out in what conditions it is possible to fulfill the right to
self-determination, one should reveal the premises that can give a
right to a specific ethnos to separate itself from a state.

Baku’s statements that proclamation of Nagorno-Karabakh’s independence
contradicts international law norms are groundless. Azerbaijan lacks
any serious arguments based on the international law norms. Here a
question arises: what to do with the problems the Hague Court has
failed to give the key to? I mean the problem of premises providing
the opportunity of self-determination in the form of separation from
a state, in the given case – withdrawal of Nagorno-Karabakh from
Azerbaijan. In this respect, the scene is quite complete from the
viewpoint of international law. The declaration about the principles
of international law adopted by the UN General Assembly in 1970 says,
in particular, that the right of people for self-determination should
not be automatically watched as a principle, which loosens territorial
integrity of a state. This principle functions when a state, within
which the given nation exists, does not at all represent this nation.

That is to say, by its actions this state does not respect the right
for self-determination the way it is fixed in the declaration. For
this reason, it stops being the legal representative of the people,
which want to self-determine. Taking all this into account, the
process of Nagorno-Karabakh establishment as an independent state
fully meets international law norms.

The resolutions on the Karabakh conflict adopted by various
international structures do not take into consideration the factors
mentioned by you. How can such lack of interrelation be explained?

I ascribe this circumstance to the passivity of Armenian foreign
policy, which has held defensive positions from the very beginning.

The Armenian party’s negotiations for resolution of the conflict
have not been based on the existing legal documents. Nagorno-Karabakh
proclaimed independence from the Azerbaijani SSR and not from sovereign
Azerbaijan, which was in line with the Soviet legislation effective
in that period. The legal positions of Nagorno-Karabakh and Armenia
must be as follows: since the moment of the collapse of the Soviet
Union Nagorno-Karabakh has not been part of Azerbaijan.

Therefore, it is absurd speaking of territorial integrity of Azerbaijan
including the territory of Nagorno-Karabakh. It is quite hard to
correct the situation, but it does not at all mean that one should
do nothing.

How much probable is the cession of 5 regions around the NKR to
Azerbaijan? And is this right stipulated in the NKR Constitution?

According to the NKR Constitution, these territories are under
control of Karabakh but are no integral part of it. The cession of
territories should be considered only in the context of liquidation of
consequences of Azerbaijan’s aggression against the self-determined
people. The problem of territories can be settled only in case
of complete restoration of the NKR’s territorial integrity, since
Shahumyan region, as well as a number of villages of Martakert region
are still under occupation of Azerbaijan.

The Un International Court delivered the verdict on Kosovo after
70 countries had recognized its independence. Can we speak of any
political engagement of this instance?

Certainly, we can. One shouldn’t forget that the international law
appears as a result of agreements reached by the states, and this
circumstance already implies dependence on political processes.

Actually, Kosovo exists as an independent state, and it has already
been recognized by a great number of states. Unfortunately, the
situation is different in case of the NKR. I think both Armenia and
the NKR failed to exert enough efforts to gain international legal
recognition, because we ourselves didn’t completely realized the
strength of the legal arguments possessed by Nagorno-Karabakh when
proclaiming its independence.

Both Armenia and Nagorno-Karabakh should gain recognition of the NKR
at least by several states. It is not right to hope that peaceful
settlement of the conflict may be reached only within the frames
of the OSCE MG. Baku is trying all the time to take the discussion
of the conflict out of the frames of the OSCE MG format. For this
reason, the Armenian party should create serious counter-balance to
activeness of Azerbaijan in the Organization of the Islamic Conference,
as well as in the UN. Naturally, Armenia cannot do anything in the OIC,
but adequate measures should be taken in the UN and other structures.

Armenian diplomacy has to insist on the fact that the so called
“occupied territories” appeared as a result of Azerbaijani aggression
against Nagorno- Karabakh. In full accordance with the norms of
international law and the acting legislation of the Soviet time
Nagornyy Karabakh declared its independence, because of which it
underwent Baku’s aggression. The principles of inadmissibility of
aggression may be applied just in the relations between the NKR
and Azerbaijan.

May the NKR’s return to the negotiation table introduce any changes
in the situation?

I think it may, since it will thereby be acknowledged that
Nagorno-Karabakh is an international subject and the destiny of
this subject is being determined in course of the talks. Actually,
Armenian diplomacy made a rough mistake, having excluded Karabakh
from the negotiation process. Today modest attempts are being made to
make up for lost time; however, there are no tangible results yet. If
we do not consider the issue in the specified context, we willy-nilly
accept the mistaken thesis, according to which the conflict is between
Yerevan and Baku, not between Stepanakert and Baku.
