TURKEY’S TOP COURT: LEAKING OF TELEPHONE CONVERSATION TO MEDIA JUSTIFIED

/PanARMENIAN.Net/ Turkey’s top court has ruled that the leaking of a
telephone conversation to the media cannot be considered a violation
of privacy because it benefits the public.

The ruling by the Supreme Court of Appeals concerned the phone
conversations of Erhan Tuncel, a police informant, whose role in the
2007 murder of Turkish-Armenian journalist Hrant Dink has yet to be
determined. Police officer Muhittin Zenit, whose phone conversation
with Tuncel was leaked to the press, had demanded damages from
the court.

Zenit had argued that the rule regarding the "confidentiality
of investigation" had been violated by the publication of his
conversation with Tuncel and that he was made a target. He also filed
lawsuits against some media outlets that published or broadcast the
conversation.

But his demand for compensation was rejected by the Fourth Chamber
of the Supreme Court of Appeals, which ruled that the basic principle
in evaluating the case should be "the public good."

"The press is responsible for observing, researching, informing,
educating and directing the public. The basic principle for this is the
public good," the ruling stated and added: "The published conversation
involved intense debates about the murder. The information published
concerns an important issue that is currently under debate, and there
is public good in its dissemination.

Therefore, the act is within the rule of law, and the plaintiff’s
personal rights were not violated," Today’s Zaman cited the Supreme
Court resolution.

Hrant Dink (September 15, 1954 – January 19, 2007) was born in
Malatya. Dink was best known for his role as editor of ‘Agos’ Turkish
and Armenian Language weekly in Istanbul. He worked as the columnist
and editor-in chief of AGOS weekly newspaper, which can be regarded
as the voice of Armenian community, from 1996 until January 19,
2007 when he was shot dead outside of his office.

Investigations concerning Ergenekon clandestine, Kemalist
ultra-nationalist organization have led to suspicions concerning
Ergenekon’s involvement in Dink’s assassination.

Fund marks the decade in 2010. A number of commemorative events
launched on 8 January in the capital of Nagorno-Karabakh Republic,
Stepanakert. A festive concert, "Save a Life" and other events were
organized by the Ministry of Health, Culture and Youth Affairs of
NKR and ABMDR.

Concert, which lasted 6 hours, was aimed at increasing the number of
donors. 160 people between18 and 50 became bone marrow donors.

Chairman of the NKR National Assembly Ashot Gulyan, leader of the
Artsakh Diocese of the Armenian Apostolic Church Archbishop Pargev
Martirosyan, NKR Minister of Health Armen Khachatryan, Minister of
Culture Narine Aghabalyan were among them.

Armenian Bone Marrow Donor Registry Charity Fund " was officially
established in Armenia on 8 January 2000. The Registry is aimed to
search appropriate bone marrow donors for patients with leukemia
and other blood diseases in Armenia and the Diaspora. Armenian
Registry cooperates with other existing registries in the world,
promote development of transplantation in Armenia and seek to open
the Center for collection and transplantation of stem cells in Armenia.

tariffs will be soon submitted to the Public Services Regulatory
Commission of the Republic of Armenia. The decision was made by
company’s Director General Karen Karapetyan in an extended session
held Monday.

Estimating the company’s activities for the past year, Mr. Karapetyan
recommended its subdivisions to generalize and prepare 2009 reports,
focusing particularly on the financial and economic indexes of gas
supply, security system installation and other programs.

Founded in 1997, ArmRosGazprom, a subsidiary of Gazprom, supplies
gas for the domestic market in Armenia. The company also transports,
stores, processes, distributes, and sells natural gas; and generates
electricity, as well as engages in the reconstruction and expansion
of the gas transportation system and underground storage facilities
system in Armenia. In addition, it manages gas deliveries from the
Russian Federation to Armenia, as well as exports to Turkey.

Currently, the company’s authorized capital totals AMD 316.6 billion.

Armenian peacekeepers to Germany and later to Afghanistan, RA Minister
of Defense Seyran Ohanyan stated that participating in such a mission
is Armenia’s moral duty. In a month, 40 Armenian peacekeepers forming
part of a German contingent will leave for Afghanistan for six months.

