YEREVAN, AUGUST 14, NOYAN TAPAN. The RA ministry of transport and
communication jointly with several passenger transportation companies
has organized transportation of more than 1,600 people in taxes,
minibuses and buses in recent days. NT was informed by spokeswoman
for the RA minister of transport and communication Susanna Tonoyan
that people were transported free of charge from the Bavra crossing
point to Yerevan and Gyumri.

On August 9, 208 people were transported from Kobuleti to Armenia
in 13 taxis, and 160 people were brought from Bavra to Yerevan in 7
PAZ buses.

On August 10, 224 people were moved from Kobuleti in 14 minibuses,
115 ones were brought from Bavra to Yerevan in 5 buses.

On August 11, 224 people were moved from Ureki to Armenia in 14
minibuses, 240 were transported from Bavra in 2 buses and 6 minibuses.

On August 12, 192 passengers were transported in 12 minibuses, 46
ones were moved from Bavra to Yerevan in 2 buses, 46 were moved from
Bavra to Gyumri, and 16 passengers were transported in a minibus.

On August 13, 192 people were transported from Kobuleti in 12
minibuses.

On August 14 the ministry was in constant touch with the Armenian
embassy in Georgia and the Armenian consulate in Batumi. The ministry
is ready to provide, in case of necessity, vehicles for transporting
people to Armenia.

330 passengers left and 286 arrived by using services of South
Caucasian Railways company (Yerevan-Tbilisi route) on August 6-13. 446
people left and 1,000 ones arrived by Yerevan-Batumi railway in the
indicated period.

Criminal Case Of Mushegh Saghatelian Sent To Court

CRIMINAL CASE OF MUSHEGH SAGHATELIAN SENT TO COURT

YEREVAN, AUGUST 14, NOYAN TAPAN. The investigation into the case of
Mushegh Saghatelian – within the framework of the criminal case on the
March 1-2 events under investigation of the RA Special Investigation
Service – has been completed. The criminal case of M. Saghatelian
was sent to court.

Based on the eveidence obtained by investigators, M. Saghatelian
was charged under Article 316 parts 1 and 2 of the RA Criminal Code
for committing violence (dangerous to life and health) agaisnst the
commander of the 2nd platoon of the 8th company of the State Defence
Service police regiment A. Arshakian and committing violence (not
dangerous to life and health) against policeman of the same regiment’s
3rd company A. Arushanian when the above mentioned policemen were
performing their official duties. He was also charged under Article
235 part 4 for illegal keeping of cold steel weapons.

The case was sent to the Yerevan Criminal Court.

According to the press service of the RA Prosecutor General’s
Office, as of August 14, 12 accused persons are under preliminary
arrest. Precautionary measures other than arrest were chosen with
respect to another 9 accused persons.

84 criminal cases on 97 persons were sent to court: the examination of
67 cases on 77 persons was completed. The examination of the remaining
cases is underway.

Out of the indicated 77 persons, 5 were aquitted, the case on one
person was quashed – due to reconciliation with the accused person by
the order envisaged by Article 183 of the RA Criminal Procedure Code,
fines were imposed on 5 persons, 33 were sentenced to imprisonment,
another 33 persons received suspended sentences and were put on
probation.

YEREVAN, AUGUST 14, NOYAN TAPAN. Armenia’s policy in the South Caucasus
has not changed and the country remains faithful to peaceful solution
of problems, deputy chairman of the Republican Party of Armenia (RPA)
Galust Sahakian said at the August 14 press conference. He avoided
accusing some or other person of what happened in South Ossetia. In
his words, he who instigated these actions is to blame. He expressed an
opinion that a slaughter of civilians was committed in South Ossetia.

G. Sahakian called on Armenia’s political forces and in general
everyone in the country to make reserved judgements, including on
the behaviour of the Armenian authorities.

G. Sahakian has come to the conclusion that the CIS will strengthen
in the near future. He said that if the CIS structures had been
strong, the situation would not have become so strained. He expressed
confidence that the Georgian-Ossetian process will have no relation
to the Karabakh problem.

qualification of audit services is being liberalized and transferred
to the private sector. The RA minister of finance Tigran Davtian said
at the August 14 briefing that until now the qualification of audit
activity has been done only by the ministry, whereas henceforth it
will be also implemented by specialized NGOs that will undergo the
necessary procedures in order to fulfil this function.

