A SLAP ON THE FACE ISN’T A CRIME, SAYS SIS IN CASE OF FEMALE ENTREPRENEUR SLAPPED BY SYUNIK MARZPET

The RA Special Investigative Service (SIS) has concluded its
investigation into an incident involving entrepreneur Silva
Hambardzumyan, who asserted that Syunik marzpet (regional governor)
Suren (Surik) Khachatryan hit her in a Yerevan hotel on Nov. 14,
reads a statement issued by the RA Special Investigative Service today.

Recall, criminal proceedings were launched under battery charges
(RA Criminal Code Article 118).

“During their dispute on Nov. 14, 2011, in the Armenia Marriott
[Hotel] cafe, the marzpet hit (slapped) Silva Hambarzumyan once
with his hand. This fact was based on evidence acquired during the
investigation, including witness testimonies and video footage,
which was seized and enclosed in the criminal case.

“According to Silva Hambardzumyan’s testimony, she didn’t receive
bodily injuries from Surik Khachatryan’s slap and she refused a
medical report, while Suren Khachatryan in his testimony said that
he regrets what he did,” reads the statement.

The investigation determined that the pair had been on unfriendly
terms for a long time and came to the conclusion that the marzpet’s
actions did not constitute battery (a criminally punishable offense)
per se. Thus, the SIS decided to dismiss the case.

Recall, on Nov. 10, Hambardzumyan charged that a mining company owned
by Khachatryan misappropriated mining equipment worth more than 100
million drams ($265,000 USD) from a mine belonging to her. Later,
in an interview with local daily Haykakan Jamanak, the entrepreneur
said that Khachatryan, through intermediaries, promised to transfer
his debt to her account by Dec. 15.

jours. Le quotidien Milliyet dénonce ces pratiques, contraires à la
démocratie et à la liberté d’expression.

Les libertés fondamentales et les droits de l’homme ont été
constamment bafoués chez nous sous prétexte de lutte contre le
communisme, le fondamentalisme musulman, le séparatisme [kurde] et le
terrorisme. Et ils continuent de l’être. La liberté d’expression est
l’une des conditions indispensables à l’instauration d’une véritable
démocratie. Si la Turquie est encore aujourd’hui une démocratie de
seconde zone, c’est principalement parce que cette liberté y est
entravée. En s’appuyant sur plusieurs articles du code pénal, l’Etat a
pendant des années sanctionné durement et envoyé derrière les barreaux
écrivains, caricaturistes, journalistes et politiques.

Ainsi, pendant des années, les articles 141 et 142 ont puni l’adhésion
aux thèses communistes et séparatistes, tandis que l’article 163
réprimait les `activités contraires à la laïcité`. Quant aux articles
311 et 312, ils sanctionnaient ceux qui `[encourageaient] la
population à la révolte`. Si vous portez `atteinte à la personne
morale de l’Etat ou du gouvernement`, l’article 159 vous envoie tout
droit en prison. A la fin de la guerre froide, en 1991, estimant que
les articles 141, 142 et 163 commençaient à faire honte au pays, les
autorités turques ont décidé de les supprimer du code pénal. Sauf que
la loi antiterroriste promulguée au même moment a continué de porter
des coups à l’exercice de la liberté d’expression, le plus souvent
sous prétexte de séparatisme.

Est arrivé ensuite l’article 301 [condamnant les atteintes à la
`turcité` et dont le journaliste turco-arménien Hrant Dink, assassiné
en 2007, fut l’une des principales victimes]. Cet article, qualifié
pas plus tard que la semaine passée d’`ennemi de la démocratie` par la
Cour européenne des droits de l’homme, a été particulièrement
liberticide pendant les années 2000 et l’est encore aujourd’hui
[malgré la révision dont il a fait l’objet].

J’écris tout cela parce qu’il y a quelques jours l’éditeur Ragip
Zarakolu* s’est fait arrêter dans le cadre d’une opération policière
visant le KCK [organisation considérée comme faisant le lien entre le
PKK et le parti prokurde BDP]. Ce même Ragip Zarakolu qui depuis les
années 1970 subit les affres de tous ces articles liberticides. Cet
intellectuel qui a toujours combattu les interdits et les tabous. Ce
militant des droits de l’homme qui, par les livres qu’il a édités, a
fait la lumière sur nos tragédies et sur les origines du totalitarisme
chez nous. Comme me le disait un intellectuel kurde, `il n’a de cesse
de prouver que les Kurdes existent dans ce pays et que les Arméniens y
sont morts`.

