Deputies of the State Duma of Russia in the plenary session passed the second and third reading of the government bill, according to which foreigners will be denied citizenship, as well as temporary residence permit or right of residence, if they have an outstanding or outstanding conviction for any crime. According to the current norms, foreigners are denied citizenship if they have been convicted of intentional crimes. Moreover, a temporary residence permit or right of residence is not granted only to persons who have been convicted of serious or particularly serious crimes. The law also provides that citizenship, temporary residence permit or right of residence will not be granted if there is an unexpired or outstanding conviction for any crime. If the documents have already been issued, they will be revoked if an outstanding conviction is found.
At the same time, the document states that the new norms will not apply to foreigners who have been recognized as refugees or have received political asylum in Russia.
The law also provides new requirements when applying for a temporary residence permit or right of residence. Thus, migrants must submit a document that will either confirm the absence of a conviction or contain information about the crimes for which the applicants have been convicted. Such a document must be issued by the competent authorities of the country where the migrant resides no earlier than three months before submitting the application. If a foreigner has dual citizenship (or multiple citizenship) or several residence permits, he must submit an appropriate number of documents on the presence or absence of a conviction.
It is planned that such a document will not be required from foreigners under 14 years of age, from refugees who have received political asylum in Russia, as well as from those foreign citizens who have served or are serving in the Armed Forces of the Russian Federation on a contractual basis.
If the law is signed by the President of the Russian Federation, the document will enter into force 180 days after its publication. Moreover, all the applications that were submitted until that moment will be considered according to the old rules, that is, foreigners will not have to additionally submit a document on the presence or absence of a conviction.