According to T. Davtian, henceforth the certificates granted by
international audit organizations will also be acknowledged by
the state.

It was mentioned that there are about 30 audit companies in Armenia.

government approved the draft decision on allowing visits without an
entry visa for Turkish citizens on September 1-6. During the draft’s
presentation, the head of the RA police Alik Sargsian said that the
decision was made in connection with an Armenia-Turkey football match
scheduled for September 6.

In response to Prime Minister Tigran Sargsian’s question about whether
it is not too early to start that process on September 1st, the police
head replied that 20,000-25,000 citizens of Turkey are expected to
arrive in Armenia during the indicated period, and some of them are
likely to spend 1-2 days in our country.

MOSCOW, Aug 15 (Reuters) – Some of Russia’s closest allies in the
former Soviet bloc have distanced themselves from Moscow over its
conflict with Georgia, heralding a possible rift with the Kremlin.

Belarus, Kazakhstan and others in the Commonwealth of Independent
States remained silent for days after fighting erupted last week as
they scrambled to work out their positions.

As Russia grew uneasy over the silence, its ambassador to Belarus
chided Minsk for failing to offer open support. Belarus eventually
expressed condolences for the victims almost a week into the conflict
but kept it statements neutral.

Georgia then announced it was pulling out of the CIS — a Russian-led
grouping of former Soviet states — and urged others to follow suit.

Kazakh President Nursultan Nazarbayev, who has skilfully balanced
strong ties with both Russia and the United States, broke the silence
on Wednesday, offering unusually strong words and saying CIS unity
was under threat.

"Complex inter-ethnic issues should be solved through peaceful means,
through negotiations. There is no military solution to these issues,"
he said in a statement.

"Unfortunately, due to actions by some CIS states, our community has
become weak and has no levers to intervene in such conflicts."

Armenia, Russia’s staunchest ally in the strategic South Caucasus
region, also expressed concern.

"It has been noted that attempts to solve existing problems through
military means are fraught with tragic consequences," the presidential
press service said in a statement.

Russia-friendly Turkmenistan, courted by the West as a new source
of energy for Europe, likewise said "conflicts must be solved only
through peaceful, diplomatic efforts".

RUSSIA’S ISOLATION

The United States said this week that Russia, its ties with the West
already strained over several issues, risked deeper isolation because
of the violence in Georgia.

The conflict over South Ossetia has already given rise to further
disagreement between Russia and Ukraine, which has sharply criticised
Moscow’s military incursion.

In a gesture of support, Ukrainian leader Viktor Yushchenko, with the
leaders of Estonia, Latvia and Lithuania, and Poland attended a mass
rally in Tbilisi this week.

Russia’s traditional allies were more restrained and some, such as
Uzbekistan, have preferred to stay out by saying nothing.

Azerbaijan, keen to regain control over its own rebel region of
Nagorno-Karabakh, avoided sharp words and called for peace.

"We support the territorial integrity of Georgia and support efforts
to avoid the escalation (of violence) in the region and restore peace,"
a foreign ministry spokesman said.

Nagorno-Karabakh, an Armenian-populated region of Azerbaijan,
broke away following a war soon after the Soviet Union collapsed in
1991. The region, backed by Armenia, claims full independence but is
not internationally recognised.

Independent Azeri media, however, have criticised the government over
its ambiguous position. The widely read Zerkalo newspaper described
Russia’s actions as "fascism".

Commentators in Russia said Moscow was caught off guard by this
reaction from its ex-Soviet neighbours.

"Everyone in Moscow thought: ‘We are in the right and the enemy will
be destroyed’, but in Minsk and other CIS capitals everyone was in
disarray," Nezavisimaya Gazeta daily wrote.

"This has totally paralysed the CIS leaders including Belarus. Moscow

RETURN OF LEGAL BOOMERANG

YEREVAN, AUGUST 15, NOYAN TAPAN. "On August 8 Georgian military
sub-units began, as official representatives stated, "establishing
constitutional order" in the territory of its former insurgent
autonomy, currently – the Republic of South Ossetia unrecognized by the
international community. A number of sources claim this armed operation
was allegedly provoked by the Ossetian side. However, we have not
yet found any confirmation of this circumstance by independent sources.

