McCain, Obama should help revive bill

High school students such as Arthur Mkoyan are an asset to this
country. He came to Fresno as a 2-year-old from Armenia and graduated
Tuesday from Bullard High School as valedictorian. He has been
accepted to the University of California, Davis, where he would like
to major in chemistry.

But there’s a catch. He’s about to be deported to Armenia, a country
he doesn’t know and whose language he hardly speaks.

Mkoyan (whose case is also discussed in Peter Schrag’s column today)
is among about 65,000 students — 25,000 of them in California — who
graduate from high schools each year in a similar situation: They were
brought here by their parents and have grown up here, but they are
prevented from a path to citizenship.

Mkoyan’s parents fled the old Soviet Union, but their appeals for
asylum ran out this year. Arthur’s father is being held at a detention
center in Arizona; his mother was released to care for the
children. Arthur’s U.S.-born brother, now 12 years old, is a
U.S. citizen.

Friends and family are urging Sen. Dianne Feinstein to introduce a
private bill to allow Arthur to stay in the United States. But this is
not just a private matter. This case shows why U.S. immigration policy
needs a fix.

Last year, Congress considered the DREAM Act, which would have given
temporary legal status to kids who arrived in the United States before
age 16, have lived here for five years, graduated from a U.S. high
school and have no criminal record. The bargain is that if they go to
college or join the U.S. military, they can get a green card within
six years — putting them on a path to citizenship.

But a filibuster killed it. Presidential candidates Sens. John McCain
of Arizona and Barack Obama of Illinois should revive that bill.
McCain originally was a co-sponsor. Obama, a supporter, said he would
"fight to bring this legislation back for another vote as soon as
possible."

Now is the time. Students such as Mkoyan have been trained here and
brought up as Americans. We should do everything we can to tap their
talents for the United States.

"My country is the country that began with separatism, and after we get
gained our independence, many separatists appealed to us for support;
sometimes we supported them, sometimes we didn’t," ingenuously said
the U.S. deputy assistant secretary of state Matthew Bryza in drawing
parallels between Kosovo and Karabakh in an interview with the Regnum
news agency.

Matthew Bryza who is the U.S. co-chair of the OSCE Minsk Group
actually confessed that the essence of the conflict is the following:
will they recognize the independence of NKR or not? In other words,
it does not matter how many arguments there are in the legal folder of
one side and how many weapons in the arsenal of the other side. The
problem is the attitude of great powers, if they want to recognize,
they will, if not, continue to confront.

With regard to separatism from which the United States and a lot more
other countries began, Matthew Bryza actually recognized the right of
the people of Karabakh for self-determination. However, the diplomat
asserts that the problem is not recognition but its consequences.

"There is an international legal principle of territorial integrity,
and that has developed in recent years since the early days of
my country.

It’s a principle we have to support, we are obligated to by law.

It’s only on an exceptional basis when we can deviate from that
principle. Kosovo was an exception; there was a series of Security
Council Resolutions, and direct UN action, in the case of Kosovo
that made that situation different, made it unique in terms of
international law, because it is the UN and its Security Council that
are the highest purveyors of international law," Matthew Bryza said.

In a recent Baku-Moscow-Yerevan telebridge the director of
the Caucasian Institute also noted: "The Karabakh conflict is
political, and its solution should be sought in the political
sphere." Nevertheless, the Armenian, Azerbaijani and Russian political
scientists long discussed which party’s arguments are forceful.

For his part, the Armenian foreign minister Edward Nalbandyan
stated yesterday that the efforts of the Armenian side are aimed
at the recognition of the right of the people of Karabakh for
self-determination. Considering the pronouncements of the mediators,
nobody has been disputing this right for a long time now. And the
question occurs whether it is not time to direct the efforts of the
Armenian diplomacy at the solution of another problem.

Armenia has already spoken for the complete participation of the
self-declared "Nagorno Karabakh Republic" as a party of talks on
the resolution of Nagorno Karabakh conflict, said Armenian Foreign
Minister Edward Nalbandyan.

"It is wrong to say that Nagorno Karabakh does not take any part
in the talks, as during the visit to the region, the OSCE Minsk
Group co-chairs also meetr with the leadership of "Nagorno Karabakh
Republic". I do hope that during the coming meeting the chairmen
will meet with the leadership of Nagorno Karabakh", said the Minister
Wednesday.

The OSCE Minsk Group co-chairs will visit the region in the last week
of June.

The Minister informed that the Armenian leadership, which holds talks
with Azerbaijan, holds consultations with Nagorno Karabakh, discussing
principles and approaches of the conflict resolution before and after
the talks.

"The sooner Nagorno Karabakh is involved to the negotiation process,
the better. Yet, definite terms should not be set. If it depended on
Armenia, Nagorno Karabakh would become a party of talks in the near
future, but everything also depends on Azerbaijan’s position". said
Nalbandyan.

Official Baku believes that the European Union (EU) should address
"a sharp statement" to Armenia over the Nagorno Karabakh conflict.

"It would be better for the EU to make open statements to the opposite
party in order to restore peace and stability in the region," Khazar
Ibrahim, the spokesman for the Foreign Ministry of Azerbaijan, said
when commenting on France’s chairmanship in the EU.

Azeri political experts believe that France’s chairmanship in the EU
will not accelerate peace talks and settlement of the conflict.

"Presently, the EU can not be actively be engaged in the Nagorno
Karabakh conflict settlement process as Russia do not provide a
possibility for it," said Vafa Guluzade, former adviser to the
Azerbaijani president on foreign policy.