Addressing the peacekeeping brigade, the Minister Ohanyan said: `Our
Armed Forces’ international reputation, and our state being a full
member of the international community, imposes a moral duty on us `
participating in the tasks facing the international community. We
cannot but participate in the activities aimed at establishing peace
and stability. This is in conformity with Armenia’s specific features
and priorities. I can assure you that by carrying out your mission in
Afghanistan you render an invaluable service to the Homeland.

‘You must remember that your will be hosted by the Afghan people. Your
duty is to protect them, and you must be on the alert," Ohanyan said.

The Minister also thanked the German side for its financial assistance
and moral support in resolving the problems of stationing the Armenian
troops.

German Ambassador to Armenia Hans-Jochen Schmidt addressed the
Armenian contingent. He said that the problems of further activities
in Afghanistan will be discussed in London, Great Britain, late this
January.

Berlin Offers Turkey Renewed Hope of EU Accession

Doha, January 08 (QNA) – German Foreign Minister Guido Westerwelle
appeared to keep the door ajar for Turkey’s accession to the European
Union yesterday when he visited Ankara as part of a two-day trip, the
English language newspaper daily /Gulf Times/ said.

Progress had stalled during 2009 as both France and Germany raised
concerns about whether a mainly Muslim country betwixt Europe and Asia
should become a member of the 27-nation bloc.

Those arguments were spurious, of course, but perhaps the real issue
to be discussed in Brussels is just how big the EU will become with
several other countries also knocking on the door, the Gulf Times said
in its editorial comment published here on Friday.

With the possible exception of the United Nations, the EU is already
the biggest bureaucracy in the world capable of exerting increasing
influence over sovereign nations. German Chancellor Angela Merkel and
her conservative Christian Union party sought a compromise whereby
Turkey would have been granted "privileged partnership" status.

Such an outcome would have created an impossible two-tier structure
that would attempt to bring Turkey into the fold like a country member
at a golf club.

So, it seems that commonsense is prevailing but there is a long way to
go. Germany has the largest ethnic Turkish population outside Turkey
of nearly three million and according to 2008 figures bilateral trade
volume reached nearly $36bn.

At a time when the country has performed well despite the global
financial crisis and prospects for growth are encouraging many EU
members would prefer to welcome a large vibrant economy over a
weakling like Iceland, which also has European aspirations.

Westerwelle, who is due to visit Qatar next week as part of a regional
visit, was asked at a press conference in Ankara if he actually spoke
for Berlin in his pledge to support Turkey. His answer was somewhat
unconventional but unequivocal. "I am not here as a tourist in shorts
? I am the German foreign minister and what I say counts."

It must be hoped that French President Nicolas Sarkozy softens his
stance as well while continuing to insist that Turkey moves forward
with reforms that were stipulated by the EU in 2004.

Turkey has failed to meet important EU criteria such as opening its
borders to member country Cyprus but the onus is also on Nicosia to
find a solution to the decades-long dispute.

Pope Benedict XVI yesterday called Turkey a "bridge between Islam and
the West" while meeting the new Turkish ambassador to the Vatican.
Indeed, the country has played a significant diplomatic role in Iraq,
Lebanon, Afghanistan and Pakistan and has made efforts to heal its
rifts with Armenia.

For its increasing influence alone, Turkey should be considered a
welcome addition to the monster that is now the European Union and the
pedestrian pace of accession talks should now accelerate. (QNA)

Meeting scheduled as Turkey continues to link Nagorno Karabakh

Washington, DC – U.S. Secretary of State Hillary Clinton will meet
with Armenian-American organizations next month to consult on the
protocols between Armenia and Turkey announced the Armenian Assembly
of America (Assembly). The Assembly requested a meeting with Secretary
Clinton to discuss issues of concern to the community.

"The Republic of Armenia through its President, has taken bold steps,
yet the Republic of Turkey continues its counterproductive actions
with respect to normalizing relations with Armenia," stated Assembly
Executive Director Bryan Ardouny. "As such, this meeting offers an
important opportunity to discuss the Administration’s efforts to hold
Turkey accountable," added Ardouny.

