Armenian Prime Minister’s Answers To Questions Of Noyan Tapan News Agency

YEREVAN, DECEMBER 13, NOYAN TAPAN. NT: Mister Prime Minister, according
to the agreement on transfer of the fifth power unit of the Hrazdan
Thermal Power Plant to the jurisdiction of Gazprom, which was signed in
April 2006, Gazprom assumed a commitment to invest the necessary funds
for completion of the power unit’s construction. At the same time,
there have been doubts that this commitment cannot be fulfilled, say,
under the pretext of lack of funds. What about this problem? When is
the construction of the fifth unit expected to finish? A.M: There is
no problem of insufficient funds. Gazprom has already transferred the
first tranche for the fifth power unit. Now the assessment of technical
state and the design work are under way. It is envisaged to complete
the 5th unit’s construction in 2008. NT: There are also investment
problems in the four operating power units of the Hrazdan Thermal Power
Plant, which are considered depreciated and non-competitive. RAO UES,
their owner, also speaks about investments. Will these investments
be made, and if so – when? A.M: First of all, the Hrazdan TPP’s four
power units are not the property of the RAO UES but the property of
the RF Federal Property Management Agency that manages it. As regards
investments, today these four power units can be operated in parallel
with each other, whereas in the past we were able to operate only two
units at the same time. Enough investment was made and is being made
in these units now. NT: The problem of communication routes linking
Russia and Armenia continues to be urgent. Can we expect progress in
this respect, be it opening overland routes or increasing the passing
capacity of sea routes (a new ferry, etc)? What steps does or can
the government take with respect to this problem? A.M: As you know,
the problem of opening the overland routes is related to improvement
of the Russian-Georgian relations, in which our country is, quite
naturally, interested. We have no right to interfere in the internal
affairs of the two countries. However, during meetings with the
authorities of these countries we have always stated that if Armenia
can assist with improvement of their relations, it is ready to do this
and will try its best. As for communication by sea, here we see some
opportunities to improve the situation and are conducting an active
dialog with Russia. This problem is one of the agenda issues of the
Armenian-Russian intergovernmental commission, with the sides being
committed to finding efficient solutions. During my recent visit to
Russia, we discussed seriously this problem during the meeting with
the Russian Prime Minister Fradkin. Taking into consideration that
the Verin Lars crossing point has been closed for an indefinite
time and its functioning has a seasonal character, the issue of
organizing Novorossiysk-Poti-Novorossiysk car-ferry transportation
becomes especially urgent. We also spoke about the launching of
the Kavkaz-Poti-Kavkaz reailway-ferry link. We are interested in
completing the construction of the second shift of the ferry complex
at the Kavakaz port as soon as possibble, which will allow to put
this route into operation. NT: Next year Russia is likely to cut off
the gas supply of Georgia, which may endanger Armenia’s gas supply by
Russia. How much prepared is Armenia to deal with such a situation:
for example, can this lack be compensated with gas from Iran? A.M:
If the gas supply from Russia is cut off for some reason or other,
Armenia’s energy system is ready to use such regimes that would cause
the minimal problems for both the economy and population in terms
of electricity and gas supply. The government attaches importance
not only to the operation of the new gas pipeline but also to the
use and development of alternative energy sources in the future, it
is already taking measures aimed at developing hydropower energy,
using wind energy and developing other sources. NT: The Russian
government recently made a decision to prohibit or restrict the labor
of foreigners in the country’s market. It means that tens of thousands
of Armenians may lose their jobs in Russia, which is fraught with
unpredictable consequences, up to the return of these people in large
numbers to homeland. Is the government taking any measures in this
connection (for example, Azerbaijan has set up a special governmental
commission)? A.M: I think the matter concerns the Russian government’s
Decision No. 683 of November 15, 2006 on Fixing the Permissible Number
of Foreign Workers Employed by Economic Entities Engaged in Retail
Trade in the Territory of the RF in 2007. When assessing the possible
consequences of this decision for Armenian citizens, we should view
two groups of our citizens: legal workers, i.e. persons who do not
break the RF migration legislation and the requirements on foreign
labor and so have job pewrmission, and illegal workers who are either
unregistered or have no job permission. Persons of the first group
can find jobs in other spheres after the decision comes into force –
their legal status allows them to do so. Naturally, persons of the
second group will have job problems. The decision’s approaches will
take effect in 2007, and it is not ruled out that as a result of the
practical use of this decision, these approaches will be reviewed
in 2008 and some new approaches will be adopted. Nevertheless,
it is likely that some of our citizens will return because of this
decision. They will be able to find jobs in the same order and by
the same rights as all our citizens: they can get registered at a job
agency and will be offered jobs, they may participate in competitions
for vacant jobs, as well as get a suitable job based on market demand –
in the same way as any other Armenian citizen.