"Neither France nor European Union have any opportunity to seriously
influence the settlement process. Besides, the Nagorno Karabakh
conflict has not been solved yet though the chairmen of OSCE and
Council of Europe, and EU representatives on conflict were changed
more than once. Therefore, France’s chairmanship in the EU and
co-chairmanship in the Minsk Group will not influence on settlement
talks," Guluzade said.

Another expert Hikmat Hajizade stated that the United States and Russia
should reach to an agreement to solve the Nagorno Karabakh conflict.

"EU does not have any leverage on Russia. Therefore, EU chairmanship
of France will not influence the settlement of Nagorno Karabakh
conflict. The problems of Russia should be solved first of all for the
settlement of the conflict," he said, Trend Azeri news agency reports.

"Of course I wouldn’t like any political speculations over my quitting
Dashnaktsutyun party. Because I held and continue holding the viewpoint
that Dashnaktsutyun is one of our national values; it is one of the
values of our political thought. It existed in the past, exists today
and will exist in future. No divergence of opinions is possible in this
regard. At least as far as my personality is concerned, I really can’t
imagine our political thought without Dashnaktsutyun. I possibly can’t.

It’s quite a different matter that there is a certain disagreement
with the present-day leadership of the party in terms of political
attitudes. And this has caused us to be represented in different camps
now," former parliamentarian ROUBEN HAKOBYAN announced in "Pastark"
(argument) club yesterday.

In response to the question what disagreements he had with
Dashnaktsutyun, the speaker said, "Dashnaktsutyun would have a
better representation if it didn’t form part of the coalition. Our
political arena would be more balanced if Dashnaktsutyun weren’t a
coalition party."

What is, after all, the former RA Consul in St. Petersburg going to
do after returning to Armenia? R. Hakobyan has nothing to hide because
as a public figure, he is going to be engaged in active politics. But
already in the status of a non-partisan. And in general, he rules
out the possibility of becoming a member of any party.

Mr. Hakobyan informed that a political-analytical center will soon be
registered with the relevant state agency by his initiative; the centre
will be engaged in political analyses and issue publicistic articles.

Touching upon the internal political problems, the speaker again
insisted on his well-known proposal as the only variant for overcoming
them.

R. Hakobyan believes that, "the post-electoral struggle is not
over yet.

Both the state of emergency and the subsequent developments did not
contribute to the internal political arena to overcome the tension." As
regards the "wondering subject", i.e. the dialogue, "unfortunately it
did not descend from the heaven; it did not become a reality. In my
deep conviction, the reason was that neither of the parties actually
had a sincere desire to have a dialogue with the other."

Although the lack of desire is obvious, there is one "plane" which, if
made available, may enable the parties to start a dialogue. R. Hakobyan
makes the following conclusion-prediction: "The plane on which L.

Ter-Petrosyan and the authorities may have a dialogue is, in my
opinion, being sketched. That is, finding one culprit who will meet
the requirements of the two parties. It looks as though this culprit
were Robert Kocharyan, as the former President. And it looks as though
this might enable the parties to start a dialogue.

Why? Because during the pan-national congress they dropped a very plain
hint that the President had nothing in common with the March 1 events."

Substantiating his conclusion-prediction, the speaker also noted,
"I don’t think any representative of the authorities would be against
this scenario."

Despite the prediction, the author believes that considering
R. Kocharyan responsible for and guilty of all this is not a requisite
condition for initiating a dialogue "so as it would be possible to
make an accurate assessment on the existing situation and enable the
state to overcome the tension through a dialogue."

So, there is one way out. "To organize extraordinary presidential
and parliamentary elections and hold them no sooner than in a year
and no later than in half a year."

YERE VAN, JUNE 11, NOYAN TAPAN. On June 11, the RA National Assembly
with 84 votes for, 6 against, and 1 abstained adopted the bill
authored by parliament Speaker Tigran Torosian, which envisaged making
amendments and addenda to the law On Holding Meetings, Gatherings,
Marches and Demonstrations. The members of the Zharangutiun (Heritage)
faction and independent deputy Viktor Dallakian voted against.

The requirement of Venice Commission’s reconsidering the amendments and
addenda made to the law by NA on March 17, under state of emergency,
was also stipulated by well-known Resolution N 1609 adopted during
the PACE spring session.

After the voting the parliament continued the discussion of draft
decision On Creating an Ad Hoc NA Commission for Study of Events in
the City of Yerevan and Their Reasons that started the day before. The
draft decision proceeds from another demand of the above mentioned
Resolution. According to it, the tasks of the commission to be
created will be to clear up the used violence, as well as legality
of Police actions, circumstances of death of perished people, to
present proposals on political, legal, and other solutions excluding
recurrence of such events.

The commission will be formed from two deputies from each NA faction
and one deputy not included in them. The commission will also
have a right to involve proper specialists and experts, including
international ones, as well as will send an invitation to Levon
Ter-Petrosian and extra-parliamentary political forces to be determined
by the commission to take part in its proceedings with the right of
consultation vote. The commission is to report about the results of its
activity until October 25 at the NA sitting by presenting a conclusion.

Press Secretary of RPA Eduard Sharmazanov told ArmInfo he had urged
radical opposition to think of state interests.

Sharmazanov said the steps taken by President of Armenia after
the unrest in March will be positively evaluated, first of all, by
the Armenian public and than by PACE. ‘Armenia is a member of CE
and we ought to be guided with the rules we adopted when joining
the organization. What we do we do to meet our interests’, he
said. Sharmazanov believes it impossible to fulfill the requirements
of PACE Resolution ‘On function of democratic institutions in Armenia’
within such short period of time. ‘The authorities, in particular,
President Serzh Sargsyan has political will to fulfill the requirements
