Three Krekorian-Backed Bills Pass Senate
Head back to the Assembly then to Governor for his signature

BURBANK – Three bills authored by Assistant Majority Leader Paul
Krekorian (D-Burbank) passed the Senate this week and now head back to
the Assembly for a final vote before landing on the governor’s desk. The
bills, which received broad support, will increase consumer protections,
public safety and healthcare efficiency administration.

Assembly Bill 1319 – The Advance Fee Talent Scam Prevention Act will
protect consumers without inhibiting businesses who act in the best
interest of their clients. It requires talent services claiming to hold
"auditions" or claiming that successful artists have used their service
maintain supporting proof that the claims are true; in turn, that proof
must be made available to law enforcement for inspection and copying.
The bill also promotes consumer protection by requiring that all artist
contracts include a clear notice of cancellation and refund procedures
while prohibiting automatic renewal of terms without the artist’s
affirmative assent. The act will also curb bait-and-switch business
practices by prohibiting talent services from requiring clients to
purchase photographs, websites and other promotional materials as a
condition for using the talent service or for obtaining preferential
treatment from the talent service. The Senate floor vote Wednesday was
24-10.

AB 530 – The Safe Neighborhoods Act arms city attorneys and prosecutors
in the cities of Los Angeles, Long Beach, Palmdale, San Diego, Oakland,
and Sacramento with the authority to bring unlawful detainer actions
against weapons and drug offenders. This bill will also help landlords
who are intimidated from bringing eviction proceedings against tenants
engaged in drug-related crimes and illegal possession of weapons or
ammunition on the premises. The vote was 39-0

AB 952 – Approximately 1.6 million Californians receive their health
benefits from federally regulated "Taft-Hartley" health plans. AB 952
will provide Taft-Hartley plan administrators with the data they need to
administer those benefits smoothly and efficiently, but preserve
California’s strong patient privacy protections and ensure that benefit
data is not misused. The vote was 38-0.

Other Krekorian bills to be taken up this week include potentially
groundbreaking environmental legislation (AB 64), the Golden Shield Act
to honor slain public safety officers (AB 671) and the Financial
Assurances through State Timeliness Act (FAST Act, AB 548), which
quickens the reimbursement process for schools.

Promising its closest ally Azerbaijan that it won’t leave it in the
lurch, Turkey will try to press influential countries to let them
push for a swift development on the Nagorno-Karabakh problem between
Yerevan and Baku.

"To be able to turn this normalization [between Turkey and Armenia]
into permanent peace, we are expecting a forthwith settlement on
the dispute between Armenia and Azerbaijan with the contributions of
the international community," Foreign Minister Ahmet Davutoglu told
reporters late Tuesday.

As stated in the joint statement issued by Turkey and Armenia, under
Swiss mediation, the two countries will complete internal political
deliberation on the signing of the two protocols for the establishment
of relations within six weeks. Then two countries will have to complete
parliamentary ratification processes to let the protocols enter into
force. If there are no delays, the process is expected to be completed
before the end of this year or early 2010.

However, Turkey could face great difficulty if there are no
improvements on the Nagorno-Karabakh track. Turkey earlier assured
Azerbaijan that it would not open the border with Armenia if Armenian
troops do not withdraw from the occupied Azerbaijani territories.

Turkey has already launched a new diplomatic initiative for mobilizing
international actors in this regard, according to sources. Davutoglu
held a long phone conversation with the foreign ministers of France
and the United States, two members of the Minsk Group, tasked for the
settlement of the Nagorno-Karabakh issue. The issue was already largely
discussed with Russia, the third member of the Minsk Group. Davutoglu
will continue to discuss the issue with his counterparts on every
occasion, sources stated.

The issue will also be on the agenda of Prime Minister Recep Tayyip
Erdogan, who will attend the U.N. General Assembly late September. The
Foreign Ministry is trying to arrange bilateral meetings with the
United States, France and Russia with Erdogan. In any case, Erdogan
will be able to take the issue to the G-8 meeting in Pittsburgh at
the end of this month.

