L’AFFAIRE SAFAROV DéBATTUEA L’APCE – II

Info Collectif VAN – – La trente-cinquième
séance de l’Assemblée Parlementaire du Conseil de l’Europe (APCE)
a mis la sinistre “Affaire Safarov” a l’ordre du jour des débats
du jeudi 4 octobre 2012 a 15 h 30 heures. L’occasion pour les
parlementaires d’exposer leur interprétation de faits gravissimes
qui bafouent les valeurs européennes les plus essentielles. Certains
ont été clairs et nets dans leur dénonciation de l’Azerbaïdjan,
d’autres ont cru bon de mettre sur le même plan victimes et assassins
en affirmant que “les deux parties en conflit considèrent qu’elles
sont libres de bafouer la loi !” Or, en l’occurrence, l’Arménie n’a
bafoué aucune loi puisqu’elle n’a même pas été consultée pour
le transfèrement de l’assassin a la hache Ramil Safarov, de Hongrie
vers l’Azerbaïdjan.

Les interventions les plus “jouissives” sont celles des parlementaires
azéris qui se servent de cette tribune de l’APCE pour assener une
propagande anti-arménienne des plus primaires, n’hésitant pas a
s’indigner de l’acquittement par une cour allemande en 1921, du jeune
Soghomon Tehlirian, un Arménien rescapé du génocide de 1915, qui
avait exécuté Talaat Pacha, le “Hitler” turc en fuite a Berlin… :
“J’aimerais donc poser quelques questions. Comment peut-on justifier
que les tribunaux allemands aient relâché un meurtrier arménien
qui avait assassiné un Turc a Berlin ? ” s’est en effet interrogé M.

Huseynov (Azerbaïdjan). Nous remercions ce valeureux parlementaire
d’une institution européenne de ridiculiser le pays qu’il représente
et d’assumer aussi clairement la complicité du nationalisme et du
négationnisme turco-azéris. Son collègue turc, Ahmet KutalmiÅ~_
TurkeÅ~_, lui a prêté main forte en matière de cynisme et de
mauvaise foi, pour justifier l’odieux crime de Ramil Safarov et sa
grâce par le dictateur de l’Azerbaïdjan Ilham Aliev : “De 1973 a
1987, des organisations terroristes arméniennes ont commis – y compris
en France – 170 attentats, qui ont tué 31 diplomates turcs, causé la
mort de 39 civils et fait plus de 500 blessés. Or nous n’avons jamais
entendu le moindre Arménien – officiel, parlementaire ou citoyen –
condamner ces assassinats de diplomates turcs. Au contraire, ceux-ci
ont été glorifiés et récompensés.” Damned ! Ces organisations –
un peu distraites sans doute – n’ont pas dÔ entendre les excuses de
la Turquie moderne pour les 1 500 000 victimes du génocide arménien
en 1915, pour l’éradication totale d’un peuple et de sa culture de
ses terres ancestrales en Anatolie. Elles ont par contre dÔ prendre
bonne note de la glorification des criminels Jeunes-Turcs y compris
dans la Turquie d’aujourd’hui : Talaat Pacha, le “Hitler” turc a
son Mausolée sur la Colline de la Liberté a Istanbul, des écoles
et des avenues portent son nom en Turquie et les gouvernements turcs
successifs pratiquent un négationnisme d’Etat outrancier a l’échelle
nationale et internationale. Ils interfèrent même dans la politique
intérieure de la France, des Etats-Unis, pour bloquer toute loi
reconnaissant le génocide arménien ou condamnant le négationnisme.

Voici les principales interventions des débats a l’APCE sur l’Affaire
Safarov

Les agissements de l’Azerbaïdjan justifient de tels crimes. Le
comportement inacceptable de ce pays a des répercussions sur
l’ensemble de la région. De son côté, l’Arménie a déclaré qu’elle
ne souhaitait pas la guerre, mais qu’elle était prête a se battre
si nécessaire et a remporter le combat.

J’espère pour ma part que la réconciliation est possible. J’admire
le geste de notre Président, qui a invité les deux délégations pour
faire avancer les choses ; mais cela ne suffit pas. Je demande donc que
l’on organise une réunion de haut niveau sur ce conflit pour essayer
d’avancer vers une solution. Seuls, ces deux pays n’y parviendront
pas. Le Conseil de l’Europe devrait donc assumer ses responsabilités.

LE PRÃ~ISIDENT – La parole est a M. Zourabian.

