Victory as couple accused of bringing £14m of ‘dirty’ cash into Britain can be named

London couple accused of bringing £14 million of “dirty money” from Azerbaijan into Britain should be named, a judge ruled today in a major step forward in the fight against secret justice.

District Judge Vanessa Baraitser said that continuing to conceal the couple’s identities would be a disproportionate interference with the principle of open justice as she lifted an anonymity order protecting their names.

The judge — who was making her ruling at Westminster magistrates court in response to an application by the Evening Standard backed by the National Crime Agency — added that there were also no grounds for holding any of a forthcoming forfeiture hearing involving the “laundromat” couple in secret.

Instead, full details of the allegations against them will be made public. In a concession to the couple, the judge granted a seven day “stay” on naming the couple — who own several multi-million pound London properties and face the seizure of around £6.5 million in their bank accounts — to allow them to seek a judicial review of her decision.

The pair’s lawyers have said they want a High Court injunction and permission for judicial review on the grounds that lifting anonymity will interfere with other proceedings. But if their bid fails the couple’s names will finally be made public next week.

The couple, who can only be referred to as X and Y, are accused by the National Crime Agency of using a complex web of “brass plate” companies in locations ranging from the Seychelles to Potters Bar to launder illicit money made by the “ruling elite” in Azerbaijan.

The NCA alleges that the money was moved via banks in Estonia and Latvia into accounts at Coutts, Barclays, Lloyds, Santander and Metro Bank and told a previous court hearing that allegedly fake invoices for £500 million worth of steel were one method used to mask the money transfers.

It has also disclosed that several of the companies involved in transferring money to the couple have been identified as involved in the Azerbaijan laundromat — a scheme under which billions of pounds made via corruption was moved by the Azeri elite to the West to buy property and fund their lifestyles overseas.

In her ruling today, Judge Baraitser says that there is a “public interest in informed public debate” about account forfeiture orders.

She adds: “Such debate is stimulated and enhanced by the identities of the parties being revealed… and, in accordance with the usual principle of open justice the public has a right to know who they are.

“In this case the press has a legitimate journalistic purpose in reporting these proceedings, namely to inform the public about the process of forfeiture and to contribute to public debate about the flow of “dirty” money into the United Kingdom and its laundering through our financial institutions.

“In all of the circumstances, I have concluded that an anonymity order preventing the disclosure of their names would now be a disproportionate interference with the principle of open justice and with article 10 of the European Convention of Human Rights. I am satisfied that lifting anonymity is both proportionate and necessary.”

The judge points out that the Evening Standard had submitted that its  “purpose in reporting these proceedings is to contribute to public debate, in this case the use of the UK’s financial systems to launder large sums of money derived from unlawful sources in Azerbaijan.”

She said this had not been contested by the couple’s lawyers and nor had the newspaper’s argument that the case also “raises important questions about the safeguards that are in place against such activity, and about the visa policy operated by the Home Office which enables access to the UK’s systems.”

She added that a previous judge had found that this newspaper had a “proper journalistic purpose” in wanting to report the proceedings and identify the couple.

Judge Baraitser said the couple, who had originally sought a fully private forfeiture hearing which the press would have been unable to report, had also provided no evidence to support a subsequent application for proceedings to be conducted partially behind closed doors.

She said there was no reason to allow this, stating in her judgment that: “The burden of displacing the general rule as to publicity lies on the Respondents [X and Y]…. and there is no evidence before me which would justify a derogation from the usual principle of open justice.

“As no substantive reasons have been advanced to depart from the usual principle I reject the application that the forfeiture hearing, or any part of it, should be heard in private.”

This newspaper has been fighting for nearly two years to name the couple as part of a court battle that is also intended to make it easier for the media to report future “dirty money” forfeiture cases.

The couple deny wrongdoing and are contesting the forfeiture of their accounts.

New Ambassador of Bangladesh presents credentials to Armenian President

The Armenian President congratulated the Ambassador on appointment, hoping that his activity will contribute to the development of the bilateral cooperation.

