When push came to shove, Georgia never stood a chance of defending
these parts of its territory (South Ossetia and Abkhazia) against the
military might of its northern neighbour, Russia. Arguably, the
decision of Georgian president Mikheil Saakashvili to forcibly wrest
control of South Ossetia from so-called Russian peacekeepers was
foolish in the extreme. In David-versus-Goliath battles like this,
Goliath usually wins.

Russia has violated Georgia’s territorial integrity. But whether it
was justified in doing so is yet to be determined. Much of the
analysis and debate triggered by this conflict centre on the recent
actions and consequences of the Russian and Georgian military
forces. The violation of Georgia’s sovereign rights, it is argued, is
bad. Defending democracies against the threats posed by authoritarian
states, the argument follows, is good.

Such views are, of course, simplistic. Sovereign rights are not
inviolable. There are sometimes good reasons for violating a state’s
territorial integrity, particularly as a remedy against systematic
human rights abuses. Russia has justified its actions along these
lines. But our knowledge of the facts on the ground before the
outbreak of war remains sketchy. It is therefore difficult to assess
the validity of Russia’s claims properly.

I do not defend Russia’s actions. Instead, I make a broader point
about the justifiability of unilateral secession, that is, the
forcible break-up of a sovereign state. Perhaps if there were some
consensus among policy-makers about the circumstances in which
separatism should be supported, there might be less of an ad hoc
approach to the recognition of breakaway states such as South Ossetia
and Kosovo.

International law states that nations or ”peoples” have a legal
right to self-determination or statehood. But this runs counter to the
legal principle of sovereignty, which permits states to defend their
territory with deadly force. Russia, China, Turkey, Burma, Thailand,
Indonesia and the Philippines, among others, have sought to justify
the suppression of separatist forces in their respective countries by
reference to sovereign rights.

States should retain the right to defend their territory. But, if the
cost of doing so is the continued oppression of minority groups, we
need an exception to this rule. After all, a state’s primary function
is to protect the basic rights of its citizens. If it fails to protect
these rights, a state’s legitimacy is compromised. Aggrieved citizens
and groups would then be entitled to take remedial action in defence
of their basic rights.

In extreme cases, secession may be the only way to defend the rights
of oppressed groups in the long term. Sovereign rights must give way
to human rights. What does this mean in practice? It means that third
parties should not stymie an oppressed group’s attempt to be
self-determining. It also means that third parties would be justified
in aiding the separatists.

Consider the Georgian example. If it could be shown that the citizens
South Ossetia or Abkhazia were systematically oppressed by Georgia
(notwithstanding the presence of Russian forces in these breakaway
regions), then Russia would be justified in supporting the
separatists, assuming its intentions were noble. If, on the other
hand, Georgia’s rule were benevolent, there would be no justification
for unilateral secession.

Georgia is a fledgling democracy. It is also a multi-ethnic state
which has been accused of paying lip service to rights. Saakashvili
promised ”equal opportunity” to all Georgian citizens, irrespective
of ethnic identity. The Government has also adopted many conventions,
including the Framework Convention for the Protection of National
Minorities.

But in Georgia word does not match deed. Those who do not speak
Georgian find it harder to access justice, education and employment
than those fluent in Georgian. For example, the Azeri and Armenian
minorities of Georgia are compelled to have official documents
translated into Georgian a language in which they lack proficiency
before submitting them to courts or administrative bodies (something
they did not need to do as Soviet citizens).

University entry is also difficult for Georgia’s ethnic minorities,
given that national exams for higher education include a compulsory
Georgian-language test. For many ethnic Armenian and Azeri students,
studying abroad is the only option.

The International Crisis Group believes that the political will to
protect and promote minority interests and rights in Georgia is
lacking. Many ethnic Armenians have publicly protested against what
they deem to be ”Georgianisation” policies and have called for
limited autonomy.

