Question: Can the Armenian-Azerbaijani Nagorno-Karabakh conflict be
solved in 2009?

Answer: The key to the solution of the conflict lies with the leaders
and peoples of Azerbaijan and Armenia. It is primarily Azeris and
Armenians, including those from Nagorno-Karabakh, who need to find
a mutually acceptable compromise solution. This solution should be
achieved through peaceful negotiations and with due consideration to
the rights and underlying interests of all major stakeholders in the
conflict, so as to ensure a stable, sustainable and just peace.

The external players, be it OSCE Minsk Group or individual states,
may only play a secondary role in shaping the dynamics of the conflict
and helping the parties to come to peace. We cannot fully exclude the
possibility of signing of a peace agreement in 2009. However, even if
Armenia and Azerbaijan sign a peace agreement, it will take years for
Azeris and Armenians to build trust and learn to peacefully coexist in
Nagorno-Karabakh and elsewhere. So, solution to the Nagorno-Karabakh
conflict is a long-term process.

We cannot exclude the possibility of a significant progress towards
peace in 2009. Both Armenia and Azerbaijan continue talks using Minsk
Group’s Madrid proposals as a framework. The August crisis in Georgia
has increased the importance and urgency the international community
attaches to the solution of the conflicts in the South Caucasus. The
Moscow declaration signed in November by Armenian, Azerbaijani and
Russian presidents, despite the fact that it was perceived as primarily
a Russian attempt to improve its international image after Georgia war,
was an important development in a sense that it was the first signed
document between Armenia and Azerbaijan ever since 1994 cease-fire
and called for a political resolution of the conflict.

Turkey is also stepping up its regional efforts in the Caucasus
and the normalization of Turkish-Armenian relations would have a
positive impact to the Nagorno-Karabakh peace process. So, given
all these recent developments, there are some grounds for cautious
optimism. However, as I said, the solution to such complex problems
as Nagorno-Karabakh conflict is a long-term process and it will take
at least a decade, if not more, before the conflict can be fully
resolved. To start that process it is essential that leaders on all
sides start making their populations aware of the Madrid principles
and encourage confidence building measures between their societies.

Q: Can the war be resumed this year?

A: War can erupt at any time as long as the conflict is unresolved
and the two armies face each other in the trenches. The August
war in Georgia has demonstrated how fragile the status quo is in
the region. But it also had a deterring effect in a sense that it
showed what catastrophic consequences the resumption of hostilities
may have. This puts a special responsibility on the shoulders of the
Azerbaijani and Armenian leaders not to allow a similar scenario in
Nagorno-Karabakh, which represents an even bigger security challenge
for regional and European security than the one posed by August 2008
war in Georgia. The leaders of Azerbaijan and Armenia should benefit
from increased attention of the international community to the South
Caucasus and use its assistance to achieve a peaceful solution.

Q: What principles of the draft framework agreement on the
Nagorno-Karabakh conflict remain uncoordinated?

A: The Minsk Group proposals, officially presented to the foreign
ministers of Armenia and Azerbaijan at the Madrid summit of the OSCE in
November 2007 constitute the basis of present-day negotiations. These
proposals, also known as "basic principles", are an outcome of series
of meetings between Armenian and Azerbaijani foreign ministers since
2004 initiated in Prague, and thus dubbed the "Prague process". The
proposals are generally known, and have been previously elaborated in
Crisis Group’s relevant reports "Plan for Peace" (2005) and "Risking
War" (2007).

The proposals envisage determination of a final status of
Nagorno-Karabakh by a popular vote in the last stage of the peace
process, after all other confidence measures, including renunciation of
the use of force, gradual withdrawal of the Armenian forces from the
occupied territories, return of displaced population to their homes
and re-opening of trade and communications, have been put in place.

However, the parties have significant differences on the issue of
return of Kelbajar and Lachin districts, the modalities of the vote
which would determine Nagorno-Karabakh’s ultimate status, and the issue
of return of displaced Azeris to Nagorno-Karabakh before such a vote
takes place. The Minsk Group currently works with parties to bridge
the remaining differences so as to enable Azerbaijani and Armenian
leaders sign up to the "basic principles".

