The anti-corruption court accepted the action of the Prosecutor General’s Office against the Dilijan community, Artur Arshakyan, former Minister of Nature Protection Aram Harutyunyan, to declare invalid the auction organized on October 12, 2012 regarding the plot of land with an area of 0.8 ha located at 29/24 Maksim Gorku Street, Dilijan city, between Arthur Arshakyan and Aram Harutyunyan in June 2017 About the demands to declare the real estate sale contract signed on 20 as invalid and to apply the consequences of invalidity, including the demands to return the land area of 0.8 ha from the illegal possession of Aram Harutyunyan to the Dilijan community.
At the same time, a measure to secure the claim was applied and the defendant Aram Harutyunyan was prohibited from performing such actions that would lead to a change in the actual or legal status of the plot of land mentioned in the claim.
The General Prosecutor’s Office, with the investigation carried out within the framework of the authority to initiate a lawsuit for the protection of state (community) interests, found out that the 0.8 ha plot of land included in the list of restrictions of Article 60 of the Land Code is “environmental forest” operational purpose land of “specially protected areas of nature”, which could not be alienated to individuals.