The meeting touched upon the possibilities of boosting the commercial ties between Armenia and Bangladesh, as well as developing the cooperation in education and culture fields.

The Ambassador said he will make all efforts to develop the relations between the two peoples, having historically friendly ties, noting that the centuries-old Armenian presence in Bangladesh is also a good base to deepen the economic relations.

Opposition LHK leader calls for immediate emergency meeting of Security Council over Azeri aggression

YEREVAN, MAY 26, ARMENPRESS. Opposition Bright Armenia (LHK) leader Edmon Marukyan is calling for an immediate emergency meeting of the Security Council with participation of the heads of all parliamentary factions.

“Taking into consideration the fact that Azerbaijan continues the use of force, aggression, violation of the Armenian territorial integrity, given the fact that as a result of Azerbaijan’s criminal actions the Armenian military suffered casualties, and today also servicemen were captured, given the further escalation of the situation and irreversible consequences, we demand to immediately convene an emergency meeting of the Security Council with participation of heads of all parliamentary factions,” Marukyan said.

In the early morning of May 27, six Armenian troops were kidnapped and captured by the Azeri armed forces from the Armenian territory in Gegharkunik Province.

YEREVAN, MAY 27, ARMENPRESS. Caretaker Prime Minister Nikol Pashinyan commented on the May 27 incident on Armenian-Azeri border.

“Six servicemen of the Armenian Armed Forces where carrying out engineering works of the border on Armenian sovereign territory, landmining works were carried out, moreover I want to specially emphasize that these works were carried out parallel with installing warning signs,” Pashinyan said, adding that these works were done to raise the level of protection of the Armenian border.

Pashinyan said the circumstances surrounding the six Armenian troops being taken captive must be determined, but he emphasized that what happened is actually a kidnapping of Armenian troops from Armenian territory.

“The ongoing processes are completely unacceptable for Armenia and incidents like this are happening because some want us to adapt with the presence of Azerbaijani forces on our territory, which can’t happen. I find it very important to emphasize over this incident that this issue should not be used for domestic political goals, I think that all attempts to use this situation against the army and armed forces must be condemned, because our troops, the army are fulfilling their function of protecting the borders of the Republic of Armenia,” Pashinyan said, adding that the ongoing situation is a direct threat to Armenia’s territorial integrity and sovereignty, a gross violation of international law, and that this is the case when Armenia must use all levers.

“I think our society must be united around our armed forces, the army and state institutions. The demand is clear, the Azerbaijani armed forces must unconditionally withdraw from Armenia’s territory, and Armenia will be sober in all situations and the management of provocations must be done maximally prudently. The armed forces must continue carrying out their functions of preserving the protection and strength of the Armenian borders and territorial integrity. As difficult as the situation is today that we are going through, emotional and unbalanced actions and statements are totally inappropriate.”

Artsakh FM calls capture of Armenian servicemen by Azerbaijan in Gegharkunik “political terrorism”

STEPANAKERT, MAY 27, ARMENPRESS. Foreign Minister of Artsakh Davit Babayan called the recent capture of 6 Armenian servicemen by the Azerbaijani forces in the border section of Armenia’s Gegharkunik province as terrorism.

“In fact, Azerbaijan is conducting political and geopolitical terrorism. Firstly, with such step Azerbaijan is again showing that it doesn’t and is not ready for building its relations with Armenia in any reasonable and civilized way. Azerbaijan continues terrorist actions, is capturing people who were just conducting engineering works. In fact, they kidnap, capture Armenian servicemen and call them as saboteurs”, he told Armenpress, expressing confidence that Azerbaijan’s aim of taking hostages and prisoners of war is the run a policy of again labeling them as saboteurs and terrorist. “They are trying to complicate the domestic political situation in Armenia in this way, create an atmosphere of distrust toward the future especially in the most important strategic and border areas”, the Artsakh FM said.

According to him, Azerbaijan’s this behavior is a blow to the CSTO, because terrorism has been carried out against the servicemen of the Armed Forces of its member state.

