CoE seeks Armenian authorities’ reply over alleged disproportionate violence against journalists

The Council of Europe (CoE) is awaiting a reply from the Armenian authorities regarding alleged disproportionate violence against journalists during anti-government protests in Yerevan, CoE Secretary General Marija Pejčinović Burić said in response to a request for comment from opposition With Honor faction MP Taguhi Tovmasyan.

“Regarding the cases on using disproportionate force by the police against citizens exercising their rights to peaceful assembly on April 29 and May 2, on the bodily injuries of people, also the cases on violence against journalists, I addressed the Secretary General of the Council of Europe Marija Pejčinović Burić. In my letter I presented the situation in Armenia thoroughly, the evidently violent actions violating human rights. I requested my colleague to give relevant reaction to such cases as her public opinion may play a key role in the prevention of violence and protection of human rights,” Tovmasyan wrote on Facebook on Thursday.

Replying to her letter, the CoE chief says that freedom of peaceful assembly is one of the foundations of a democratic, tolerant and pluralist society. It is guaranteed by the European Convention on Human Rights, as interpreted by the European Court of Human Rights including in cases concerning Armenia.

“CoE Secretary General expects the police in their actions to adopt a human rights-based approach to policing assemblies and the use of force by law enforcement agencies should be lawful, necessary, proportionate and limited to cases where it is strictly unavoidable. Force should only be applied to the minimum extent necessary,” Tovmasyan noted.

“Be assured that the Council of Europe and its relevant institutions will remain attentive to the situation and continue to work with the authorities in Armenia – as in other member states – to uphold these principles,” Burić said.

“As far as alleged disproportionate violence against journalists is concerned, an alert has already been posted on our Platform to promote the protection of journalism and safety of journalists. A reply from the authorities is awaited.”

The lawmaker promised to share the replies of other influential international organizations after achieving their consent for publicizing their opinions on such “pressing issues”.

Parents of fallen soldiers insist on prosecution of Pashinyan

The parents of Armenian soldiers killed in the 2020 war in Artsakh, who demand criminal charges against Nikol Pashinyan, were summoned to the Investigative Committee of Armenia for questioning on Thursday.

The parents of 15 fallen soldiers were expected to be questioned.

They claim that Pashinyan publicly admitted deliberately sacrificing thousands in his remarks in the parliament on April 13, when he said the war “could have been averted, as a result of which we would have had the same situation, but of course without the casualties.” They submitted a “crime report” to the Prosecutor General’s Office on April 18.

Ara Rostomyan, the father of fallen soldier Hakob Rostomyan, says the parents have been recognized as legal successors of their killed sons “based on the errors made by a group of senior officials”.

“I claimed that “a group of officials” is an abstract statement, saying the official holding the highest post in Armenia is Nikol Pashinyan, who made a confession in the National Assembly on April 13, thus he is the only culprit,” he told reporters.

Rostomyan said all parents insisted on their demand to prosecute Pashinyan and arrest him while the probe continues.

Vahan Hovhannisyan represents the interests of the parents in the case.

Vanetsyan: We have no right to take steps that would lead to fading of protest movement

Many people expect the opposition to take steps which would lead to the prompt fading of the protest movement, Chairman of the Homeland Party Artur Vanetsyan told the Zhoghovurd newspaper in an interview on Thursday.

“For example, if we seize the government or the National Assembly buildings, what will it give us? It will just enable the authorities to detain the leaders of the movement and numerous protesters, thus stopping the campaign. We have no right to allow it to happen,” he said.

At the same time, the opposition leader did not rule out such a step at a “critical moment”.

“We’re not afraid, we’re not delaying or stepping back, we just realize that we must do our best to make this process run within the law,” he said, adding that the movement has a clear plan, which they are adhering to.

As a result of the opposition campaign, he claims, the situation in the country has changed and there is broad public consensus on the need to oust the current government.

Speaking about the composition of the government to be formed after Nikol Pashinyan’s possible resignation and the possible candidate for the prime minister’s post, Vanetsyan said the government should be composed of around 250 professionals to get the country out of the current situation.

“Ishkhan Saghatelyan said in his speech that a person, who once held public office, got rich due to his position and enjoys no popular support can’t be the prime minister. Talking about who will be prime minister, believe me, at the moment is just another trap set by the authorities,” he said.