The Armenian General Benevolent Union, the Diocese of the Armenian
Church of America (Eastern), the Diocese of the Armenian Church of
America (Western), the Knights of Vartan, along with the Assembly
issued a joint statement in support of President Serzh Sargsyan’s
initiative "in taking a positive approach to the process of
normalizing relations…." The joint statement also made it clear that
we will continue "to stand firmly with the Nagorno Karabakh Republic
to ensure its freedom and security" and will also continue to lead the
charge with respectto "all those working for universal affirmation of
the Armenian Genocide."

While Armenia has taken a constructive approach, in direct
contradiction to the protocols signed in October of 2009, Turkish
Prime Minister Recep Tayyip Erdogan continues to link progress on the
protocols to a resolution of the Nagorno Karabakh conflict. In
addition, while in Washington, DC last month, Erdogan, when asked
about the Armenian Genocide on the Charlie Rose television program,
stated that "I can say very clearly that we do not accept genocide.
This is completely a lie."

"In the face of Turkey’s ongoing campaign of denial, we must redouble
our efforts to secure U.S. reaffirmation of the Armenian Genocide and
urge swift passage of the Armenian Genocide resolution in Congress,"
stated Ardouny. Invited to attend the meeting with Secretary of State
Hillary Clinton are: the Armenian Assembly of America, the Armenian
General Benevolent Union, the Diocese of the Armenian Church of
America (Eastern), the Diocese of the Armenian Church (Western), the
Knights of Vartan, and the Armenian National Committee of America.

Azerbaijani political expert: Negotiations to resolve Nagorno-Karabakh
conflict are at finish line

Day.Az interview with Azerbaijani political expert Eldar Namazov.

Is the Armenia-Azerbaijan Nagorno-Karabakh conflict likely to be
resolved in 2010, especially in the first decade of the year?

Already in the second half of 2009, co-chais of the OSCE Minsk Group
made statements about possibility of reaching agreement on basic
principles of the conflict resolution in the coming months. Although
it did not happen, these statements indicate that the talks are at the
finish line.

Apparently, 2010 will clarify final fate of the "Prague Process" and
the so-called "Madrid principles". There is possibility to delay the
agreement and repeat these long-known conditions over and over again
for couple of months, or six months. But in 2010 one needs to expect
either singing of an agreement or formal recognition that " Prague
process" failed giving no results.

In the meantime, there is favorable international environment around
the negotiation process and co-chairs act coherently and consistently
while socio-economic situation in Armenia strongly necessitates
normalization of relations with its neighbors, without which the
economic prospects of the country, to put it mildly, are vague. There
are still skepticism about prospects of reaching agreement about basic
principles in the first half of 2010.

Many internal and external factors are pushing Armenia to necessary
compromises, but in fact, Yerevan believes that it is easier to push
normalization of relations with Turkey through public opinion than
with Azerbaijan despite almost century-old propaganda of the enemy
image for Turks and accusations of the so-called "genocide"! It should
be borne in mind that when the so-called "Prague process" started,
there was no indication that this process can result in a breakthrough
and agreement. Armenia viewed it as the next stage of simulation of
the negotiation process and prolonging the situation in the occupied
territories.

Consequences of the Russian-Georgian August war and the global
economic crisis have changed the situation in the region in the middle
of "low-intensity" Prague process. Russia came up with a real
motivation to reach a settlement, and Armenia, following decline of
per capita GDP by almost 20 percent in 2009 and dim prospects for
economic future, is obliged to urgently seek ways of restoring
economic relations with its neighbors. Therefore, Armenia has been
taken aback. The situation is completely different than it was in the
beginning of the "Prague process". Armenia faces a very difficult
choices.

Armenian president Serzh Sargsyan has stated that Armenia is ready to
ratify the Armenia-Turkey protocols. Do you believe the protocols will
be ratified and borders be opened till April 24, the next anniversary
of the so-called `Armenian genocide’?