TRANSIT FLIGHTS OF THE RUSSIAN AF ACROSS GEORGIA PROHIBITED; Tbilisi
finds new and more ways of making Russia’s life difficult.

The Russian Foreign Ministry demanded from Georgia "an immediate end
to the practice of sabotaging the Accord on military shipments and
personnel transit across Georgia" and accused Tbilisi of deliberate
tension-mounting, last week.

Diplomat Mikhail Kamynin ascribed the demarche to the fact that
"Georgia has ignored the request for the planned Russian flights to the
Russian military base in Gyumri, Armenia" on December 8-22. The request
was forwarded to Tbilisi in advance, but the Georgian authorities
"chose to leave it unanswered" (to quote Kamynin). Moscow took it
as "a deliberate attempt to interfere with the functioning of the
Gyumri base" and with the withdrawal of the Russian troops from
Georgia itself.

As far as the Russian Foreign Ministry is concerned, Tbilisi is
deliberately mounting tension in the bilateral relations. Georgian
Ambassador Irakly Chubinishvili was summoned to the Russian Foreign
Minister and served a note, last Saturday.

Sources in the Georgian Foreign Ministry promise a response to
the Russian statement come Monday. The Georgian Defense Ministry
denies "any sabotage of flights of Russian military transports"
because all planes flying over Georgia are the responsibility of
Gruzaeronavigatsia, a civilian outfit.

A spokesman for the latter who insisted on anonymity claims that
Russia owes Gruzaeronavigatsia money. The source refused to say what
exact sum was meant. "If Russia uses the clearly invented pretext of
Georgian air carriers’ debts to Russia to prohibit air traffic from
Georgia to Russia, then Georgia is also entitled to demand what the
Russian Defense Ministry owes Gruzaeronavigatsia," he said.

stability and security of the country in conditions of the legally
unsolved Karabakh conflict. Just for that reason, as RA National
Assembly Deputy Speaker Vahan Hovhannisian mentioned at the December
13 meeting with students of higher educational institutions, having
disagreements with the authorities in some issues, Dashnaktsutyun
makes a part of the authorities today. Touching upon the National
Security conception, V.Hovhannisian said that it is a step on the way
of getting consensus concerning the country fate among the political
forces. He positively estimates the document being discussed in
the academic sense. But in V.Hovhannisian’s words, the way of
implementing the conception does not exist in the document. The
NA Deputy Speaker proposes to fill this ommission, founding an
institutional national security council. Defining the place and role
of the parliamentary forces in the political life, V.Hovhannisian
mentioned that right-left separation does not function in Armenia in
its classic sense. Dashnaktsutiun, being a socialist left-side party,
is often for adoption of liberal laws. In V.Hovhannisian’s words,
they are led by that consciousness that in a poor country socialism
can bring to Bolshevism. That’s why they consider necessary first
to enrich the country, to make it attractive for investments, then
to implement socialist programs. And right parties, arising of the
present conditions of the country, often vote for laws having social
orientation. V.Hovhannisian also expressed confidence that it is a
wastefulness for a small country like Armenia to have 131 deputies.

the RA National Assembly signed the statement demanding to immediately
set free Zhirayr Sefilian, the coordinator of the "Defence of Liberated
Territories" public initiative, "Shoushi" battalion commander, who
was put under arrest. The initiator of gathering of signatures is
independent deputy Hmayak Hovhannisian.

Members of the "Ardaroutiun" (Justice), "Orinats Yerkir" (Country
of Law) factions and some independent deputies signed under the
statement. After bringing gathering of signatures to the end,
H.Hovhannisian intends to address the statement to the RA National
Security Service, Prosecutor’s General Office and RA President’s
residence.

group will have concerts in the "Astral" club of Yerevan starting
from December 14. As group members Seto Tuncboyaciyan, William Dace
and Carlton Carvalho mentioned at the December 14 press conference,
in their performances they use most different music instruments:
kanon, duduk (Armenian national pipe) trumpet, saxophone, etc. It was
mentioned that the first disk of "Paper Boys INTL" having one-year
history will be released soon. And a part of the second disk will be
recorded in Armenia.

