Burcuoglu has said that the decision of the Constitutional Council
of France had left no any open door to preparation of a new bill
criminalizing the rejection of the Armenian allegations regarding
the incidents of 1915.

Ambassador Burcuoglu held a press conference upon decision of the
Constitutional Council and said, “all the experts in constitutional
law we have interviewed say, ‘there is no way of reopening a gate to
this issue until lawmakers come from space and find a new formula.’
Also the historians and jurists are against this law.”

Burcuoglu said that judgment of Constitutional Council was important
in terms of avoiding such attempts from spreading to other countries.

“After the law was adopted by the parliament, diplomatic relations
have been dropped to minimum level. We will follow the election
process and it

TURKEY was celebrating today after a hotly disputed new Bill making
it a crime to deny the Armenian genocide in France was rejected.

The Constitutional Council in Paris refused to ratify the legislation,
which states that 1.5 million Armenian Christians were slaughtered
by Ottoman Turks during the First World War.

Anyone who said otherwise faced a year in prison or a fine equivalent
to £40,000. President Nicolas Sarkozy, whose government had backed the
measure, was humiliated after the Council ruled that Parliament had
caused “unconstitutional harm to the exercise of freedom of expression”
by passing it.

He said he shared “the immense disappointment and the profound sadness
of all those who had welcomed with recognition and hope the adoption
of this law”.

The council said that it was concerned “not to enter into the realm
of responsibility that belongs to historians”.

Turkey had seen the measure as an insult when the French Senate passed
it last month and had suspended all military, economic and political
ties with Paris.

A government spokesman in Turkey said: “We consider the annulment of
the legislation by the Constitutional Council as a step that complies
with the principles of freedom of expression and research, the rule
of law and international law in France.”

However, the Turkish official stated that NATO is impressed by the
level of Armenia’s involvement in different spheres in the result of
cooperation with the alliance.

“We highly appreciate the fact that Armenia increases its peacekeeping
presence in Afghanistan. NATO attaches great importance to the military
education and its organization. But as we have stated in our documents,
ensuring this military education must be a priority for the defense
ministry of Armenia in the first place. We are trying to cooperate
in this sphere, too,” Huseyin Dirioz said.

Huseyin Dirioz and Head of Force Planning Department Frank Boland are
in Armenia within the frames of the Individual Partnership Action Plan
implemented with the corresponding staff of RA defense ministry and
within the frames of the evaluation of the progress in the Planning and
reviewing process implementation. Earlier, RA Defense Minister Seyran
Ohanyan received the delegation headed by Dirioz. Envoy Dirioz has
stated NATO’s readiness to enhance further computational and experts’
support to Armenia in the defense sphere.

WASHINGTON, DC. – During testimony before two key U.S. House Committees
today, Secretary Clinton was pressed on a range of concerns to
Armenian Americans, including, most prominently, her recent remarks
misrepresenting the Armenian Genocide, as well as calls for Turkey’s
return of confiscated Christian churches, the Administration’s proposed
19% reduction in aid to Armenia, and efforts to focus U.S.

assistance to the Samtskhe-Javakheti region of Georgia, reported the
Armenian National Committee of America (ANCA).

House Democrats Adam Schiff (D-CA), Brad Sherman (D-CA), David
Cicilline (D-RI), Jesse Jackson (D-IL) and Steve Rothman (D-NJ) each
used a portion of their limited questioning time to focus Clinton’s
attention on key issues, with some responses offered during the
hearing and others to be submitted in written form at a later date.

Additional House Members may be submitting written questions on
community concerns in the upcoming days.

Armenian grandmaster Levon Aronian has maintained the second place
in the latest ranking published by FIDE. With 2 820 points Aronian
yields 15 points to #1 Magnus Carlsen of Norway.

The top 100 of FIDE also includes Armenian grandmasters Sergei
Movsesian (41th), Vladimir Akopian (64th) and Gabriel Sargissian
(72th).

The FIDE Top 100 female players list includes three Armenian
grandmasters. Elina Danielian is 25th with the rating of 2 478,
followed by Lilit Lazarian (33rd) and Lilit Galojan (98th).

Armenia comes 4th in the rating of countries. Russia tops the list
of chess nations, followed by China and Ukraine.

As Secretary of State Hillary Clinton testified before the House
Appropriations Subcommittee on State-Foreign Operations, Congressman
Adam Schiff (D-CA) expressed his strong concerns over remarks Clinton
made last month, while speaking at a State Department presentation,
in response to a question regarding the Armenian Genocide, reported
the Armenian Assembly of America (Assembly).