These are serious shortcomings for a state that claims to be
democratic. If such discrimination is not ameliorated by a more
enlightened approach to policy-making there is a real chance that
political tensions will persist, leading to more separatist violence.

Arguably, Georgia’s inadequacies are indicative of a long and
difficult transition from one-party rule to liberal democracy. Under
communist rule, they say, you could speak any language so long as you
didn’t criticise the regime. Under post-communist rule, you can say
what you like provided that you use the state’s official language.

For now, the world’s gaze is fixed on the war in Georgia. Sensational
images from the warzone continue to be flashed across the
world. Short-term solutions have been sought. US President George
W.Bush, has indicated his desire to see a return to the status quo of
before August 6. France, for its part, has brokered a ceasefire. Early
reports suggest it’s failing to hold.

I suspect that this conflict will disappear off the media radar as
soon as the violence stops. But the underlying problem of how the
international community ought to deal with separatist conflict
persists. Powerful states such as Russia will continue to act of their
own accord. But middle-ranking powers, such as Australia, must adopt a
principled approach rather than simply throw in their lot with a
powerful ally as these crises arise.

The remedial principle which holds that systematically oppressed
groups may secede if other modes of redress are unavailable provides a
useful framework for assessing the justifiability of secession in
particular cases. This framework looks beyond the immediate causes of
violent conflict to properly identify both victim and culpable
aggressor.

If middle-ranking powers were to allow this framework to inform their
foreign policy, they might, through force of numbers, show up the
Goliaths of this world who often justify their aggression on
humanitarian grounds. More consistency in this area of international
relations might also serve to expedite the resolution of violent
separatist conflicts which continue to rage in parts of many parts of
Asia, Africa and Europe.

In a statement released through PEOPLE this week, Kardashian said `we
talk about it,’ when she was asked about engagement rumors to the
star. "I think I finally made the right choice. He’s just a really
sweet, normal guy."

Kardashian who is currently filming the latest season of her reality
series plans to return to New Orleans to be with her beau throughout
his NFL season with the Saints. `I’m probably going to spend most of
my time in New Orleans for a little bit until he’s done.’

Turk FM holds series of talks on conflict in Georgia

Turkish Foreign Minister Ali Babacan held phone conversations over the
past two days with his United States, German, French, Swedish and
Finnish counterparts on recent developments in Georgia.

Babacan spoke by phone with U.S. Secretary of State Condoleezza Rice,
French Foreign Minister Bernard Kouchner whose country holds European
Union’s rotating presidency, German Foreign Minister Frank Walter
Steinmeier, Foreign Minister Carl Bildt of Sweden that is the chairman
of the Council of Europe, and chairman of the Organization for
Security and Cooperation in Europe (OSCE) Finnish Foreign Minister
Alexander Stubb, Turkish Foreign Ministry said in a statement on
Sunday.

Babacan told his counterparts about his impressions at his visits to
Moscow and Tbilisi together with Turkish Prime Minister Tayyip
Erdogan, the statement said.

Months of tension between Georgia and its former Soviet master erupted
on Aug. 7, when Tbilisi launched an assault to seize back control of
the Russian-backed breakaway South Ossetia region. Russia said 1,600
civilians, many of them Russian citizens, were killed in the Georgian
bombardment.

Ankara has stepped in to resolve the conflict with Prime Minister
Tayyip Erdogan and Foreign Minister Ali Babacan had visited both
Moscow and Tbilisi.

Turkey has proposed the formation of a Caucasian union after the
clashes erupted between Georgia and Russia. Turkey, as a neighboring
country of the region, has close interest in the Caucasus in its
efforts to ensure energy supply safety.

Turkey’s proposal to establish a Caucasian union was widely
accepted. The union, called by Turkey as "Caucasus Stability and
Partnership Platform", is envisaged to bring Turkey, Armenia, Georgia,
Azerbaijan and Russia under the same roof.

