Armenian parliament clears way for arrest of opposition oligarch

The Armenian parliament has voted to lift the parliamentary immunity of opposition leader Gagik Tsarukyan, leading the way for his prosecution. Supporters of Tsarukyan, who leads the Prosperous Armenia Party have taken to blocking the streets of Yerevan.

Tsarukyan, one of the richest men in Armenia, is under investigation for vote-buying, illegal business practices, and organising a fraudulent land transfer scheme. 

Speaking in parliament on Tuesday, the prosecutor general of Armenia appealed for MPs to ‘end Gagik Tsarukyan’s immunity, so there can be a full and objective investigation’.

In two votes on Tuesday, parliament approved motions to strip him of his parliamentary immunity leading the way for his arrest. Both opposition parties with seats in the Armenian parliament, Tsarukyan’s Prosperous Armenia and the liberal opposition Bright Armenia Party, boycotted the votes.

Bright Armenia stated that despite their misgivings about Prosperous Armenia, they believed the decision was politically motivated, a charge the authorities have denied.

Before the motion was voted on, Tsarukyan insisted that he was innocent of the charges levied against him and that, as a politician, he only had the interests of Armenia at heart. 

‘Let no one say I’m doing this for personal gain or personal dividends’, he said.

Outside of parliament, scores of Tsarukyan supporters were arrested for protesting the move. In other parts of Yerevan, several lorries belonging to Multi Group, a company owned by Tsarukyan, were turned into impromptu roadblocks. Bystanders were seen on camera pushing the lorries out of the streets shortly thereafter.

According to Armenia’s Prosecutor General, Tsarukyan organisedvote bribing ahead of the 2017 parliamentary elections paying out ֏170 million ($360,000) to over 17,000 voters in Gegharkunik Province.

Prosecutors have also accused him of engaging in $62 million worth of illegal business practices through his casinos and orchestrating a fraudulent land transfer scheme costing the state $800,000.

Tsarukyan’s house was raided by the National Security Service (NSS) on the morning of 14 June and he was taken in for questioning for over 10 hours.

The houses of several other MPs from Tsarukyan’s Prosperous Armenia party were also searched.

The search came a week after Tsarukyan made a speech at the party’s Political Council in which he stated that the government had failed on all fronts — from domestic affairs to the economy, from negotiations around the status of Nagorno-Karabakh to its fight against the spread of COVID-19 in the country. Tsarukyan claimed the government should resign. 

Mane Gevorgyan, spokesperson to Prime Minister Nikol Pashinyan, shot back with a statement accusing Tsarukyan of trying to turn attention away from his criminal activity.

Soon after, court papers from a 1979 criminal case against Tsarukyan were leaked to the media.

They appear to show that Tsarukyan, along with several others, was convicted for the rape and robbery of two tourists. The verdict was overturned in 2001 following an appeal by Tsarukyan. 

After the leak, Tsarukyan’s lawyers filed a case with the General Prosecutor’s office claiming that by leaking the 41-year-old case, Tsarukyan’s right to privacy was violated.

Tsarukyan is one of the wealthiest men in Armenian politics. Having begun his business career in food processing during the 1990s, over three decades he has amassed a stake in a wide variety of industries throughout Armenia, including alcohol and food production, casinos, hotels, mineral extraction, pharmaceuticals, and most recently, bitcoin mining.

He has also had a large influence over sporting in Armenia, financially supporting a large number of athletes, sports centres, and serving as the head of the Armenian Olympic Committee since 2005. 

Tsarukyan has also had a successful if tumultuous career in politics.

In their first major electoral outing, his Prosperous Armenia party gathered 15% of the vote in the 2007 parliamentary elections, entering parliament as a junior coalition partner of the ruling Republican Party. In 2012, the party doubled its vote share to 30%. 

Tsarukyan’s political career suffered a hiccup when he publicly split with then-President Serzh Sargsyan in the aftermath of the 2012 election and left the ruling coalition. 

In 2015, he called for Sargsyan’s resignation and threatened to bring his supporters into the streets. Sargsyan, in turn, accused the oligarch of ‘stealing millions’ and removed him from the National Security Council. 

