TURKISH GOVT. TOPS GOOGLE LIST FOR CONTENT REMOVAL REQUESTS

PanARMENIAN.Net – In stark comparison to 2011, the Turkish government
submitted 501 requests to Google for content removal in the first half
of 2012, whereas it filed only 45 requests during the previous period,
according to Google’s most recent Transparency Report. Hurriyet Daily
News says that according to the newly-released report, the total number
of content removal requests issued to Google Services by governments
around the world rose from 1,048 to 1,791 in the first period of this
year. Among Turkey’s long list of removal requests, critical content
pertaining to official authorities and pornographic content are seen
as the two main reasons behind the government’s requests. The United
States follows Turkey on the list with 273 requests for removal,
up from 187 in the last period. After publishing their sixth report
on the issue, Google’s Transparency Report alleges that “government
surveillance is on the rise,” adding that government demands for user
data have increased significantly since the first report was issued.

The World’s largest search engine said, independent from the number
of requests it receives, Google may choose not to respond positively
to a government’s request for content removal.

Mher Vardanyan, the mayor of Jiliza, a rural community in Armenia’s
northern Lori Province, still hasn’t given up hope that a border
crossing will open, ushering in some much needed development.

“There’ll be some traffic going through here when the border crossing
is set up,” says Vardanyan.

Hetq had spoken to Vardanyan a year ago on the same issue. Back then,
the mayor was convinced that Georgian authorities were delaying
the opening.

The border crossing and a resolution of the Khorakert church complex
located between Jiliza and the Georgian village of Chanakchi depends
on a delineation of the Armenian-Georgian border in this region.

Last year, Armenia’s Foreign Ministry told Hetq that it had reached a
preliminary agreement with Georgia on the delineation of 160 kilometres
of the total 225 kilometres of border.

The remaining 65 kilometres includes the villages of
Bavra and Khozhorni, a small section near Jiliza and the
Akhkyorpi-Chanachi-Brdadzor area.

A week ago, Hetq sent a written request to the foreign ministry
asking if there had been any progress since last year. We still
haven’t heard back from them.

Forty families live in Jiliza. Mayor Vardanyan told us that this year
there had been seven deaths in the village and two births. Vardanyan
boasted that one of the newborns is his grandchild.

The village’s socio-economic situation is in a rut. The only
positive change has been a new playground built by the World Vision’s
development center in Alaverdi.

16 months into his term as Lori Regional Governor, Artur Nalbandyan
hasn’t even visited Jiliza to get a firsthand look at the village’s
problems.

The annual budget of Jiliza is 4 million AMD, of which 3.5 million
is state subsidies. It’s just not enough to fix the roads and assist
families in need.

There’s also a question of public transportation. There’s only one
bus a week from Jiliza to the town of Vanadzor.

School enrollment in Jiliza decreases from year to year. There are no
first, second, third or sixth grades. “There was one child scheduled
for enrollment in the first grade, but the family moved away,” says
Mayor Vardanyan.

The school doesn’t instruct students in English, Russian or math
because it doesn’t have the teachers. The village has no kindergarten.

It doesn’t need one because there are no children of kindergarten age.

No one engages in farming in Jiliza; it’s mostly tending livestock.

The St. Mariam Astvatsadzin Church is in ruins. It was blown up by
the Soviet authorities in 1932 and the stones were used to build barns.

There’s only one store in the village; a tiny grocery.

While Jiliza seems to be under the radar of the government in Yerevan,
Georgia actively pursues a policy of hindering any contact between
Armenian villages on either side of the border.

Senator Collomb in the recognition of the Armenian Genocide and the
development of Yerevan-Lyon relations. The President of the Republic
of Armenia said that he is confident for the continuous development of

Lettre d’un journaliste turc en prison

L’auteur*, emprisonne – comme 75 autres journalistes turcs – depuis
deux ans, nous ecrit depuis sa cellule d’Istanbul cette lettre,
transmise par sa femme, alors qu’il doit etre juge le 16 novembre pour
“complicite de complot”.

Voici mon crime, ma faute : poser des questions, chercher la verite
et ecrire

J’ecris de ma cellule où la lumière reste allumee 24 heures sur 24,
où les coupures d’eau durent 17 heures, et où je suis surveille
constamment par deux cameras. Pour tenir, je me repète a voix haute
ces mots : ” Y a-t-il quelqu’un dehors ? ” Je suis detenu depuis deux
ans dans l’attente d’un procès dans la prison de Silivri a Istanbul.

Je ne sais pas combien de temps la procedure va encore durer, mais
je sens deja que je suis condamne a etre oublie. Tout cela parce que
j’ai commis une faute majeure, celle de penser et d’etre journaliste.

