KARABAKH TELECOM LAUNCHES NEW PREPAID AND POSTPAID TARIFFS

Operator Karabakh Telecom, working in Mountainous Karabakh republic,
has introduced its new 1D, 7D and 30D prepaid on-net call packages.

The daily 1D package contains five minutes of outgoing calls for AMD
120, the price of the weekly 7D package is AMD 550 and it includes 25
call minutes, while 100 minutes of calls are offered under the monthly
30D package for AMD 2,000. The 1D daily SMS package includes five
on-net messages for AMD 40, the price of the weekly 7D SMS package
totals AMD 180 and it contains 25 messages, while the monthly 30D
SMS package includes 100 messages and costs AMD 600. The operator has
also launched its new Shakhavet tariff for postpaid subscribers. The
monthly rate is AMD 5,800 and it provides 300 on-net call minutes
and 100 SMS messages. The services are not available when roaming

Your Holiness, the Armenian Patriarch of Jerusalem will be elected
on January 23-25. Are there any new candidates? Are there any news?

During the general meeting of the brotherhood we expect that our
internal and external brothers, about 30-32 people, will make a list of
candidates and each participant must write the names of five persons
and those five who will get more votes will be the candidates.

During the next meeting of the brotherhood one of them will be
elected patriarch of the Holy Apostolic See of Jerusalem. A doctor or
a bishop aged above 35 can participate in the election. During the
meeting of the brotherhood we will learn who enjoys the confidence
of the majority of the brotherhood.

Is there a rivalry among the four candidates? Is the race equitable?

Doctor Babken says there are no controversies among the candidates?

Doctor Babken is right because there are no controversies and an
overt rivalry among the members of our brotherhood. As I said, the
candidates will be officially identified during the meeting of the
brotherhood, and the official list of candidates will be made by
voting of the brotherhood.

What will be your priorities if you are elected patriarch? Doctor
Babken said St. James~Rs Church needs renovation, as well as protection
of lands is urgent. Is land leased for 99 years lost?

We are aware of all these issues because we see the problems from
the inside. Doctor Babken lives in the United States and learns about
these issues from afar.

These issues are not issues identified by this candidate. This
is the general concern of the brotherhood because out brotherhood
is responsible for the protection of our land, holy places, so we
are well-aware of the issues we are facing. As a patriarchy we have
monastic issues and I know that every member of the brotherhood knows
about reconstruction and renovation needs, budget issues and so on.

Hence, I cannot say what issue needs to be put forth. There are a
number of issues that concern everyone and it is the duty of every
one of us to deal with these issues.

To what degree can the election be transparent and fair? Will all the
brothers vote honestly or will they try to ~Sgrab~T votes? How do the
patriarchal elections differ from political elections by transparency?

You asked a good question. We do not need to invite observers from
European countries to control our voting. In this sense, our voting is
secret, free and transparent. So the authenticity of the results of
the voting never arouses doubts. During the voting we will designate
a three-party commission, the electoral commission, and each member
will read the names written on the ballot in the presence of everyone,
so there is no fraud.

The Armenian press reported that land owned by the patriarchy was
sold under Patriarch Torkom. What is the state of affairs?

No land was sold under Patriarch Torkom, only leased for 99 years
which is not sale. 99 years later those lands will be returned to
the Holy See. The leased land brings income to the Holy See but no
land was solved during the tenure of Patriarch Torkom.

EXPOSE DES MOTIFS

Mesdames, Messieurs,

La construction europeenne a deja necessite plusieurs modifications de
la legislation en vigueur afin que la transposition en droit interne
des engagements internationaux souscrits par la France s’inscrive
dans notre hierarchie des normes. L’adaptation du droit interne,
afin d’assurer la construction d’un espace de liberte, de securite
et de justice, tel qu’il est prevu par le Traite signe a Amsterdam
le 2 octobre 1997, appelle une nouvelle modification de cette nature.

Sur le fondement, de l’article 34 du Traite sur l’Union europeenne,
dans la redaction qui lui a ete donnee par le Traite d’Amsterdam,
et de l’action commune 968/443/JAI, une Decision-cadre 2008/913/JAI
sur la lutte contre certaines formes et manifestations de racisme et
de xenophobie au moyen du droit penal a ete adoptee par le Conseil de
l’Union europeenne le 28 novembre 2008. Le but de cette decision-cadre
est de faire en sorte que la xenophobie et le racisme soient passibles
de sanctions penales effectives, proportionnees et dissuasives au sein
de l’Union europeenne. Elle vise aussi a encourager et a ameliorer
la cooperation judiciaire dans ce domaine.