Si les tabous sur le massacre – ou le génocide – des Arméniens, en
1915, ou sur cette question kurde qui retarde les progrès de la
démocratie dans notre pays, ont été un tant soit peu brisés, c’est
notamment à lui qu’on le doit. Cet individu, qui a déjà connu la
prison et la torture, a été l’un de ceux qui ont brisé le silence par
rapport à ces tabous, ce qui n’était pas chose facile à une époque où
tout le monde se taisait.

Je dénonce le placement en garde à vue de Ragip Zarakolu, celui de son
fils Deniz Zarakolu [arrêté début octobre], et celui du Pr Büsra
Ersanli. Je pense que ces opérations retardent l’instauration de la
paix et de la démocratie.

Note :* Ragip Zarakolu a notamment fait publier par Belge (c’est le
nom de sa maison d’édition) la traduction en turc d’ouvrages sur le
génocide arménien.

« Je me sens montpelliérain pour la première fois. » Me Luc
Kirkyacharian savoure. Hier, ses pairs l’ont élu btonnier désigné
(*), titre qui lui avait échappé lors des deux dernières élections.

Sa troisième candidature a été la bonne : il l’a facilement emporté
face à Régine Barthélémy (dont c’était la première tentative) dès le
premier tour, par 402 voix contre 244 sur 708 votants. « Je me sens
désormais montpelliérain » Me Kirkyacharian « C’est une belle
élection, avec une majorité absolue au premier tour, cela ne s’était
pas vu depuis dix ans » , se targue ce spécialiste du droit du
travail. Qui a cependant eu l’avantage de n’avoir à lutter que contre
un seul adversaire… Étonnant ? « Cela fait longtemps qu’il n’y a pas
eu aussi peu de candidats , confirme Michèle Tisseyre, l’actuel
btonnier. La fonction est très lourde, c’est une expérience
formidable, mais il faut vraiment se rendre disponible. Moi, c’est
douze heures de travail par jour en moyenne. » Luc Kirkyacharian,
presque sexagénaire, natif de Paris, mais qui a longtemps vécu à
Grenoble avant de prêter serment à Montpellier, en 1979, aime cette
ville qu’il n’a plus quittée. Et avec ce btonnat, il entend consacrer
une grande partie de son énergie à ses confrères. « J’ai tellement été
boulimique de travail que j’ai voulu prendre du recul et m’intéresser
au collectif », dit celui qui a effectué deux mandats au conseil de
l’Ordre et passé dix ans comme membre du conseil régional de
discipline. « Mon travail sera de faire le lien entre les quinze
branches de notre profession qui sont quinze métiers différents et
dont le judiciaire n’est que la partie visible. » Féru de haute
montagne, arménien par son père – « Kirkyacharian veut dire ‘l’homme
du milieu de la vie’ » -, il vit cette élection comme une intégration
à la cité. « Avec mon nom arménien, moi qui n’ai pas fait l’université
ici, qui fais du droit social longtemps méprisé, je me sentais décalé.
C’est pour ça que je me sens désormais montpelliérain. » Y. P.

Representatives of the Nagorno-Karabakh’s Armenian community deny from
the meeting with Azerbaijani community to disrupt the talks to resolve
the conflict, official Baku said.

“The Armenian side often makes such statements to break the
negotiation process,” the Head of the Foreign Relations Department at
the Azerbaijani Presidential Administration Novruz Mammadov told media
today.

He was referring to the statement made by the “Foreign Ministry” of
the separatist regime of Nagorno-Karabakh.

The Armenian community will not meet with Azerbaijani community till
the status of Nagorno-Karabakh is determined, the statement of the
“Foreign Ministry” of the separatist regime said on Friday.

The Armenian side negotiates under a certain pressure from the
international community and the OSCE Minsk Group co-chairmen, Mammadov
said. It tries to prove to be constructive. Perhaps, it manages to do
this to some extent.

“But at the very last moment, they look for any excuses to get away
>From the talks,” Mammadov said.

He said the Armenian side’s last statement in the current situation
aims at disrupting the negotiation process.

Despite the fact that a meeting of the Armenian and Azerbaijani
communities of Nagorno-Karabakh was planned to be held in late
November. The Armenians refused from participating in this meeting at
the last moment.