Crisis Group believes the ongoing negotiations based on Madrid
proposals constitute the best framework for peaceful resolution of
the conflict. In Azerbaijan there are widespread misperceptions and
cliche-type thinking about these proposals, as if they constitute
a hidden plot to legitimize Nagorno-Karabakh’s secession from
Azerbaijan. Analogical fears exist in Armenia too. It is crucial that
the leaders of Azerbaijan and Armenia inform and consult with their
societies on the substance of the Minsk Group’s proposals. Greater
public awareness and civic discussions within Azerbaijan and with
Armenian counterparts is very important for achieving a progress in
the peace process.

Q: Media outlets have reported Russia has transferred
800-million-dollar worth weapons to Armenia. Does this undermine the
peace process?

A: I have read about this in the Azerbaijani media and at this stage
it is hard for me to judge on the issue. The Russian side denies
the report and we do not have an independent verification of the
claim. However, if true, this fact certainly undermines Russian
position as a Minsk Group co-chair and impartial mediator in the
Nagorno-Karabakh conflict. The arms transfer also contravenes the
UN Security Council Resolution 853 (1993) urging the states to
"refrain from supply of any weapons and munitions which might lead
to an intensification of the conflict or the continued occupation
of territory".

We in Crisis Group believe any supply of offensive weapons to either
Armenia or Azerbaijan as long as the Nagorno-Karabakh conflict is
unresolved serves only to undermine the peace process, brings further
militarization and diverts scarce resources away from public needs.

Turkish PM in Davos replied to reporters’ questions on IMF and
Turkish-Armenian relations.

Turkey’s prime minister said Thursday that IMF would carry out some
works in the next ten days.

Turkish Premier Recep Tayyip Erdogan, who is currently in the Swiss
town of Davos to attend the annual meeting of the World Economic Forum
(WEF), replied to reporters’ questions on IMF and Turkish-Armenian
relations.

Prime Minister Erdogan said that the IMF would carry out some works
in the next ten days. "After ten days, it will be up to the IMF to
sign an agreement with Turkey," he said.

Commenting on his recent meeting with John Lipsky, First Deputy
Managing Director of IMF, Erdogan said that Turkey’s comprehensive
talks with the fund would continue.

"I believe yesterday’s meeting was quite fruitful. I have seen that
there was no negative outcome and there was an approach towards a
solution. I hope we will reach a conclusion soon," he said.

Erdogan said that Turkey’s current debt to the Fund was about 8.7
billion USD.

Upon a question about his scheduled meeting with President Serzh
Sargsian of Armenia later in the day, Prime Minister Erdogan said,
"as you know, I met with President Ilham Aliyev of Azerbaijan yesterday
evening. Our talks will constitute a frame for today’s meeting with
President Sargsian. We cannot leave Azerbaijan alone about the Upper
Karabakh dispute. Armenia should display the necessary understanding
to this end. If Armenia acts sincerely, today’s meeting could pave
way to a road map."

Meanwhile, Prime Minister Erdogan held bilateral talks with Prime
Minister Sali Berisha of Albania.

ARMENIAN ASSEMBLY WELCOMES TURKISH GOVERNMENT’S DECISION NOT TO
PROSECUTE SIGNATORIES TO ARMENIAN APOLOGY CAMPAIGN

Washington, DC – According to multiple sources, Ankara’s Public
Prosecutor will forgo pressing charges against a group of Turkish
intellectuals who, late last year, asked the public in Turkey to sign a
petition, which read, "My conscience does not accept the insensitivity
showed to and the denial of the Great Catastrophe that the Ottoman
Armenians were subjected to in 1915. I reject this injustice and for my
share, I empathize with the feelings and pain of my Armenian brothers
and sisters. I apologize to them."

When the petition first appeared, the Assembly welcomed the development,
noting that an "irreversible trend" had commenced in Turkey. "This is
another step in the right direction," stated Armenian Assembly of
America (Assembly) Executive Director Bryan Ardouny. "The Assembly
continues to urge Turkey to come to terms with its genocidal legacy and
to open a new chapter in relations with Armenia," Ardouny continued. "We
continue to be concerned that there will be a backlash, not unlike the
tragedy which befell Turkish Armenian journalist Hrant Dink. There is a
long way to go yet, but this is definitely a positive step, especially
in light of the well known abuses of Article 301 of the Turkish Penal
Code to muzzle citizens for acknowledging the historical truth."