En effet, elle prevoit le rapprochement des dispositions legislatives
et reglementaires des Etats membres en ce qui concerne les infractions
racistes et xenophobes, sur la base du principe de reconnaissance
mutuelle. Les comportements racistes et xenophobes doivent constituer
une infraction dans tous les Etats membres et etre passibles de
sanctions penales effectives, proportionnees et dissuasives d’au
moins un a trois ans d’emprisonnement au maximum, et s’applique a
toute infraction commise sur le territoire de l’Union europeenne,
y compris par un système d’information, par un ressortissant d’un
Etat membre ou pour le compte d’une personne morale ayant son siège
dans un Etat membre.

Ainsi, l’article 1 de la decision-cadre prevoit que sont punissables en
tant qu’infractions penales certains actes commis dans un but raciste
ou xenophobe, tels que : l’apologie, la negation ou la banalisation
grossière publiques des crimes de genocide, des crimes contre
l’humanite ou des crimes de guerre tels que definis dans le Statut
de la Cour penale internationale (articles 6, 7 et 8) et des crimes
definis a l’article 6 de la charte du tribunal militaire international,
lorsque le comportement est exerce de manière a inciter a la violence
ou a la haine a l’egard d’un groupe de personnes ou d’un membre d’un
tel groupe. En complement, l’article 3 de la decision-cadre prevoit
que, pour les actes enonces a l’article 1 precedemment cite, les
Etats membres etablissent des sanctions effectives, proportionnees
et dissuasives et une peine maximale d’au moins un a trois ans
d’emprisonnement.

Deja en France, plusieurs textes nationaux definissent et sanctionnent
les genocides, crimes de guerre et crimes contre l’humanite.

Recemment, la loi n° 2001-70 du 29 janvier 2001 a instaure la
reconnaissance officielle de la France du genocide armenien de 1915
et la loi n° 2001-434 du 21 mai 2001, la reconnaissance de la traite
et de l’esclavage en tant que crime contre l’humanite.

Toutefois, si cette reconnaissance a une portee symbolique evidente,
actuellement seule la contestation du genocide juif perpetre durant
la seconde guerre mondiale constitue un delit, de sorte que les
victimes rescapees de crimes contre l’humanite se trouvent inegalement
protegees. En effet, l’article 24 bis de la loi sur la liberte de la
presse du 29 juillet 1881, introduit par la loi Gayssot du 13 juillet
1990, incrimine et reprime d’un an d’emprisonnement et de 45 000
euros d’amende la contestation de l’existence des seuls crimes nazis,
a l’exclusion des autres crimes contre l’humanite, et notamment ceux
reconnus par les lois precedemment citees.

Dans ce contexte, une proposition de loi tendant a reprimer la
contestation de l’existence du genocide armenien avait ete adoptee
par l’Assemblee nationale le 12 octobre 2006. Cependant, le Senat l’a
rejetee le 4 mai 2011 par l’adoption d’une exception d’irrecevabilite.

Pourtant la transposition de la Decision-cadre 2008/913/JAI prevoyant,
notamment, que sont punissables l’apologie, la negation ou la
banalisation grossière publiques des crimes de genocide, s’impose
a la France comme le precise la Circulaire du Premier ministre du
27 septembre 2004 relative a la procedure de transposition en droit
interne des directives et decisions-cadres negociees dans le cadre
des institutions europeennes.

C’est la raison pour laquelle le present texte propose de transposer
la Decision-cadre 2008/913/JAI en punissant d’un an d’emprisonnement
et de 45 000 euros d’amende ou de l’une de ces deux peines seulement
ceux qui auront publiquement fait l’apologie, conteste ou banalise
les crimes de genocide, les crimes contre l’humanite et crimes de
guerre, tels que definis aux articles 6, 7 et 8 du Statut de la
Cour penale internationale, a l’article 6 de la charte du Tribunal
militaire international annexee a l’accord de Londres du 8 août 1945,
ou reconnus par la France.

Afin de garantir l’efficacite de la repression, la presente proposition
de loi a donc pour objet de modifier la loi sur la liberte de la
presse, afin que les infractions a caractère raciste visees constituent
desormais un delit de droit commun inscrit dans la loi sur la liberte
de la presse. En outre, elle permet a toute association regulièrement
declaree depuis au moins cinq ans a la date des faits, qui se propose,
par ses statuts, de defendre les interets moraux et l’honneur des
victimes de crimes de genocide, crimes contre l’humanite et crimes
de guerre d’exercer les droits reconnus a la partie civile en ce qui
concerne l’apologie, la negation ou la banalisation des crimes de
genocide, crimes de guerre ou des crimes contre l’humanite.