Je m’appelle Soner Yalcin. J’ai 47 ans et je suis journaliste depuis
vingt-cinq ans. Je collabore ou dirige des supports mediatiques en
Turquie depuis toutes ces annees, dans la presse ou a la television.

J’etais entre autres l’un des chroniqueurs du grand quotidien Hurriyet,
” Liberte “. J’ai ecrit douze livres, dont beaucoup se sont vendus a
plus de cent mille exemplaires. Je suis le proprietaire et fondateur
d’un site Internet qui s’appelle OdaTV.com. Pendant toute ma vie
professionnelle, j’ai enquete sur l’histoire recente de mon pays,
ecrit sans repit sur les meurtres irresolus de personnalites
politiques ou journalistiques, sur les mafias, les gangs, les
organisations illegales agissant a l’interieur de l’Etat, et les
factions religieuses extremistes.

J’ai recu des menaces de mort a cause de mes textes et articles. J’ai
dû me cacher pendant des mois tout en continuant a dire la verite.

J’ai temoigne devant la Cour europeenne des droits de l’homme et
des commissions de l’Assemblee nationale turque qui enquetaient sur
les liens entre la mafia et le gouvernement. À part des associations
professionnelles de journalistes, je n’ai jamais ete membre d’un parti
politique ou d’une quelconque organisation. Je suis reconnu comme
journaliste independant et non comme militant. Malgre tout cela,
je croupis en prison parce que je suis accuse d’etre membre d’une
organisation ” terroriste ” appelee Ergenekon, avec laquelle je n’ai
rien a voir. Les procedures ne sont toujours pas achevees après cinq
ans d’instruction.

Qu’ont-ils comme preuve contre moi ? Des documents classes ” secret
defense ” soi-disant decouverts sur les ordinateurs d’OdaTV en
format Word. Ces documents ne nous appartiennent pas. Ils ont ete
sciemment places la par un virus exterieur. Nous l’avons prouve avec
mes avocats par une serie d’expertises : celles de trois universites
turques differentes et d’une societe americaine specialisee dans le
cybercrime. Nous pensons qu’une organisation religieuse associee aux
services de police se trouve derrière cette machination.

En fait, les 134 pages de mes interrogatoires revèlent bien ce qui est
le sujet de cette procedure a mon encontre : le mot ” information ” est
repete 361 fois dans l’acte d’accusation, ” livre-ecriture ” 280 fois,
” chronique ” 53 fois, ” interview ” 26 fois et le mot ” article ”
5 fois ! Il n’y a aucune mention d’arme, de bombe ou de meurtre dans
cet acte. Durant mes interrogatoires, les seules questions que le
juge m’a posees etaient : ” Pourquoi avez-vous ecrit sur ce sujet ? ”
” Pourquoi avez-vous publie cet entretien ? ” Rien d’autre. Voici mon
crime, ma faute : poser des questions, chercher la verite et ecrire.

En d’autres termes, mon erreur fut de faire mon travail. Mes
confrères et consoeurs de Turquie savent très bien que l’on m’a mis
en prison pour me faire taire. Malgre cela, la plupart d’entre eux
savent que s’ils ecrivent a ce propos, ils risquent d’etre renvoyes
ou meme arretes a leur tour. C’est pourquoi je vous ecris cette
lettre. Dans mon pays, les opinions sont toujours percues comme un
acte de malveillance. Je vous ecris cette lettre car vous etes mon
” partenaire en crime “.

Nous avons appris de vous les Lumières, la liberte d’expression et
le rationalisme. N’etes-vous pas Erasme, Descartes, Montesquieu,
Voltaire, Rousseau, David Hume, Kant, Marx, Weber, Sartre et Camus ?

N’etes-vous pas Zola qui est reste au côte de Dreyfus ?

Chers amis, oui, vous etes bien mes partenaires en crime. Je vous
invite a agir. Montrez s’il vous plaît que je ne suis pas seul et que
je ne vais pas etre oublie. Soyez ma voix, soyez ma plume ! Abattez
ces murs construits sur le mensonge. Autrement, dans ma prison,
cette cellule etroite où j’ai ete place en isolement pour me faire
perdre ma dignite humaine, je cherche la terre, le ciel, les fleurs,
les arbres, et mon fils qui a maintenant douze ans. Je vais continuer
a dire a voix haute : ” Y a-t-il quelqu’un dehors ? ”

fabrications de preuves, les articles diffamatoires dans les medias,
les reports d’audience pour mille et une raisons, les intimidations,
les acquittements et les appels de la Cour de Cassation. Torturee et
emprisonnee en 1998, Pinar Selek est depuis la cible d’un acharnement
politique et judiciaire qui tente de la detruire, de la reduire
au silence.