Before the conflict could escalate, Tsarukyan and Sargsyan reconciled in a meeting supposedly mediated by then-Prime Minister Hovik Abrahamyan, who is Tsarukyan’s son-in-law, as well as Russian-Armenian billionaire Samvel Karapetyan.

Following the meeting, Tsarukyan announced that he was leaving politics, and resigning from his position as an MP and head of his own party. In the autumn of 2015,  he was awarded a medal by Sargsyan for ‘services done for his country.’

Tsarukyan returned to politics in February 2017. His return also coincided with a push towards making international connections, as he feted a number of prominent eurosceptic politicians from abroad such the British former MEP Daniel Hannan, and former MP James Wharton. 

He was one of the few oligarchs and major politicians with ties to the pre-revolutionary government who had previously remained untouched by the 2018 Velvet Revolution.

Fired dishwasher sues Glendale restaurant that told him they do things ‘the Armenian way’

LOS ANGELES — A former dishwasher at a Glendale restaurant is suing his ex-employer, alleging he was wrongfully fired in 2019 for taking medical leave and that when he objected he was told, “We do things here the Armenian way, not the American way.”

Andreh Fazelimoghadam’s Los Angeles Superior Court lawsuit alleges that Adams Kabab House is guilty of wrongful discharge, retaliation, harassment and discrimination. He seeks unspecified damages in the suit filed Monday, which seeks $10 million in damages.

A man who answered the phone Tuesday at the restaurant located on the 1100 block of South Adams Street declined to comment on the suit.

Fazelimoghadam was hired last July as a dishwasher, and his duties additionally included the daily unloading of delivery trucks with an average of 40 large, heavy boxes of food supplies, pots and trash, the suit states.

Fazelimoghadam worked alternating schedules of three or four days weekly in 14-hour shifts and was paid $100 per shift, far less than the minimum wage, the suit states. He was not paid overtime was not provided meal and rest breaks, according to the suit.

Last November, Fazelimoghadam dropped a heavy crate of apples on his left toe, resulting in a long hospitalization and the amputation of one of his left toes, the suit states.

Management fired him later that month due to his injury and disability and also because he took a medical leave, the suit states. When Fazelimoghadam protested, his supervisor replied, “We do things here the Armenian way, not the American way,” according to the suit.

The restaurant never had workers compensation insurance covering Fazelimoghadam, a violation of California law, the suit states. The eatery has at least three other seriously injured employees, all of whom fear they also will be fired if they complain, the suit states.


Parliamentarian: Armenia is taking steps to mitigate the consequences of the statement in the European Parliament

In this light, the negative response to certain actions of Armenia,  according to the parliamentarian, in no way means that Armenia should  not take these actions. Another question is the work necessary to  level the real impact of such responses. In this direction, Armenia,  of course, faces the need for its implementation.

To recall, on June 11, Marina Kaljurand, Co-Chair of the  Parliamentary Cooperation Committee of the European Parliament for  Azerbaijan, Georgia and Armenia, Traian Basescu, Permanent Rapporteur  for Armenia, and Zhelyana Zovko, European Parliament Standing  Rapporteur for Azerbaijan, made a joint statement regarding the  construction of a new highway linking Artsakh and Armenia. Expressing  concern in this regard, they emphasized that the decision to build  was taken bypassing the Azerbaijani authorities.

Zolyan stressed that this statement was distributed on behalf of only  a few European parliamentarians and in no way reflects the official  point of view of the European Parliament. In his opinion, in any  case, the very fact of this statement causes concern, given the  position of its authors in the parliamentary cooperation bodies of  EU-Armenia and EU-Azerbaijan. According to him, Yerevan’s harsh  reaction to this statement is caused precisely by this fact.

Artsakh President Arayik Harutyunyan reported on the project of  building a third highway between Armenia and Artsakh on June 5. The  latter, together with the Minister of Territorial Administration and  Infrastructures of Armenia Suren Papikyan, visited the south of the  Kashatagh region, from where it is planned to continue the route to  the southern part of the Syunik region of Armenia. After the Goris-  Stepanakert road and the Vardenis-Martakert highway, the  150-kilometer highway will become the third highway connecting  Armenia and Artsakh.

