Well-intentioned laws that prescribe how we remember terrible events
are foolish, unworkable and counter-productive

Among the ways in which freedom is being chipped away in Europe,
one of the less obvious is the legislation of memory. More and more
countries have laws saying you must remember and describe this or
that historical event in a certain way, sometimes on pain of criminal
prosecution if you give the wrong answer. What the wrong answer is
depends on where you are. In Switzerland, you get prosecuted for
saying that the terrible thing that happened to the Armenians in
the last years of the Ottoman empire was not a genocide. In Turkey,
you get prosecuted for saying it was. What is state-ordained truth
in the Alps is state-ordained falsehood in Anatolia.

This week a group of historians and writers, of whom I am one,
has pushed back against this dangerous nonsense. In what is being
called the "Appel de Blois", published in Le Monde last weekend,
we maintain that in a free country "it is not the business of any
political authority to define historical truth and to restrict the
liberty of the historian by penal sanctions". And we argue against the
accumulation of so-called "memory laws". First signatories include
historians such as Eric Hobsbawm, Jacques Le Goff and Heinrich Aug u
st Winkler. It’s no accident that this appeal originated in France,
which has the most intense and tortuous recent experience with
memory laws and prosecutions. It began uncontroversially in 1990,
when denial of the Nazi Holocaust of the European Jews, along with
other crimes against humanity defined by the 1945 Nuremberg tribunal,
was made punishable by law in France – as it is in several other
European countries. In 1995, the historian Bernard Lewis was convicted
by a French court for arguing that, on the available evidence, what
happened to the Armenians might not correctly be described as genocide
according to the definition in international law.

A further law, passed in 2001, says the French Republic recognises
slavery as a crime against humanity, and this must be given
its "consequential place" in teaching and research. A group
representing some overseas French citizens subsequently brought
a case against the author of a study of the African slave trade,
Olivier Pétré-Grenouilleau, on the charge of "denial of a crime
against humanity". Meanwhile, yet another law was passed, from a very
different point of view, prescribing that school curricula should
recognise the "positive role" played by the French presence overseas,
"especially in North Africa".

Fortunately, at this point a wave of indignation gave birth to a
movement called Liberty for History (lph-asso.fr), led by the French
historian Pierre Nora, which i s also behind=3D2 0the Appel de Blois. The
case against Pétré-Grenouilleau was dropped, and the "positive role"
clause nullified. But it remains incredible that such a proposal ever
made it to the statute book in one of the world’s great democracies
and homelands of historical scholarship.

This kind of nonsense is all the more dangerous when it comes wearing
the mask of virtue. A perfect example is the recent attempt to enforce
limits to the interpretation of history across the whole EU in the name
of "combating racism and xenophobia". A proposed "framework decision"
of the justice and home affairs council of the EU, initiated by the
German justice minister Brigitte Zypries, suggests that in all EU
member states "publicly condoning, denying or grossly trivialising
crimes of genocide, crimes against humanity and war crimes" should be
"punishable by criminal penalties of a maximum of at least between
one and three years imprisonment".

Who will decide what historical events count as genocide, crimes
against humanity or war crimes, and what constitutes "grossly
trivialising" them?

International humanitarian law indicates some criteria, but exactly
what events qualify is a matter of often heated dispute. The only
cast-iron way to ensure EU-wide uniformity of treatment would be for
the EU to agree a list – call it the Zypries List – of qualifying
horrors. You can imagine the horse-trading behind closed doors in
Brussels . (Polish official to French=3D2 0counterpart: "OK, we’ll give
you the Armenian genocide if you give us the Ukrainian famine.") Pure
Gogol.

Since some countries with a strong free-speech tradition, including
Britain, objected to Zypries’ original draft, the proposed agreement
now also says: "Member states may choose to punish only conduct
which is either carried out in a manner likely to disturb public
order or which is threatening, abusive or insulting." So in practice,
individual countries will continue to do things their own way.