Pourquoi ?

Nombreux sont les enjeux autour du symbole qu’est devenue Pinar Selek
et ils sont pour la plupart obscurs, bases sur les rapports entre les
forces politiques et militaires, entre les gouvernements successifs
et leurs groupes d’appui souterrains.

En 2002, l’AKP arrive au pouvoir avec l’intention proclamee de resoudre
la question kurde. Aujourd’hui, alors que l’AKP entame son 3ème mandat,
14 000 intellectuels, principalement kurdes, sont en prison, la guerre
s’intensifie et les positions se durcissent. Le gouvernement s’enlise
dans la guerre, incapable de tenir ses promesses de paix.

Alors qu’on pouvait penser que ce gouvernement mettrait fin
a l’acharnement contre Pinar Selek, il semble que les nouvelles
alliances dues au durcissement du conflit jouent en sa defaveur.

Les guerres ont besoin de symboles et de mensonges.Tous ceux qui
tentent de s’y opposer, d’analyser les positions des uns et des autres

C’est dans ce contexte que la prochaine audience du procès de Pinar

Much has been written on the legal aspects of my lawsuit against the
Arab Salach clan that infiltrated and squatted on my land in Givat
HaMatos in southern Jerusalem and didn’t leave until forced to,
about 20 years later.

But much less has been written about the most miraculous manner in
which I won the case!

I imagine that it is impossible to really comprehend the emotional
turmoil that this court case of illegal trespass has caused me.

However, in the end, the events showed that Eliyahu HaNavi, Elijah the
Prophet’s hand was guiding me! It is otherwise impossible to explain
the miracles that occurred to help me prove that the property was
mine and that the Salachs were lying brazenly.

Underlying the entire mystery is the totally incomprehensible fact that
this simple trespass case took nearly 20 long years to be solved….

Misinterpreting Chazakah A major hurdle that I faced is the fact that
when someone has possession – a chazakah – this causes him to believe
that he actually owns the object in his posession. This is of course
not necessarily correct. But the law of chazakah is in fact vague and
easily misunderstood; there are many interpretations of this law of
possession as ownership.

Therefore, when the Israeli Police did not take firm action to take
the Salach trespassers off my property, despite my repeated demands,
the Salachs became accustomed to the idea that they were there, that
they could not be taken out, and that the property was theirs. Even
when I showed the police my proof of ownership – proof of purchase
from M.G., a Jew from California – the police did nothing to get the
Salachs out, strengthening their distorted understanding that the
property was theirs.

In short, the police did not know the law of possession and ownership,
and therefore they could not enforce it.

My work was thus cut out for me: To prove my ownership, against
their possession.

I knew the history of the property and the chain of title to it.

However, I was missing one link to prove that I was and am the latest
and current owner, and they were not.

The judge had formed a strong opinion from the very beginning, after
hearing the testimony of the “Queen Mother” Salach. She testified
that she had given the original Armenian owner a huge amount of money
as a loan, with the property as security. In the end, the Armenian
died without paying back the loan, and so, she claimed, the property
belonged to her family because of the default on the loan.

The judge also heard my testimony, as the legal owner of the property,
according to the records. As mentioned, I had purchased the property
from M.G., who had bought it from the Armenian.

The judge then took both lawyers into his chambers and told them
of the decision he intended to give: The money the Salach clan gave
the Armenian amounts to key money, and therefore he would rule that
they cannot be evicted. However, he said, because the property was
registered in my name, I am the legal owner – and therefore the case
should be negotiated for a settlement. He said that this is what we
must do, and that he was taking the case off his calendar.

The situation was thus as follows:

· The Salach clan had nothing to lose by staying put and enjoying
the property while the case is no longer being adjudicated.

· I, on the other hand, who initiated the law suit and who had to
suffer the loss of my legally-bought property, knew in my heart that
they were lying about this loan; I knew that the document they brought
as proof was a forgery. But how could I prove that the Armenian’s
“signature” was forged?

I was determined to fight this case and win, and find a way to show
that the Armenian had not agreed to give his property – which he
later sold to M.G. – in lieu of paying off his loan.

I pressured to have my claim returned to the court calendar, while the
Salachs tried all the tricks in the book to ensure the opposite. In
the end, more than a year after it was removed from the calendar,
it was restored. I would not have to negotiate with those who stole
my property!

Salvation Begins From the Air

The start of my salvation came when the City Manager for Arab Affairs
suggested I find an expert in aerial photography. I found one who
had over a half-million aerial photos; his business was to take such
photos of every square inch of Jerusalem many times per year – ever
since 1966.