Schiff conveyed that her mischaracterization of the Armenian Genocide
was the cause of “much anguish” in the Armenian-American community,
as well as for many human rights advocates. He was sharply critical
of the comment by saying that “tragically this is in the line of the
Turkish government.” Schiff’s comments follow a bipartisan letter
that he and Representative Robert Dold (R-IL) spearheaded and sent
to the Secretary.

Citing the voluminous U.S. record on the Armenian Genocide, including
the U.S. filing before the International Court of Justice in 1951
that referred to the “Turkish massacres of Armenians” as an example
of genocide, the1981 proclamation by President Ronald Reagan which
invoked “the genocide of the Armenians,” and both President Obama’s
and Clinton’s statements as Senators, Schiff put the question bluntly
of the Secretary of State whether she now held a “different view.”

Explaining that her comments were in reference to the French
Parliament’s recent legislation on the Armenian Genocide, and
thus should be viewed in that context, Clinton then restated the
Administration’s position by referencing President Obama’s several
April 24 commemorative statements. Clinton also invoked Obama’s call
for a “full, frank, and just acknowledgment.”

Returning to his point about the importance of clarity on the Armenian
Genocide, Congressman Schiff reminded the Secretary of the continuing
consequences of delaying U.S. affirmation. He noted that the recent
Ninth Circuit Court of Appeals decision overturning California
legislation, which extended that statute of limitations to allow
descendents of survivors to bring life insurance claims for policies
dating from the Armenian Genocide era, was due to the inability of the
federal government to speak forcefully and truthfully as then-Senator
Obama stated in 2008. The court’s decision effectively denied redress
to the victims of genocide.

Representatives Jesse Jackson, Jr. (D-IL) and Steve Rothman (D-NJ)
associated themselves with Congressman’s Schiff’s remarks. In addition,
Congressman Jackson expressed concern regarding the 18 percent across
the board cut in the Europe and Eurasia account, which also impacts
Armenia.

Hovannes Tamamian, General de la police arrete l’an dernier, est
passe devant la justice avec deux autres policiers accuse d’avoir
dissimule un meurtre et une tentative de meurtre qui avait echoue.

Le procès a commence presque un an après que M.Tamamian ait ete arrete
et mis a la porte alors qu’il etait le chef de la Direction Generale
des Enquetes Criminelles au service de la police nationale. Il risuqe
entre deux et six ans de prison pour abus de pouvoir commis pour ”
des motifs marchands ou autres ” et ayant ” des consequences sevères “.

L’affaire fait suite a un meurtre commis a Erevan en 2010. Les
procureurs d’Etat disent que les anqueteurs de la police sous les
ordres de Tamamian n’ont pas deliberement poursuivi le criminel en
cause et ont accuse un autre individu au lieu de cela. Ils ont aussi
allegue une tentative faite pour etouffer une affaire semblable de
tentative de meurtre en 2009 dans une autre ville armenienne, Gavar.

Les avocats de Tamamian ont dit le mois dernier que leur client
plaidera non coupable aux accusations parce qu’il les considère sans
fondement. Ils ont refuse de faire des remarques lors de l’audience.

Un des avocats, Artavazd Parsadanian, a dit seulement que les
enqueteurs urs n’accusent plus Tamamian d’avoir recu des pots-de-vins
en echange de tentative faite pour etouffer les presumees affaires.

devant la cour generale a Erevan, souriant et saluant ses amis dans

Le Parti Republicain d’Armenie (HHK) a declare jeudi qu’il ” regrette
” la decision prise par le Conseil constitutionnel au sujet de la
loi francaise criminalisant la negation du genocide armenien. Le
gouvernement armenien, quant a lui, n’a pas fait de declaration
officielle. Le porte-parole du HHK et vice-president du Parlement
Eduard Sharmazanov, a exprime ses regrets face la decision annoncee
par le Conseil constitutionnel francais mardi 29 fevrier 2012. Il a
evoque ” des questions de politique interne et de lobbying intense
par la Turquie et ses allies francais. ” ” Il est plus facile
d’influencer une decision prise par huit personnes que celle prise
par 130 “, a declare Sharmazanov a RFE / RL service (Azatutyun.am),
se referant respectivement aux membres du Conseil constitutionnel
et au parlement francais. Un membre eminent de la Federation de
l’opposition revolutionnaire armenienne (Dachnaktsoutioun),a de meme

PARIS, 29 fev 2012 – La decision du Conseil constitutionnel de censurer
la loi sanctionnant la negation des genocides, dont celui des Armeniens
en 1915, ne remet pas en cause la loi Gayssot sur le negationnisme et
doit etre l’occasion de contraindre la Turquie a ouvrir ses archives,
estiment des historiens interroges par l’AFP.