Despite its manifold flaws, this framework decision was approved by the
European Parliament in November 2007, but it has not been brought back
to the justice and home affairs council for final approval. I emailed
the relevant representative of the current French presidency of the
EU to ask why, and just received this cryptic but encouraging reply:
"The FD ‘Racism and xenophobia’ is not ready for adoption, as it is
suspended to some outstanding parliamentary reservations." Merci,
madame liberté: that will do till the end of this year. Then let the
Czech presidency of the EU, which covers the first half of next year,
strike it down for good – with a dose of the Good Soldier Svejk’s
common sense about history.

Let me be clear. I believe it is very important that nations, states,
peoples and other groups (not to mention individuals) should face
up, solemnly and publicly, to the bad things d one by them or in
their name. The W est German leader Willy Brandt falling silently to
his knees in Warsaw before a monument to the victims and heroes of
the Warsaw Ghetto is, for me, one of the noblest images of postwar
European history. For people to face up to these things, they have to
know about them in the first place. So these subjects must be taught in
schools as well as publicly commemorated. But before they are taught,
they must be researched. The evidence must be uncovered, checked and
sifted, and various possible interpretations tested against it.

It’s this process of historical research and debate that requires
complete freedom – subject only to tightly drawn laws of libel and
slander, designed to protect living persons but not governments, states
or national pride (as in the notorious article 301 of the Turkish
penal code). The historian’s equivalent of a natural scientist’s
experiment is to test the evidence against all possible hypotheses,
however extreme, and then submit what seems to him or her the most
convincing interpretation for criticism by professional colleagues
and for public debate. This is how we get as near as one ever can to
truth about the past.

How, for example, do you refute the absurd conspiracy theory, which
apparently still has some currency in parts of the Arab world, that
"the Jews" were behind the September 11 2001 terrorist attacks
on New York? By forbidding anyone from saying that, on pain of
imprisonment? No. You refute it by=3D2 0refuting it. By mustering all
the available evidence, in free and open debate. This is not just
the best way to get at the facts; ultimately, it’s the best way to
combat racism and xenophobia too. So join us, please, to see off the
nanny state and its memory police.

LECTURE ON THE SASUN EPIC AT NAASR BY VISITING SCHOLAR FROM ARMENIA

Prof. Azat Yeghiazaryan, Director of the Manuk Abeghyan Institute of
Literature at the National Academy of Sciences of Armenia, will give a
lecture entitled "Daredevils of Sasun: The Poetics of the Armenian
National Epic," on Wednesday, October 22, at 8:00 p.m., at the National
Association for Armenian Studies and Research (NAASR) Center, 395
Concord Ave., Belmont, MA.

Daredevils of Sasun (also known as David of Sasun) was passed down for
centuries before being written down in the late 19th century. The epic
presents a rich legacy of accumulated folk wisdom and creative insight
on the human condition.

Evolving from ancient mythic roots through folkloric antecedents up to
its main period of gestation (8th-12th centuries A.D.), it tells the
tale of the life, loves, and heroic struggles of four generations of the
House of Sasun to establish their patrimony and uphold the weal of their
community against the onslaught of imperialist invaders. Water-born and
fiery-eyed, they embody their society’s ideals of freedom and guileless
nobility, empathy toward the stranger, and a spiritual affinity with all
living things. Vividly sketched with not a little humor, these hardy
mountaineers evolved imperceptibly with the community that transmitted
them, bridging the heroic era and the present day.

Prof. Yeghiazaryan has authored several monographs including Literary
Narrative: A Theoretical Review (1986) and T’umanyan’s Poetics and its
Popular Roots (1990). He has organized two international conferences on
the Armenian epic tradition and edited their collected papers. He is
also founder-editor of the institute’s official journal Handes.

The NAASR Center is located opposite the First Armenian Church and next
to the U.S. Post Office. Ample parking is available around the building

NAGORNO KARABAGH SELF-DETERMINATION

— Dan Fried Repeats New Administration
Line in Remarks in Yerevan

WASHINGTON, DC – Bush Administration officials continued to press
forward their new, more aggressive position against freedom for
Nagorno Karabagh, citing, as recently as today in Yerevan, that a
resolution of this longstanding conflict must proceed from the
principle of Azerbaijan’s territorial integrity, while remaining
conspicuously silent on the core American value of self-
determination, reported the Armenian National Committee of America
(ANCA).