One of the short-term expectations is to let Armenia and Azerbaijan
agree on an interim agreement for the Nagorno-Karabakh issue. A meeting
between the leaders of the two countries is scheduled for Nov. 8
in Moldova during the summit of the Community of the Independent
States. Accompanied with this deal, Armenia’s decision to withdraw
from some surrounding regions of Nagorno-Karabakh will be a very
important additional step that would facilitate the reconciliation
process between the three countries.

Day of Knowledge at school No 6 in the city of Abovian was marked by
a festive event on the occasion of naming 8a class after the great
Armenian philanthropist Alex Manoogian. The decision to name 8a class
after the Honorary President of the Armenian General Benevolent Union
(AGBU) was taken by the council of pupils.

The pupils showed a play about the victory of good over evil. The
scene of the play accompanied by songs and dancing and presenting the
image of the Armenian benefactor Alex Manoogian was set in Western
Armenia. More than 20 pupils of the class named after A. Manoogian
vowed to remain true to Alex Manoogian’s cause and traditions. They
were congratulated by the pupils of 6b class after Garegin Nzhdeh.

The event was attended by the RA Minister of Diaspora Ms. Hranush
Hakobian who quoted Movses Khorenatsi’s words that the ignorance
established wickedness. She said: "The main character of our lesson
today is Alex Manoogian, who was a prominent representative of the
Armenian people and an embodiment of kindness". Speaking about Alex
Manoogian’s activities to the benefit of the Armenian nation, she
reminded that the great philanthropist funded the creation of numerous
schools, cultural centers, and churches in Armenian colonies worldwide.

Ms. Hakobian stated with satisfaction that the Ministry of Diaspora
has launched a series of events called "Great Armenians", with over
70 events being dedicated to Alex Manoogian. The initiative received
an enthusiastic response from many Armenian schools.

The minister said that the activities of Alex Manoogian should become
a guideline, "based on which and with the help of our kbowledge and
kindness, we should build our Homeland, bring the Homeland and the
Diaspora together, while Armenia should provide the greatest support
for the Armenians scattered around the world".

On the occasion of Day of Knowledge and in connection with the naming
of 8a class after Alex Manoogian, the headmistress of school No 6
Greta Kroyan and London-based teacher Lily Adamian made speeches. The
latter said that Alex Manoogian was well-liked in the Diaspora as well
because he helped all schools, regardless of what party or union had
founded them.

Member of the Great National Assembly of Turkey (TGNA) from the
National Movement Party (NMP) Å~^enol Bal commented on the statement
by Turkish Foreign Minister to start negotiations on establishing
diplomatic relations between Turkey and Armenia.

"The question of normalization of Turkey-Armenia relations have been
raised earlier. But the confusion in this matter which appeared as
a result of the reaction of Turkish society led to the fact that
Turkish Prime Minister Recep Tayyip Erdogan once again promised
in the Azerbaijani parliament that without resolution of the
Armenia-Azerbaijan Nagorno-Karabakh conflict, the border between
Turkey and Armenia will not reopen," Bal said.

"As for my opinion, I do not believe Armenia-Turkey relations will
be normalized without resolution of the Nagorno-Karabakh conflict
and Armenia’s renouncing claims of the so-called "genocide". I do
not believe this will happen," Bal added.

"But at the same time, I think, Turkey, who took large foreign
policy steps recently, faces outside pressure. Still, in recent days
Turkish Foreign Minister Ahmed Davutoglu promised that in any case,
the interests of our Azerbaijani brothers will not be infringed. We
will not accept a different foreign policy," the Turkish MP said.

"Naturally, our country must solve all problems with neighboring
countries. But this should not take place without taking into account
interests of fraternal countries. Besides, why should Turkey always
make concession?" she said.

Bal also commented on possible reaction of the Turkish Parliament to
the protocol, which will be sent to the Great National Assembly at
the end of six weeks.

"Once this happens, we will evaluate it and make appropriate
decision. Our party has a firm stand on this matter which we have
expressed and express now. Our stand is that the Karabakh conflict
should be resolved, that Turkey must not face claims of so-called
"genocide." We have talked about it and continue to insist on this. We
are interested in a document that will be sent to the Great National
Assembly of Turkey at the end of six weeks. I think since we have a
firm position on these issues approval of any document that does not
meet our stand is impossible."