The Georgian army, which at the moment of starting the military
operation had a considerable superiority over the Russian peacekeepers
and the military units of South Ossetia both in terms of their number
and heavy armement, at the first stage of operations managed to take,
without much difficulty, control of most of the dominant heights over
Ossetia’s capital of Tskhinval/Tskhinvali and launched an attack on
the city where half the population of that unrecognized repubublic
lives. The onslaught on the city was accompanied by the massive use of
large-calibre artillery, "Grad" ("Hail") units and tanks. Meanwhile,
the Georgian army rushed to the Roki tunnel in order to gain control
of the tunnel linking Russia and South Ossetia. To all appearances,
the blitzkrieg envisaged restoring Tbilisi’s power over South Ossetia
through "enthronement" of the government of Ossetian collaborationist
Dmitry Sanakoyev.

However, Georgian troops stuck in street battles in Tskhinval with
a Russian peacekeeping battalion and Ossetian regular and irregular
sub-units that offered fierce resistance. The Georgian army also failed
to reach the intended boundary lines in the area of the Roki tunnel.

In response to the actions of the Georgian side, Russia sent motorized
units, tanks and aircraft to help its peacekeepers in South Ossetia. At
the same time Russia reinforced its peacekeeping contingent in Abkhazia
and brought the maritime boundaries of this republic (unrecognized by
the international comunity) under control. The flagship of Russian
Black Sea Navy – "Moscow" rocket cruiser arrived from Sevastopol
to Novorossiysk.

During several days Russian troops forced Georgian sub-units from South
Ossetia and established full control of the zone of peacekeepers’
responsibility. They also hit the whole military infrastructure
of Georgia within the framework of the operation on "enforcement
of peace". On August 12 the operation was completed, and on August
13 Russia began withdrawing its troops from Zugdidi and Gori, two
Georgian cities at the front.

It is also noteworthy that performing their duty as an ally of
Ossetins, the sub-units of Abkhazian armed forces succeeded in
distracting part of the Georgian army and carried out a successful
special operation of driving Georgian troops out of Abkhazia’s Kodori
gorge which Georgian sub-units entered in 2006 in violation of the
1994 Moscow Agreements.

Like in the previous years of intensification of Georgian-South
Ossetian confrontation (1990-1992 and 2004), it was the civilian
population of South Ossetia that suffered the greatest losses as
a result of hostilities: by unspecified data, more than 1,600 were
left dead, while the number of Ossetian refugees from the conflict
zone exceeded 30 thousand. 74 Russian servicemen, including about
15 peacekeepers, were killed. By some expert estimates, the Georgian
side’s losses made 170-180 people. The number of South Ossetian troops
killed is being specified.

The United Nations Security Council held discussions on a resolution
presented by France. To all appearances, the principles, which were
agreed on during a meeting of French President Nicolas Sarkozy with
Russian President Dmitry Medvedev in Moscow, will form a basis for
the resolution.

We will try to sum up the above mentioned developments:

– we can assess the actions of official Tbilisi and president Mikhail
Saakashvili as unsufficiently considered and badly calculated which
have put Georgia in a very difficult position. The matter concerns
not only its undermined military infrastructure and irrecoverable
losses but also the fact that in essence, all the achievements in
the country’s sociopolitical and economic life gained thanks to
the 2003 "revolution of roses" are now in question. The Georgian
residents who lived in the zone of the conflicts had to leave their
homes. Anti-Georgian moods in North Caucasus have reached quite a
high level.

– the unreasoned force operation of Tbilisi resulted in the fact that
Georgia questioned its ability to settle its conflicts with Abkhazia
and South Ossetia without methods involving force,

– given the existence of the Kosovo precedent, South Ossetia and
Abkhazia took a significant step to realization of their plans of
secession from Tbilisi,

– many today ask themselves the question about whether Mikhail
Saakashvili’s actions were sanctioned by Washington or not. Strange
as it may seem, in both cases this can be seen as failure of
the U.S. policy in the South Caucasus. If Americans sanctioned
M. Saakashviki’s actions, it turns out that they were mistaken in
their military and political forecasts, while on the other hand they
did not give the appropriate support to their ally. If the action
was not sanctioned by Washington, it turns out that M.

Saakashvili has involved the Bush administration in an extremely
dangerous adventure and questioned some important positions of the
U.S. in the region.

