APPEAL COURT’S DECISION ON MATAGHISI CASE

Today Decision VB-176/06 on Mataghisi Case adopted by the Criminal
Chamber of the Armenian Appeal Court was sent to the Armenian
prosecutor’s office and appellants. According to this decision, the
first instance court and the review court violated several articles of
the Armenian Criminal Code resulting in major breaches in criminal
judicial law and affecting on the lawfulness of the judgment. The case
is submitted for further investigation. The court also set free the
three young men arrested with the accusation of murder on the belief
that their release will not impede discovery of truth.

Lord Russel Johnston Is Dissatisfied With The Work Of PACE Ad Hoc Co

LORD RUSSEL JOHNSTON IS DISSATISFIED WITH THE WORK OF PACE AD HOC
COMMITTEE ON NAGORNO-KARABAKH

Strasbourg, January 25. ArmInfo. The chairman of PACE Ad Hoc
Committee on Nagorno-Karabakh Lord Russel Jonhston has told ArmInfo’s
correspondent that he is dissatisfied with the committee’s work. He
said this after the committee’s meeting today.

He said that the committee members have had many meetings with the
sides in order to better understand them. At first, he planned to
invite the delegations to the meeting but they refused saying that
they had no experience. Johnston said that the Committee has decided
to monitor the sides’ mutual charges and has agreed to visit Armenia,
Azerbaijan and Nagorno-Karabakh.

At the same time, he noted that the compromise that will lead to the
settlement requires necessary public opinion, which is not the case
for the time being. The OSCE MG co-chairs keep saying that there is a
certain compromise but nothing has changed so far. Speaking about the
possible enlargement of the committee’s mandate, Johnston said that
the committee members live far from each other and find it hard to
coordinate their work. The volume of work requires that the committee
meet more often than four times a year, Johnson said.

YEREVAN, JANUARY 25, ARMENPRESS: A government meeting today
has approved release of 4.6 billion drams this year to back up
implementation of a plan of actions designed to improve the situation
of Armenian women and increase their role in the society.

The plan was started back in 2004 and is supposed to end in 2010. This
year’s allocation is up from 4 billion last year. Lala Ghazarian,
head of a labor and social affairs ministry in charge of women,
children and senior citizen issues, said this year the plan will
address health, educational and employment issues.

She said last year 60 percent of people who were offered jobs by
regional employment offices were women. Also 72 percent of unemployed
receiving allowances and 98 percent of those involved in different
training courses were also women.

*Goodbye Hrant, we are all Armenians

Tens of thousands of mourners gathered for a last farewell to murdered
journalist Hrant Dink in Osmanbey, one of the central districts of
Istanbul where he was shot in the head in front of his newspaper’s
office building, Agos.

Dink’s fame for his courage and integrity stretched way beyond the
Armenian community, whose rights he dedicated his life defending. His
murder has made him a symbol for most citizens of Turkey.

The organizers of the funeral deliberately banned political slogans
from the rally, as Dink, who had been subjected to various death
threats already, had expressly wished. Only leaflets bearing the slogan
"We are all Hrant Dink" and "Repeal Article 301" were circulated.

Dink, like many Turkish intellectuals, had been charged with "insulting
Turkishness" under the terms of Article 301 of the Turkish Penal Code
(TCK).

Although large, the funeral remained a strangely intimate affair.

Members of the Armenian community of Osmanbey, Bomonte and Sisli poured
in from the side streets along with famous intellectuals, actors and
media personalities. Police cordoned off the area, searching the bags
of all participants.

Television crew cables ran all along the building facades into
the apartments that offered the most advantageous view of the Agos
entrance, which was decorated with wreaths

Police presence at the initial stage of the rally was hefty but
discreet. A helicopter patrolled the skies above Osmanbey and several
green berets were stationed on the roof tops.

The speeches took place punctually and the melancholy sound of the
Duduk, the Armenian musical instrument, preceded the oration given
by Dink’s widow Rakel.

After a two-minute silence, a poet read a militant poem by Aydin Engin.

Rakel Dink gave an impassioned speech. Some chanting was heard from
the periphery against the "fascist state," but subsided immediately.

"Today we are here to raise a voice by our silence," she said.

As Dink’s widow gave her speech from the doorway of Dink’s newspaper,
Agos, the only noise that could be heard among the audience was the
sobbing of grown women and men.

"He left his wife, his daughters, his grandchildren and those who loved
him, but he did not leave his country," she said about her husband.

Rakel Dink also said, "Whoever the murderer is, whether aged 17 or
27 does not matter. I know they were babies once. But nothing can be
done without questioning what makes a baby into a murderer."

Dink’s bier was placed on the funeral car after Mrs. Dink’s speech,
and the cortege set off on the eight kilometer march that would lead
to first to the Armenian Church of the Virgin Mary, then to Dink’s
burial ground at the Balikli Armenian Cemetery.

