Interview with the President of "Yerkir" Union of Public Organizations
on Repatriation and Settlement Sevak Artsruni

– Mr. Artsruni, your organization raised the alarm about
Georgianization of the Armenian St. Norashen church in Tbilisi as
far back as June 2008. How do you assess the processes developing
at present?

– Norashen is only a manifestation of a whole process that started
since the independence of Georgia and becomes more dangerous. All
three Presidents of Georgia – Gamsakhurdia, Shevardnadze and
today Saakashvili – were guided by the same scenario against the
ethnic minorities of the country and led by the same principles not
giving political status to ethnic minorities in Georgia; creating
unbearable living and development conditions and forcing them to
immigrate and become an alien. Norashen is not the first and the only
manifestation of that policy. Since the independence of Georgia, a
number of churches were blown up and cemeteries destroyed (Khojivank
cemetery or Shamkhoretsots church in Havlabar). The Catholic Church
has similar problems as well. The latter ineffectually struggles to
return the temples belonging to it.

However, it is not right to say that the phenomenon has not provoked
discussions. In October 2007, the United Nations Commission on Human
Rights called on the Georgian authorities to return the expropriated
churches to their legal owners.

The Georgian diocese of the Armenian Church and the Embassy
of Vatican periodically filed appeals and protests to different
countries’ diplomatic representatives in Georgia, mainly the Embassy
of France. The issue of the churches is on the agendas of their
discussions with the Georgian authorities. The Georgian Ombudsman,
the US Department of State and others also raise the issue in their
statements and reports.

However, until today the Georgian authorities treat all those appeals,
mediations and recommendations with absolute contempt.

– What is going on in Javakhk today?

– The Armenians of Javakhk desert their motherland. The Georgian
authorities consistently carry out the policy on alienation of the
Armenians here. Elements of that policy are: a/compulsion of the
Georgian language in all spheres of public life, including courts,
official correspondence with administrative bodies, in all types
of contacts with the residents and government bodies, b/ weakening
of political, social-economic, educational and cultural relations
between Armenia and Javakhk, c/passing of some new laws on compulsion
of the Georgian language, d/ prohibition on establishment of political
parties based on national principles to protect the rights of ethnic
minorities, e/ actual prohibition on foundation of higher educational
institutions based on Armenian language, etc.

At present, some of the Armenians in Javakhk endowed with talent for
leadership are imprisoned or emigrated, as they principally refused
to bargain. On the contrary, people without scruples that only think
of becoming rich, who are defamed and refused by the people, being
time-servers are ready to take obediently the orders of the Georgian
authorities, break the people’s spirit and serve as a tool of the
Georgian policy on alienation of the Armenians.

– When speaking of the imprisoned political figures do you bear in
mind Vahagn Chakhalian?

– Yes, first of all him. The incidents (July 17-21, 2008) that happened
under extremely suspicious and strange circumstances – the explosion
near the house of the local chief of police and the assassination
of two Armenian policemen – were used as a pretext by the Georgian
authorities to settle a score with the "United Javakhk" democratic
alliance and its leader Vahagn Chakhalian – a famous activist
struggling for protection of rights of the Armenians in Javakhk.

After those incidents Vahagn Chakhalian, his father and juvenile
brother were arrested. Legal proceedings were brought against them for
"acquisition of weapons and armament". Later Vahagn Chakhalian was
charged with some other crimes, based on his political activities in
2005-2006, mainly organization of mass demonstrations.

– What is the real reason for arresting Vahagn Chakhalian?

– The "United Javakhk" movement and its leader Vahagn Chakhalian
deprived the Georgian authorities of an opportunity to speculate
about the so-called Javakhk separation, as they took the separation,
revolutionary and similar adventurous approaches out of the political
process.

Vahagn Chakhalian suggested that the Armenians of Javakhk should
struggle for their rights in a practicable way acceptable by the
international community.

Consequently, the Georgian authorities are really afraid of this
alternative and not the virtual calls for autonomy.

– Does it mean that the Georgian authorities are not ready for
a dialogue?

– They were not ready until today. But the latest developments in
the region may lead to change of situation.

