>From 1915 to 1923, the Ottoman Empire murdered 1.5 million of its
Armenian population by way of massacres and death marches through the
desert. In order to protect U.S. security interests with Turkey, the
United States has avoided characterizing the massacres as genocide
and opposed congressional resolutions that would do the same. In
2000, California passed Senate Bill 1915, codified as §354.4 of the
California Code of Civil Procedure, which extended the statute of
limitations until Dec. 31, 2010, for Armenian genocide heirs to file
claims against insurance providers who allegedly owe them money. Eric
Khodadian provides background information on the Armenian genocide and
U.S. efforts to acknowledge it, examines the foreign affairs doctrine,
analyzes the Movsesian case, contends that to preempt §354.4, the
insurers in the Movsesian case must show that U.S. foreign policy
conflicts with §354.4, and concludes that the foreign affairs
doctrine is irrelevant because California’s decision to characterize
the Armenian massacres as genocide is not subject to judicial review
or preemption by federal law.

In December 2003, Vazken Movsesian filed a class action suit against
German insurers Victoria Versicherung AG, Versicherungsgruppe AG, and
Munchener Ruckversicherungs-Gesellshaft Aktiengesells AG (collectively,
Munich Re), claiming that Munich Re failed to honor his ancestor’s life
insurance policy. Munich Re argued that the foreign affairs doctrine,
which provides that states cannot interfere with or conduct foreign
policy, preempts Movsesian’s claims. The district court held that
Movsesian could sue Munich Re under §354.4, which it concluded was
not preempted by the foreign affairs doctrine.

In 2008, the Ninth Circuit granted Munich Re’s interlocutory appeal
to determine whether §354.4 was unconstitutional on the ground that
it contravened the federal government’s exclusive power to conduct
foreign affairs. Although the Ninth Circuit initially ruled in
favor of Munich Re, the same three-judge panel later overturned its
decision and ruled in favor of Munich Re. In 2012, by en banc appeal,
the Ninth Circuit unanimously held that the foreign affairs doctrine
preempted §354.4. Movsesian’s attorneys indicated that they will
likely petition the U.S. Supreme Court for review.

Party attempting to invalidate the law must show it conflicts with
U.S. foreign policy. The author concludes that the foreign affairs
doctrine is irrelevant because California’s choice to characterize the
massacre as genocide is not subject to judicial review or preemption
by federal law. Since there is no consistent U.S. foreign policy on
the issue of Armenian genocide, Munich Re cannot argue that foreign
affairs policy preempts § 354.4. Furthermore, the foreign affairs
doctrine is inapplicable because §354.4’s use of the word genocide
is purely descriptive and, therefore, the foreign affairs doctrine
is irrelevant because Munich Re ris objecting to the words that
California used to describe Armenian history.

The author cautions that if the U.S. Supreme Court grants certiorari
and sides with Munich Re, it will set precedent that any state law
mentioning Armenian genocide will be invalid and set a dangerous
precedent that, for reasons of foreign policy, the U.S. President
may censor state governments from discussing history.

First Coffeehouse In London Opened By Armenian

FIRST COFFEEHOUSE IN LONDON OPENED BY ARMENIAN

The Huffington Post has published an old ad of coffee dating back to
1650s, which is exhibited at the British Museum in London.

The store was opened by an Armenian Pasqua Rose, who moved to
London through Paris and made a coffee revolution in the city. As
MrBreakfast.com informs, the first coffeehouse in London was opened
in 1652 by an Armenian named Pasqua Rose.

Originally he was brought to London as a servant by the merchant
Daniel Edwards. Rose served coffee each morning to Edwards’ house
guests. Curiosity about the new drink soon spread through Edwards’
friends, and the number of his visitors steadily grew over time.

There was so much excitement that Edwards eventually decided to
financially assist Rose in opening a coffeehouse at St. Michael’s
Alley in Cornhill.

Yerevan, July 18, ARMENPRESS: The Republic of Nagorno Karabakh and the
central electoral commission of Transnistria signed a cooperation
agreement. As “Armenpress” reports calling Kavkaz-uzel.ru, the
agreement was signed between the President of the Artsakh CEC Rashid
Petrosyan and the head of the Transnistria CEC Peter Denisenko.

The cooperation between the two countries was considered to be
successful by Rashid Petrosyan. The latter outlined that the contract
was signed on the eve of the NKR presidential elections. “Transnistria
CEC delegation is in Artsakh for the purpose of election observation
mission, which can be considered as another fact of the implementation
of the contract,” briefed Petrosyan.