Over the past several weeks, since the time of Vice President Dick
Cheney’s early September visit to Azerbaijan, the Administration
has rolled back any mention of self-determination, eliminating any
reference to this core international legal and democratic principle
from its diplomatic vocabulary. Speaking in Baku, the Vice
President – echoing Azerbaijan’s negotiating stand – said that a
Nagorno Karabagh settlement "must proceed" from the principle
of territorial integrity and only "take into account other
principles." As recently as earlier today, in Armenia, Assistant
Secretary of State Dan Fried repeated the newly formulated U.S.
stand that a Nagorno Karabagh settlement must start from the
principle of "territorial integrity," although he did concede that
there were "other established norms," an apparent reference to
democracy and self-determination, which he carefully avoided
naming.

In a January 19, 2008 statement, Presidential candidate Barack
Obama pleged that, if elected, he would work for "a lasting and
durable settlement of the Nagorno Karabagh conflict that is
agreeable to all parties, and based upon America’s founding
commitment to the principles of democracy and self determination."

In recent weeks we’ve seen Bush Administration officials, from Dick
Cheney down to Matt Bryza, abandon even the pretense of a balanced,
honest-broker role for the United States in the Nagorno Karabagh
conflict.

In public statements, here in Washington and in Baku, they’ve gone
over the top – even by their standards – in siding with
Azerbaijan’s efforts to retake Nagorno Karabagh.

Dick Cheney said in Baku that his Administration prioritizes the
principle of territorial integrity, which he’s conveniently and
consistently misapplied to the Nagorno Karabagh issue, over the
basic American ideal of self-determination.

Matt Bryza has said that, as a precondition for peace, Armenia must
accept that Nagorno Karabagh remains legally part of Azerbaijan.

These comments would have put the Administration on the side of the
British during the American Revolution.

— Pressuring our Founding Fathers not to challenge the British
Empire’s territorial integrity.

— Urging them to hold off on signing the Declaration of
Independence because the colonies rightfully remained legally part
of a foreign power.

In their last months in office, these officials are acting a lot
less like responsible stewards of U.S. policy and more like
surrogates for the Azerbaijani Embassy, it’s K Street lobbyists,
and energy industry allies.

It’s no coincidence that Azerbaijan’s President, hearing this
outright cheerleading from Washington, has pledged an all out
political, economic, and military offensive against Armenia.

America stands for something better than defending Stalin’s borders
or Azerbaijan’s desire to re-subjugate a free people. Something
better than trading in our core values of self-determination,
democracy, and human rights.

We stand – as Americans – for the proposition that democracy can
serve as the only durable foundation for lasting peace; For the
fundamentally American ideal that all people deserve the right to
live free of foreign tyranny -to live under a government of their
own choosing.

STEPANAKERT, 17.10.08. DE FACTO. Construction works that did not cease
until deep night in Stepanakert various regions could arouse the city
guests’ astonishment, but not that of the local inhabitants. Artsakh’s
capital city was getting ready for a big wedding.

"The Lovers’ Lane", a stepped road leading from the Revival Square to
the Stadium after St. Shahumian, has been completely reconstructed, the
Stadium has been repaired, works on the improvement of the territories
around Surb Ghazanchetsots and Gandzasar churches have been carried
out. At mid-day sharp the cars’ column with 550 pairs of newly-weds
set off from the Stepanakert Revival Square to Shoushi. To guarantee
the newly-weds’ festive mood a concert was initiated in the yard of
Surb Ghazanchetsots Church.

All 550 young pairs lit candles at the Church, after which Archbishop
Pargev Martirosian, spiritual leader of Artsakh Eparchy, held a
wedding ceremony.

The Most Holy admonished, prayed and blessed the newly-weds. "Give
them children, the Most High, as You will wish. Make sweet every day of
their life with your generous mercy, for them to enjoy their life, live
till deep oldness and be honored with kingdom of heaven and everlasting
crown", Archbishop Pargev Martirosian wished in his blessing.

"It is the brightest day of my life. I am very gl ad that I participate
in the wedding. So many pairs, so many happy snow-white garments,
unforgettable moments for us. I wish all the pairs strong family,
love and happiness, as well as a lot of children", said 23-year-old
Marine Hovsepian from Hadrut region.