Many of those not attending the demonstration because of work stood
outside their shops respectfully. A few were merely curious on this
sunny day. The staff stood in an orderly line outside of a Yapimerkezi
branch. "We have lived together in peace for so many years, this
murder must be a provocation," said Nihan, a shop assistant.

Many waved from the windows of the offices overhead; few as excitedly
as those thronging the windows of a second-story branch of the CHP,
Turkey’s main opposition party.

They were greeted with taunts from the crowd, "Fascists" and "Where
is your leader?"

Deniz Baykal, the leader of the CHP, was conspicuously absent from
the funeral.

"We are really sad, and these are not crocodile tears," Cafer Alchin,
told the TDN inside his office. "Connecting the murder to Article 301
is too simple," he said. The CHP has been accused of using nationalist
rhetoric and defends Article 301.

"We are here to mourn Hrant," said a demonstrator who was standing
outside with his girlfriend, "But we left him alone."

In the Armenian Hospital in Harbiye, Galip Atintepe, a senior surgeon,
was wearing a picture of Dink stapled to his chest. "I was born a
decade after the events of 1915 and I cannot feel guilty for something
I had no hand in," said Dr Altintepe, himself a Turk. He was referring
to the year the Armenians were forced away from Anatolia.

"Judges should think hard before indicting people on Article 301
charges. The police in Trabzon should be brought to task for failing
to track down the networks behind the murderers."

He said that his Armenian friends and patients felt that the French
and U.S. approaches to the Armenian "genocide" were ridiculous,
and that these were not the issues at stake.

The cortege proceeded to the Armenian church in Kumpkapi gathering
in numbers. Ohannes Menceshe, a 77-year-old Armenian who was standing
outside of the church, told TDN that conditions were dire for Armenians
in the 1930s and 1940s. He then addressed a group of Turkish children.

"We are not walking for Armenia," he told them. "We are walking
for you."

high but it will reduce with the improvement of economic situation in
the region, Russian President Vladimir Putin told a news conference
in Sochi. According to Putin, optimism grows. The conflict potential
is still great but unfortunately the most problematic issues have
not been resolved yet.

Putin assured that Russia will contribute to stabilization in the
Caucasus. "We will work at it and do our utmost to settle problems,"
he said, reports RIA Novosti.

PACE Approved Report, By Almost Solid Vote, On Fulfillment Of Commit

PACE APPROVED REPORT, BY ALMOST SOLID VOTE, ON FULFILLMENT OF
COMMITMENTS BY ARMENIA

Strasbourg, January 23. ArmInfo. The Parliament Assembly of the Council
of Europe has approved, by an almost solid vote: 32 votes "for" and
1 – "against", the report on fulfillment of commitments by Armenia,
presented by co-reporters Georges Colombier and Mikko Elo.

As ArmInfo special correspondent reports from Strasbourg, during
the debates on a draft resolution, the European parliamentarians
have highly appreciated the report quality and Armenia’s efforts in
fulfilling its commitments on the way of reforms implementation.

Nevertheless, the European parliamentarians noted that the monitoring
on fulfillment of commitments by Armenia will not be stopped, since,
in their opinion, "it is not enough to pass a law but also to assure
mechanisms for the law to function ". According to a Netherlands
parliamentarian, Leo Platvoyet, Armenia has made the first steps
forward on the way of reforming the legal system, the Electoral code
and granting of freedom to Mass Media. "However, still much is to
be done. Monitoring is not a punishment but a continuous process of
advising", L. Platvoyet said. Moreover, the European parliamentarians
underlined that adoption of this document is a preliminary examine
for Armenia, while the main examine will be a conduction of democratic
parliamentary elections in May, 2007.

In his turn, a French parliamentarian Francis Rochedloine, having
positively assessed the fulfillment of commitments by Armenia, noted
that despite the fact the Armenian state is very ancient, it has got
the independence only 15 years ago and it is unreal to require an
ideal compliance to the structure commitments. "As for the issue of
determining the status of Yerevan, the provisions of mechanisms of
election of the capital Mayor and other implemented reforms, France
had been working for two centuries to achieve the results Armenia
has achieved within 15 years of independence, and no one considered
the French Republic undemocratic", Francis Rochedloine.

ARMENIAN ENERGY MINISTER ATTACHES IMPORTANCE TO CONSTRUCTION OF
DEPOSITORY FOR DRY STORAGE OF USED NUCLEAR FUEL AT ARMENIAN NUCLEAR
POWER PLANT

YEREVAN, JANUARY 24, NOYAN TAPAN. In presenting the 2006 annual report,
the RA Minister of Energy Armen Movsisian underlined the importance –
among the implemented measures of program and strategic importance –
of the issue of constructing a depository for dry storage of nuclear
fuel used by the Armenian Nuclear Power Plant (ANPP) CJSC, as well as
the importance of implementation of measures on increasing the ANPP’s
security in cooperation with international donor organizations. The
minister also attached importance to the signing of a tripartite
agreement by Armenia, Iran and Georgia on construction of new 400 kv
electricity transmission lines.