“We have stated that this movement has no leaders. It is a nationwide movement and we will proceed according to this logic. It is a matter of time, we will talk about everything in the next few days. I can only say that the opposition camped out in France Square now has a serious human resource base and we can nominate at least 3-4 candidates for one post,” Vanetsyan added.

No Armenian-Azerbaijani document can secure them against geopolitical shocks – Arman Melikyan

And a new politico-military balance that would ensure long-  lasting peace in the region will take a considerable amount of time  to form, Ambassador Arman Melikyan said in an interview with ArmInfo. 

“The present geopolitical situation does not allow either the  Armenian or the Azerbaijani leaders to ignore the geopolitical  situation in our region and in the neighboring ones even during the  next six months. Under the circumstances, any document Yerevan and  Baku would sign here and now will not secure the signatories against  possible – and even expected – geopolitical shocks in and round our  region,” Mr Melikyan said.  

Amid the ongoing geopolitical transformations, signing any interstate  document supposed to “legally cement” the Armenian-Azerbaijani  relations in terms of their level and content is pointless. On the  other hand, the negotiations amid the region’s geopolitical  reconfiguration are, beyond doubt, a deterrent to possible use of  force.   

Even if Armenia and Azerbaijan sign a peace treaty in the foreseeable  future, such a treaty should not be expected to contain special  points on Artsakh. And given the fact that Azerbaijan’s legislation  does not contain a point on a territorial unit named  Nagorno-Karabakh, Baku can at best guarantee the rights of the  Artsakh Armenians.  

“My greatest concern is that Armenia’s incumbent authorities are  lacking experience and knowledge necessary to manage such complicated  processes. In this context, I think that the prospects of Russian  military presence in Artsakh will depend on the presence of the  Armenian population that needs protection rather than on an  Armenian-Azerbaijani peace agreement,” Mr Melikyan said.

Baku responds to Pashinyan`s statements about POWs and accuses Yerevan of insincerity

ArmInfo.Baku reacted to the statements of the Prime Minister of the Republic of Armenia Nikol Pashinyan about the prisoners of war.

The Azerbaijani Foreign Ministry said that they consider the  accusations voiced by Pashinyan during his visit to the Netherlands  “unfounded and calling into question the sincerity of Yerevan in the  issue of normalizing relations with Baku and achieving peace in the  region.”

“The baseless accusations made by the Prime Minister of Armenia  against Azerbaijan, including far from reality claims on humanitarian  issues, show that the Armenian leadership is not at all sincere in  the issue of normalizing relations between the two countries.  Providing maps of minefields by Armenia is not a “humanitarian  gesture”, it is was Yerevan’s commitment in the framework of the  tripartite statement dated November 10, 2020. After the signing of  this document, 219 people became victims of mines in Azerbaijan, and  these are mostly civilians, said Abdullayeva. As for the accusations  of not returning the detained Armenians, Baku considers them  saboteurs, sent to the territory of Azerbaijan after the end of the  war. Unfounded accusations against Azerbaijan cast doubt on Armenia’s  readiness to act in the name of peace,” said Leyla Abdullayeva,  spokeswoman for the Azerbaijani Foreign Ministry.

Thus, from the logic of Abdullayeva, it turns out that only Yerevan  has obligations under the agreement, and they are not obligatory for  Baku. It is also worth noting that in the tripartite statement there  is not a word about the transfer of maps of minefields, however,  paragraph 8 of the statement of November 9, 2020 states the need for  an exchange of prisoners of war and detainees on the principle of  “all for all”.

It should be noted that on May 11 in the Netherlands, Pashinyan  touched upon the issue of the return of Armenian prisoners held by  Baku. He expressed regret that, despite the statement of November 9,  2020, in response to the calls of many international organizations,  the citizens of the Republic of Armenia, taken prisoner during the  44-day war, have not yet been returned. “This is the practice of  using people for political purposes and turning them into an object  of trade, which is very reprehensible,” Nikol Pashinyan said,  stressing that it was in order to avoid such bargaining that he once  decided to transfer to Azerbaijan all the maps of minefields at his  disposal. The Armenian side hoped that this humanitarian step would  be followed by another humanitarian step.  “Nevertheless, today at  least 38 of our prisoners of war remain in Azerbaijan (according to  unofficial data, there are many more – ed. note). Attempts are  constantly being made to make this process the subject of bidding on  a variety of topics. By the way, for the last time in the presence of  the President of the European Council, the President of Azerbaijan  promised to release another group of prisoners, but this has not  happened yet. I think it is impossible to talk about peace, ignoring  the humanitarian side of the issue, we have shown this in practice,”  Nikol Pashinyan said. 