Pour autant, cette decision, qui rejoint celle de la Cour europeenne
des droits de l’homme s’appuyant sur la liberte d’expression, sonne
“la fin des lois memorielles” dictees par le parlement, estiment
plusieurs d’entre eux a l’instar de Robert Badinter, ancien senateur
PS, garde des Sceaux et ancien president du Conseil constitutionnel.

“Elle ne remet absolument pas en cause la loi Gayssot (1990, qui
fait de la contestation des crimes contre l’humanite un delit),
au contraire, elle la met a l’abri”, estime Pierre Nora, membre
de l’Academie francaise et president de l’association “Liberte pour
l’histoire”. “C’est très habile, car cette decision enterine la loi de
2001 reconnaissant le genocide armenien par la France tout en disant
qu’elle ne peut penaliser sa contestation, ce qui serait contraire
a la liberte d’expression”, ajoute M. Nora.

Le negationniste Robert Faurisson, rappelle au passage M. Nora,
“a ete condamne sur la base des lois de 1881 (reprimant notamment
l’encouragement a la haine raciale), anterieures a loi Gayssot”. “Le
devoir des politiques est de s’occuper du passe mais pas de faire des
lois qui le qualifient, empechent de le discuter et qui brisent tout
travail historique”, ajoute-t-il.

Annette Becker, professeur a Paris-ouest Nanterre, ne voit pas non plus
de danger pour la loi Gayssot, “basee sur le jugement du tribunal de
Nuremberg (autorite de la chose jugee) a laquelle a souscrit le droit
francais après la Seconde guerre mondiale”. Elle l’oppose a “la loi
declarative de 2001”, lorsque la France a reconnu officiellement le
genocide armenien. L’historienne, qui en janvier avait denonce “une loi
mal ficelee”, recuse le qualificatif de “loi memorielle”. Pour elle,
si “la loi peut dire qu’il y a eu un genocide, qu’on va punir ceux qui
nient le genocide, elle ne peut en aucun cas obliger a la memoire du
genocide”. “L’idee des lois memorielles est extremement restrictive
car ces sujets relèvent de questions ethiques et politiques sur la
negation de l’etre humain”, ajoute-t-elle.

Annette Wieworka, specialiste de la memoire de la Shoah, rappelle “le
consensus” et le “contexte” qui entouraient le vote de la loi Gayssot,
“très differents” de ceux de la loi votee le 23 janvier dernier. “Dans
les annees 80, c’est une extreme droite antisemite qui s’emparait de
cette negation (…). Les historiens ne se sont pas prononces contre
cette loi et elle n’a jamais ete appliquee a aucun travail historique
qui donnait des interpretations differentes de ce qui s’est passe”.

“La loi Gayssot n’est pas de meme nature que les autres lois. Je ne
voudrais pas que l’on pense qu’il y a deux poids, deux mesures entre
les Juifs et les autres, mais s’il faut la relire pour assurer une
liberte de la recherche, eh bien relisons la”, dit-elle.

Si “l’hypothèque que cette loi faisait peser sur l’histoire est
balayee”, dit Pierre Nora, “Paris doit exiger du gouvernement turc la
constitution d’une commission internationale d’historiens, patronnee
par exemple par l’Unesco, dont Ankara s’engagerait a accepter d’avance
les conclusions”.

Annette Wieworka souscrit a cette idee. Elle suggère d’engager “Ankara
a ouvrir ses archives et a faire la lumière sur le genocide de 1915”
a l’occasion des futures commemorations du centième anniversaire du
debut de la Grande guerre.

Après la defaite (0-2) contre la Serbie (mais l’Armenie etait privee
de nombreux titulaires) en match amical a Limassol (Chypre), l’Armenie
au complet et en presence de Roman Berezovksi, Araz Ozbilis, Marcos
Piselli, Youra Movsissian, Henrikh Mekhitarian, affrontait hier soir,
pour son second match amical l’equipe du Canada. Contre toute attente,
le Canada ouvrait le sore a la 5e minute par Kevin McKenna. Mais
l’Armenie dominait et a la 23e Marcos Piselli egalisait. A la 66e il
doublait le score. Dans les arrets de jeu, Arthur Sarkissov etait
fauche dans la surface de reparation canadienne. Araz Ozbilis pour
sa première selection au sein de l’equipe d’Armenie transformait le
penalty. L’Armenie s’imposait ainsi sur le score de 3-1 face au Canada.