M. ZOURABIAN (Arménie)* – Même si j’appartiens a la délégation
arménienne, j’aimerais que la question que nous examinons soit
extraite des discussions brÔlantes entre mon pays et l’Azerbaïdjan
sur les responsabilités morales et historiques des uns et des autres
dans le conflit du Haut-Karabakh. Je ne souhaite pas non plus examiner
ici la question de savoir si la glorification d’un assassin, quelle
que soit la nation par laquelle il a été condamné, peut être
considérée comme un comportement acceptable. Je ne me demanderai pas
davantage si le fait que des négociations soient au point mort puisse
justifier des violences brutales. En effet, toutes les réponses a
ces questions vont de soi pour la majorité de ceux qui nous écoutent.

En revanche, ce qui est en jeu a l’heure actuelle, c’est la destinée
de nos deux peuples et celle du Haut-Karabakh ; c’est l’avenir de la
paix dans le Sud Caucase et la stabilité de l’ensemble de la région.

En mai 1994, un cessez-le-feu a été instauré entre les parties
au conflit du Haut-Karbakh. Depuis, les négociations dans le
cadre du Groupe de Minsk de l’OSCE ont tenté de trouver une
solution durable au conflit pour apporter la paix aux Arméniens
et aux Azerbaïdjanais. Ces négociations sont difficiles, parfois
frustrantes. Néanmoins, c’est la seule solution a une guerre
régionale destructive a grande échelle.

Soyons réalistes, l’acte de l’Azerbaïdjan et, dans une moindre
mesure, de la Hongrie était en somme une extradition, une libération,
une glorification d’un meurtre, qui a porté un coup sérieux au
processus de négociations, sapant la perspective de renforcement
de la confiance entre les parties dans un proche avenir. Il y a
trop de crises, de tensions dans cette région : la Syrie, l’Irak,
les positions prises par l’Iran. Dans un tel contexte, il convient
de tout faire pour préserver un processus de négociation fragile
et cela afin de résoudre le problème du Haut-Karabakh. Voila la
priorité de la communauté internationale !

En tant que principale opposition dans le pays, nous avons demandé
devant l’Assemblée nationale arménienne que le gouvernement arménien
n’apporte pas une réponse destructrice aux actions agressives de
l’Azerbaïdjan, c’est a la communauté internationale de réagir
fortement. Elle doit envoyer un message clair aux leaders de la
région : les responsables ne peuvent pas obtenir ce qu’ils cherchent
en attisant le sentiment nationaliste ; au contraire, ils doivent
contribuer a la résolution du conflit sur un mode pacifique. Toute
action en sens contraire ne ferait qu’alimenter les tensions dans le
sud Caucase et saper un cessez-le-feu fragile et des négociations
de paix difficiles.

LE PRÃ~ISIDENT – M. Beneyto, inscrit, dans le débat, étant absent
de l’hémicycle, la parole est maintenant a Mme Gafarova.

Mme GAFAROVA (Azerbaïdjan )* – Nous parlons du transfèrement de Ramil
Safarov. Il s’agit d’une procédure judiciaire. A aucun moment, les
conditions juridiques n’ont été violées. Ces mécanismes juridiques
existent et le transfèrement ne constitue pas une violation du droit.

Je reviens sur certains événements évoqués par mes collègues. En
avril 2001, un terroriste arménien, qui avait été condamné a la
prison pour avoir commis un attentat a Orly, a été transféré
en Arménie alors même qu’il n’était pas citoyen arménien. De
hauts responsables arméniens l’ont accueilli a l’aéroport en
héros. L’Arménie était alors membre de l’Assemblée parlementaire
du Conseil de l’Europe et pourtant personne dans notre Assemblée n’a
réagi ni n’en a débattu ici. On critique l’Azerbaïdjan aujourd’hui,
pourquoi est-on resté muet a cette époque ?

Nous discutons aujourd’hui du cas d’un citoyen azerbaïdjanais qui
a déja purgé huit ans de prison et qui a été gracié, certes,
mais non innocenté. Si nous évoquons l’affaire Safarov, il convient
également d’évoquer les raisons tues, mais réelles de ce crime qui
trouve son origine dans la situation d’occupation. Il faut replacer
cette affaire dans le contexte du conflit du Haut-Karabakh. Les
membres de la famille de Safarov ont été tués sous ses yeux. Nous
reconnaissons son crime, mais n’a-t-il pas été condamné pour cela ?