Appeals panel ruling misinformed, lawyer involved argues

Washington – On August 20, a panel of the U.S. Court of Appeals
for the Ninth Circuit struck down a California law that allows the
descendants of Armenian Genocide victims to sue in state courts for
unpaid insurance benefits, as we reported last week. The majority in
the 2-1 ruling argued that the statute interfered with the president’s
prerogative to conduct U.S. foreign policy.

Vartkes Yeghiayan, a lawyer based in Glendale, Calif., has spearheaded
lawsuits against major U.S. and European insurance companies that did
business in Ottoman Turkey. These efforts led to settlements with New
York Life for $20 million and with the French AXA insurance company
for $17 million in 2004-2005.

On August 27 Mr. Yeghiayan discussed last week’s court ruling with
Washington Editor Emil Sanamyan.

Armenian Reporter: What is the meaning and what are the ramifications
of the ruling of the Appeals Court panel on August 20?

Vartkes Yeghiayan: We were surprised by this decision. The District
Court had previously ruled that this [lawsuit against German insurance
companies] is valid and that our clients have a right to continue
with the lawsuit.

When we got to the Ninth Circuit court [to which the insurance
companies had appealed], three judges listened to us, and two out of
three decided that there is a conflict between state and federal power.

This decision basically rested on the fact that the [California]
statute . . . said that the killings that took place [in Ottoman
Turkey] are called the Armenian Genocide; because the words "Armenian
Genocide" were used, [the majority found that] they were in conflict
with federal policy. . . .

We disagree with that. The federal government has never taken a stand
against the Armenian Genocide. And [as part of its decision making,]
the court did not [cite] any statute, executive order, or statement
saying that this [state law] interferes with the foreign policy of
the United States.

They are just speculating, and their speculation is drawn from the
fact that in the last decade there were three resolutions placed before
Congress and these resolutions didn’t pass because of opposition from
the administration.

But the administration did not dispute the validity of what resolutions
said. Rather they spoke of bad timing and impact on the war in Iraq
or whatever other developments were taking place at the time.

The arguments the court cited were only half-true. For example,
President Ronald Reagan used the term "Armenian Genocide," as did the
Congress in two resolutions that passed in the 1970s and 80s. And they
did not cite those facts at all, focusing on the last decade alone.

But our issue here is not with Turkey. We are suing private
insurance companies that owe money to Armenians and are in breach
of contract. But everything [in the court decision] seems to turn
around the words "Armenian Genocide." Had those "toxic" words not
been used in California legislation, the court would have no problem
with the statute.

AR: Has the federal government ever expressed opposition to the
California law?

VY: Absolutely not. In fact they have never objected to any of the
resolutions passed in the 40-odd states.

They have never formally made a statement. Apparently, they did
not feel those resolutions interfered with the conduct of foreign
policy. And it seems obvious to me [that they did not].

In making its decision the [Appeals] court cited past decisions in the
Jewish Holocaust cases [to deny the victims’ rights to sue]. But that
situation is different because there was a formal agreement between the
United States and Germany that said that [following German agreement to
pay reparations,] no additional lawsuits could be filed in U.S. courts.

[There is no such agreement in the Armenian case.]

AR: What could be the immediate consequences of this ruling? Do you
plan to appeal? Could there be new legislation passed in California?

VY: The first thing we will do is petition for a rehearing. And because
we only had 14 days to do that, we just requested an extension and we
were granted an additional seven days. So, our brief for a rehearing
will be filed on September 10.

Basically, we are asking for a larger panel of judges to listen and
review our arguments. It could be up to ten judges hearing the case.

If, for some reason, the judgment is not reversed, we will appeal to
the Supreme Court.

And, of course, we can amend our lawsuit and remove the words "Armenian
Genocide," while describing all of the killings, deprivations,
deportations, etc.

But first we will be appealing, because "Armenian Genocide" is the
appropriate term for the events that occurred and the U.S. government
does not have the policy that says that Armenian Genocide did not
take place.