Transnistria CEC chairman Peter Denisenko added that the cooperation
between the two CEC will allow to more deepen and develop the bilateral
relations.

82 international observers and 48 foreign media representatives have
accredited in the Artsakh CEC to observe the elections.

HAK Going To Initiate New Collection Of Signatures In Fall

The Armenian National Congress (HAK) explains the failure of an
initiative group to collect 44 signatures required for convening an
extraordinary sitting on the Harsnakar case in its own way.

“Holidays have started, many MPs are absent from the country,” says
HAK senior representative Gagik Jhnagiryan.

The HAK MP does not consider it failure; rather, he is glad that the
initiative united the representatives of four political forces.

HAK will initiate a new collection of signatures in autumn in an
attempt to gather the required 44 signatures.

“The Prosperous Armenia Party (BHK) has no other option. It is bound
to be opposition,” Gagik Jhangiryan stressed.

Asked what prevents HAK to organize a collection of signatures to
begin impeachment proceedings, Mr. Jhangiryan expressed his doubts
over the success of the move.

“After 2-3 successful moves with other opposition forces, I do not
rule out such an initiative,” he concluded.

Rakel Dink, la veuve du journaliste assassine Hrant Dink, a visite
Uludere dans le cadre d’un projet artistique voulant rendre hommage
aux 34 personnes tuees lors d’une attaque aerienne par l’armee turque.

Rakel Dink, l’ecrivaine Bejan Matur, la danseuse Zeynep Tanbay et la
chanteuse Sezen Aksu sont apparues ensemble.

Pendant sa visite, Rakel Dink a offert ses condoleances aux familles
des decedes et a visite le cimetière d’Uludere avec elles.

” S’ils acceptent votre realite, ils commenceront a sentir les regrets
et comprendrons la situation. La comprehension precède la honte et
les excuses, mais ils n’ont rien fait jusqu’a present. Les positions
de l’Etat est qu’il est lui-meme le père, mais ici le père est devenu
le tueur ” a dit Rakel Dink pendant sa visite.

Les quatre femmes ont amorce un projet de commemorer les noms des
civils decedes et la douleur de leurs familles. Tanbay et Matur avaient
visite la zone deux fois auparavant pour solliciter les idees des
familles des victimes sur un monument et chercher leur consentement
sur le projet.

Le 5 juillet, ils ont visite Uludere de nouveau avec Rakel Dink. Aksu
n’a pas pû participe a la visite en raison d’un changement de date
de son concert et un problème de sante avec sa jambe.

Sur une pierre gigantesque noire, les 34 noms des civils decedes
et la date de quand ils ont ete tues seront ecrits, tandis que 34
aretes pointues sur le sommet de la pierre symboliseront a la fois
les battements du coeur et les montagnes.

” Nous n’avons pas accepte la compensation de 123000 lires. Nous ne
nous soucions pas de l’argent. Nous voulons seulement des excuses
et que les criminels soient punis ” a dit un membre des familles
de victimes.

Rakel Dink s’est exprimee en kurde avec les familles.

Un envoye de haut rang du Pape Benoît XVI aurait appele au renforcement
des relations fraternelles “entre” l’Eglise catholique romaine et
l’eglise apostolique armenienne au cours d’une visite en Armenie lundi.

Le cardinal Leonardo Sandri, representant de la Congregation pour les
Eglises orientales catholiques, a rencontre le Catholicos Garegin
II, chef supreme de l’Eglise armenienne, a sa residence officielle
a Etchmiadzine. Ils ont eu des entretiens avant de prier ensemble a
la cathedrale armenienne situee a 20 kilomètres au sud d’Erevan.

” Les discussions avec le Cardinal Sandri ont porte sur les relations
fraternelles de l’Eglise catholique romaine avec l’Eglise armenienne,
exprimant l’espoir qu’elles deviennent encore plus etroites et plus
profondes”, a indique une declaration emise par le bureau de presse
de Garegin.

Garegin II a pour sa part evoque son ” amour fraternel ” pour le
souverain pontife et ” la chaleur particulière ” des relations entre
les deux Eglises s~urs “. ” Sa Saintete a insiste avec satisfaction
sur l’importance de la cooperation existant entre l’eglise armenienne
et le Vatican dans les domaines educatifs et sociaux “, precise le
communique. Il n’a pas donne plus de details sur la reunion.

Sandri a rencontre le ministre des Affaires etrangères Edouard
Nalbandian mardi. Le cardinal etait accompagne par l’archeveque Rafael
Minassian, chef spirituel des minorites armeniennes catholiques en
Armenie, en Georgie et en Europe orientale.