Si nous discutons de l’affaire Safarov, pourquoi ne pas évoquer
l’assassinat d’Azerbaïdjanais en Arménie car on semble oublier que de
nombreux crimes ont été commis durant l’occupation des territoires
azerbaïdjanais par les Arméniens ? Pourquoi ne parlons-nous pas
du Président Sarkisyan qui a déclaré qu’il était a Khodjali a
l’époque de ces massacres ? L’occupation du territoire azerbaïdjanais
est illégale et le Conseil de sécurité l’a confirmé en 1993.

LE PRÃ~ISIDENT – La parole est a M. Salles.

M. SALLES (France)* – Chers collègues, la libération et la
glorification de M. Ramil Safarov ont soulevé, a juste titre, de très
vives protestations. Accueillir en héros un homme qui a commis un
acte aussi odieux est indigne d’un pays membre du Conseil de l’Europe.

Je ne reviendrai pas sur les faits, mais la préméditation et
la brutalité de ce crime sont des circonstances aggravantes. Sa
motivation, la haine des Arméniens et l’absence totale de remords
de M. Safarov aussi.

C’est pourquoi la grâce et la promotion accordées a M. Safarov par le
Président de l’Azerbaïdjan suite a son extradition et a l’occasion de
son retour dans son pays portent atteinte d’autant plus a nos valeurs,
au respect élémentaire de la vie de l’autre, quel qu’il soit.

Un troisième pays membre de notre Assemblée est impliqué : celui
où s’est produit ce massacre et qui a autorisé l’extradition vers
l’Azerbaïdjan : la Hongrie. Car cette affaire pose aussi la question
de l’application de la Convention européenne sur le transfèrement
des personnes condamnées, une convention du Conseil de l’Europe.

Bien sÔr, d’un point de vue purement technique, la convention a été
suivie a la lettre. Bien sÔr, son article 12 prévoit que les Etats
peuvent user de leur droit de grâce. Mais la condamnation de Ramil
Safarov prononcée par un juge hongrois avait fait l’unanimité contre
elle en Azerbaïdjan ; l’Arménie avait demandé a la Hongrie de ne
pas extrader ce meurtrier. Alors pourquoi cette décision a-t-elle
été prise si rapidement, sans prévenir la partie arménienne ?

Au-dela du texte et des procédures juridiques, il y a aussi l’esprit
de la convention : elle a pour objet principal de favoriser la
réinsertion sociale des personnes condamnées en permettant a un
étranger privé de sa liberté a la suite d’une infraction pénale
de purger sa peine dans son pays d’origine. Oui, purger sa peine !

La gravité de l’acte – rappelons que M. Margarian a été massacré
de 16 coups de hache pendant son sommeil – la sévérité justifiée
de la condamnation, la perpétuité, pour un homme reconnu responsable
de ses actes par les experts, y compris azerbaïdjanais, la situation
des relations entre l’Arménie et l’Azerbaïdjan, tous ces éléments
auraient dÔ conduire la Hongrie a plus de prudence et de retenue
dans l’application de la convention.

L’attitude de l’Azerbaïdjan est quant a elle intolérable et doit
être condamnée. En libérant cet homme, ce pays a encore une fois
éloigné toute perspective de règlement pacifique du conflit
du Haut-Karabakh et remis en cause le processus de Minsk. En le
transformant en héros national, ce pays, membre du Conseil de
l’Europe, a fait honte a notre institution.

Il faut donc que l’Azerbaïdjan prenne ses responsabilités et respecte
ses engagements : pour cela, Ramil Safarov doit retourner en prison
et purger sa peine.

Je me tourne maintenant vers mes collègues azerbaïdjanais pour leur
dire que ce ne sont pas des arguments que nous avons entendus cet
après-midi, c’est de la propagande ! L’amalgame avec le Haut-Karabakh
était totalement insupportable. Les déclarations des représentants
de votre délégation cet après-midi la déshonorent dans cette
enceinte, qui est le temple des droits de l’homme en Europe. Si
l’Azerbaïdjan persiste dans cette attitude, cette affaire restera
comme une tache indélébile, que ce pays devra un jour ou l’autre
effacer. Dans l’immédiat, je m’interroge sur la légitimité de
l’Azerbaïdjan a siéger au sein du Conseil de l’Europe.

LE PRÃ~ISIDENT – La parole est a M. Gaudi Nagy, dernier orateur
inscrit dans ce débat.