Naturally, Georgia will continue to clutch at Ankara-Tbilisi-Baku axis,
but at the same time, it will have to take serious steps towards EU
integration. The rights of the Armenians in Javakhk as a national
minority should be involved in that process as a precondition. In
this sense, "Yerkir" Union of Public Organizations on Repatriation
and Settlement has carried out a sufficient work for years.

Mainly, in October 2007, with the efforts of "Yerkir" Union the
recommendations of the United Nations Commission on Human Rights
to the Georgian authorities embraced the issues of registration
of the Armenian Apostolic Church and return of Norashen and other
expropriated churches.

Underlining the low level of political representation of the ethnic
minorities, the United Nations Commission on Human Rights bound
Georgia:

– to view the opportunity to let the ethnic minorities use their
languages in the local self-governing bodies’ administrative works,

– to take all appropriate measures to provide adequate political
representation and participation for the ethnic minorities abolishing
language discrimination,

– to organize a dialogue between the groups showing interest in the
issues of the ethnic minorities and the civil society institutions.

It’s worth to mention that "Yerkir" Union has created the necessary
prerequisites for the visit of the experts (European Framework
Convention for the Protection of National Minorities) to Javakhk in
the mid of December.

– What initiatives are and will be taken by "Yerkir" Union to overcome
the crisis that the Armenians of Javakhk face?

– On July 21, 2008, the next day of the arrest, Vahagn and Armen
Chakhalians’ mother Gayane Chakhalian told us that Vahagn asked
"Yerkir" Union to systematize his advocacy case.

In spite of the Georgian authorities’ evident resistance, we have
succeeded in:

– splitting the informational vacuum of Vahagn Chakhalian’s case
and making it well-known by carrying out fact-finding missions in
Akhalkalaki, issuing press releases and holding press conferences
to show that in the person of Vahagn Chakhalian and others we have
political prisoners,

– involving in the investigation of the case and compelling the
Georgian authorities to register an advocate from Armenia to defend
the interests of Vahagn Chakhalian and his family,

– involving in the investigation of the case the French attorney
Patrick Arapian well-known in the sphere of human rights,

– drawing the international institutions (following the democratization
processes in Georgia (OSCE, EC)) and human rights organizations’
attention to the case (some of them promised to follow the trial
through their observers).

At the previous court sitting of Chakhalians’ case the attorneys
succeeded in showing proofs that Vahagn Chakhalian’s juvenile brother’s
arrest was illegal and as a result of it he was released on bail.

Even today, we consider our mission as partially
accomplished. Actually, the Georgian authorities’ desire to condemn
Vahagn Chakhalian as a criminal failed. His father and brother
were released. The prosecutor’s office and the judge continuously
adjourn the trial trying to concoct new criminal charges. And with
this scandalous trial the Akhaltskha court has become a platform of
condemnation of the Georgian policy on violation of the rights of
Armenians in Javakhk. What is happening today in Javakhk is in the
focus of international organizations’ attention and will not be futile.

This counteraction has strengthened the Georgian authorities’
persecutions; they terrorize not only the activists and co-thinkers
of the "United Javakhk" but also everyone who dares to complain
of the present situation. They also carry out economic terrorism,
the last example is 10.000 US dollars bail for Armen Chakhalian,
in spite of the attorney’s proofs that Armen’s arrest was illegal.

Thus, a political procedure has started in Akhaltskha. And what
is happening and will happen is of secondary importance. The most
important thing is that from the first moment of the court sitting
the struggle of the Armenians in Javakhk will come onto political
platform and after that none of the Georgian statesmen can announce
that "The Armenians of Georgia don’t have problems".

Thus, we call on everybody not to be disoriented and provoked and
to be guided by the norms of the international law and Georgian
legislation and in Javakhk, Armenia and Diaspora continue demanding
from the Georgian authorities the following:

– to release Armenian political prisoners

– to organize a dialogue between the groups showing interest in the
issues of the ethnic minorities and the civil society institutions,

– to give a legal status to the Armenian Apostolic Church and other
traditional churches in Georgia,

– to return the temples of the Armenian Apostolic Church and the
Roman Catholic Church expropriated in the Soviet period

– to give a status to the Armenian language as an internal clerical
and court language in Javakhk,

– to establish an Armenian-Georgian bilingual university in Akhalkalaki
based on corresponding educational program,

– to involve Javakhk in all regional economic projects.