Le pape Benoît avait salue les ” bonnes relations ” de l’Eglise
catholique avec l’Armenie lors de sa rencontre avec le president Serge
Sarkissian au Vatican en decembre dernier. Le president Sarkissian et
le Catholicos avaient invite le pape a visiter l’Armenie en 2008. Il
n’a pas encore repondu a l’invitation.

Le predecesseur de Benoît XVI, Jean-Paul II, s’est rendu en Armenie
en 2001, rendant hommage a ” la glorieuse histoire du christianisme
” dans un pays qui fut le premier a l’adopter comme religion d’Etat
en 301. Il a egalement signe une declaration conjointe avec Garegin
sur les massacres de la Première Guerre mondiale commis contre les
Armeniens dans l’Empire ottoman comme ” le premier genocide du 20ème
siècle.”

Contrairement a Jean-Paul II, Benoît XVI a renonce a utiliser le mot
genocide pour qualifier la mort des quelques 1,5 million d’Armeniens.

Rencontrant Garegin II au Vatican en 2008, il n’avait mentionne que le
” martyre ” de l’Eglise armenienne.

Today Petros Makeyan, the leader of the Democratic Motherland Party, a
member of the Armenian National Congress (ANC), informed
that their party would prepare and spread an answer to what the
State Property Management Department had said in the next few days,
“We want to answer and reveal the lies of the State Property

Management Department. On Monday or on Tuesday, the party will spread
an answer to that.”

Let us note that the Democratic Motherland Party was compelled
to vacate the rented premises at 12 Vagharshyan Street, Yerevan,
since the term for rent had expired and the State Property Management
Department doesn’t want to sign a new agreement with this party. And
this, according to Mr. Makeyan, has only political reasons. Makeyan
was offered to rent other premises, but in Garni or Armavir.

Margarit Sargsyan, the spokesperson for the department, said to Radio
Freedom that Makeyan had sublet the most part of the premises rented
from the state to the Arabkir office of the Social Security Fund,
“as a result of which they have gained more than 21 million AMD
(around $50 thousand). The party has never stated about this and has
not responded to the facts published by the department.”

In Petros Makeyan’s words, “The detailed answer to this false and
tricky statement will be in our statement. We were just late to find
out that the State Property Management Department had spread lies,
otherwise, we would have responded earlier.”

We inquired whether the whole clarification of the State Property
Management Department didn’t correspond to the reality, Mr. Makeyan
replied, “There were certain things, the chronicle that they have
written, the process of confiscation, the financial part was partially
accurate, but as the work style of this Cabinet is with the use of
lies and tricks, this statement also included such things, the clear
answer to which we will give.”

Republican Party MP Vahe Hakobyan only trails Prosperous Armenia
Party leader Gagik Tsarukyan in terms personal wealth in Armenia’s
legislature.

Vahe, the son of Zangezur Copper Molybdenum Combine Director General
Maksim Hakobyan, is only 35 year-old but is well on the way to
financial success.

In 2011, Vahe Hakobyan declared 875.9 million AMD in revenues of
which only 3.1 million was his salary as a legislator.

At the end of 2011, his cash holding amounted to 1.4 billion AMD.

Hakobyan owns shares in a number of companies including Armenia
Molybden and Niash.

He declared a whopping 1.6 billion in revenues in 2009 and 906 million
in 2010.

YEREVAN. – “The passing of that bill was surprising because we
evidently had a fairly snowy winter this year,” environmentalist and
Armenia’s former Nature Protection Minister Karine Danielyan told 168
Zham daily’s reporter, reflecting on the law, which National Assembly
passed on June 22, with reference to allowing a maximum release of
320 million cubic meters of water from Lake Sevan, the daily writes.

‘”The Government’s explanation was that the months of April and
May were dry and that, despite the snowy winter, the reservoirs are
empty, the river flows have considerably reduced, and that the sole
opportunity is [Lake] Sevan.

They note that when the snow melted, it did not fill the reservoirs or
the rivers, but, instead, penetrated into the soil. Water is never lost
to anywhere. This also means that the soil should have been damper,
the ground water, richer. There is a mystery here,’ she said.

Also, [Karine Danielyan] expressed bewilderment over the Government’s
reasoning that [irrigation] water will be scarce this year.

‘The nature seems to have contradicted. There has never been a time in
Armenia when there was this much rainy weather in late June and early
July,’ said Danielyan, and added that 170 [million and,] in case of
emergency, 200 million cubic meters [of water] should be released
from Lake Sevan,” 168 Zham writes.