M. GAUDI NAGY (Hongrie)* – Je suis triste pour les victimes de ce
conflit qui ont toutes des liens particuliers avec la Hongrie –
arméniennes comme azerbaïdjanaises. Mais j’ai le sentiment que
nous ne voyons, ici, que la partie émergée de l’iceberg. Evitons
de tomber dans le piège du ” deux poids deux mesures ” !

Les organisations internationales doivent se mobiliser pour tenter
de résoudre le conflit et se pencher sur la convention du Conseil
de l’Europe relative au transfert des prisonniers.

La question qui se pose est simple : les autorités d’un pays
peuvent-elles, oui ou non, prévoir la grâce de ses condamnés ? D’un
point de vue juridique, ce principe est incontestable. Mais dans le
cas qui nous concerne, nous devons avoir une vue globale des choses,
et notamment du conflit du Haut-Karabakh. Nous devons faire en sorte
que les Arméniens et les Azerbaïdjanais puissent vivre en bonne
intelligence, dans le respect des normes européennes. Il ne s’agit pas
ici de jeter l’anathème sur la Hongrie, l’Arménie ou l’Azerbaïdjan !

Il est clair que les conflits gelés doivent être réglés sur la
base du principe de l’autodétermination.

On pourrait rappeler d’autres crimes, comme celui de cet Irlandais qui
a assassiné des enfants hongrois et qui n’a jamais été condamné
! Il y a des problèmes partout, ne montons pas ces actes cruels en
épingle a des fins politiques.

M. CHOPE (Royaume-Uni)* – Monsieur le Président, je ne m’attendais
pas a reprendre la parole.

Je veux simplement remercier toutes celles et tous ceux qui sont
intervenus. Si cet hémicycle a pu tenir un débat civilisé sur une
question aussi émotionnelle, c’est déja un bon exemple a suivre.

J’espère que nous n’aurons plus a gérer ce type d’incident a
l’avenir.

LE PRÃ~ISIDENT – Je vous rappelle qu’a l’issue du débat d’actualité,
l’Assemblée n’est pas appelée a voter. Ce débat aura néanmoins
permis un échange de vues intéressant entre les membres de
l’Assemblée. Votre conclusion, monsieur Chope, est effectivement
celle que l’on peut tirer de ce débat. Le Bureau peut, a un stade
ultérieur, proposer que la question traitée soit éventuellement
renvoyée a la commission compétente pour rapport, et c’est, je crois,
ce qu’a suggéré Anne Brasseur. Le Bureau évoquera certainement
cette éventualité dès demain matin.

Jewish tribute for Armenian religious leader

A Sydney Jewish leader has paid tribute to the Armenian archbishop of
Australia and New Zealand at his funeral last week.

Archbishop Aghan Baliozian, Primate of the Armenian Church of
Australia and New Zealand, died suddenly late last month. He was 66.

At his funeral in Sydney last Thursday, attended by hundreds of
mourners including of the Armenian Archbishop of Jerusalem, India and
Armenia, NSW Jewish Board of Deputies chief executive Vic Alhadeff
paid tribute.

`The Armenian and Jewish peoples share a number of key and core
themes – the importance of family, the value of culture and tradition,
the trauma of genocide, the need at all times for acceptance of
diversity and celebration of difference,’ he said.

`All these were issues which Archbishop Baliozian personified, values
which he exemplified.’

Others who spoke at the graveside included the Mayor of Willloughby,
Councillor Pat Reilly, and numerous Armenian dignitaries. Also present
were several MPs, including Minister for Transport Gladys Berejiklian,
who is Armenian, and Federal Shadow Treasurer, Joe Hockey, also
Armenian.

`On behalf of the NSW Jewish Board of Deputies and the Jewish
community of NSW, it is an honour to pay tribute to His Eminence,
Archbishop Baliozian.

Archbishop Baliozian’s life and career were personified by his
commitment to a society based on the principles of respect and harmony
– a worldview which is reflected by the nation of Armenia, where Jews
have lived for 2000 years.

The Jewish community of Armenia suffered along with the rest of the
population as regional powers sought to take over the area throughout
history.

During the Soviet era, Jews moved to Armenia from other nations
because Armenia was a tolerant society which permitted them to
practise their faith.

Ten years ago, a book was published celebrating the relationship
between the Armenian and Jewish people. Published by the Centre for
Armenian Studies at the Hebrew University of Jerusalem, it was edited
by Professor Michael Stone – a prominent member of the Sydney Jewish
community who has been instrumental in building up the Hebrew
University as one of the world’s leading centres of Armenian studies.