"The prosecution lacks convincing evidence. So far I haven’t heard
strong case-based reasoning. Courts always defend the interests of
prosecution," Armenian Ombudsman Armen Harutyunyan said today with
regard to the trial of the so-called case of seven due on December 19.

Mr. Harutyunyan has heard both the prosecutor and the defender but
mostly he believes in the defense. "The advocates have submitted
weighty and convincing evidence," he said.

"As Russians say the trial of the case is a litmus paper and may
become an ordeal for the country’s future prosperity.

The Ombudsman thinks the case of seven can be an indicator of strategic
development of the society because both prosecution and defense have
been focusing efforts in this direction. Therefore, the Ombudsman’s
Office will constantly monitor the trial, use its scarce resource to
the full, follow attentively the arguments of the two sides and the
judge’s behaviour. The office will come up with a final assessment,
possibly with a report, at the end of the court proceedings.

Armen Harutyunyan thinks it will guarantee a professional and unbiased
approach of their office, avoiding an early opinion.

In the given situation the Ombudsman sees pardon and amnesty as the
best way out, although he is for amnesty since it does not require the
detainee’s pardon or repentance. "It is a demonstration of goodwill
towards the case. During our visits to prisons and my talks with the
detainees I was convinced that they shouldn’t made repentant as they
don’t plead guilty of any crime. The court is already hearing the case,
and let the prosecutors unveil the reality and prove their crime. Man
is not bound to prove his innocence."

Armen Harutyunyan couldn’t say for sure how one can get acquainted
with the 40-volume case within nine days. Anyway, he didn’t want to
underestimate anyone. "Maybe there are talented people who can get
acquainted with the material within nine days which I can do only in
90 days," said Mr. Harutyunyan.

The Ombudsman urges mass media and civil society institutes to follow
up the trials on March 1 events without major scandals and shows as
they delude and distract from real arguments hindering professional
observation.

The monitoring held by the Human Rights Defender showed that the
court trials mostly turn into shows with the participation of judges
and journalists.

"We still have much to do to be called a legal country as opposition
journalists and businessmen still encounter obstacles in our country,"
Armen Harutyunyan said regarding the state of human rights in Armenia.

Ararat Has New Coach

Ashot Kirakosyan has been appointed chief coach of Yerevan’s
Ararat. He will replace Varujan Sukiasyan who has recently tendered
his resignation, Ararat’s Executive Manager Karo Topuzyan informed A1+.

"The club’s president Hrach Kaprielyan appointed Ashot Kirakosyan as
the new chief coach of Ararat. The contract will be signed in a few
days. Anyway, it is already known that Kirakosyan will head the team
at the forthcoming championship," said Topusyan.

Ashot Kirakosyan is not a "newcomer" in Ararat. He headed Ararat-2
last year. Everybody is well aware of his professional background
as Kirakosyan started his sporting career 20 years ago. He worked
and lived in Syria from 1993 to 1997, later he headed Armenian teams
which never competed for higher awards.

Kirakosyan will be assisted by the former footballer of the Armenian
national football team Tigran Gspeyan, and Vahan Nikoyan.

It was rumoured that Karo Topuzyan had been fired.

"I have also heard the rumours. As you see I am here, and no one has
given me the sack."

Today in the frames of "The risks of Gold Mining for Lake Sevan"
round table meeting "Golden Mine for Sevan" film presentation has
been conducted, said Inga Zarafyan, the President of "Ecolur" NGO
to Panorama.am.

"It has been found out that "GeoProMining" company which is the owner
of Ararat Gold Recovery Company and Sotk mining plans to transfer
the production from Ararat to Sotk. In fact this is not a new idea,
as in 2005 "Vedanta Resources" Indian Organization had some plans on
this issue, but their project has been rejected by the Ministry of
Environmental Protection," said Zarafyan.

Currently the company has started its activities and Lake Sevan is
in danger.

Imported Poultry Cheaper Than Local Product

The Minister of Agriculture Aramayis Grigoryan has had a meeting
with the Ambassador of the USA Marie Yovanovich, reported the press
department of the Ministry. The Minister and the Ambassador have
discussed a range of questions, in particular the import of poultry
into Armenia from America.