PROPOSITION DE LOI

Article 1er

Le premier alinea de l’article 24 bis de la loi du 29 juillet 1881 sur
la liberte de la presse est remplace par cinq alineas ainsi rediges :

” Seront punis des peines prevues par le sixième alinea de l’article
24 ceux qui auront fait l’apologie, la negation ou la banalisation
grossière publiques des crimes de genocide, crimes contre l’humanite
et crimes de guerre, tels qu’ils sont definis de facon non exclusive :

” 1°) par les articles 6, 7 et 8 du statut de la Cour penale
internationale creee a Rome le 17 juillet 1998 ;

” 2°) par les articles 211-1 et 212-1 du code penal ;

” 3°) par l’article 6 du statut du tribunal militaire international
annexe a l’accord de Londres du 8 août 1945 ;

” et qui auront fait l’objet d’une reconnaissance par la loi,
une convention internationale signee et ratifiee par la France ou
a laquelle celle-ci aura adhere, par une decision prise par une
institution communautaire ou internationale, ou qualifies comme tels
par une juridiction francaise, rendue executoire en France. ”

Article 2

L’article 48-2 de la meme loi est ainsi modifie :

1° Après le mot : ” deportes “, sont inseres les mots : ” , ou de toute
autre victime de crimes de genocide, crimes de guerre, crimes contre
l’humanite ou des crimes ou delits de collaboration avec l’ennemi “.

2° Après le mot : ” apologie “, sont inseres les mots : ” des
genocides, “.

La production industrielle en Armenie cette annee devrait atteindre
approximativement 1005 milliards de drams selon Vazgen Safaryan,
le president e l’Union de Producteurs des Marchandises Domestiques.

Il a dit que sa prevision est basee sur les donnees des huit premiers
mois avec les entreprises industrielles qui ont produit 700 milliards
de drams de marchandises.

” Ce chiffre en memoire nous pouvons prevoir avec certitude que le
chiffre final sera de 1005 milliards de drams ” a-t-il dit.

Selon le Service National de la Statistique, la production industrielle
entre janvier et septembre de 2012 a augmente de 11,6 % compare a 2011.

En 2011, la production industrielle de l’Armenie s’est elevee a
environ 990 milliards de drams.

Selon le journal turc Hurriyet, de nombreux objets volants non
identifies ont ete observes il y a quelques jours vers midi autour du
mont Ararat dans la region d’Aghri. Ces objets ” brillants et blancs
” effectuaient des deplacements très rapides puis ils disparurent en
laissant des traces bleues dans le ciel. Des photos furent prises
et sont en cours d’analyse. Haktan Akdogan le president du centre
turc d’astronomie et de recherches sur les ovnis (objets volants non
identifies) a affirme ” les photographies prises furent analyses et
de nombreux tests effectues ont prouve que ces images n’etaient pas
truquees et il faut bien l’avouer qu’on y voit des objets volants
non identifies “.

Serzh Sargsyan put a task to close the year with 7% of economic
growth. National Statistical Service published 7.1% of economic
activity for November. In fact, now it is possible to say that the
government “honorably” implemented the RPA leader’s recommendation.

ARF member, Vice President of the Standing Committee on
Financial-Credit and Budgetary Affairs Artsvik Minasyan said that it is
natural, economic growth cannot be ordered, and in that point of view,
it corresponds to the truth , if not, it is necessary to consider the
impact on citizens’ quality of life and economic competitiveness of
the state.

“It is evident that development of 1, 2 or 3 entities cannot be
considered in the context of overall growth. The point is that
Armenia’s citizens are grabbling in poverty, but the economy may show
growth. This is talking about the fact that our economic structure and
economic policy is not consistent with the socio-economic challenges
the country faces,” said Minasyan.

“TARAF” COLUMNIST ACCUSES TURKEY IN BLACKING OUT INFORMATION ON ARMENIAN GENOCIDE

YEREVAN, DECEMBER 25, ARMENPRESS: Lately Turkish columnists are
frequently referring to the position of former and current Turkish
governments over Armenian Genocide. This time the issue was highlighted
my “Taraf” columnist Serdar Gaya.

As reports Armenpress referring to “Marmara” daily, published in
Istanbul, in his article Gaya has reminded that in 1915 Young Turks
deported or massacred the majority of Armenians living in Anatolia
eliminating thousands of Armenians living in this area for years.

“Even though year after year Anatolia’s Muslims lived with Armenians
they very easily forgot Armenians. Armenians, as well as their
villages and churches very quickly vanished from their memory,”
writes columnist. He highlights only after 1973 numerous demands
on recognizing Armenian Genocide made Turkey “remember” its past
with Armenians.

“For Turkish Armenian identity is nothing else but a political meaning
formed with sense of hostility,” Gayan writes.

Columnist refers to UN Declaration on Genocide signed by Turkey
in 1950, underlining that Turkish side signed the document without
acknowledging the meaning of word “genocide”. For such a situation
he accused Turkish state which “blocked all sources of information”.

