DISOBEY COURT OF CASSATION!

Today about 200 members of the Chamber of Advocates led by its chairman
Ruben Sahakyan held protest in front of the Court of Cassation. They
held up posters with notes “No to Executioners of Justice”, “Justice
Without “Approvals”~T, “We Demand Genuine Justice”.
“Justice is in agony, it’s on the verge of an abyss, it’s plunging
into the abyss, today justice is dead, courts are proxies of the
prosecution,” says the famous advocate Ruben Rshtunee who declares
the start of public protest.
The last drop in the cup of patience of advocates was the disciplinary
action launched by the Court of Cassation upon the decision of Judge
Samvel Mnatsakanyan of Avan and Nor Nork districts to release the
accused on bail.
On June 24 the Council of Justice appealed to Serzh Sargsyan for
suspension of Judge Mnatsakanyan because he had not justified his
decision on release on bail.
The chairman of the Chamber of Advocates who has studied this
case says, “Now look, he is not punished for failing to justify
his decision, whereas the president of the Court of Cassation, the
disciplinary board of the Council of Justice and the other members
condemn release on bail.”
The advocate says every day dozens of unjustified decisions are
made in Armenia. He urges the advocates to report these decisions to
the Chamber of Advocates, then to the Council of Justice to launch
disciplinary action against the judges who pass unlawful decisions.
“In fact, today a judge is punished for disobeying the Court of
Cassation. Our purpose is not to protect Mnatsakanyan, our purpose
is to protect the judge who is guided by the law,” says Advocate
Lusine Sahakyan.
Among the advocates there were also judges and even detectives and
prosecutors. These are the people who need “approval” to administer
justice.
By the way, Arman Mkrtumyan, the president of the Court of Cassation,
announced Judge Mnatsakan Martirosyan last year’s best judge,
the judge who is totally discredited in the eyes of the society,
underlining that he approves this kind of judges.