The conflict between the two South Caucasus countries began in 1988
when Armenia made territorial claims against Azerbaijan. Armenian
armed forces have occupied 20 percent of Azerbaijan since 1992,
including the Nagorno-Karabakh region and 7 surrounding districts.

Azerbaijan and Armenia signed a ceasefire agreement in 1994.
The co-chairs of the OSCE Minsk Group – Russia, France, and the U.S. –
are currently holding the peace negotiations.

Armenia has not yet implemented the U.N. Security Council’s four
resolutions on the liberation of the Nagorno-Karabakh and the
surrounding regions.

`From the very beginning, Bernard Fassier and other co-chairs know
that Azerbaijan’s position is fair’, chief of the foreign policy
department of the Presidential Administration of Azerbaijan Novruz
Mammadov said while commenting on the OSCE Minsk Group French co-chair
Bernard Fassier’s last statement.

Mammadov said Azerbaijan wanted both co-chairs and leaders of the
international organizations to display fair position from the very
beginning, from the first moment.

The French Senate organized a round table on the Armenian-Azerbaijani
conflict and French co-chairmanship at the OSCE Minsk Group. French
co-chair of the OSCE Minsk Group Bernard Fassier said during the round
table that he understood the pains of Azerbaijan: `As a Frenchman I am
familiar with the occupation’.

London: The opponent was tough, from the same 2800 plus Club but the
draw was short and easy. World Champion and NIIT MindChampion
Viswanathan Anand and Levon Aronian of Armenia just belted out 25
moves before drawing their encounter in the 7th round of the London
Chess Classic 2011 being played at the Olympia Conference Centre.

However the Classic after a all draw sixth round, once again came
alive with Magnus Carlsen defeating Michael Adams, Vladimir Kramnik
routing David Howell and Luke McShane busting Nigel Short. All the
three winners are now jointly leading the nine player Category 20
event with 12 points each. A win here fetches 3 points while a draw
garners just one point.

Overnight sole leader Hikaru Nakamura had a bye and assisted the
commentary team and had to watch the others leap frogging over him as
he stayed still on 11 points.

Anand and Aronian follow Nakamura with seven points each while Short
is next with 4 points and Howell and Adams bring up the rear with 3
points each.

With just two more rounds remaining, Anand is out of contention for
the title and on late Sunday evening will take on Carlsen with the
White pieces. Anand incidentally will turn 43 today and would be
hoping for a good result as a birthday present.

It was a Queen’s Gambit declined game between Aronian and Anand who
played with the Black pieces. The variation opted by the players
indicated very early that they were not averse for a `draw’ result and
it was no surprise when they shook hands after repeating the moves.

Luke McShane has been the most impressive player in this tournament
but has tough opponents in Anand and Kramnik in the last couple of
rounds.
The race for the title is still wide open with Carlsen, Kramnik,
McShane and Nakamura in contention. However Nakamura though one point
behind the joint leaders has better prospects as he is pitted against
both out of form British players, Adams and Short, where he will wield
Whites in both games.

Games. The Games are being held in Beijing, China.

Now the rapid chess tournament is going on. Danielian and
Skripchenko-Aghababian have 1 point each after two rounds. The leader
is WGM Alexandra Kosteniuk with 2 points.

`There are rumors that Public Radio’s director Armen Amiryan will be
appointed Armenian Minister of Culture, but he laughingly said: `I
have not received such proposal, [and] I do not intend to go there,
even they had suggested me to go.’ To our observation as to why he has
not accepted the proposal to be appointed minister, Amiryan responded:
`I practicably work at the Radio, and I am very happy with my work.’
To note, the changing of this minister is frequently spoken about, but

Lebanese President leaves, expresses his thanks for warm welcome

A farewell ceremony for President of Lebanon Michel Suleiman took
place at the Presidential Palace in Yerevan today, according to
President’s press office.

The Armenian and Lebanese Presidents summed up the visit in a brief
private talk before the farewell ceremony.

Armenian President Serzh Sargsyan expressed the hope that he will meet
with the President of Lebanon again in the near future, which would
give all concerned sides an impetus to constantly strengthen the
Armenian-Lebanese warm relations.

Lebanese President Michel Suleiman expressed his thanks for the warm
welcome and noted that Lebanon will be consistent in carrying out the
agreements reached during his visit. The Lebanese President also gave
his assurance that his official visit to Armenia will boost
Armenian-Lebanese ties.