The Armenian and Jewish peoples share a number of key and core themes
– the importance of family, the value of culture and tradition, the
trauma of genocide, the need at all times for acceptance of diversity
and celebration of difference.

All these were issues which Archbishop Baliozian personified, values
which he exemplified.

I can do no better than borrow from my colleague, Jeremy Jones AM, who
as president of the Executive Council of Australian Jewry worked
closely with Archbishop Baliozian: `He was a fine person, with great
intelligence, a quick wit and a willingness to take risks to further
ideals of peace, justice and an ethical society,’ he said. `Those of
us fortunate enough to have been his guests, particularly at his
colourful, dignified and warm services, knew him as a leader, a caring
person and an outstanding contributor to Australian society. His
Jewish friends miss him dearly.’

I conclude with an expression which we say in the Jewish community at
a time of bereavement: `I wish you long life’. The significance is
that you should all live a long life so that you may continue to
honour the memory of Archbishop Baliozian and his great legacy.’

The World Energy Weekly, published by the Paris-based Petrostrategies
consulting firm which carries out strategic and economic research and
analysis on the energy industry, reports this about Azerbaijan’s energy
sector, in its October 1, 2012 issue. As with nearly every aspect of the
energy sector, economic and production news always carry political
implications. This is even more true in the case of Azerbaijan, given
that government’s reliance on its oil and gas revenues to buttress its
positions regarding Armenians.

According to Petrostrategies, `The government of Azerbaijan and the
international consortium AIOC, which exploits the three large off-shore
oilfields of Azeri, Chirag and Guneshli Deepwater (ACG), must face up to
an unexpected challenge: the decline of ACG production began at least
three years earlier than expected, in 2011 instead of 2014-15. Contrary
to the official theory put forward in Baku, this precipitated drop is
not due to the government’s wish to extend the lives of ACG’s reserves.
Reliable reports put this decline down to geological, economic and
contractual reasons. This information comes from sources close to
companies that are members of the consortium and western diplomats
posted in Baku. Their message is summed up in four points; 1) the
geology of the fields has proved to be more complex than expected; 2)
the production facilities that were created at the beginning are no
longer adequate; 3) very big investments must be made to maintain and
prolong production; 4) to ensure that the consortium commits to these
investments, a guarantee must be provided for the extension of the
current production-sharing contract, which expires in 2024, together
with `sweeteners’. In oil jargon, this word refers to tax breaks or
other incentives that companies ask for.

`Given the nature of the political regime in place, i.e. very close to a
complete dictatorship, not many feel at ease to speak openly in
Azerbaijan. Yet the official statistics show that the production from
ACG peaked at 823,000 barrels per day in 2010, that it fell to 718,000
in 2011 and to 684,000 barrels per day in the first half of 2012. After
phase 3 of its development, ACG should have produced 1 million barrels
per day. In order to meet this projected growth (and in the hope of
receiving greater volumes of crude oil from Kazakhstan, too), the
capacity of the BTC oil pipeline to Ceyhan, on the Mediterranean, was
raised to 1.2 million barrels per day in March 2009. The new Chirag
project (known as COP), which is slated for completion at the end of
2013, will make it possible to add 100,000 barrels per day. But to what
extent will the output have fallen by then?

`Baku says it wants to prolong the life span of its reserves and that
the robustness of oil prices ensures it enough oil revenues to avoid
having to boost production. Azerbaijan’s crude oil export revenues are
currently around $25 billion/annum, but according to the figures of the
State Oil Fund, net hydrocarbon revenues will hit $16.5 billion in 2012.
It can be estimated that around $14 billion/annum will come from crude
oil exports, $1.6 billion from gas exports (8 to 9 bcm/annum) with the
rest coming from refined products. Added to this are revenues generated
from State Oil Fund assets, which stood at $32.5 billion at the end of
the 1st quarter of 2012 (sources say they generate 5 to 6% per annum of
revenues).