“This is a blow also to our brotherly state Russia, because, Azerbaijan, seems, is again throwing a challenge to Russia with such action. Understanding that Russia must solve this issue in a very calm atmosphere and must intervene in some sense, Azerbaijan is creating such difficulties because it is terroristic and Armenophobic as a state and doesn’t change”, Babayan said, adding that it would be naïve to hope a change in Azerbaijan’s behavior.

Armenia’s highest flag raised in Gegharkunik province

The state flag of the Republic of Armenia was hoisted 53 meters high in the territory of Noy Land hotel complex in Chkalovka community of Gegharkunik region, Governor Gnel Sanosyan informs.

The tricolor, 70 meters above the level of Lake Sevan, is the highest in the territory of the Republic of Armenia. The flag is 9 meters long and 4.5 meters wide. The blessing ceremony was performed by the Vicar of the Gegharkunik Diocese of the Armenian Apostolic Church, Archbishop Part Barseghyan.

The Vicar recalled the names of the founders of the Republic of Armenia, the heroes fighting for the freedom of Armenia and wished peace and victory to the homeland.

“Raising this flag on the occasion of the founding day of the Republic of Armenia is a good occasion to be filled with new energy and faith, to continue building and strengthening the homeland with joint efforts.,” the Governor said in a Facebook post. 

Armenian National Congress releases electoral list ahead of snap polls

The list consists of 101 people.

First President of Armenia Levon Ter-Petrosyan is leading the list.

Among the people in the list are Levon Zurabyan, Inessa Gabayan, Hayk Maghakelyan, Bagrat Asatryan, Anna Gevorgyan, Arman Musinyan, Samvel Abrahamyan, Karine Yaralyan, Grigor Grigoryan, Aram Manukyan, Tatevik Zoryan, Tigran Paskevichyan, etc.

Snap parliamentary elections in Armenia will take place on June 20.

This year we are celebrating the Republic Day in a difficult and depressing situation for our country, once again reflecting on the reminiscences of the establishment of the First Republic of Armenia.

Our people, who suffered the bitter blows of the genocide more than 100 years ago, also faced great challenges in defending their existence in the eastern part of their homeland, however did not retreat and fought bravely in the May heroic battles, restoring the native state.

The First Republic did not survive for a long time, but it became a visible guarantor of an independent statehood, which inspired the further victories of the revival of our people.

Today, we are concerned about the problems facing our homeland, the ongoing encroachments on our borders, and the safe and secure life of our people.

The Mother See of Holy Etchmiadzin has expressed its concerns over the capture of 6 Armenian servicemen by the Azerbaijani armed forces today early morning in the border section of Armenia’s Gegharkunik province, which was followed by publication of humiliating images on the internet.

“Such behavior of the Azerbaijani authorities must be strongly condemned as it violates the provisions of the international law, opposes the universal perceptions of humanism.

The recent developments in the Gegharkunik and Syunik sections of the Armenian-Azerbaijani border are an encroachment against Armenia’s sovereignty and our people’s right to peaceful and safe life. Such provocative actions demonstrate Azerbaijan’s real militaristic plans, endangering the efforts made for the restoration of peace and establishment of stability in the region.

The Mother See of Holy Etchmiadzin calls on the international community and human rights organizations to take actions to release the Armenian servicemen and the remaining POWs and prevent new undesirable developments in the region”, the statement says.

Robert Kocharyan: We see serious prerequisites for building a firm statehood

Second President of Armenia Robert Kocharyan extended congratulations on the Republic Day celebrated on May 28. The message reads:

On May 28, 1918, after a centuries-old and heavy breaks, the Armenian statehood was eventually restored. This is one of the brightest chapters of our modern history, written by the collective will of our people, heroic efforts and blood of its best sons.

Historical parallels are always arbitrary. However, the current situation in Armenia is no longer characterized by just a domestic political crisis, but by a crisis of statehood. Our whole nation is now facing the imperative of saving our statehood. Since 28 May 1918, we have experienced moments harder than this.

But today we are full of determination, unlike the current authorities that bring disgrace and kneel down [before the enemy]. We see serious prerequisites for building a firm statehood, resetting the disintegrated government institutions and the life of our society as a whole.