The Salachs claimed that they lived in my property since 1966. I asked
the photographer for his pictures of the site, and we found that the
house – which had been bombed during the Six Day War in 1967 – was
uninhabitable. Its roof was caved in, and part of a wall was missing.

However, a photo from 1984 showed something very critical: For the
first time, there was a tent not far from the ruined house! Apparently
the Salachs put it there so they could live in it – in 1984, not 1966,
as they had claimed! They also put up a corral to keep their sheep
just outside of the house near the fence.

In short, the house was in ruins all those years, so it could not
have been inhabited.

Testimony of David Dovid

David Dovid, a senior Israel Lands Authority employee, testified at
the trial. He knew the story of the Salach squatters through his work.

He testified that the Salach clan did not come to the Givat HaMatos
area until around 1982. He told the court that at that time, the
Salach clan had their eye on buying the property, and had asked him
who the owner was.

Is this not a clear proof that they knew the property was not theirs?

Attorney Eitan Geva

Now comes the most miraculous part of the story.

Someone suggested I meet Atty. Eitan Geva, who had worked as a lawyer
from before 1948, including in purchasing lands from Arabs for the JNF
(Jewish National Fund). He was expert in this entire area of lands.

He told me to bring my entire file, and when he looked at it, he
saw that the name of the man who had power of attorney to transfer
ownership from the Armenian to M.G. was very familiar to him. He
remembered that it was the same person who had once given him (Geva)
theoriginal ownership deed of the property in question! (Why did he
give it to him? Because the Armenian wanted Geva to find a buyer for
the property.)

In other words, we had an amazing discovery! Geva had a document with
the original, notarized signature of the Armenian – and the signature
could be compared to the signature on the Salachs’ “loan” document.

It must be emphasized that my search for original documents had hit a
dead end. This, because all the records in the Hall of Records had been
destroyed by the Irgun in their fight against the British for a Jewish
State. The building that held the records of property ownerships had
been fire-bombed and all the records were destroyed. By now finding
this signature of the Armenian, I could show that the loan document
of the Salachs was totally bogus.

It turned out, in fact, that the signatures were very different. The
original was clear and legible, while the bogus one was barely
readable.

[Later, a handwriting expert testified at the trial that the “loan”
signature was nothing more than a forgery – and this helped restore
my property to me.]

The way I see things, presentation of evidence that is a forgery is
a criminal offense. I now ask why the State of Israel does not and
did not prosecute the Salach clan for doing so?

The finding of the original deed was a miracle that proved to me
that the hand of Eliyahu HaNavi helped me in my fight for justice in
Jerusalem. Thank you Hashem!

The Azerbaijani parliament must protest against recent statements
of Uruguay’s MP and his illegal visit to the Azerbaijani occupied
territories, Azerbaijani MP Ganira Pashayeva said at a plenary session
of the Parliament today.

“The Uruguay’s MPs actions show disrespect towards the Azerbaijani
people,” Pashayeva said. “They are contrary to international
standards and have a negative impact on the settlement of the
Armenian-Azerbaijani Nagorno-Karabakh conflict. The Foreign Ministry
is taking the necessary measures. However Parliament must lodge a
protest to Uruguay’s leadership.”

Uruguay may become the first country which recognises the independence
of the separatist Nagorno-Karabakh, head of the Armenian-Uruguayan
inter-parliamentary friendship group and member of the Committee on
Foreign Relations of Uruguay’s Parliament Ruben Martínez Huelmo said
in Khankendi, ARKA reported.

The conflict between the two South Caucasus countries began in 1988
when Armenia made territorial claims against Azerbaijan. Armenian
armed forces have occupied 20 per cent of Azerbaijan since 1992,
including the Nagorno-Karabakh region and seven surrounding districts.

Azerbaijan and Armenia signed a ceasefire agreement in 1994. The
co-chairs of the OSCE Minsk Group – Russia, France and the U.S. are
currently holding peace negotiations.

Armenia has not yet implemented the U.N. Security Council’s four
resolutions on the liberation of the Nagorno-Karabakh and the
surrounding regions.

RinkÄ”viÄ~Ms will pay an official visit to Armenia on November 14-16.

Within the framework of his visit, Edgars RinkÄ”viÄ~Ms is scheduled to
meet with Armenian Prime Minister Tigran Sargsyan, National Assembly
vice speaker Eduard Sharmazanov and his Armenian counterpart Edward
Nalbandyan.

Edgars RinkÄ”viÄ~Ms will also deliver a speech at the Diplomatic
School of the Armenian Foreign Ministry.

Latvian Foreign Minster will also visit the Memorial of victims of
the Armenian Genocide.