In terms of encouraging the investment policy on energy saving and
renewable energy, the minister indicated the creation of the Energy
Saving and Renewable Energy Fund by the World Bank, the European Bank
for Reconstruction and Development (EBRD) and the Cafesjian Foundation
and the establishment of the Small Hydropower Plants Development Fund
with the assistance of KfW Bank (Germany). According to A. Movsisian,
in 2006, construction of Meghri-Kajaran section of the Iran-Armenia
gas pipeline was mainly completed. Gas supply of 78,221 individual
users was either installed or restored in 2006, as a result of which
the total number of users increased to about 443 thousand. 750.35
km of gas distribution lines and 1.17 km of main gas pipelines, as
well as 69 stations of electric and chemical protection were put into
operation again. According to the speaker, the process of improving
the legislative field on energy sector was continued in 2006.

Local Self-Government Elections Scheduled In 9 Armenian Regions’ 23

LOCAL SELF-GOVERNMENT ELECTIONS SCHEDULED IN 9 ARMENIAN REGIONS’
23 RURAL COMMUNITIES IN FEBRUARY

YEREVAN, JANUARY 22, NOYAN TAPAN. Local self-government elections are
scheduled in 9 Armenian regions’ 23 rural communities in February. NT
correspondent was informed about it from CEC Spokesperson Tsovinar
Khachatrian. Except the community head special elections to be held
on February 4 in the community of Rind, Vayots Dzor, the elections
of all other communities are regular. In particular, the same day
regular elections of community head are scheduled in the community
of Karmrakar, Shirak region.

On February 11, community head elections are scheduled in 5 rural
communities if Armavir region – in Berkashat, Geghakert (former
Samaghar), Dasht, Lernamerdz and Tsakhkunk. On February 18, community
head elections will be held in Ararat region’s community of Verin
Dvin, Lori region’s community of Ardvi, Shirak region’s community
of Bayandur. On February 25, community head elections will take
place in Aragatsotn region’s community of Geghadir, Gegharkunik
region’s community of Getik, Kotayk region’s community of Kaghsi,
Syunik region’s community of Kuris. The same day, councillor members
elections are scheduled in Gegharkunik region’s communities of Aygut,
Pambak, Geghamasar, Kakhakn, Shatjrek, Nerkin Shorzha, Syunik region’s
community of Karashen. Both councillor members and community head
elections will be held in community of Verin Sasnashen, Aragatsotn

Moscow, January 22, Interfax – Patriarch Alexy II of Moscow and
all Russia handed out several awards for distinguishing activity
in strengthening the unity of Orthodox nations in 2006, at Moscow’s
Christ the Savior Cathedral on Sunday.

The awards ceremony, now in its seventh year, was established by the
international foundation for the unity of Orthodox believers.

"This is both an appraisal of achievement and the public recognition
of deeds to strengthen spiritual ties between Christian communities
and states bound together by history," the patriarch said.

The prize has received recognition in every part of the Eastern
Christian world, he said, adding that "the highest Russian authorities
treat the prize winners with respect."

The prizes are awarded to a head of a local Orthodox Church, a head
of state, a public figure and a businessman.

Metropolitan of Warsaw and all Poland Savva received a prize for
his personal contribution to reviving Orthodoxy in Poland and the
overcoming of schisms in society.

Armenian President Robert Kocharian received a prize for his
contribution to the development of state-church relations.

The prize for the revival of shrines of the Russian Orthodox Church,
as well as Orthodox churches in other parts of the world, was awarded
to Russia’s Gazprom.

Sixth UN Secretary General Boutros Boutros Gali received a prize
for his personal contribution to the promotion of Orthodox spiritual
values.

The international award includes a cash prize, usually given to
charity.

Baku-Tbilisi-Kars railroad to initially carry 5m tons of freight

"Although the EU called Baku-Tbilisi-Kars railroad a political
project, many European States show great interest in this project,"
said TRACECA Azerbaijan National Secretariat Chief Akif Mustafayev.

He told the APA that Kazakhstan and China were interested in the
railroad, but hesitate to join now.

"This railway will be one of the arms of TRACECA in 2009. Armenia
will remain uninvolved in this project unless it frees Azeri lands,"
he said.

He added some 5 million tons of goods will be transported through the
railroad at the first stage while the capacity will be expanded to
10m to 15m tons later.

Azerbaijan allocated a loan of $220 million to Georgia for financing
of Georgian part of the railway line. The cost of the project is
$420m.