Armenia, Russia, Azerbaijan discuss implementation of trilateral statements on Karabakh and Baku- Yerevan relations normalization

ArmInfo.Foreign Ministers of Azerbaijan, Armenia and Russia Jeyhun Bayramov, Ararat Mirzoyan and Sergey Lavrov discussed issues related to the implementation of  tripartite statements on Karabakh and the normalization of relations  between Baku and Yerevan on the sidelines of the CIS Foreign  Ministers Council in Dushanbe on May 12. This was reported by the  press service of the Azerbaijani Foreign Ministry, TASS reports.

“At the meeting, the parties discussed the current situation in the  region and issues related to the implementation of tripartite  statements,” the report says. According to the source, an exchange of  views on issues related to “the normalization of relations between  Azerbaijan and Armenia, including the start of the process of  delimitation of the state border, the opening of all transport and  communication lines, and the negotiation of a peace treaty between  the two countries” took place. “The parties stressed the importance  of fulfilling the agreements reached for ensuring peace and security  in the region,” the statement says.  According to TASS, at the  beginning of the meeting, Russian Foreign Minister Sergey Lavrov  thanked his colleagues from Azerbaijan and Armenia for responding to  the Russian side’s proposal “to take the opportunity of the  participation of the CIS Foreign Ministers to hold a trilateral  meeting, which will allow the parties to continue joint work to  monitor the implementation of tripartite statements “, which were  previously accepted at the highest level. “We are interested in  turning the South Caucasus into a zone of peace, sustainable  development and prosperity,” the head of the Russian diplomatic  department said, adding that it is important for Moscow to increase  trust between the parties while creating conditions for the full  normalization of Armenian-Azerbaijani relations. “I hope that today’s  meeting will make it possible to move forward along the path that was  outlined by our leaders,” Lavrov said.

In turn, Azerbaijani Foreign Minister Bayramov stressed in his  opening speech that this meeting “is a good opportunity to discuss  the progress that can be achieved.” At the same time, he expressed  regret due to the fact that so far there are no proper improvements  in the work on opening transport communications in the region. “I  know that contacts between our partners continue. And we believe that  there is a good prospect, a good opportunity to achieve results and  achieve full implementation of tripartite statements,” he said. “I  believe that there are good developments, understanding in terms of  the composition and representativeness of the parties in the  commission on delimitation issues, and I also believe that in the  near future it will be possible, at least, to launch this process.”  Bayramov noted that Baku, for its part, “is ready to begin work on a  peace treaty,” and the meeting of ministers and the preservation of  contacts between the parties “will have a positive impact on the  continuation of the discussion on this topic.” 

Armenian Foreign Minister Mirzoyan stressed that Yerevan has been and  remains committed to the implementation of all agreements and  statements between the leaders of the three countries. “We are ready  to continue all work on the current formats: on opening  communications of economic infrastructures in the region, and on a  peace treaty, or, as it is probably more correct to call it, an  agreement on the normalization of relations, the establishment of  relations, and on the solution of all remaining problems, including  humanitarian ones, release of prisoners of war and other issues that  remain unresolved,” he said.

Earlier, Lavrov held separate meetings with partners from Azerbaijan  and Armenia.

ArmInfo.During a meeting of FMs of Armenia, Russia and Azerbaijan on May 12 in Dushanbe, RA Foreign Minister Ararat Mirzoyan stressed the importance of a speedy  settlement of the humanitarian issues resulting from the 44-day war,  including the need for immediate repatriation of the Armenian  prisoners of war. Thus, according to the source, “the process of implementation of the  commitments undertaken within the Trilateral Statements of November  9, 2020, January 11, 2021 and November 26, 2021 was discussed.

The sides exchanged views on the unblocking of regional  communications and economic ties, the establishment of the commission  on delimitation and border security, and the agreement on  normalization of relations between Armenia and Azerbaijan.  Minister  Mirzoyan reaffirmed the position of the Armenian side on the  guarantee of security, rights and freedoms of the Armenians of  Artsakh, as well as on the status of Nagorno-Karabakh within the  framework of the comprehensive settlement of the Nagorno-Karabakh  conflict.”