Wedding of 150 more pairs was held the same time at the Gandzasar
monastery, the village of Vanq.

At 4 p. pm., making an oath before God and those present, the pairs
returned from Shoushi to Stepanakert. The pairs, who had got married
at the Gandzasar Church, also arrived in Stepanakert by that time.

At 5:30 p.m., after having a short rest and dinner at the solemn
ceremony salons, the newly-married gathered together.

>From here 700 snow-white fairies with their husbands went down to the
city stadium, in the rain of flowers. The same time the NKR leadership
headed by President Bako Sahakian and guests from abroad also visited
the stadium.

They wished all 700 newly-weds happiness, mutual love and respect,
healthy and prosperous family.

The wedding’s witnesses have become, alongside with those who assumed
the responsibilities of godfathers, seven Armenian philanthropists,
who arrived from Russia. The main godfather and sponsor has become,
as it has already been reported, a renowned philanthropist, devoted
patriot of his native land Levon Hayrapetian.

Well, we can hope that the aim for which he has undertaken the
wonderful measure – "demographi c outburst" in Artsakh – will become
a reality.

It should be mentioned that such wedding festivities have never been
held in the world. The wedding that was held in Nagorno-Karabakh on
October 16, 2008, can be considered the biggest in the world, worthy
to be included in the Guinness book. 700 nuptials in a day is really
a "Big wedding" for Artsakh, the number of population of which makes
150, 000.

During the press conference yesterday Prime Minister Tigran Sargsyan
gave information regarding his meetings in the USA and answered the
questions of the journalists.

What influence does the world crisis have on Armenia or what impact
can it have in the future? What does the government do to avert
the possible crisis in our country? Before touching upon the main
questions the Prime Minister firstly said that the financial crisis
is conditioned by the mistrust towards the financial institutions.

"Trust is the most important factor in the temporary financial
and economic systems and financial crisis usually intensifies
due to mistrust, the Prime Minister said and added, "The financial
institutions usually refuse to function in concert with one another,
they usually try to freeze their active functions, guarding themselves
against additional risks which in its turn contributes to the
intensification of financial crises.

This is the most important circumstance, because it formulates
expectations also among the citizens. And if those negative
expectations are formulated by negative tendencies naturally
these tendencies contribute to the intensification of the financial
crisis. In this regard the state interference in settling that problem
is aimed at averting those negative expectations and creating trust
among the participants of the market to improve the financial indexes."

The second problem is the level of the liquidation of the financial
institutions, which means they have enough financial means to realize
their current interferences.

Tigran Sargsyan detailed the level of the capitalization of the
financial institutions, which is also a matter of concern. It is very
important also to jointly realize the before mentioned events. Touching
upon the situation created in Armenia the Prime Minister said:
"Do we have indexes in our financial sector, which give reasons for
concern? We must firstly be attentive towards the information given to
the public by the Mass Media. We must avoid false information, which
is aimed at creating panic, negative expectations, mistrust, and all
this as you remember from the first message is very important for us.

"Naturally we understand that there are politicized assessments,
which are far not aimed at ensuring financial stability, or helping
the government overcome all the difficulties, just the contrary,"
Tigran Sargsyan said.

"In this respect our economic team is ready to give operative answers
to all the issues of concern and allocate operative information about
the situation.

Touching upon the second problem the Prime Minister brought several
arguments to state that our financial institutions have enough
liquidation to realize their payments. Moreover the exist ing indexes
demonstrate that our financial system has got even extra liquidation.

Tigran Sargsyan says the indexes characterizing the reliability of
our banks are much higher than the similar indexes of CIS countries,
as well as the indexes of the banks of the developed countries. The
Prime Minister brought numbers and facts to assure that the next index
of the capitalization of the banks also doesn’t give any grounds for
negative expectations.

"Because the level of capitalization is on a very high level in
Armenia, in this regard as well we can say that the reliability of the
financial sector is on a very high level and there is no reason for
concern. If we look at the other indexes of the financial system,
particularly deposits and active functions, the specific weight
of the credits, then we will see that we have tendencies of stable
development in 2008.

