Azerbaijan Submitted Two More Documents To The UN

AZERBAIJAN SUBMITTED TWO MORE DOCUMENTS TO THE UN

Azerbaijan, as a member of UN, continues its efforts to bring the
Armenia-Azerbaijan, Nagorno Karabakh conflict to the notice of the
international community. On this purpose, the Azerbaijans Permanent
Mission to UN submitted two more documents to the UN Security Council
and General Assembly.

Resolutely expressing its position on the conflict in a number
of resolutions of the Security Council and General Assembly,
the UN has, on Azerbaijan`s initiative, included the question on
situation in the occupied areas in the agenda of the last sessions
of the General Assembly in a separate clauses. In March 14, 2008,
the UN GA has adopted a resolution On the situation in the occupied
territories of Azerbaijan. According to the document, the General
Assembly requested the Secretary General to submit a comprehensive
report on the implementation of the present resolution.

As stated, one of the documents is Azerbaijans Permanent representative
to UN Agshin Mehdiyevs report to the UN Secretary General entitled
Support by States Members of the United Nations and international
organizations to Azerbaijans position on the conflict in and around
the Nagorno Karabakh region of Azerbaijan. The 9-page report described
the international support to Azerbaijan during the Armenias military
aggression against Nagorno Karabakh and the adjacent regions and in
the following period. The statements made by the Organization of the
Islamic Conference, UN Security Council and General Assembly, US State
Department, foreign ministries of Russia, Iran and Turkey, European
Union, Council of Europe, NATO, Economic Cooperation Organization in
Turkey in 1993, OSCE Chairmanship during the Minsk Conference in that
year, and the resolutions adopted by the above-mentioned organizations
in respect to the territorial integrity of Azerbaijan, were submitted
to the UN Secretary General. UN General Assembly resolution 62/243
adopted on March 14, 2008 completed the list of documents. The letter
quoted that resolution as saying: The General Assembly reaffirms
continued respect and support for the sovereignty and territorial
integrity of the Republic of Azerbaijan within its internationally
recognized borders; demands the immediate, complete and unconditional
withdrawal of all Armenian forces from all the occupied territories
of the Republic of Azerbaijan; reaffirms the inalienable right of the
population expelled from the occupied territories of the Republic of
Azerbaijan to return to their homes.

The second letter sent to the UN Secretary General was entitled as
Report on the international legal responsibilities of Armenia as
the belligerent occupier of Azerbaijani territory. 27-page report
requested to answer to three questions: Is Armenia an occupier in
international law of Azerbaijani territory? If so, then, what are
Armenias duties as an occupier of Azerbaijani territory with regard
to issues as the maintenance of public order, the preservation of
Azerbaijani legal system, and the protection of human rights in the
territory in question? And the last, how may Armenias responsibilities
be monitored and enforced in international law?

The report envisages that Armenia should take commitments under 21
Articles. The report proved that Armenian actions in Nagorno Karabakh
and regions around it is applicable to international humanitarian
legal articles, it is impossible to establish an official sovereignty
upon these lands legally , Armenia, as an occupant state, on the Hague
Convention, bears responsibility for 4210 Azerbaijani missing people
and persons participated in military crimes should be held accountable.

Earlier, Azerbaijani Permanent Mission to the UN submitted to General
Assembly and Security Council first two reports on December 24, 29
last year. The first Report is about legal complications of Armenian
Republics military aggression against Azerbaijan Republic and the
second is Report about self-determination against the background
of basic norm of the states territorial integrity and Armenias
revisionist claims. The Armenia-Azerbaijan, Nagorno Karabakh conflict
still remains on the agenda of UN General Assembly`s 63rd session
under the Articles 13 and 18, to end in September current year.