Leader of the Prosperous Armenia party Gagik Tsarukyan stated this from the parliamentary rostrum on July 16, speaking about the criminal cases  instituted and in connection with this the possibility of depriving  him of parliamentary immunity.

The politician said that his persecution began on June 5, when he  criticized the authorities and announced the need for a complete  change in the composition of the government. Meanwhile, Tsarukyan  noted that his every word about the crisis reigning in the country is  true, and he says it openly, without resorting to fakes and Facebook. < I demand that today parliament take a full-fledged step towards real  life. Let everyone be responsible for his decision to his  conscience>, he said, adding that the current development of events  only heroizes his name in society.

The politician noted that the promises made by the current  authorities two years ago did not become a reality, and instead real  failures were recorded. , he emphasized, noting that he was ready to help solve the  existing problems 24 hours a day.

Tsarukyan noted that it is impossible to carry out an economic  revolution without money.

As for the criminal cases, the politician called them fabricated,  adding that there is no real evidence of the distribution of election  bribes, in which the PAP is accused of. According to Tsarukyan, today  the public is on his side, but the authorities, contrary to their  promises to ensure freedom of _expression_ of the people, today blocked  the regional roads by the police to prevent the arrival of his  supporters in Yerevan. , Tsarukyan emphasized, noting also about Armenia’s failed  foreign policy.

Tsarukyan also informed about the institution of the another criminal  case, and that after his speech in parliament he would go to the NSS  for questioning. Today, Prosecutor General of Armenia Arthur Davtyan  submitted a motion to the parliament to initiate criminal prosecution  of Gagik Tsarukyan, as well as the deprivation of his freedom. 

To recall, in the morning of June 14 searches were carried out in the  house of Tsarukyan. Then he went to the NSS for questioning. By  chance or not, the former Chairman of the Control Chamber Ishkhan  Zakaryan, who was in close relations with Gagik Tsarukyan, was also  summoned to the NSS. Tsarukyan called the developments political  persecution, meanwhile, the NSS reported three criminal cases  involving the politician. So, according to the investigation, the  leadership and other members of the Prosperous Armenia party  distributed hundreds of millions of drams of election bribes in 2017  in accordance with well- developed schemes, and this was done under  the pretext of charity.  In another case, Tsarukyan’s companies were  involved in the organization of the casino’s illegal activities,  resulting in damage to the state of $ 60 million.  Another criminal  case concerns a company associated with Tsarukyan, which illegally  appropriated land, and the state suffered damage of 342 million drams  (about 685 thousand dollars).  The politician himself believes that  criminal prosecution is being carried out against him.

Armenian Parliament refused to include on the agenda issues proposed by Prosperous Armenia faction

ArmInfo.The National Assembly of Armenia at the plenary meeting on June 16 voted against the inclusion of two issues on amendments to the Tax Code of the country.

It is curious that the author of both documents, MP from the  Prosperous Armenia faction Mikael Melkumyan refused to submit the  amendments proposed by him, saying that he had “nothing to say.” On  both bills, the National Assembly’s profile committee issued negative  conclusions.

Apparently, the demarche of the faction’s representative is   connected with the situation surrounding leader of the Prosperous  Armenia party Gagik Tsarukyan, in relation to whom a criminal case  was initiated under several articles of the RA Criminal Code. As  expected, RA Prosecutor General Arthur Davtyan will present two  motions to deprive Tsarukyan of parliamentary immunity and arrest.

As the Prosperous Armenia faction member Naira Zagrabyan said from  the rostrum of the parliament, the Prosecutor General, who has  petitioned for depriving Tsarukyan’s immunity,  is carrying out a  political order. the lawmaker emphasized.   Zohrabyan said that Prosecutor General Arthur Davtyan proved by his  actions that he would carry out any orders of any government. , the MP noted.

–  concluded Zohrabyan.  According to her, no one is eternal, not a  single political force is eternal. You will be held responsible for  your actions>, the lawmaker concluded.

Prosecutor General Artur Davtyan, in turn, stated that all his  actions were lawful and open.  , wondered the Prosecutor General, answering  the charges related to the case two years ago. The Prosecutor General  said that throughout his career he had never felt shame. , – concluded the  Prosecutor General.
