‘Attorney to the Stars’ Mark Geragos is also a hero in the Armenian
community

You can’t turn on a TV these days without seeing criminal defense
attorney Mark Geragos commenting on a high-profile criminal case on
"Larry King Live" or the "Nancy Grace" show or the "Today" show or
"Good Morning America."

These days, Geragos is known as attorney to the stars — infamous
cultural luminaries, really, people like former Clinton insider
Susan McDougal; former California Congressman Gary Condit, who came
under suspicion in the death of former Capitol intern Chandra Levy;
actress Winona Ryder in her shoplifting problem in Beverly Hills;
Michael Jackson, with whom he worked for a while when Jackson was
accused of molesting a boy; murderer Scott Peterson, who now sits
on death row; and now Gary Anderson, trainer for recently indicted
baseball great Barry Bonds.

Anderson was released Nov. 15 after spending most of the year in jail
for refusing to testify against Bonds, who was indicted for allegedly
lying under oath about using steroids. Geragos told Forbes.com that
Anderson will likely refuse to testify at Bonds’ trial.

But for all the celebrities he’s represented over the years, Geragos
is pretty much an everyday criminal defense attorney whose firm has
taken on almost a quarter of its clients free of charge.

Part of the reason for Geragos’ generosity with both his time and
skills is the intense pride that the 50-year-old father takes in
his Armenian heritage, and much of that pro bono work is focused on
helping his community.

Along with being a trustee with the Armenian Assembly of America,
Geragos, according to brief profiles on Wikipedia, Armenipedia and
other Web cites operated by various organizations, serves on the
advisory committee of Birthright Armenia. He’s also chairman of
Armenian Bone Marrow Donor Registry and has been a member of the
Armenia Fund International board of trustees.

Geragos was also one of three lawyers in two federal class action
lawsuits against New York Life Insurance for policies that never
paid death benefits to relatives of victims of the Armenian Genocide
of 1915 in which 1.5 million Armenians were slaughtered by Ottoman
Turks. The two cases were settled for more than $37.5 million.

His celebrity was apparently not lost on jurors he was selecting
recently for the trial in Pasadena of a young Armenian man accused
of murder. "They were perplexed as to how it was I was in Pasadena
and representing a person who is charged with murder. ‘How would he
have the money?’ His mom’s a recent immigrant," Geragos said of the
questions he read on the faces of those prospective jurors.

But the fact is Geragos, who lives with his family in nearby La Cañada
Flintridge, continues making his mark — without much fanfare — as a
criminal defense lawyer in the Pasadena Courthouse. In fact, shortly
after representing Susan McDougal, who was also charged but later
acquitted of stealing from conductor Zubin Mehta, Geragos served as the
attorney for Michelle Holden, former wife of Pasadena City Councilman

Chris Holden, who was ultimately convicted of molesting the family’s
teenage male babysitter.

We caught up with Geragos last week while he was having lunch at the
Green Street Tavern in Old Pasadena.

Pasadena Weekly: How did you get so involved with Larry King and
Nancy Grace and all those shows?

Mark Geragos: It started, actually, with Susan McDougal, and that
really when cable started to come in, because that was all Whitewater
at that time, and I’ve had the good fortune to have a series of cases
that attract attention, I guess … You can look at that from two
different perspectives. Most recently I’ve been involved with the
Barry Bonds’ indictment and I represent Gary Anderson, who is his
trainer. We just got [Anderson] freed after 51 weeks, which is kind
of a throwback to McDougal and the civil contempt [citiation].

(In 1996, McDougal spent 17 months behind bars for refusing to
answer questions related to Independent Prosecutor Kenneth Starr’s
investigation of the Whitewater real estate scandal involving former
President Clinton, who later pardoned McDougal before leaving office
in 2001.)

In my opinion, there aren’t enough voices from the defense side
articulating on TV why this pro-prosecution and pro-law-and-order
mentality may not be the be-all and end-all.

It seems somewhat ironic that you have all these high-profile cases,
when you and your firm do a lot of pro bono work.

Over the years, fully 25 percent of our practice has been pro bono.

Actually, you are very involved in the Armenian community. How
important is that work to you?

To me that’s the best thing that I do. This year, we raised over $15
million for Armenia Fund in the Thanksgiving telethon. I’m one of the
three lawyers who worked on the genocide class action cases and we’ve
recovered over $37.5 million. Just in this past month we distributed
another $4 million to charities that came out of that work, so it’s
pretty satisfying.

I guess the biggest thing now, legally speaking, is still Peterson,
because he’s on death row. Are you still his lawyer?

We still consult with and represent him in the civil matters and I’ll
continue to do so until someone tells me not to.

I can guess the answer, but what is your opinion of the death penalty
at this point?

I never thought that the death penalty made any sense. Still don’t.

Three strikes?