`At the same time, Azerbaijan has revised its gas production forecasts
downwards for the 2025 time horizon. Instead of the 50-55 billion cubic
meters (bcd) that had been announced, it believes it will be able to
produce 40 bcm/annum, said Rovnag Abdullayev, the President of
state-owned company Socar. He stated that exports could range from 20 to
30 bcm/annum, while underlining that this would depend on domestic gas
consumption. If the population of Azerbaijan hits 20 million people, as
Baku hopes, then gas exports could fall to only 10-19 bcm/annum, warns
Abdullayev, i.e. less than the contracted export volumes. On the other
hand, the cost of developing the Shah Deniz field (phase 2) has been
reassessed, rising from $20 billion to $28 billion, according to Socar’s
President. And, he added, this figure could climb even further.’

In October of last year, Vanadzor resident Vachagan Markosyan, 60, was
rushed to Vanadzor’s No. 1 Hospital named after Areshyan for an injury
to his spinal region and chest, saying that he was injured due to a
careless fall in the foyer.

He was taken by ambulance to the hospital on the same day where he
died one hour later. Meanwhile, Dr. Vardan Mkhitaryan, examining him
at the hospital, had noted that the patient had tuberculosis and one
side fracture. The doctor treating him, Georgy Iloyan, assigned him to
the hospital for infectious diseases, since he wasn’t allowed to keep
a patient with tuberculosis in the hospital complex.

According to the autopsy in the criminal case launched following the
patient’s death, the cause of death was traumatic and hemorrhagic
shock. Dr. Mkhitaryan’s diagnosis was wrong; he hadn’t taken note of
the blood in the patient’s lungs; instead of 4 side fractures, he had
noted only one, while Dr. Iloyan had given the wrong treatment.

Charges were laid against the doctors and they were arrested. They
were kept for 3 days in detention facilities after which a motion for
imprisonment was made. The court sustained the motion, however,
applying an alternative punishment – a bail of 500,000 AMD (about
$1,227 USD), which the doctors paid the following day and were
released.

It’s important to note that the incident took place in October,
material was gathered and prepared since that time, and several times
the doctors were called for questioning, but they were arrested 7
months later, with a phone call to come to the police precinct.

After the doctors were arrested, detained and subsequently released on
bail, the defense motioned the investigative body to appoint another
autopsy. On Sept. 3 of this year, the second autopsy report was
produced, which refuted the first one. The new report cites the cause
of death as an acute respiratory failure conditioned by the
tuberculosis. Accordingly, there was no shortcoming or mistake on the
doctors’ part that would lead to the patient’s death.

After receiving this conclusion, the investigative body, in
particular, Lori Police Investigator Taron Tadevosyan, however,
decided on Sept. 20 to assign a new investigation, explaining that
there are two contradictory conclusions in the case, one of which

Dr. Vardan Mkhitaryan’s attorney Ruben Hakobyan states, the
investigator’s decision to assign a new autopsy is unlawful.

“The investigator says there are opposing conclusions, let’s appoint a
third. It turns out, there’s one wrong and one right conclusion, a
third is assigned to see if the wrong was wrong and the right was
right. However, by assigning a second autopsy, they determined that
the first [autopsy] was wrong. The grounds for assigning another
autopsy are clearly defined by law: a repeat examination is assigned
when the conclusion from the initial examination is determined to be
wrong. Consequently, when the investigator sustains our motion and
appoint another autopsy it means that he recognized the first
conclusion, that the doctors are guilty in the patient’s death, was
wrong, unfounded,” explains the attorney, though he’s convinced that a
third autopsy report will confirm the doctors’ innocence.

“If a third autopsy takes place, the criminal proceedings have to be
dropped, which already at this stage should’ve been dropped. When the
criminal case proceedings are finally dropped, on the grounds of
acquittal, that there was no crime in the doctors’ actions, I will
take action so that those giving instructions for illegal charges and
illegal arrest and those fulfilling such illegal orders are subject to
the appropriate responsibility. In any case, they have to draw some
conclusions for their wrong decisions,” says the attorney, Hakobyan.

The first meeting of heads of the Customs Cooperation Council of
Turkic-speaking States uniting Azerbaijan, Turkey, Kazakhstan and
Kyrgyzstan has been held in Nakhchivan.

The State Customs Committee of Azerbaijan informs that its chairman
Aydin Aliyev attracted attention to the CCC initiative on “Silk Road”
and the future frequency of CCC meetings.

The meeting presented a range of projects of member countries –
Kazakhstan’s Silk Wind, Azerbaijani system of one-stop shop during the
customs inspection, the Kyrgyz customs automation system, Turkish
project Karavansaray within the CCC Silk Road framework.