How expedient is it to deal with such a hardly predictable leader?

– the readiness of numerous volunteers from North Caucasus to take
part in military operations against Georgia on the side of Abkhazia
and South Ossetia showed once again that North and South Caucasus are
two parts of one geopolitical system. Thus, any political planning
in the region of Greater Caucsus is doomed to fail when it does not
take this circumstance into consideration,

– as a result of its strict response actions against Georgia, Russia
has considerably strengthened its positions in North Causasus – at the
time these positions were undermined by two wars in Chechnya. Moreover,
Russia’s rating has risen not only in the Russian regions of the South
Federal Okrug but also in such regions as Adygei, Karachai-Cherkess,
Kabardino-Balkaria, and certainly North Ossetia. Besides, the
demonstration of Moscow’s force capacities in its confrontation
with Georgia became a convincing argument for radicals in Chechnya,
Ingushetia and Dagestan. We do not state that these actions have
resulted in final liquidation of the danger of separatism in North
Caucasus but it is definite that the number of its supporters will
not grow in the foreseeable future,

– Russia’s use and demonstration of force will make Baku consider
everything seriously before taking a decision on solution of the
Nagorno-Karabakh problem by force,

– the "problemness" of Georgia may slow down the development of
projects on realization of hyfrocarbon raw material supply routes
from Central Asia to the West via the South Caucasus by bypassing
Russia. This in its turn means tendencies of strengthening positions
of Russia in Central Asia. Baku and Central Asian countries will think
over South Caucasian routes for supply of power-bearing substances
and the possible actions of Moscow in a crisis situation,

– in the foreseeable future the U.S. can hardly use bridgeheads in
the South Caucasus for military operations against Iran,

At the moment Russia is being accused of violating a number of rules
of international law. There may be some grounds for it but the fact
remains that it is Georgia and not Russia that began the military
operation and that Tbilisi acted in violation of the 1992 Dagomys
Agreements.

On the other hand, what can be done about the precedents of violation
of international law in former Yugoslavia, Iraq and Kosovo which were
set at the time by the U.S, West and the same NATO? At the time they
did much so that the right of force rather than the force of law
could triumph in a number of conflicts. Now the legal boomerang is
coming back.

It can be stated that the currently forming situation in the South
Caucasian region will cause Washington and the West to use considerable
resources for restoration of the previous (before the recent conflict
in South Ossetia) status quo.

Meanwhile the regional players, including official Yerevan, which had
sustained a long pause throughout the conflict, hurried to demonstrate
their loyalty to the winner – Moscow. However, until recently president
Serzh Sargsyan tried to maneuver between the West and Russia because
of the not simple internal political situation."

use of force was carried out by 100%. The vicious economic system
created by Robert Kocharian and Serzh Sargsyan forms the basis of
such diligence displayed by the power structures, Hrant Bagratian,
former prime minister of Armenia, chairman of "Freedom" party, stated
at the August 15 sitting of the public committee on inquiry into the
March 1 events in Yerevan. In his words, the March 1 events showed that
Armenia has the highest index among CIS countries by controllability
of state structures, including power ones.

H. Bagratian said that the state’s total control over the majority of
representatives of the authorities, including members of the government
and parliament, served as a basis for the cruelty that the power
structures showed to the people. In his words, it is property that
makes them vulnerable and easy to control, that is, they fear to lose
their property rather than some post or another. "The involvement in
this model makes people vulnerable, easy to control and linked with
this vicious system which they cannot leave," H. Bagratian said.

According to him, in this way the March 1 events have all every reason
to happen again. At the same time, he underlined that there are some
ways out of the current situation, and "Freedom" party that makes part
of the Armenian National Congress is now working on such mechanisms,
one of which, in the words of H. Bagratian, is the opposition’s
ability to control the masses.

Movement’s leaders to give a pivotal role to young forces, we state
that we support the Armenian National Congress, considering it an
evolutionary and victorious key point of People’ Movement and we
join this structure to bring this final stage of the struggle to a
successful finish and create a dignified and free Armenia," is said
in the August 15 statement of "Hima" youth initiative.

The authors of the statement see the only way to get the state out of
the inadmissible situation, which has formed as a result of systematic
violations of laws and the Constitution, in the consistent struggle
of People’s Movement.