In fact, I would like the U.S. government to come out and declare
its policy once and for all.

AR: As part of your petition do you plan to invite testimonies and
briefings from the state of California and other interested parties?

VY: Yes. We don’t want to make announcements yet, but we have asked
three organizations to file amicus briefs [as "friends of the court"]
and [we expect that] they will do it.

AR: What has been the immediate repercussion of the ruling so far?

VY: We have a separate case with the British insurance company Aviva
and the judge has just given us until September 12 to dismiss the
case because of the Ninth Circuit Court ruling. Now we are talking
with attorneys to see if we can stipulate the continuance of the case
or if we have to do a dismissal, make sure it is a dismissal without
prejudice, so that we could re-file the minute there is a new statute.

AR: Are you receiving public feedback following the ruling?

VY: Yes, we are hearing from a lot of lawyers and law-school professors
at some of the top universities, who see this ruling as part of a
pattern of continuous infringement by the federal government in powers
of the states. On most domestic issues, such as insurance, family law,
property, and tort, it is up to the states to regulate, and these
issues must not be affected by the rhetoric of federal officials.

I read the Turkish press and I noticed they are celebrating [this
ruling] and reading things into it that don’t exist. I don’t think
it’s a victory [for Turkey].

It’s an issue of balancing powers of the state and federal
governments. If necessary, we Armenians will be ready to pursue it
all the way to the Supreme Court.

Republic of Turkey have agreed to start their internal political
consultations on the two protocols – the "Protocol on the establishment
of diplomatic relations" and the "Protocol on the development of
bilateral relations" – which have been initiated in the course of
their efforts under Swiss mediation.

The two Protocols provide for a framework for the normalization of
their bilateral relations within a reasonable timeframe. The political
consultations will be completed within six weeks, following which
the two Protocols will be signed and submitted to the respective
Parliaments for the ratification on each side. Both sides will make
their best efforts for the timely progression of the ratification in
line with their constitutional and legal procedures.

The normalization of bilateral relations will contribute to the
regional peace and stability. The Republic of Armenia and the Republic
of Turkey are committed are pursuing their joint efforts with the
assistance of Switzerland.

Protocol on the Establishment of Diplomatic Relations between the
Republic of Armenia and the Republic of Turkey

The Republic of Armenia and the Republic of Turkey, Desiring
to establish good neighbourly relations and to develop bilateral
cooperation in the political, economic, cultural and other fields for
the benefit of their peoples, as envisaged in the Protocol on the
development of relations signed at the same day, Referring to the
obligations under the Charter of the United Nations, the Helsinki
Final Act, the Charter of Paris for a New Europe, Reconfirming
their commitment in their bilateral and international relations,
to respect and ensure respect for the principles of equality,
sovereignty, non-intervention in internal affairs of other states,
territorial integrity and inviolability of frontiers, Bearing in mind
the importance of the creation and maintenance of an atmosphere of trus
ntries that will contribute to the strengthening of peace, security and
stability of the whole region, as well as being determined to refrain
from the threat or the use of force, to promote the peaceful settlement

The Republic of Armenia and the Republic of Turkey, Guided by the
Protocol on the Establishment of Diplomatic Relations between the
Republic of Armenia and the Republic of Turkey signed on the same day,
Considering the perspectives of developing their bilateral relations,
based on confidence and respect to their mutual interests, Determining
to develop and enhance their bilateral relations, in the political,
economic, energy, transport, scientific, technical, cultural issues and
other fields, based on common interests of both countries, Supporting
the promotion of the cooperation between the two countries in the
inte pecially within the framework of the UN, the OSCE, the Council
of Europe, the Euro-Atlantic Partnership and the BSEC, Taking into
account the common purpose of both States to cooperate for enhancing
regional stability and security for ensuring the democratic and
sustainable development of the region, Reiterating their commitment
to the peaceful settlement of regional and international disputes and
conflicts on the basis of the norms and principles of international
law, Reaffirming their readiness to actively support the actions of
the international community in addressing common security threats

and energy infrastructure and networks between the two countries,
and to undertake measures in this regard; develop the bilateral legal
framework in order to foster cooperation between the two countries;
cooperate in the fields of science and education by encouraging
relations between the appropriate institutions as well as promoting
the exchange of specialists and students, and act with the aim of
preserving the cultural heritage of both sides and launching common
cultural projects; establish consular cooperation in accordance
with the Vienna Convention on Consular Relations of 1963 in order
to provide necessary assistance and protection to the citizens of
the two countries; take concrete measures in order to develop trade,
tourism and economic cooperation between the two countries; engage
in a dialogue and reinforce their cooperation on environmental issues.