The Prime Minister said the government has powerful tools and even in
case of the worst scenario, taking into consideration the lessons of
the developed countries, can operatively interfere in the financial
field to avert any risk."

"Can we say that our financial system is under stable indexes?"

Tigran Sargsyan also touched upon the problems that we can face in
2009 and have negative impact on economic indexes he also pointed
out the work that the government has to do in this regard.

The high prices recorded in Armenia in 2008 are conditioned by the
high prices of the imported goods.

In case these high prices drop and our harsh monitory-credit and
tax-budgetary policy provide opportunity to resist the pressure of
the mounting prices, this will give an opportunity to the Central
Bank to reduce the percentages and take corresponding actions to
improve favorable conditions for the economic growth.

Not excluding that the reduction of the prices of power-generating
substances in Russia can lead to the reduction of the economic growth
in the country, which will naturally lead to the reduction of the
incomes of our compatriots in that country and the money transfers
to Armenia will of course trim down. The Prime Minister said it can
have a bad impact on our financial sector and in general the level
of consumption, because 80% of the money transfers are directed to
the consumption.

"This means we must increase the volume of the credits of small and
average businesses," Tigran Sargsyan said and assured that for that
purpose they have corresponding arrangement with the World Bank.

According to the Prime Minister the increase of the volumes of credit
allocated to the small and average businesses will be an additional
buffer, which will defend our average consumer, giving them possibility
to neutralize the before mentioned possible negative consequences.

Turkey Takes Advantage Of The Dialogue

TURKEY TAKES ADVANTAGE OF THE DIALOGUE

With the purpose of including the bill condemning the Armenian Genocide
into the agenda of the French Senate, a number of French-Armenian youth
organizations organized a function, which became the "litmus test"
clearly revealing the hidden "springs" of the policy that continues
to be pursued by our neighboring country even after A. Gul’s visit
to Yerevan.

Just a day after the launch of the function, Speaker of the Turkish
Parliament Köksal Toptan made the following statement in a meeting
with Joséline de Rohan, Head of the Foreign Relations, Defense and
Armed Forces Committee of the French Parliament, "We ask our French
colleagues not to intervene in the Armenian-Turkish relations because
any intervention will bring harm to those relations."

It turns out that the French Senate’s discussion over the bill
condemning the Armenian Genocide at the demand of the Armenian young
people is viewed by Turkey as an intervention in the Armenian-Turkish
relations, in which no essential progress has been observed so far.

It should be noted that instead of showing any counteraction to this
strange statement, Joséline de Rohan assured her Turkish colleague
that France had no intention to intervene in the dialogue between
Yerevan and Ankara and even made hints that it was necessary for the
parties to look to the future.

This leads to the assumption that Joséline de Rohan also considers
the passage of a new Armenian Genocide bill as an attempt of returning
to the past instead of looking to the future.

This completely justifies the misgivings that Turkey may try to take
advantage of the dialogue with Armenia with the purpose of preventing
the further process of the international recognition of the Armenian
Genocide.

There is, certainly, no need to accuse the Turkish diplomacy of
cynical hypocrisy and immorality because such is the essence of
that country. The thing is that the obstacle currently faced by the
French-Armenian youth organizations can very soon be used in other
countries as well, so the Armenian side has to think about elaborating
relevant methods and technologies for finding a way out.

The thing is that a legal initiative on the recognition of the Armenian
Genocide has been proposed by the Swedish parliamentary opposition
as well, and the Turkish diplomats may be expected to pay a visit to
that country in the near future and demand non-interference in their
dialogue with Armenia.

Appeals for recognizing the Armenian Genocide are also voiced in
Ukraine, so it’s quite possible that the Turkish parliamentarians or
diplomats may organize a voyage to that country too.

It turns out that Turkey’s tactics of "shutting the enemy’s mouth with

hugs" may soon be applied as a universal tool laying obstacles to
the process of the international recognition of the Armenian Genocide.

Whereas, Turkey uses almost the same tactics with regard to the
Karabakh issue as well. Following the presidential elections in
Azerbaijan, Ankara intends to initiate a new trilateral meeting
with the participation of the Armenian, Turkish and Azeri Foreign
Ministers within the frameworks of the agenda discussions over the
Karabakh issue.