Babacan and his counterparts discussed efforts to establish an
enduring cease-fire and exchanged views on steps to take to preserve
peace and stability in the region, Sunday’s statement said.

Ministers also discussed possible functions of the U.N. Security
Council, EU, NATO, Council of Europe and OSCE, as well as Turkey’s
contributions to the process, it added.

BEIJING — A Swedish wrestler was disqualified and stripped of his
bronze medal yesterday for dropping his medal in protest after a
disputed loss at the Beijing Olympics.

Ara Abrahamian was punished by the International Olympic Committee for
violating the spirit of fair play during the medal ceremony, becoming
the fourth athlete kicked out of the Games and bringing the number of
medals removed so far to three.

The 28-year-old Abrahamian became incensed when a disputed penalty
call decided his semifinal match against Italian Andrea Minguzzi, who
went on to win the gold medal in the Greco-Roman 84-kilogram division
on Thursday.

During the medal ceremony, the Armenian-born Abrahamian took the
bronze from around his neck and angrily dropped it on the mat as he
walked away. He did not take part in the rest of the medal ceremony.

BEIJING — Chinese state media appealed to fans to stop cheering
inappropriately at tennis matches, urging them to present a good image

TBILISI (Reuters) – A major Georgian railway that delivers Azeri oil
exports to European markets will be reopened within 10 days following
its destruction on Saturday, Georgian Railways said on Sunday.

Traffic on the railway, which also links Armenia to Georgia’s Black
Sea coast, was halted after a bridge was destroyed near the western
Georgian town of Kaspi. Tbilisi accused Russian forces of attacking
the bridge, but Russia denied this.

"The construction or repair works are expected to be completed within
10 days maximum," Irma Stepnadze, a spokeswoman for Georgian Ralways
said.

She said engineers and workers from neighboring Armenia and Azerbaijan
were expected to arrive in Georgia on Sunday to help with
reconstruction. They were also bringing specialist equipment.

A pipeline running from the Caspian Sea to Russia’s Black Sea port of
Novorossiisk currently remains Azerbaijan’s only oil export outlet.

The Georgian railway line runs through Tbilisi and the
Russian-occupied Georgian town of Gori, before splitting in three and
running to the Black Sea ports of Poti and Batumi and southwest to
just short of the Turkish border.

Azerbaijan, emerging as an important oil supplier to the West and
whose fast economic growth heavily depends on revenues from oil
exports from the land-locked Caspian Sea, last week suspended crude
shipments via its key, BP-operated (BP.L: Quote, Profile, Research)
Baku-Tbilisi-Ceyhan link to Turkey after a fire damaged it.

Earlier this week BP closed the pipeline taking crude from
Azerbaijan’s Caspian port of Baku to the Georgian port of Supsa on the
Black Sea, citing fighting between Georgian and Russian troops.

Russian national gas exports to Armenia have decreased by 30% as of
August 7, ArmRosGazprom’s CEO, Shushan Sardarian, told Interfax.

She said that gas deliveries to Armenia had decreased owing to the
actions of the Georgian Oil and Gas Corporation, which without notice
had commenced test operations on its section of a 700 mm trunk gas
pipeline. As a result, gas pressure in the system fell.

Sardarian added that OJSC Gazprom (RTS: GAZP) is supplying natural gas
to the Transcaucasia in full volume. The company is compensating for
the drop in natural gas supplies through Georgia through reserves from
the Abovyan underground gas storage facility. As a result, gas
consumption in Armenia has gone unchanged, she said.

ArmRosGazprom was founded in December 1997 and is the sole importer of
natural gas to Armenia.

2,000 foreign citizens leave Georgia for Armenia

YEREVAN Aug 11

Some 2,000 foreign citizens have been evacuated from Georgia to
Yerevan with help from Armenia, the Armenian Foreign Ministry
reported.

Among these people are "diplomats accredited in Tbilisi, officials
from international organizations and their families," the ministry
said.