YEREVAN, DECEMBER 14, NOYAN TAPAN. Series of books of modern
Armenian literature consisting of Dramaturgy, Prose, Poetry volumes
was published in English. Its presentation took place on December
14. The series of books published with the assistance of the Armenian
General Benevolent Union (AGBU) presents works of about 80 modern
Armenian writers, including Silva Kaputikian, Hrant Matevosian, Perch
Zeytuntsian, David Muradian, Alvard Petrosian and others. In the
words of Levon Ananian, Chairman of the Union of Writers of Armenia,
the publication of the series of books is unprecedented: it will
enable the English-language readers to get acquainted with the works
of modern Armenian writers. "With this unprecedented attempt we prove
that in the period of independence the Armenian literature continues
its best traditions and today we have a high-level and presentable
literature," L.Ananian said.

Orhan Pamuk, the winner of the 2006 Nobel Literature prize, flew back
home late Wednesday amid tight security against possible demonstrations
over his dissident views on the massacres of Armenians under Ottoman
rule, the Turkish media reported Thursday.

Dozens of riot police were deployed at Istanbul’s Ataturk airport for
Pamuk’s arrival after a nationalist television station urged Turks
to denounce the writer at the airport with Turkish flags.

There were no security incidents. On the contrary, Pamuk was greeted
with flowers while passengers in the terminal applauded and took
pictures of him.

"I am a little tired but very happy," a smiling Pamuk told reporters.

"This award was given to Turkey, the Turkish culture and the Turkish
language in which I have been swimming like a fish for years,"
he added.

The 54-year-old Pamuk won the reputation of a "traitor" among
nationalist circles and stood trial on charges of "insulting
Turkishness" when he told a Swiss magazine last year that "one million
Armenians and 30,000 Kurds were killed in these lands."

His remarks were widely seen as an acknowledgement that the Ottoman
Turks committed genocide against Armenians during World War I,
a label that Ankara fiercely rejects.

The court case against Pamuk, in which he risked up to three years
in jail, was dropped on a technicality in January.

The celebration of Pamuk’s award at home was overshadowed by skeptics
who argued that the author won the favors of the West not for his
literary skills but for his vocal criticism of his country.

Pamuk was in the United States when it was announced in October that
he won the 2006 literature prize.

He came back briefly to his home town Istanbul before Sunday’s
awards ceremony in Stockholm, and was greeted with indifference,
going through the airport like an ordinary passenger.

La 11e chambre de la cour d’appel de Paris a reporte au 24 janvier
2007 sa decision sur l’action en justice intentee par plusieurs
associations contre le Quid pour sa presentation jugee contestable
du genocide armenien dans son edition 2003.

Le Quid avait fait appel de sa condamnation civile prononcee par le
tribunal de grande instance (TGI) de Paris, le 6 juillet 2005.

En première instance, le TGI de Paris avait estime que la presentation
par le Quid de cet episode historique etait fautive "au regard des
exigences attendues d’un ouvrage a vocation pedagogique qui se prevaut
d’un souci d’exactitude et de neutralite".

La societe editrice Robert Laffont et la societe Quid avaient ete
condamnees a payer solidairement a chacune des associations un euro
de dommages-interets.

Le Comite de defense de la cause armenienne (CDCA), auquel s’etaient
jointes plusieurs associations, dont J’accuse et Memoire 2000,
remettaient en cause la presentation faite par le Quid 2003 du massacre
des Armeniens par la Turquie, estimant qu’elle aboutissait a nier le
caractère genocidaire de cet evenement historique.

Le CDCA reprochait notamment aux auteurs de l’ouvrage d’avoir
ecrit pour l’annee 1915: "Transfert d’Armeniens vers les province
meridionales de l’Empire ottoman (…) nombreux decès (epidemie,
maladie) pendant le voyage". Une presentation qui, selon les
plaignants, conduisait a gommer "les massacres et donc forcement
l’aspect genocidaire".