Same thing. One of the good things about [LA County DA] Steve Cooley
has been a more judicious use of [the] three strikes [law]. You go
out of LA County and some of the horror stories you hear are just
unbelievable. But we are fortunate in LA County that Steve has a more
enlightened view of how to use it.

That goes to the next contention, which is the criminal justice system
is broken. How do you go about fixing that, in your opinion?

Part of the problem is the fact that so many people have this view
of defendants getting off and all of that. That’s not the problem
with the criminal justice system. The problem is innocent people are
being convicted. That is clearly the biggest problem.

But how can that be reversed?

Well, I think there are a lot of things. There needs to be more
resources for public defenders … you know the problem is 95 percent
of the cases that go through the justice system involve people who
are indigent, and that’s a real problem. Because they can’t afford
representation. Public defenders are strapped. They don’t have enough
resources, and it’s a real problem.

Has the PATRIOT Act increased your workload at all?

It has and it hasn’t. It’s increased the workload because I’m
generally more suspicious of how evidence is obtained. But generally
the mitigation of those things is really on the periphery.

It’s the implementation of it that I think is a bit scary.

Moscow Court Opens Hearing In Race-Hate Group Trial

MOSCOW COURT OPENS HEARING IN RACE-HATE GROUP TRIAL

RIA Novosti, Russia
Dec 19 2007

MOSCOW, December 19 (RIA Novosti) – Moscow City Court is to begin
on Wednesday considering the case of eight defendants charged with
a series of race-hate bombings that claimed 14 lives in the Russian
capital in 2006-2007.

The most high-profile of the group’s attacks took place on August 21,
2006, when a bomb ripped through the multi-ethnic Cherkizovsky market
in the northwest of Moscow, killing 11 people, including two children,
and injuring over 40.

An investigation of the blast led police to the "Spas"
extreme-nationalist group, the leader of which is said to be a
25-year-old Muscovite, Nikolai Korolyov. The group waged a campaign
against "immigrants" and people of "non-Slavic appearance", and
operated under the cover of a martial-art club.

The alleged market bombers were detained on the day of the attack and
charged with premeditated murder on the grounds of ethnic and racial
hatred. The suspects later confessed that they had been motivated by
racial hatred, prosecutors said.

The group’s remaining attacks were carried out on a student hall of
residence, a cafe, a clinic, a Muslim community center, an amusement
arcade, the offices of the Russky Vestnik newspaper, as well as
shopping centers.

Apart from the bombings, a number of the defendants are also charged
with the murder of an Armenian student in the Moscow Metro in 2006.

The initial hearing is to be closed for the public. The defendants’
lawyer said that his clients would seek trial by a jury.

Russia has seen a wave of racially-motivated crimes since the collapse
of the Soviet Union in 1991. Routine attacks by skinheads and young
gangs on foreigners and people with non-Slavic features are a regular
occurrence. However, authorities have been generally reluctant to
treat the attacks as race-hate crimes, portraying them instead as
acts of hooliganism.

The Vremya Novostei daily recently expressed concern that leading
politicians are remaining silent over rising xenophobic trends in
Russian society, saying that, "Today when ‘the unification of the
nation’ is declared a priority, it would be politically inconvenient
to admit the obvious nationalistic sentiments in the country".

TER-PETROSYAN STANDS A GOOD CHANCE TO WIN, STEPAN DEMIRCHYAN SAYS

Lragir, Armenia
Dec 19 2007

The first president of Armenia Levon Ter-Petrosyan stands a good
chance to win the presidential election in February 2008, stated the
leader of the People’s Party of Armenia Stepan Demirchyan today.

"We witness the rating of the first president grow, and both
pollsters and NGOs point to that," Demirchyan stated. According to
him, Ter-Petrosyan’s main opponent in the presidential election will
be Prime Minister Serge Sargsyan.

"The nomination of the first president is going to be the main intrigue
of the upcoming election. This fact has already become an object of
political trade for many," Demirchyan said. He says his party will
support Ter-Petrosyan all through the election campaign.

Tariffs For Technical Inspection Of Transport Means To Be Establishe

TARIFFS FOR TECHNICAL INSPECTION OF TRANSPORT MEANS TO BE ESTABLISHED BY RA PUBLIC SERVICES REGULATORY COMMISSION

Dec 12 2007

YEREVAN, DECEMBER 12, NOYAN TAPAN. At the December 17 special session,
the RA National Assembly adopted in the first reading the bill on
establishment and reconsideration of tariffs for provision of services
on mandatory technical inspection of transport means.

According to the main speaker, the RA minister of transport and
communication Andranik Manukian, this legislative initiative of the
government is conditioned by the fact that starting from January 1,
2008, technical inspection of transport means will be carried out by
private companies. In order to exclude the possibility of establishing
unfoundedly high tariffs by these companies, the government proposes
that the RA Public Services Regulatory Commission should establish
the tariffs of provision of technical inspection services.