In a very short period of time, the petition garnered over 28,000
signatures and marked a real breakthrough in the progression of
encouraging developments that builds on the visit of Turkish President
Abdullah Gul to Armenia at the invitation of Armenian President Serzh
Sargsyan, and the independent legal report issued by the International
Center for Transitional Justice (ICTJ) that concluded that the events of
1915 constituted genocide under the criteria set forth by the United
Nations Genocide Convention.

The leaders of two Armenian nationalist groups have been detained on
suspicion of espionage in Georgia.

The two, seized by Georgia`s Interior Ministry counter-intelligence
department, have also been charged with creating illegal armed units.

The two Armenians, Grigor Minasian and Sergey Akopian, are citizens
of Georgia, a source from the ministry told local media.

Minasian is the director of an Armenian youth center in the largely
Armenian-populated Akhalkalaki region of Georgia, while Akopian is the
president of the Charles Aznavour charity. Searches have been conducted
at the homes and offices of the Armenians and some items confiscated.

This is not the first arrest of representatives of Armenian
organizations in Georgia. In June 2008, the head of the United
Democratic Alliance, Gurgen Shirinian, was arrested after throwing
a bomb at a police station in Akhalkalaki. Other representatives of
the alliance were also arrested.

The Armenian public alleges that the frequent arrests are part
of a put-up anti-Armenian campaign intended to sideline Armenian
activists from public development. To prevent this from happening,
members of Armenian organizations have sent complaints to the Council
of Europe Commissioner for Human Rights, Thomas Hammarberg, and to
Amnesty International.

ANKARA: No Legal Proceedings For Apology

ANKARA – The initiation of legal proceedings concerning the
controversial "I apologize" campaign regarding the 1915 incidents
is not required, the Ankara Public Prosecutor’s Office announced
yesterday.

"Since opposing ideas are protected by the right to freedom of thought
in democratic societies, it has been decided that the initiation of
proceedings is not required," the decision read.

Six prosecutors submitted a petition calling for the penalization of
organizers of the apology campaign for "insulting the Turkish nation
openly" under Article 301 of the Turkish Penal Code, or TCK, and the
public prosecutor’s office opened an investigation into the issue. "My
conscience does not accept the insensitivity and the denial of the
‘Great Catastrophe’ that the Ottoman Armenians were subjected to in
1915. I reject this injustice and for my share, I empathize with the
feelings and pain of my Armenian brothers and sisters. I apologize
to them," said the campaign’s petition, which a few of Turkey’s
intellectuals opened for signature.

The campaign drew harsh reactions from some groups within the
country. So far the petition has 28,219 signatures.

"I can not say for sure that the free supply of Russian military
hardware of a total of $800,000,000 to Armenia really occurred. But we
know well that earlier there have been facts of free supply of arms to
Armenia by Russia. This allows us to suspect that Russia really made
this step", said political scientist Hikmet Hajizade regarding the
statement of the Russian ambassador to Azerbaijan Vasili Istratov that
the document spread in mass media about the alleged supplies of Russian
military hardware to Armenia is disinformation and falsification.

He saud the recent statement of the Russian Foreign Ministry, which
says that Russia has officially not transferred arms in the said
amount raises distrust to the version of the Russian side.

"A reasonable question arises that perhaps this military hardware
was unofficially supplied to Armenia", asks Hajizade. In any case,
in order to clarify this issue, we need to reveal the primary source
of information about the free supply of military hardware. "Only then
we will be able to clarify this issue", said Hajizade.

Yerevan is very satisfied with the level of defense and
military-technical cooperation with Moscow, Armenian Defense Minister
Seyran Ohanian told Interfax.

"Defense and military-technical cooperation between Russia and Armenia
is on a very high level. The plans of 2008 have been fulfilled.

There are no major plans for 2009. The Armenian armed forces will
have internal training," he said.

"We have a plan of military-technical cooperation with Russia, and
this plan is being fulfilled on schedule. I would rather not comment
on military hardware, but we are supplying our troops within the
cooperation framework," the minister said.