In this regard Panorama.am reporter has been informed by Alexander
Alexanyan of the Ministry of Agriculture that poultry from America
has been imported into Armenia after the poultry flue. In general
poultry is imported from Canada and Brazil also. Armenia does not
export poultry because of lack of roads.

Alexanyan said that there are 5 big firms which give good product. To
the question if there are firms in Armenia providing poultry
why Armenia has become poultry importing country, he answered:
"Our local product is more expensive that’s why imported product is
purchased well".

The Republic of Nagorno Karabakh has joined the Declaration of
Human Rights, announced the spokesman of NKR National Assembly Ashot
Ghulyan during a two-day conference on human rights organized in NA
of Nagorno Karabakh.

The conference was devoted to the 60th anniversary of international
day of human rights and to the adoption of Constitution in NKR. The
General Prosecutor Aghvan Hovsepyan and the President of Constitutional
Court Gagik Harutyunyan were also present at the conference.

and Azerbaijan will take place in early 2009, according to Novruz
Mammadov, head of the international relations department at the Azeri
presidential administration.

The date and place have not been exacted yet, Trend Azeri news
agency reports.

An agreement on presidential talks was achieved during the OSCE
ministerial meeting in Helsinki on December 4 and 5.

Serzh Sargsyan and Ilham Aliyev last met in Moscow on November 2 in
presence of Russian President Dmitry Medvedev.

STEPANAKERT, DECEMBER 12, ARMENPRESS: On 9 December NKR President Bako
Sahakyan received head of the Constitutional Court of the Republic
of Armenia Gagik Harutyunyan.

Central Information Department of the office of Karabakh President
told Armenpress that during the meeting the discussed issues on
enlarging cooperation between the Constitutional Court of the Republic
of Armenia and the Supreme Court of the Nagorno Karabakh Republic,
increasing effectiveness of the work of judicial bodies as well as
the reforms carried out in the system.

Head of the Office of the NKR President, secretary of the Security
Council Marat Mousayelyan and chairman of the NKR Supreme Court Ararat
Danielyan were also present at the meeting.

President Of Armenia Completes The Visit To Bulgaria

The President of Armenia, Serzh Sargsyan, completed his visit to
Bulgaria.

In the framework of his official visit to Bulgaria, in the evening of
December 10, Presidents Serzh Sargsyan and Georgi Prvanov attended the
celebratory concert of the renowned Armenian and Bulgarian artists
which took place at the "Bulgaria" music hall in Sofia. Later that
evening, the President of Bulgaria Georgi Prvanov gave the official
dinner in his residence in the honor of Serzh Sargsyan’s official
visit to Bulgaria.

The Presidents of Armenia and Bulgaria participated at the opening
ceremony of the Armenian-Bulgarian Business Forum, during which
the two Presidents stated with satisfaction the high level of the
political dialogue between Armenia and Bulgaria, once again stressed
the necessity to foster business cooperation in different areas,
and expressed readiness to provide a comprehensive support to all
relevant initiatives. A number of bilateral documents were signed in
the framework of the Business Forum.

President Serzh Sargsyan and President Georgi Prvanov participated at
the opening of Sergei Parajanov’s collage exhibition in the Bulgarian
National Gallery of Foreign Arts.

The official visit of the President of Armenia to Bulgaria was
concluded by his visit to the Embassy of Armenia in Sofia and his
meeting with the diplomatic20staff. Later, the President of Armenia
returned to Yerevan.

During today’s meeting with journalists Acting Executive Director
of the Hayastan Fund Ara Vardanyan assessed Telethon 2008 as
brilliant. Armenia Fund’s 11th International Thanksgiving Day Telethon
broke another record by more than doubling last year’s result and
raising a total of $35,009,156. Thirty million was donated during a
dinner organized in Armenia.

This year the benefactors expressed the wish to gift the apartments
they built. According to Ara Vardanyan, the fund will execute control
over this process for the sum of the gifted apartments to correspond
to the sum announced.

As of November 30, 9 500 people donated 10 million AMD through HayPost.

Another 300 thousand was transferred directly to the Fund’s account.

According to the Acting Executive Director, the construction of the
Stepanakert Hospital has already started on the sum donated by Russian
benefactor Samvel Karapetyan. However, the Fund still has much to do
in Russia.