NKR: President Says It Is Our Internal Problem

On December 11 soon after the release of the preliminary results of
the referendum on NKR Constitution NKR President Arkady Ghukassian
met with the observers and reporters. "Today we are happy to announce
that the majority voted for the NKR Constitution, and I congratulate
everyone," said Arkady Ghukassian, and thanked everyone for their
work. "The results of the referendum impress.

About 98.6 percent said yes. This fact shows that the establishment
of an independent and sovereign state in Karabakh is irreversible,"
he said. "The adoption of the Constitution is not an end in itself,"
stressed Arkady Ghukassian, assuring that since the declaration
of independence the country has not only managed to overcome the
consequences of the war imposed by Azerbaijan but also went ahead of
this country by achievements of democratization of the society. In
answer to the question if Artsakh needs a constitution, and if it can
be helpful for the development of the country, Arkady Ghukassian said,
" The Constitution is the summary of our achievements after becoming
independent.

I think it is a very important step on the track for reinforcing
statehood and democratization." In addition, it helps to be more
flexible in solving both internal and external problems. "People who
have a balanced Constitution and uphold the European values stand a
good chance to be recognized by the international community rather
than a totalitarian country," said Arkady Ghukassian assuring that
if Azerbaijan had a document like the constitution of Artsakh, the
question would be solved more quickly and easily. Azerbaijan rejects
the fact that the constitution was adopted by referendum, and in this
connection the president said there is no reason why the international
community should accept this stance. The reporters reminded that
the president had promised to make efforts for the adoption of the
basic law of the country before he leaves office. Arkady Ghukassian
said he considered it as one of his important goals. With regard to
current problems requiring solution, he assured that there are many
such problems, and he would make sufficient efforts to solve them by
the end of his office. The guests who had arrived in NKR on the eve
of the referendum wanted to know about the preparations and debates on
the draft constitution. President Ghukassian pointed out transparency,
freedom of expression of opinion and proposals for all the citizens
of NKR. He also emphasized the contribution of the political forces
and generally the citizens in improving the draft. The next question
was if the provisions of the constitution will be brought into being
successfully. "In fact, the adoption of the constitution is not a
solution of problems, but by adopting it we have a new possibility for
democratization of the country," Ghukassian agreed. According to him,
this is a lasting process, which is facilitated by a constitution. "By
adopting a constitution we solved a very important problem: there is
no important issue for NKR which can be solved without taking into
account the opinion of people," said the head of state. In connection
with the settlement of the conflict, the president said Artsakh is the
most interested party but the existing circumstances do not enable
it to set up relations with different countries and international
organizations. "However, this is not a unilateral process. The stance
of the Azerbaijani leadership is not constructive, which would
facilitate the settlement. The problem can be settled if there is
mutual confidence, which lacks now," said the president. In connection
with the influence of the Constitution on the talks, the head of state
assured that "it fits the process mediated by the Minsk Group", and
expressed his surprise why Azerbaijan had a negative attitude towards
the referendum in NKR from the very beginning. "This means that we
may hardly reach agreement in this situation because if Azerbaijan
does not accept the right of NKR to live as it wants, we cannot agree
on any other question. Azerbaijan has to accept the right of NKR to
live the way it chooses. Adopting or not adopting a constitution
is our problem. We do not interfere with the internal problems of
Azerbaijan. We have much to say about the Azerbaijani constitution
and laws. But this is their choice. Azerbaijan should do the same in
connection with Nagorno Karabakh." In answer to the question whether
the constitution will help NKR to become involved in the talks,
the president said: "The participation of NKR is necessary for the
process rather than us because otherwise it is impossible to settle
this issue. The mediators, Armenia and Azerbaijan acknowledge this,
and we too. The fact that Karabakh is not participating in the talks
means that Azerbaijan is not ready for the settlement of the problem."

leadership and people on the adoption of the Constitution by popular
voting. "By organized and active participation in the referendum
the people of Artsakh confirmed once again their determination to
be free. This referendum held in compliance with the benchmarks of
democracy reinforces the establishment of the state of Karabakh. On
the day of declaration of independence Nagorno-Karabakh Republic took
the track for democratic development, which was proved for a number of
times by free and fair elections. The referendum on constitution upheld
the tradition of expression of free will, and enabled to set down the
rules of democracy in the basic law of the country," runs the message.