“As far as alleged disproportionate violence against journalists is concerned, an alert has already been posted on our Platform to promote the protection of journalism and safety of journalists: A reply from the authorities is awaited.” The Secretary General of the Council of Europe Marija Pejčinović Burić replies to my letters on police violence. Taguhi Tovmasyan, an MP of the opposition “With Honor” Faction in the National Assembly (NA) of Armenia and Chair of the NA Standing Committee on Protection of Human Rights and Public Affairs, wrote this on Facebook. Tovmasyan added as follows:

Attorney of fallen Armenian soldiers’ legal successors: PM Pashinyan will be questioned by investigative body

At this point, all the parents of the fallen servicemen are recognized as the legal successors of the victim, we are recognized as their [legal] representatives, and the parents are being questioned. Lawyer Vahan Hovhannisyan, the legal representative of the parents of the Armenian servicemen who fell during the Artsakh (Nagorno-Karabakh) war in the fall of 2020, told this to reporters Thursday outside the building of the Investigative Committee of Armenia.

He noted that the decision to recognize as the legal successor of the victim gave a very general legal assessment of the actions, in particular, of the alleged perpetrators of the crime, and did not specify the names.

“All the parents object to this descriptive part, and all of them stated that their demand is not met, as the only one accountable for and the only culprit in the death of their sons is [PM] Nikol Pashinyan, (…) and they demand that Nikol Pashinyan be noted as guilty of the above-mentioned actions in the decision to recognize as the legal successor of the victim,” the lawyer said.

He informed that on May 7, they had submitted a petition to question Pashinyan as a witness, so that the Prosecutor General could give such an instruction.

“Today we were informed that our petition on questioning Nikol Pashinyan [as a witness] was granted. The prosecutor instructed the body conducting the proceedings to question Nikol Pashinyan. (…). In order to exclude further inaction, in the second half of the day we will submit a sharper, more aggressive petition to carry out certain legal actions against Nikol Pashinyan in particular,” the attorney said.

“At the moment, the matter of including Nikol Pashinyan as an accused is put off. We will see to it that Pashinyan’s interrogation be carried out in the building of the investigation department, as he has no advantage over any Armenian citizen, especially since there are features of an apparent crime in his actions,” Vahan Hovhannisyan said.

Azerbaijan confirms that it refuses to fulfill its obligations to release all Armenian captives

The Azerbaijani foreign ministry considers the accusations made by Armenian Prime Minister Nikol Pashinyan—during his visit to the Netherlands— to be “unfounded,” and they “show that the Armenian leadership is far from being sincere in the issue of normalizing relations between the two countries.” This is how Leyla Abdullayeva, Head of the Press Service Department of the Azerbaijan MFA, commented on the statements of the Prime Minister of Armenia.

“The unfounded allegations made by the Armenian Prime Minister against Azerbaijan during his speech at the Clingendael Institute of International Relations in the Netherlands, including untrue accusations on humanitarian issues, show that the Armenian leadership is far from being sincere in the issue of normalizing relations between the two countries,” Abdullayeva said. 

“In general, it would be incorrect to describe Armenia’s submission of mine maps to Azerbaijan as a humanitarian gesture, as it was Armenia’s obligation under international humanitarian law after the signing of the trilateral statement. Since the signing of the trilateral statement, 219 people, mostly civilians, have been killed by landmines,” the Azerbaijani MFA representative added.  

“(…) the accusation of the Prime Minister of Armenia against Azerbaijan for not taking humanitarian steps and not returning the Armenian detainees is inappropriate and unfounded. It would be good for the Armenian leader to first understand the reasons for the detention in Azerbaijan of saboteurs of Armenian origin who entered the territory of Azerbaijan illegally,” Abdullayeva noted. 

“However, the fact that the Armenian Prime Minister is still making baseless allegations against Azerbaijan seriously calls into question the country’s desire to act for peace,” concluded the head of the Press Service Department of the Azerbaijan MFA.

Thus, the Azerbaijani MFA has once again put the blame on the Armenian side and confirmed that Azerbaijan refuses to carry out trilateral statement’s requirement on the release of all captives.