Some 7,500 Armenian citizens returned to their homeland as of 10:00
a.m. Yerevan time on August 11. No Armenian citizens have been harmed
in the Georgia-South Ossetia conflict, the ministry reported.

The Zvartnots international airport near Yerevan is working
intensively, Nana Avetisova, a press officer for the company Armavia,
told Interfax.

"The airport is working to its full capacity, all flights are booked,
there are many people at the airport. Some of them are foreigners
evacuated from Georgia. If the need arises, we are ready to organize
charter flights, but there is currently no such need. Some countries
are sending in special flights to take their citizens home," Avetisova
said.

In the meantime, Armenia is ready to organize addition railway
transportation from Tbilisi to Yerevan, she said.

Peace Corps volunteers in Georgia safely relocated to Armenia

PEACE CORPS VOLUNTEERS IN GEORGIA SAFELY RELOCATED TO ARMENIA

WASHINGTON

The following information was released by the Peace Corps:

Peace Corps Director Ron Tschetter announced today that all Volunteers
and trainees serving in the Republic of Georgia are safe, and they
have been temporarily relocated to neighboring Armenia.

The decision to relocate the Volunteers is due to the ongoing conflict
taking place in the South Ossetia region of Georgia and bordering
areas. All 36 Peace Corps Volunteers and 49 Peace Corps
Volunteer-trainees serving in Georgia are safe. Personnel from Peace
Corps/Georgia, as well as Peace Corps/Armenia, are now supporting the
Volunteers.

The Peace Corps/Georgia office is still open in Tbilisi, and is
constantly and carefully monitoring this situation along with Peace
Corps Headquarters in Washington. Peace Corps Volunteers do not serve
in South Ossetia, the separatist region located in the north of
Georgia along its border with Russia.

The Peace Corps program in Georgia was established in 2001. Since that
time more than 275 Volunteers have served there. The 85 Volunteers and
Volunteer-trainees currently serving in Georgia are working in English
language education, business and social entrepreneurship programs.

The safety and security of Volunteers and Volunteer-trainees is the
number one priority of the Peace Corps. Each Peace Corps program has
an Emergency Action Plan specific to that country and developed in
cooperation with Peace Corps Washington and the local
U.S. Embassy. The plans are evaluated and tested frequently and
information is updated constantly. Volunteers are thoroughly trained
in their roles and responsibilities, and posts are prepared for all
emergencies.

grab Nagornyy Karabakh from Azerbaijan’

It has been confirmed once again following the talks between the
Azerbaijani and Armenian foreign ministers in Moscow yesterday [2
August] that those who mediate these talks have only one aim: to grab
Nagornyy Karabakh from Azerbaijan. Giving us the ground to say so is
US co-chairman [of the OSCE Minsk Group] Matthew Bryza, who grows more
active after meetings between the presidents or foreign ministers and
makes statements that help journalists identify the gist of the talks.

Referendum

The assistant to the US Secretary of State told journalists in Moscow
that the population of Nagornyy Karabakh would determine its future
status: "Those people who live there will decide on it through
voting. I mean residents of Karabakh. Our proposals are that the
Armenian forces should be withdrawn from the seven districts around
Karabakh, international peace keeping forces should be deployed there
and conditions should be created for the return of refugees and
internally displaced persons. Also, a corridor should be opened to
connect Armenia and Nagornyy Karabakh and finally a vote should be
conducted to determine the future status of Nagornyy Karabakh," Bryza
said. He also added that they do not know when all this will happen.

Of course, there is nothing new in the statement of the US
diplomat. The talks have been under way on the basis of the principles
he mentioned for more than three years and the sides were very close
to achieve agreement several times as the mediators put it. Taking
into account the provision in the Azerbaijani constitution that it is
impossible to hold a referendum in one part of the country, Bryza uses
the term "". But the essence does not change at all. The ultimate goal
of the talks mediated by him and another two co-chairmen [from Russia
and France] is to make Nagornyy Karabakh’s independence official in a
vote.