As some kind of time-frame for achieving a breakthrough in
Turkish-Armenian relations, April 24 is usually viewed in the context
that the Armenian lobby in the U.S. Congress threatens that a
resolution recognizing the so-called "genocide" can be adopted till
that date. Although this is a very sensitive moment the Turkish
diplomacy, I think that there is underestimation of Turkey’s
independence in making important foreign policy decisions.

Once despite massive pressure of all branches of the United States
government, Turkey refused to allow its territory to be used for
military purposes against Iraqi thus questioning relationship of the
strategic alliance with the United States. Today Americans are obliged
to admit that Turkey was right. It was the previous Washington
administration that made a mistake.

Therefore, it is a clear mistake to assume that the Armenian lobby in
the U.S. Congress may force Turkey to adopt a rush decision
contradicting country’s interests. Moreover, it became clear in recent
months that opening the border with Armenia depends entirely on other
factors. It is already known that resolution of the Karabakh conflict
and normalization of Turkish-Armenian relations are two sides of a
coin.

They can be formally pulled apart under various diplomatic formats.
However, there will be either parallel breakthroughs in both issues or
the situation will remain "frozen" in both directions. So, prospects
of achieving those breakthroughs depend on the answer to one question
– what was Armenia’s aim when it initiated the process of
Turkish-Armenian normalization?

In your opinion, what was Armenia’s real goal?

It certainly will not work if Yerevan aims at driving a wedge in the
Turkish-Azerbaijani relations, to get Turkey to change its stance on
resolving the Karabakh conflict, opening of Turkish-Armenian border,
beginning of economic cooperation with Turkey without any compromise
in the Karabakh conflict and withdrawal from the occupied territories.

In this case, we will see no opening of the Turkish-Armenian border
and no breakthrough in resolving the Karabakh conflict. But if Yerevan
is aimed normalizing relations with Turkey and Azerbaijan and securing
peace and stability in the region when it initiated the protocols, we
may witness breakthroughs in both directions.

Yerevan has not given a clear answer to this question yet. It is
unclear whether the initiative was part of Yerevan’s political
intrigue, or it really wants peace and stability in the region.

Acting fairly consistently in terms of normalizing ties with Turkey,
it still keeps on blocking success in settlement of the Karabakh
conflict which raises serious questions in Ankara and Baku and around
the world about true objectives of Armenia’s policy. Armenia’s
attitude to compromise on resolution of the conflict has become a kind
of "litmus paper" on which prospects for normalization of
Turkish-Armenian relations depend.

it signed King of the Cage veteran Georgi Karakhanyan for its next
featherweight tournament.

Karakhanyan (12-1-1) has been fighting for more than years on various
regional circuits. He’s the first name confirmed following Bellator
CEO Bjorn Rebney’s Twitter announcement that the organization has
recently signed four featherweights with a combined record of 38-2.

Joe Soto (7-0) won Bellator’s inaugural 145-pound tournament last year.

progress be expected in 2010, Vahagn Khachatryan, the former Mayor of
Yerevan and member if the opposition Armenian National Congress (ANC)
told NEWS.am.

`In 2009, the Government proved unable to oppose the crisis, and the
anti-crisis measures did not produce any results nor could they.
Unfortunately, the authorities did not make a step to put an end to
monopolies, which are destroying the economy, preventing economic
growth,’ Khachatryan said. The gravest problem is that it is not the
crisis, but the defective economic structure, that caused the huge
economic downturn. `A rise of almost 30% in the poverty level was
first registered in 2009. One more negative factor is that the
Government did not create any basis for development, whereas this work
is normally done during crises. The Government proved unable to meet
the challenges, which will have their impact on the economy in 2010
and following years,’ Khachatryan said.

Making forecasts for 2010, he stressed that it will be a difficult
year. `Serious social problems will arise, especially if we consider
the rise in the gas and electricity prices from April 1, 2010. The
Government does not plan any measure to cope with the consequences. I
am sure that both political and economic monopolies will continue
prospering. Hardly any economic sectors are capable of ensuring
economic development in the country. Construction and money transfers
ensured development in the previous years, but neither is available
now,’ Khachatryan said.