It’s noteworthy that Armenian Prime Minister Tigran Sargsyan and
C. Rice have recently conducted a discussion in this connection,
and thereafter the US State Secretary announced that the attempts of
proceeding with the Karabakh peace process beyond the frameworks of
the Minsk Group "are not worthy of any attention". In the estimation of
the Azerbaijani media, this means that "Sargsyan has persuaded Rice not
to involve Turkey as a mediator in the Karabakh settlement process".

Actually, by providing unilateral assistance to Azerbaijan,
i.e. assuring the country that it is not going to open the
Armenian-Turkish border before the withdrawal of the Armenian troops
from the liberated territories, and pursuing the contrary policy with
regard to the recognition of the Armenian Genocide, i.e. giving the
country admonitions of not interfering in the "Turkish honeymoon",
Turkey is actually conducting a dual policy.

With the help of the20former, it continues to use pressure against
Armenia, and with the help of the latter it is trying to use against
the countries that may, in the near future, discuss bills recognizing
the Armenian Genocide.

All this comes to prove that the Turkish diplomacy has prepared for us
an entire network of traps and at the same time, it is using different
tools of pressure.

We believe our Foreign Ministry has to clearly announce that Turkey’s
attempts of laying obstacles to the process of the recognition of the
Armenian Genocide do not, as a matter of fact, bear any relationship
to the first steps undertaken in the sphere of the Armenian-Turkish
relations.

Prime Minister Tigran Sargsyan yesterday summed up the results of
his one-week visit to the United States,

Within the frameworks of the visit, the Armenian delegation had
meetings with US Vice President Dick Chainy, Secretary of State
Condoleezza Rice, as well as the representatives of the World Bank, the
International Currency Fund and the Armenian lobbyist organizations.

Introducing the details of the visit, T. Sargsyan said that during
the meeting with D. Chainy both political and economic issues had
been discussed. The US Vice President introduced his assessments
on the international financial crisis and the activities carried
out by the Bush Administration with the purpose neutralizing its
negative impact. There were also discussions over issues concerning
the Armenian-American cooperation and the Armenian-Turkish relations.

"Our attitude towards the Armenian-Turkish relations has always been
voiced by the President of the republic. That is, we are ready to
regulate our relations with Turkey without any preconditions. It is
Turkey that advances preconditions," the Prime Minister said.

Pointing out that both the US Vice President and State Secretary
attached importance to the Armenian-Turkish relations, T. Sargsyan
introduced some details of their discussion over the issue, "I said
that the speeches delivered by the Turkish President and Azerbaijani
Forei gn Minister at the UN Summit had a ‘cold shower’ effect on
us, since they were not in harmony with the meeting held and the
agreements achieved before that. In particular, we consider that
the phrase ‘occupied territories’ (voiced by the Turkish President)
contains some hazards.

In his speech, Azerbaijani Foreign Minister Elmar Mamedyarov expressed
belief that the Karabakh conflict should be settled in compliance
with the Resolution adopted by the United Nations Organization; and
this totally distorts the process of the negotiations. Naturally,
our obligation was to inform the US Vice Presided and State Secretary
about this," T. Sargsyan mentioned.

According to some press reports published recently, Hrant Vardanyan,
Head of "Grand Holding" company, provided secret financial support
to L. Ter-Petrosyan’s pre-electoral campaign. To what extent does
this correspond to the reality?

In response to this question, H. Vardanyan yesterday said, "I have
worked with R. Kocharyan both as a Prime Minister and a President,
but I have never financed him; neither am I ready to finance anyone
else. I don’t need that.

I have never been dependent upon the authorities. My business is my
knowledge and my work. So, they are supposed to finance me."

Russia will allocate 10 million dollars for the restoration of the
security system of the second energy block of Armenia’s Nuclear
Station.

The director of the nuclear station Gagik Markosyan said the assistance
will be transferred via MAGATE. This is the first assistance from
Russia of that volume. The works will start from the year 2009, the
volume and direction of the works need clarifications. The discussion
of technical issues is in process.
