Azerbaijani Laws Do Not Guarantee Fair Elections. Analysis

AZERBAIJANI LAWS DO NOT GUARANTEE FAIR ELECTIONS. ANALYSIS

20:14, 11 April, 2013

YEREVAN, APRIL 11, ARMENPRESS: Azerbaijani Civil Society Coalition
“For transparent and fair elections” presented an analysis of the
pre-election situation in Azerbaijan. The presentation, held at
the International Press Center looked at election monitoring and
recommendations, with a particular focus on electoral law.

Experts prepared documents that were presented to the public from the
members of the coalition, having significant experience in monitoring
elections in Azerbaijan. According to Coordinator Arzu Abdullayeva,
this civil society organization decided to bring their contribution
to the democratic environment in an election year.

As reports Armenpress, referring to contact.az, authorities believe
that the existing conditions guarantee democratic elections and are
unwilling to change the law that, according to the opposition and
independent NGOs, does not create the conditions for a fair election,
and especially for the voters, said Mehman Aliyev, Director of the
Turan News Agency. He presented a paper entitled “Analysis of the
pre-election situation in Azerbaijan.”

Aliyev noted that analysis of the legislation and recent protests
in the country is not calming. “If you save the legislation in its
current form, the authorities will inevitably turn the individual
grievances into a single channel of protest across the country,
because almost all the population is part of one process – the
election of the president. And universal violation will inevitably
provoke universal protests.”

The analytical report highlighted 32 specific violations that occurred
during previous elections, which could be repeated if the current
electoral law and other laws limiting the activities of political
parties, NGOs and the media are retained.

The Coalition has concluded that the Azerbaijani government has an
obligation to review current legislation and bring it in line with
international laws.

Hayk, a suspect in 19-year-old Tigran Hayrapetian’s murder, attended
Yerevan senior school No 3 and was a quiet boy, for that reason
everyone was shocked by the incident. The headmaster of school No 3
Tigran Eyramjian told this to the correspondent of Aysor.am.

“Some pupils participate in all Olympiads, others are undisciplined.

Hayk fits into neither category. He was a normal pupil and got along
with everyone. His mother is a teacher, he has a sister. It was an
exemplary family,” the headmaster said.

According to him, on that day Hayk did not attend classes and the
teacher called his mother who said that there was some problem with
his passport.

T. Eyramjian declined to publicize the cause of the incident. There
are rumors that the boys had argued with each other.

Let us remind you that on April 10 Hayk A., 16, went to the police
and confessed to Trigram Hayrapetian’s murder.

A criminal case was opened under Article 104 part 1 of the Criminal

Fortune Oil PLC From China Is Not Going To Leave Armenia Though Not

FORTUNE OIL PLC FROM CHINA IS NOT GOING TO LEAVE ARMENIA THOUGH NOT ALLOWED TO WORK IN THE COUNTRY

ARMINFO
Thursday, April 11, 12:01

Fortune Oil PLC from China is not going to leave Armenia even though
its program to develop three local iron ore deposits has not yet been
approved, says a source from Fortune Resources LLC (a company where
Fortune Oil has a controlling stake).

The source has told ArmInfo that the recent media reports saying that
the company is going to leave Armenia are not true. “Simply we are
not working because our program is pending approval,” says the source.

Fortune Resources has been registered in Armenia for implementing
three big iron ore mining projects. It has been permitted to develop
deposits in Hrazdan and Abovyan for 25 years and to explore a deposit
in the village of Svarans, Syunik region, for 3 years. The company
began working in Armenia in Oct 2010, with the prospecting activities
started in Mar 2011.

For over a year already the company is drafting a project to build
ore mining and processing factory in Hrazdan but it has yet to undergo
an environmental examination and public hearings. At one and the same
time the company is developing a report on the possible environmental
impacts of the project, with ecology being the key obstacle to its
approval.

The key shareholder of Fortune Resources is Fortune Oil PLC, a Hong
Kong-based company, who has oil and gas business in China and whose
stock is listed at LSE.

As was reported earlier, Fortune Oil was going to invest $500mln in
Armenia. Some media report that the company has paid $24mln cash for
a stake in a company having the right to develop the deposit. It is
reported to be an offshore company with an authorized capital of just
$300 owned by the son of MP, former Environment Protection Minister
Vardan Ayvazyan and businessman Tigran Arzakantsyan. As far as ArmInfo
knows, both are actively engaged in selling licenses for ore deposits
that were “written off” when Ayvazyan was Minister. For Arzakatsyan
this is already the third known deal with a foreign investor.

Moscow Attacks Armenia

MOSCOW ATTACKS ARMENIA

Today the acting Prime Minister Tigran Sargsyan and the president
of the board of the Eurasian Economic Commission Victor Christenko
signed a Memorandum of Cooperation. This is the same Christenko who
called Armenia an exclave when Tigran Sargsyan explained that Armenia
could not join the Customs Union due to not having common borders
with member states.

However, apparently, the logic of exclave has won, and Armenia has
signed this memorandum. In other words, it was laid down that Armenia
is not a sovereign state.

Now Russia needs to force Armenia to join the Eurasian Union. Without
Armenia this union will have no meaning. Otherwise, the Russians
would not persist. Besides, there is an issue of saving the face of
Armenia who has put forth the idea of Eurasian Union on the eve of
his second term.

Armenia did not take them much effort. During the post-electoral
process the Russian Public Council stated, proceeding from records sent
from Armenia, that it will set to study financial misuse by former and
present Armenian officials who are related to Russian businesses in
Armenia. And there are very many cases which are regularly reported
by the mass media, such as Nairit, ARG, railway, other companies
and sectors.

In addition, CSTO has expanded the mandate of its quick reaction
forces to intervene in the domestic affairs of its member states. CSTO
Secretary General Borduzha stated that the member states are making
efforts to destabilize the situation.

On April 9 the quick reaction forces were not used although the
situation could have escalated to that point. Instead, all the factors
are in place to force the Armenian government to sign the memorandum
of the Customs Union. And not only. The Armenian press regularly
reports interest of Moscow in one company or infrastructure.

What will this memorandum bring to Armenia apart from limiting its
sovereignty? Maybe, some investments and growth of Russian business.

However, the key purpose is to stop diversification of the foreign
policy of Armenia in the direction of the West, more exactly,
diversification of integration with the Western organizations and
foreign policy.

It should be noted, however, that Russia lacks the resources required
for keeping a new empire. Moscow can hardly sustain its own regions.

Besides, serious political developments are awaiting Eurasia, and
Russia will have to face challenges all alone or to surrender to the
West. Russia needs to have the sovereignty of its partners totally
eliminated by the time it gets to that milestone to ensure that they
integrate with the Western organizations as Russia’s exclaves.

The Eurasian Union and Customs Union will remain on paper. The
signature of Armenia will remain as a stigma of the Armenian present.