So far 31 companies (10 in Yerevan and 21 in marzes) have received
the right to carry out technical inspection of transport means.

Armenian School Urges Reconciliation Between Armenians And Azeris

ARMENIAN SCHOOL URGES RECONCILIATION BETWEEN ARMENIANS AND AZERIS

ARMENPRESS
Dec 17 2007

YEREVAN, DECEMBER 17, ARMENPRESS: A human rights school and 10 pools of
children at a Yerevan school named after a medieval Armenian doctor,
Mkhitar Sebastatsi, will be trying to identify ways to help Armenians
reconcile with their neighbors Turks and Azeris.

The project is part of Armenia-Turkey-Azerbaijan Dialogue program.

The event features a group of Azerbaijani experts, analysts and authors
who will discuss different subjects with Armenian children. The first
discussion held today was on the role of education in surmounting of
Armenian-Azerbaijani confrontation.

Ashot Bleyan, a former education minister, who is now the head of
the school, said the Armenian society should not neglect the issue
of reconciliation with its neighbors and establishing a lasting peace
in this region.

‘This program provides an opportunity for Armenian and Azerbaijani
citizens to get to better know one another," Ashot Bleyan said.

"We hope that time will come when Armenians and Azeris will travel
to one another’s countries freely and without obstacles. Our goal is
peace in the Southern Caucasus,’ said Sahib Babaev, head of Helsinki
Civil Assembly’s branch in Azerbaijan’s second largest town of Ganja.

All Azeris admitted to being surprised at the warm welcome they were
given here.

Sahib Babaev said a recent public opinion survey in his country has
revealed that 80 percent of his country fellows are against resumption
of hostilities for Nagorno-Karabakh.

He said the main goal of his visit to Armenia is not only to get to
know Armenians closer, but to also show that ordinary Azeris do not
want a new war.

BAKU: Members Of Azerbaijani Parliament Unhappy With Participation O

MEMBERS OF AZERBAIJANI PARLIAMENT UNHAPPY WITH PARTICIPATION OF LOCAL NGO REPRESENTATIVES IN THE WEEK OF AZERBAIJAN IN ARMENIA

Today, Azerbaijan

Dec 18 2007

A number of deputies have voiced discontent with participation of
representatives of local NGOs of Azerbaijan in the Week of Azerbaijan
held in Armenia.

Deputy Zahid Oruj announced that the representatives of Azerbaijani
NGOs, who are visiting the neighbor country, are famous for their
pro-Armenian position in our country.

"I can’t understand whose interests they will represent in Armenia
and how they will speak about the Azerbaijani culture and history",
he said.

He considers that the said people intend to carry out national
diplomacy over the head of Azerbaijani nation.

His colleague Azay Guliyev considers that such arrangements serve
only to the interests of Armenia. He substantiated his statement by
the announcement made by Vladimir Karapetyan, spokesman for Armenian
Foreign Ministry, which says that such arrangements prove Armenia’s
loyalty to the current peaceful talks.

"We can see once again that Armenians are not sincere in this issue
and use these events so that to present themselves as peaceful people
to the international community, which is not true, in fact", he noted.

According to A.Guliyev, if the event organizers really intend to help
the peacefull settlement of the conflict between the two nations, they
must declare their position regarding occupation of Azerbaijani lands.

What Was Oskanyan Delighted About?

WHAT WAS VARDAN OSKANYAN DELIGHTED ABOUT?

Armenia

The Armenian delegation led by Aram Gaspar Sargsyan has just returned
from Russia where the civil society and political activists and
members of parliament of Armenia, Azerbaijan and Nagorno-Karabakh
met in the framework of the Dartmouth conference. On December 14 Aram
Gaspar Sargsyan held a news conference and said that the meeting was
regress, mainly because the Azerbaijani delegation has changed its
stance on the framework agreement which had been worked out in the
previous meetings and included a peace settlement of the conflict.

Aram Sargsyan says there is no political resolution and it is possible
to solve the conflict only through a peace process. However, 90 percent
of the members of the Azerbaijani delegation have been replaced,
and their stance has become tougher, which is now based on the new
proposals by the OSCE Minsk Group co-chairs offered during the OSCE
conference in Madrid, which include return of territories without
defining the status of Karabakh, according to Aram Gaspar Sargsyan.

"The document about which Mr. Oskanyan was so delighted for whatever
reason only included the right for self-determination, the right
of the people for self-determination. If this is our greatest
achievement, I think it is not appropriate for the winner," says
Aram Gaspar Sargsyan. He thinks in this case Armenia should reject
the talks mediated by the OSCE Minsk Group because the options
under consideration are not pro-Armenian and are unacceptable. "No
territory can be returned for the simple reason that the Azerbaijanis
are reluctant to discuss the issue of the territories with regard to
the Armenian territories," Aram Sargsyan says, adding that they have
brought up the issue of Nakhidjevan for several times in the meetings
in Moscow.
