Determining Borders by Soviet-Era Maps ‘Impermissible,’ Says Tatoyan

An announcement that Armenia and Azerbaijan border positions are temporarily being determined using Soviet-era military maps has raised red flags with Armenia’s Human Rights Defender Arman Tatoyan, who said Tuesday that such methods cannot be permitted.

Armenia’s Deputy Prime Minister Tigran Avinyan told RFE/RL’s Armenian Service on Friday that until comprehensive discussions reach fruition, Soviet-era military maps from 1975 and 1976 are being used for border demarcation purposes, a practice, which thus far has cause heightened tensions in Armenia’s border regions impacted by this approach.

As a consequence of the November 9 agreement, more than 190 settlements in Artsakh and adjacent seven regions came under the control of Azerbaijan. As a result, the borders of the Syunik Province in the south of Armenia (including Kapan, its administrative center) appeared to be in close proximity to the new borders of Azerbaijan, drawn up during the Soviet times.

In a Facebook post on Tuesday, Tatoyan illustrated through a series of arguments why the determination of state borders using Soviet-era maps or GPS data is impermissible, warning that this practice will undermine the rights and interests of the population in border regions.

Below are the six points presented by Tatotoyan on this critically important matter.

1. Justifying Azerbaijani deployments in the vicinity of Syunik and Gegharkunik provinces and on the Syunik roads by relianceon Soviet Armenia or Azerbaijan borders of the 1970s, 1980s, 1940s (for example, 1975-1976, 1985, 1942), or other maps and GPS data is impermissible. As sovereign states, there has never been a demarcation or delimitation between Armenia and Azerbaijan, and furthermore no international document on this matters has been signed.

2. What happened in the Soviet Union was not determination of state borders between two sovereign states—Armenia and Azerbaijan—but rather administrative division of borders between two subjects within one sovereign state, the USSR. Soviet maps are just that. Case in point is why the 1920s maps are not referenced in connection with the border process these days.

3. The process of determining the state borders of the Republic of Armenia cannot be cross-referenced with the administrative-territorial division. These are phenomena which are completely different from one another;

4. The borders and maps of the First Republic of Armenia cannot be ignored in the process of determining state borders of the Republic of Armenia today. This requires the imperative of a real guarantee of the rights of citizens, population of the Republic of Armenia;

5. Today’s deployments by Azerbaijan have been carried out in gross and massive violations of international, including human rights standards, under the real threat of war and use of force and in the context of Azerbaijani open genocidal policy;

6. The process of determining state borders may not undermine normal life of border population or cause rights and legitimate interests of the citizen of the state, including the right to life and physical safety, the safe living of children, the cultivation of one’s own land, and the full enjoyment of water resources, pastures and grasslands; These points are among the key factors guaranteeing rights and normal life of Armenian citizens and its border population.

In recent days reports of Azerbaijanis throwing rocks at Armenian motorists in Artsakh has jeopardized the safety of Artsakh residents and further illustrates Azerbaijan’s aggression toward Armenians.

The Artsakh Foreign Ministry, in a statement issued on Tuesday, condemned the continued provocations by Azerbaijanis currently in the territories surrendered to Baku, saying that those acts are “aimed at preventing the population of the Republic of Artsakh to resume its normal life.”

“On March 25 and 29, 2021, the Azerbaijani side targeted civilian vehicles moving along the Karmir Shuka-Stepanakert and Stepanakert-Goris highways by throwing rocks. Furthermore, in the second incident, a vehicle carrying the remains of those deceased during the military aggression of Azerbaijan, Turkey and international terrorists against Artsakh was attacked,” explained the Artsakh Foreign Ministry.

“Such provocations against the civilian population of Artsakh attest that either Baku does not control the Azerbaijani armed units in the occupied territories of Artsakh, or the Azerbaijani authorities deliberately and purposefully undermine the stability in the region and the peacekeeping mission carried out by the Russian Federation. The actions of the Azerbaijani side blatantly violate the norms and principles of international law,” added the statement.

“In this regard, we consider it necessary to emphasize that these incidents are also a consequence of the illegal presence in the occupied territories of Artsakh of Azerbaijani armed units and international terrorist groups under the patronage of Azerbaijan and Turkey,” warned the foreign ministry.

“Such provocative actions deserve the strongest condemnation, and the organizers and perpetrators must be punished appropriately. Impunity and inaction are fraught with unpredictable consequences for peace and stability in the region,” concluded the statement.

The Washington Post: Despite State Department’s calls, Azerbaijan still refuses to return Armenian POWs – opinion

YEREVAN, MARCH 30, ARMENPRESS. Despite a nudge from a senior State Department official, Azerbaijan has so far refused to return Armenian prisoners who were captured during the recent war in Nagorno Karabakh, Columnist David Ignatius said in an opinion published at The Washington Post.

“U.S. officials say that 52 Armenians are still held by Azerbaijan, despite earlier exchanges of prisoners”, the columnist says, adding that Baku claims that these are not participants of the war, but came there after the ceasefire, in late November, and are terrorism suspects, an allegation that Armenia denies.

“Philip Reeker, acting assistant secretary of state for Europe, raised the issue of the captives with Azerbaijan’s foreign minister, Jeyhun Bayramov, during a telephone call in February and requested that the International Committee of the Red Cross be allowed to visit the prisoners. The ICRC was promptly granted access. U.S. officials continued in the following weeks to advocate the release of detainees”, David Ignatius says and quoted the remarks of a senior Biden administration official who said: “We hope to see more detainees released. We’re not negotiating, but we’re urging them to exercise goodwill”.

“Observers had hoped that Azerbaijan might release the Armenian captives as a goodwill gesture at the time of the Nowruz holiday on March 20. But the Armenian detainees remained in custody”, he said.

The columnist also reminds that U.S. Congressmen have also joined the calls for the release of the Armenian POWs. A group led by Rep. Adam B. Schiff (D-Calif.), the chairman of the House Intelligence Committee, introduced a bill March 16 calling on Azerbaijan to immediately release all Armenian POWs and captured civilians.

Human Rights Watch issued a report on March 19 alleging that Azerbaijani forces had abused Armenian POWs after the war, based on interviews with four former prisoners. Elin Suleymanov, Azerbaijan’s ambassador to Washington, said during an interview that Azerbaijan rejected the Human Rights Watch findings but that any serious allegations of prisoner mistreatment would be investigated. 

David Ignatius stated that prisoner issue will gain additional emotional significance in April, connected with the anniversary of the Armenian Genocide.

Armenian FM to attend CIS Foreign Ministerial Council session in Moscow

Kocharyan trial adjourned

YEREVAN, MARCH 30, ARMENPRESS. Judge Anna Danibekyan of the Yerevan Court of General Jurisdiction adjourned the trial of former president Robert Kocharyan because the prosecutors were absent. Several other ex-government officials are also defendants in the case.

The judge said that all defendants have submitted motions requesting to drop criminal proceedings which are initiated under article 300.1 of the penal code (overthrowing constitutional order), because the constitutional court determined it to be unconstitutional and void.

Judge Danibekyan said the court had to discuss the issue of stopping the criminal proceedings, but the hearing can’t take place without the prosecutors.

The issue will be discussed at the next hearing set for April 2.