3. Agree on the establishment of an intergovernmental bilateral
commission which shall compromise separate sub-commissions for the
prompt implementation of the commitments mentioned in operational
paragraph 2 above in this Protocol. To prepare the working modalities
of the intergovernmental commission and its sub-commissions, a
working group headed by the two Ministers of Foreign Affairs shall
be created 2 months after the day following the entry into force of
this Protocol. Within 3 months after the entry into force of this
Protocol, these modalities shall be approved at ministerial level. The
intergovernmental commission shall meet for the first time immediately
after the adoption of the said modalities. The sub-commissions shall
start their work at the latest 1 month thereafter and they shall work
continuously until the completion of their mandates. Where appropriate,
international experts shall take part in the sub-commissions. The
timetable and elements agreed by both sides for the implementation
of this Protocol are mentioned in the annexed document, which is an
integral part of this Protocol.

This Protocol and the Protocol on the Establishment of Diplomatic
Relations between the Republic of Armenia and the Republic of
Turkey shall enter into force on the same day, i.e. on the first
day of the first month following the exchange of instruments of
ratification. Signed in (place) on (date) in Armenian, Turkish and
English authentic copies in duplicate. In case of divergence of
interpretation, the English text shall prevail. For the Republic of
Armenia For the Republic of Turkey Timetable and elements for the
implementation of the Protocol on development of relations between

WB LOAN FUNDS TO REDUCE HARVESTING LOSSES UP TO 40 PER CENT

/PanARMENIAN.Net/ Additional WB funding, intended for the rural roads
reconstruction will help reduce harvesting losses to 40 per cent ,
Aristomene Varoudakis , the head of WB Yerevan office, told a press
conference on Monday. "The program will help farmers to reduce crop
losses up to 40 per cent on the way of delivering products to the
market, reduce transport costs, which will result in increased income,"
he said, adding that Armenia’s rural roads in the regions are in poor
condition, which result in significant losses in the economy.

The Executive Board of the World Bank on August 27 approved an
additional loan funds for Armenia in the amount of 36,6 million USD for
"Lifeline Roads Improvement Project". Credit funds will be provided at
the 25- year period, with a 10-year grace period with the crediting
rate Libor. Construction works, he said, will be launched in late
September 2009 and will be completed by November 2010. "Upon completion
of construction works about 140km of rural roads in seven regions of
Armenia will be repaired," the head of WB Yerevan office said.

Mr. Varoudakis stressed that the restoration of rural roads will
facilitate the creation of temporary jobs that will mitigate the
impact of the global crisis on the Armenian economy.

Armenians in the U.S. urge President Barack Obama to reject the recent
decision by the federal appeal court which prohibits the descendants of
victims of the 1915 events to file against foreign insurance companies
demanding payment of the unpaid insurance policies.

Armenian National Committee of America sent the letter to Barack Obama
expressing his indignation not only at this fact, but in general
administration’s policy regarding recognition of the "Armenian
Genocide."

"This is the official policy of executive branch of the United States
to actively oppose the recognition of this event and prevent adoption
of laws to help Armenians return their property," ANCA Chairman Ken
Hachikian said in a letter.

He recalled Obama has broken promises to recognize the "Armenian
Genocide" which he gave during the election campaign due to which he
gained support of the Armenian community in the United States.

Armenians of America also upset with the White House’s support for the
"road map" by Turkey and unprecedented pressure exerted on Armenia
by the U.S. State Department to create a commission of historians,
the idea promoted by Ankara for a long time.

Khachikyan insists on a private meeting to discuss these issues.
