The lawyers appealed to the ECHR regarding the issue of Karen Ghazaryan, a citizen of Armenia captured by Azerbaijan

In connection with the disappearance of Karen Ghazaryan, a resident of Berdavan, on July 15, and then his appearance in the territory of Azerbaijan, Armenian lawyers appealed to the European Court of Human Rights, which partially satisfied the claim, lawyer Ara Ghazaryan informed Aysor.am.


According to him, late in the evening of July 16, he, as well as lawyers Artur Ghazaryan and human rights defender Mary Baghdasaryan sent an application to the court against Azerbaijan under Rule 39 of the ECHR regulation.


The application refers to the case of the disappearance of Karen Ghazaryan, resident of Berdavan village, citizen of RA on July 15, whose photo was published by Azerbaijani media on the same day. The Ministry of Defense of Azerbaijan claimed that the person depicted in the photo was captured, he is an Armenian spy who was caught in the Kazakh section of the Armenian-Azerbaijani border.


In the application, the representatives of Karen Ghazaryan’s parents asked the ECtHR to instruct the Azerbaijani authorities to take all measures to protect Karen Ghazaryan’s health, as well as to ensure his return to Armenia.


Lawyer Ara Ghazaryan informed that on July 17, the ECHR received the court’s decision regarding the application, by which the court partially satisfied the sent application, instructing the authorities of Azerbaijan to take all measures to protect Karen Ghazaryan’s health.


At the same time, the court requested the authorities of Azerbaijan to provide information about the whereabouts and conditions of Karen Ghazaryan, as well as whether a criminal case has been initiated against Karen Ghazaryan, requesting to provide detailed documents and information, including detailed information about the charges brought against him.


The court also instructed the representatives of the applicants to submit a complete complaint by August 14 of this year, and also decided to examine the complaint in order of priority.

By the decision of RA Prime Minister Nikol Pashinyan, Vahagn Harutyunyan was dismissed from the position of Deputy Chairman of the RA Investigative Committee, Head of the Main Department for Investigating Especially Important Cases.


“Guided by Article 20, Part 5, Article 22, Part 1, Clause 2 of the Law of the Republic of Armenia “On the Investigative Committee of the Republic of Armenia”, release Vahagn Harutyunyan from the position of Deputy Chairman of the Investigative Committee of the Republic of Armenia, Head of the Main Department for Investigating Especially Important Cases, according to his application,” said the Prime Minister’s decision.

It is too early to announce major new US investments. US Ambassador to RA Richard Mills announced this in a briefing with journalists.


According to him, corruption and ensuring equal conditions for all economic operators was an obstacle in the way of investments and the USA welcomes the work of the Armenian government against corruption and ensuring equal conditions.


“But it is still too early to announce new large investments or start them in Armenia,” he emphasized.


Mills said they are getting a lot of inquiries from the US business community about opportunities in Armenia. According to him, potential investors are particularly interested in the extent to which the RA government pursues the fight against corruption, and the extent to which investigations of scandalous cases are conducted within the framework of the law.


In addition, the ambassador noted that the United States government is considering what means it can support Armenia. He clarified that this may include an increase in the amount of funding, which is allocated to Armenia in the form of assistance by the International Development Agency and other US government agencies.


By the way, the ambassador also referred to the situation around “Lydian Armenia”. He noted that investors are paying close attention to the process of the case.


“The actions of the government inspire me with confidence and I am confident about future investments,” the ambassador added.

After reviewing the report on the results of the control carried out by the RA Control Chamber in the RA Ministry of Internal Affairs, the attached additional materials justifying the violations, the documents have revealed the next manifestations of the schematic crime of avoiding the payment of administrative fines for violations of the traffic rules.


As a result of a deep and comprehensive study carried out by the RA General Prosecutor’s Office, it was found that in 2016-2017 during the period, a number of owners of cars, which are the subject of CRC violations, including taxi service companies, paid administrative fines in order to avoid them, presented evidence that the violations were committed by individuals without property or income. As a result, the employees of the Traffic Police Service recorded fines in the total amount of 764,853,550 AMD for 97,429 administrative offenses in the name of 478 individuals who have no property or income. And the employees of the enforcement service of judicial acts of the Ministry of Justice of the Republic of Armenia, not taking sufficient measures to find the property or funds of the debtors, ended the enforcement proceedings regarding the confiscation of money by administrative acts on the basis that the debtor has no property or income.


In the described actions, there are apparent data that the owners of cars fraudulently avoided paying the amounts of administrative fines, causing large losses to the state. And the responsible officials of the state service, for almost 2 years, by formulating many administrative offenses and enforcement proceedings against 478 individuals, have shown dishonest or negligent attitude towards the service. And as a result of not performing their duties or performing them improperly, the state suffered particularly large losses.


Bearing in mind that these actions apparently have the characteristics of crimes, a criminal case was initiated according to the facts specified by the decision of the RA General Prosecutor’s Office under Article 184, Part 2, Clause 1 and Article 315, Part 2 of the RA Criminal Code (causing particularly large amounts of damage by means of fraud or abuse of trust, official negligence that caused serious consequences). The investigation was assigned to the Special Investigation Service of the RA.


As a result of studies that have been going on for several months, including the above, 7 criminal cases have been initiated in the General Prosecutor’s Office of the Republic of Armenia with the facts of the use of criminal mechanisms to make it impossible to ensure the payment of administrative fines for the violation of the CRC rules. The amount of damage caused to the state by them has already amounted to around 1,380,000,000 drams.


Studies aimed at uncovering the facts of violations of state interests are ongoing.


By the decision of the preliminary investigation body, the criminal cases initiated until this moment are combined and examined in one proceeding. During the preliminary investigation, appropriate measures of prosecutorial intervention are used in order to ensure the completeness and versatility of the examination of these criminal cases, to find out the full scope of criminal manifestations, the full scope of the persons involved in them, including competent public servants, and to give the necessary legal assessment of their actions.


Taking into account the volume of criminal cases, the large number of subjects involved in them, the need to carry out large-scale operative-investigative, investigative and other judicial actions in accordance with the investigative plan, the Prosecutor General of RA Arthur Davtyan was instructed to create an investigative group with the involvement of investigators of the RA Investigative Committee.

RA Prime Minister Nikol Pashinyan is in the center of attention of the incident of July 17 military training in Panik village of Shirak region by soldiers of the 102nd military base of the Russian Federation without instructions and permission. A criminal case has been initiated in the main department of the RA Investigative Committee’s investigation on cases of accepting and giving bribes, brokering bribes and extortion.


On July 10, 2018, the RA NA MP Alik Sargsyan’s report submitted by the SIS to the fact that the former governor of the RA Ararat Marz, threatening to publish defamatory information since 2012, demanded a particularly large sum of money from him, about 60,000 US dollars, was received and processed in the main department of the RA Criminal Investigation Department.


In order to find out the circumstances indicated in the report, urgent legal actions were taken in the main department of the Investigation Committee’s CAG examination.


During the preparation of the materials, the former head of Ararat Marz, RA, gave an explanation and also a report that back in 2008, he transferred money to the RA police chief Alik Sargsyan to hire the son of his former employee in the police system. However, the latter was not hired and the money was not returned.


Bearing in mind that the prepared materials apparently contain features of the crimes provided for by Article 182, Part 3, Clause 2, Article 311, Part 4, Clause 2, Article 312, Part 3, Clause 1, and Article 313, Part 1 of the Criminal Code of the Republic of Armenia, a criminal case was initiated in the Main Department of the Criminal Investigation Department of the RA Criminal Investigation Department and a decision was made to send it for investigation. under the authority of the FSA.