“A teacher is one of the first soldiers of the national army. And that
soldier doesn’t have the right to turn her back or skulk. She always
has to be on the front” is how Salonik Jhangiryan, a teacher at High
School No. 1 named after Aksel Bakunts in Goris, describes the
teachers.

Jhangiryan, raised in a family of teachers, as a child dreamed of
becoming an attorney; however, as decided by her parents, she likewise
became a teacher. This successively passed on profession ties her to
the school, beginning from 1969.

“I’m not at all discontent that I became a teacher. Most importantly,
I very much loved and continue to love the children. The power keeping
a teacher at school is her love of children,” says Jhangiryan.

For an honored teacher there are two professions that don’t accept
mediocrity: doctors, who might physically kill a person, and teachers,
who might damage their minds and souls. “It’s possible to reconstruct
a building, but if a child, and forgive me for the expression, is
moving along defectively, it’s impossible to bring him back.”

Jhangiryan works at a junior high school since, she says, children are
special at that age. “Children in junior high are not ‘blackboards
that cannot be written on’ as many seem to think. They have a unique
way of thinking; you have to be able to listen to them, understand
them, and only then guide them. A child is a spark, which we have to
blow on to make a fire. And that fire, afterwards, will warm us, her
parents, the homeland.”

According to the teacher, the children gather 15 minutes early in the
morning and began the class by outlining the day. “It allows the child
to speak freely, think, and reason logically. No child in the class
has his permanent seat, except for those children who have problems
with their eyesight. In the morning, the child sits in that seat which
is vacant. The aim is to facilitate tolerance among the children. No
child is left out; all are equal – all respect, accept and listen to
each other. Perhaps this is why the children are happy to come to
class; they are never late; and there are no disagreements,” says
Jhangiryan.

“If children in junior high really adopt the basic rules of behavior,
then they are rooted as part of their character. I am grateful to
fate, that I have always come across wonderful children and parents.
If a child doesn’t have a learning disability, she can adopt the
program material as best as possible. And if not, then I’m to blame,
that I haven’t explained it better, and the parent, who didn’t the
work along with me,” she says.

In honor of the 21st anniversary of Armenia’s independence, the
president bestowed the highest state awards to individuals from
various sectors (education, science, art, culture, and so on). Among
those awarded are seven teachers, one of whom is Jhangiryan, who
received a medal named after Movses Khorenatsi (Moses of Chorene).
“Nothing has changed… it simply obliges you more, that your humble
work could be so highly regarded.”

On the occasion of Teacher’s Day, Jhangiryan wishes all teacher good
health and to be more devoted to their schools.

PETITION CAMPAIGN CALLS ON ARMENIA’S GOVERNMENT TO CEASE PROSECUTION OF
FORMER FOREIGN MINISTER VARTAN OSKANIAN AND THE CIVILITAS FOUNDATION

On October 8, the Armenian government will charge Vartan Oskanian with
embezzlement and money laundering. The charges carry a four to 20 year
prison sentence.

Civilitas has launched a petition addressed to the Armenian government,

Given the timing of the opening of the investigation (the day after Mr.
Oskanian’s party announced it was going into opposition) and the lack of
any evidence that any crime was committed, the move is widely seen as an
attempt to intimidate political opponents and stifle dissent and open media
in the country before presidential elections scheduled for this coming
February.

Vartan Oskanian served as Armenia’s foreign minister for ten years (1998 to
2008). He was born and raised in Syria but moved to Armenia to pursue his
higher education and subsequently earned Master’s degrees from Tufts and
Harvard universities in the United States. He moved back to Armenia in the
first days of independence. In 2008, Oskanian established the Civilitas
Foundation with the goal of strengthening Armenia’s civil society and in
2011, Civilitas launched an Internet based News channel, CivilNet.am, as
well as a daily newspaper, Orakarg. In May 2012, Mr. Oskanian was elected
to parliament with the Prosperous Armenia Party, which with 38 seats, is
second only to the ruling Republican Party.

The government has put forward the hard-to-understand claim that it is
protecting the interests of Civilitas by accusing its founder, Vartan
Oskanian, of embezzlement and money laundering — charges which carry a
four to 20 year prison sentence. According to the petition presented to
Parliament by the Prosecutor General, the charges relate to a January 2011
donation to Civilitas from Mr. Jon Huntsman, Sr., which came partially
(approximately $600,000) to Civilitas directly, and partially ($1,427,000)
through Mr. Oskanian, to allocate to Civilitas as necessary, at his
discretion, with no deadline. The entire amount Mr. Huntsman gave to Mr.
Oskanian for Civilitas, plus the $129,000 interest it earned in Mr.
Oskanian’s account, has been received by Civilitas.