Azeri claims regarding the alleged shipment of a large amount of
Russian armaments to Armenia were political propaganda, he said.

"This is another challenge aimed to prepare the [Azeri] population.

We know for sure about political propaganda in the Azeri army. Soldiers
are told that Russia has supplied military hardware to Armenia, which
means they must be prepared because the aggressors may do something
again. Russian officials have replied to the Baku accusations,"
the minister said.

"Meanwhile, Azerbaijan has signed arms deals with Israel and
Ukraine. Azerbaijan is breaching agreements that limit the amount of
armaments and wishes to shift the blame," Ohanian said.

Parties exchanged views on enhancing military cooperation between

situation in region.

GÄ…gor, in turn, said the Armenia-Azerbaijan conflict over
Nagorno-Karabakh must be settled only on the basis of Azerbaijan`s
territorial integrity.

Director General of Yerevan Brandy Company. A. Grigoryan joined
Pernod Ricard Ukraine and Pernod Ricard Minsk in Jan 2001 as Executive
Officer. Pernod Ricard Eastern Europe Executive Officer Eric Labord
said at a press conference Thursday.

He said Ara Grigoryan will combine the positions of YBC Director
General and Pernod Ricard Minsk Executive Officer. E. Labord
characterized the new director general of YBC as a literate manager
who much contributed to promotion of Ararat brand in the Ukraine
and Belarus. A. Grigoryan was born in 1963 in Yerevan. He graduated
from Yerevan Agricultural Institute. He joined Yerevan brandy plant
in 1989 as executive for marketing and sales. Speaking at a press
conference, Ara Grigoryan predicted no global staff policy changes. He
highly appreciated the existing staff and called it one of the best
achievements of the company. He joked that Pernod Ricard Armenia will
speak in Armenian.

Cedric Retailleau was appointed YBC Executive Officer on July 1 2007.

Starting January 1 2009 he has been appointed Pernod Ricard Venezuela
Executive Officer. The office in Venezuela is of strategic importance
for sales of Ararat brand in the American continent. In this context,
the appointment can be considered as advancement, E. Labord said.

YBC was privatized in May 1998 by the French Pernod Ricard Group for
$30 million.

STEPANAKERT, JANUARY 21, NOYAN TAPAN. In 2008, revenues, duties and
compulsory social security payments of the state budget of the Nagorno
Karabakh Republic amounted to 17 billion 271 million drams (about 55,7
mln USD), which enabled to overfulfil the annual programmed index,
the NKR president Bako Sahakain stated at the January 21 reporting
back consulation of the NKR State Tax Service.

The 2008 revenues exceeded the revenues of the previous year by 3.5
billion drams or 25.6%. "And this increase was ensured in case when
production volumes of Base Metals CJSC – the biggest tax payer of
our republic declined because of the global crisis, as a result of
which 1.6 billion drams was not transferred to the state budget,"
B. Sahakian said.

Thanks to the work done in order to rule out the use of double
standards and different rules of game for market participants,
according to the NKR president, the tax discipline as well as the
quality of tax services, especially in trade, were considerably
improved. At the same time he noted that the tax collection process
should not become an obstacle to business activity, in particular,
development of small and medium business, which can be achieved by
creating equal conditions for all economic entities, which in its
turn will allow entrepreneurs to develop and expand production and
allocate money for solution of various social problems.

In this connection the NKR president considered it necessary to improve
tax legislation and take such measures that will first of all help
increase domestic and foreign investments in the economy. Special
attention should be paid to correct organization of control aimed at
revealing the economic entities operating in the shadow sector and
making them work in a legal way.

B. Sahakian expressed satisfaction at the fact that last year 1
billion 97 million drams was transferred to the state budget as a
result of collection of commercial tax, which ensured fulfilment of the
programmed index by 163.8%, exceeding the 2007 index more than twofold.

B. Sahakian underlined the necessity to simplify tax administration,
reduce the red tape, make the changes as accessible to economic
entities as possible, and to establish normal partnership relations
with them.

In this connection he pointed out the importance of a correct manpower
policy based on skills and high human qualities of workers. In his
words, a persistent struggle against abuses and other vicious phenomena
existing in the system should be waged, without wich it is impossible
to carry out the envisaged tasks.