If the talk is about a referendum in Nagornyy Karabakh, its outcome is
clear both for now and for a period of 10-15 years from now. The
Armenians will have the majority even in the ideal option when all the
ethnic Azerbaijanis of Nagornyy Karabakh return there. Bryza, the
negotiating foreign ministers and the presidents know what those
Armenians will decide.

Territorial integrity?

What is use continuing the talks on the basis of these proposals,
which seriously question Azerbaijan’s territorial integrity and are
considered as a time bomb to separate Nagornyy Karabakh? Why have not
the Azerbaijani leadership officially refused these proposals and are
negotiating on their basis, saying in every opportunity that the talks
are being conducted on the basis of the territorial integrity of the
country?

When commenting on Bryza’s statement, officials in Baku say that the
Azerbaijani constitution does not allow the conduct of a separate
referendum in Nagornyy Karabakh. From this viewpoint the statement
about the determination of the status of Nagornyy Karabakh in a
referendum is wrong. However, this position does not alleviate
concerns because it will not be difficult for the Azerbaijani
authorities to make any amendment they wish to the constitution. Votes
of people do not decide anything in this country in any case.

"Scandalous statement maker"

It should be noted that Bryza is noted for making scandalous
statements and then denying them. Such cases have occurred more than
once in the mediation practice of the US diplomat. For example, it is
common for him to speak in one way in Yerevan and say in Baku that
journalists actually distorted his words. It is not ruled out that
Bryza may deny or otherwise interpret what he said in Moscow when he
comes to Baku. However, the essence does not change again. This is the
gist of the talks and perhaps it is worth thanking the US diplomat for
announcing it. Otherwise, the Azerbaijani public would have to be
confined to the statement of the country’s officials that "the talks
are being held within the principle of territorial integrity" and
would be unaware of the true essence of the talks.

"Hypocrite US policy"

Nevertheless, it becomes clear from the position of the US diplomat
how hypocrite his country’s policy is. For example, he says that the
status of Nagornyy Karabakh should be determined in a referendum, but
refers to another principle exceptionally that of territorial
integrity when it comes to the conflicts around Abkhazia and South
Ossetia. Bryza said that the USA’s aim and national interest are
having these conflicts resolved within the framework of Georgia’s
territorial integrity. But who will believe the mediation of his
country after hearing from him conflicting positions on two sets of
separatist conflicts? The leader of Abkhaz separatists, Sergey
Bagapsh, did not conceal yesterday [2 August] that he was encouraged
by Bryza’s statement. Bagapsh said that he welcomes the position of
the US diplomat on a referendum in Nagornyy Karabakh and at the same
time believes that the USA should recognize the outcomes of
referendums on independence in South Ossetia and Abkhazia.

Bagapsh’s statement is quite logical. How fair and sincere is it for
the USA to speak about territorial integrity concerning the conflicts
in Georgia at a time when it believes that a referendum is important
in Nagornyy Karabakh? So, as can be seen here, Bryza has encouraged
separatists with his statement in Moscow. Earlier, the USA questioned
one of the crucial principles of international law by recognizing
Kosovo’s independence in the Balkans. In response, Russia gained quite
a strong argument to support separatists in the former Soviet
republics.

The USA and its embassy in Baku declare on every occasion that the USA
recognizes Azerbaijan’s territorial integrity and does not view
Nagornyy Karabakh as an independent state. But Bryza’s statement casts
doubts on the announcements of the USA that it recognizes Azerbaijan’s
territorial integrity.

Perhaps, the position of the USA is as declared, but will change
following a referendum in Nagornyy Karabakh. It seems that every time
the USA issues statements recognizing Azerbaijan’s territorial
integrity it accidentally misses a phrase that the future status of
Nagornyy Karabakh is a topic of the talks.