Oskanian and Civilitas insist that this is political persecution. The 2012
May 6 parliamentary elections were the first in 20 years where there was a
serious challenge to the ruling party. That challenge came in the form of
the Prosperous Party, which Mr. Vartan Oskanian, a former foreign minister
(1998 to 2008) had joined a few months earlier.

Mr. Oskanian’s consistent message was the need to establish a balance of
powers and do away with the political monopoly. In the pre-election period,
Prosperous Armenia led the effort to form a united commission, with members
from all parties, to insist and oversee that voting procedures be changed
in order to assure a transparent vote. The ruling party did not join that
Commission.

Two weeks after the election, on 24 May 2012, in a move Mr. Oskanian had
been publicly advocating for weeks, the Prosperous Armenia Party announced
it would not join a government coalition but would go into opposition. The
very next day, 25 May 2012, the National Security Service opened this
criminal investigation.

Civilitas Foundation Director Salpi Ghazarian, a dual US-Armenia citizen
and a long-time activist, is also under attack.

During the election period, CivilNet.am proved itself as a source of new
and reliable information. CivilNet produced over 400 election-related
reports in the six weeks preceding the election. Their Internet and
YouTube popularity can be easily measured and is a demonstration of
CivilNet’s willingness to give voice to the voiceless, regardless of
political inclination, to cover all political players equally (including
Mr. Oskanian) and to respect the young and disconnected audience and make
news interesting to them. The daily newspaper, Orakarg, which highlights
economic news and analysis, frequently comments on the government’s
economic program.

The timing of the case in relation to challenges by these media and to
political events makes it clear that the real motive of the investigation
and prosecution is political.

est fortement opposé à la construction du Thétre Hamazgain
(Nationale) sur l’Avenue Générale d’Erevan.

Il a dit aux journalistes que l’avenue est un territoire public conçu
pour des espaces verts, pas pour des constructions.

En plus, a-t-il dit, conformément au plan général approuvé par le
gouvernement en 2005, une nouvelle ligne du métro de la capitale
arménienne croisera l’Avenue Générale dans l’avenir et la construction
de ce btiment gênera cette conception. Il a dit qu’il y a beaucoup
d’autres lieux pour cette construction.

Over the hearings on extradition and pardoning of an Azerbaijani
killer Ramil Safarov at PACE plenary session, representatives
of almost all parliamentary delegations, except the Turkish one,
expressed bewilderment with the fact.

When responding to accusations, representatives of Azerbaijani
delegation said that pardoning of a murderer is a sovereign affair of
Azerbaijan. They even started blackmailing and one of the Azerbaijani
parliamentarians reminded his European counterparts that Azerbaijan
is an important energy partner of Europe.

However, all this reasoning had a boomerang effect upon European
parliamentarians. And a representative of the French delegation
to the Council of Europe said that he wonders if it is right that
representatives of Azerbaijan, trying so eagerly to justify a murderer,
which axed a sleeping man, are in PACE plenary session hall.

Today inquired of Ashot Aghababyan, a Republican Party
of Armenia (RPA) MP, how was the ostrich business going along, why he
hadn’t fulfilled his campaign promise. Let us remind that he promised
to start an ostrich business in Ashotsk and Amasia. Mr. Aghababyan
replied, “They are drawing up the plan. We will start that business
at the beginning of next year.” We asked to clarify whether it meant
that he hadn’t forgotten his promise, Mr. Aghababyan replied, “It is
business, how can one forget it? Why should I forget it?”

In response to our observation that this campaign promise of his
had caused heated discussions and we were looking forward to its
fulfillment, Mr. Aghababyan stated, “The

thing is that the ostrich’s genetics allows it to withstand up to
minus 40 degrees and above plus 40 degrees. Why not then?”

In response to our question whether it was better to breed ostriches
than cattle, the MP said yes, “Certainly, because it weighs almost as
much, it reaches 200kg in two years and moreover, it produces offspring
not once, but 120 times a year. Naturally, it is a good business.”

We inquired why our government hadn’t thought about that so far, he
was the first to talk about that business, Ashot Aghababyan said, “No,
we have a friend who keeps 300 ostriches in the Yeghvard district. He
has roughly 100 families and in one family, there are two females
and one male. So there are attempts, we will do it based on that.”