“That is why Turkish citizens are surprised and then angry when hearing
about events of 1915,” Gayan writes, adding that reaction of Turkish
residents is not surprising when facing the issue of Kurdish Genocide
committed on physical or cultural territories.

Pope Benedict XVI delivered his annual Christmas message from the
balcony of St. Peter’s Basilica.

In his traditional Urbi et Orbi message, Benedict XVI has urged people
never to loose hope in peace this Christmas, even in situations of
conflict such as Syria, or nations afflicted by terrorism such as
Nigeria, because the “Truth has sprung out of the earth”, with the
birth of Christ, Vatican reported.

“May peace spring up for the people of Syria, deeply wounded and
divided by a conflict which does not spare even the defenceless
and reaps innocent victims. Once again I appeal for an end to the
bloodshed, easier access for the relief of refugees and the displaced,
and dialogue in the pursuit of a political solution to the conflict,”
Pope said.

He delivered Christmas greetings in 65 languages, including Armenian:

The ending year of 2012 has been marked in sports by the signal
success of Armenian chess aces at the World Olympiad in Turkey as
well as ups and downs of the nation’s Olympic athletes and soccer
players in their respective competitions.

In September FIDE’s current No. 2 player Levon Aronian led his
teammates to a spirited victory at the Istanbul biannual forum – the
third for Armenia since 2006. The team, also including GMs Vladimir
Akopian, Sergei Movsesian, Tigran Petrosian and Gabriel Sargissian,
and their coach Arshak Petrosyan were honored by President Serzh
Sargsyan upon their return home.

Team Armenia won fewer medals at the 2012 London Summer Olympic Games
than at the similar competitions in Beijing four years before, but
at least one Armenian athlete managed to upgrade the medal color to
silver. Still, many fans had hoped to see in London the first Armenian
Olympic champion since 1996.

Armenian athletes won six bronzes at the 2008 Games, while their
haul this year included one silver and two bronzes (in Olympic count
a single silver medal overweighs all bronzes just as a gold medal
beats all others).

The Armenian athletes celebrating in London in August were Greco-Roman
wrestler Arsen Julfalakian (74 kg), who won a silver medal, Greco-Roman
wrestler Artur Aleksanyan (96) and weightlifter Hripsime Khurshudyan
(+75 kg), both of whom won bronze medals.

Thus, in London Armenia finished 60th in the overall medal standings,
while in Beijing the team was only 80th.

Two athletes represented Armenia at the following 2012 Paralympics
in the British capital.

The national soccer team of Armenia in 2012 only slightly reminded fans
of its former self that won it a large following in the 2010-2011
European championships qualifying campaign. As a result, Vardan
Minasyan’s charges, despite occasionally spirited performance, lost
to main rivals in World Cup qualifying Group B, Bulgaria and Italy,
while beating bottom-of-the-barrel side Malta in the opening qualifier
in September.

Hopes for the future of the campaign were lifted by a spectacular 4-2
win over Lithuania in a friendly in November. Also, skipper Sargis
Hovsepyan made his 132nd and last appearance for the team in that
match ending his long career in soccer at a mature athletic age of 40.

Simultaneously, Armenia and Shakhtar Donetsk midfielder Henrikh
Mkhitaryan reaffirmed his world class status by his performances for
the national team and his Ukrainian side during 2012.

During the ending year athletes representing Armenia or ethnic
Armenians also registered successes in other sports such as boxing,
weightlifting, wrestling, judo, etc.

In March, Armenian Greco-Roman wrestler Artur Alexanyan won a
gold medal in the 96-kg division at the Senior Wrestling European
Championships in Belgrade, Serbia. Two other Greco-Roman wrestlers
representing Armenia, Yuri Patrikeyev and Arsen Julfalakyan, won
bronze medals in the 120-kg and 74-kg weight categories, respectively.

Wrestlers representing Armenia also won silver and bronze medals for
Armenia at recent University Championships.

Armenians were also successful in international competitions in sambo
and judo.

Armenian professional boxers including Arthur Abraham, Vic Darchinyan,
Vanes Martirosyan and others were also mostly unbeaten in the ring.

The largest sporting event hosted by Armenia in 2012 was the AIBA
Youth World Boxing Championships, on November 28-December 7, bringing
to Yerevan more than 600 participants from 68 countries, including
Azerbaijan. Team Armenia won one gold medal at the championships
praised for the level of their organization.

Finally, in basketball, Armenian American coach Carl Bardakian was
placed in charge of the men’s national team, which is going to be in
training during the 2013 off-season in preparation for the 2014 FIBA
Europe Division C Men’s Basketball Championship.
