Turkey Interferes In Lawsuit Against German Banks On Genocide Assets

TURKEY INTERFERES IN LAWSUIT AGAINST GERMAN BANKS ON GENOCIDE ASSETS

Defying all acceptable legal norms, Turkey’s ambassador to the
U.S., Nabi Sensoy, recently sent a highly inappropriate letter to
U.S. District Judge Margaret M. Morrow (Federal Court), asking her to
dismiss a lawsuit by Armenian plaintiffs against the German Deutsche
Bank and Dresdner Bank. A copy of this previously undisclosed letter
was obtained by this writer.

In a class action lawsuit, filed by Yeghiayan & Associates; Kabateck,
Brown, Kellner, and Geragos & Geragos, Armenian plaintiffs had accused
the two German banks of concealing and preventing the recovery of
assets, which were deposited by Armenians in these banks "prior to
World War I and the Armenian Genocide." The plaintiffs had further
alleged that the banks "accepted looted assets, forcibly taken by
the government of the Ottoman Turkey during World War I and the
Armenian Genocide."

Ever since the filing of this lawsuit in 2004 (amended in 2006), these
German banks have done everything possible to have it dismissed. They
have challenged the constitutionality of the law passed by the
California Legislature, which extended the Statute of Limitations,
and created standing for plaintiffs to sue the German banks and other
institutions until 2016. In their attempt to counter the charge that
they are the beneficiaries of ill-gotten gains, the German banks,
through their legal counsel, Milbank, Tweed, Hadley & McCloy, have
claimed that the California law "is an unconstitutional encroachment
on the federal government’s exclusive power over foreign affairs."

It now appears that in order to back up their claim, the German
banks have succeeded in getting Turkey to instruct its ambassador to
the U.S. to send a letter to the Judge Morrow telling her that the
District Court is interfering in a matter involving U.S.-Turkish
relations. This modern-day German-Turkish collaboration reminds
one of the alliance forged some 90 years ago between the German and
Turkish governments during the Armenian Genocide. By reviving this
unholy union, the German banks hope to keep their "loot," while the
Turkish government can continue to cover up the genocide and attempt
to preempt any future claims against Turkey itself.

However, the German banks and the Turkish government apparently were
oblivious to the fact that by writing a letter directly to the Federal
Judge, the Turkish ambassador was interfering in a judicial process
to which the Turkish side is not a legal party.

It is noteworthy that the Turkish Ambassador’s letter, dated February
23, 2007, came on the heels of Foreign Minister Abdullah Gul’s latest
visit to Washington, leading one to speculate that the Ambassador may
have been pressured into this improper act by his political superiors,
possibly against the advice of his American attorneys. It is noteworthy
that, during the court hearing on February 27, 2007, the German banks’
attorney disclosed that David Saltzman, the attorney for the Turkish
Embassy, had been in close communication with him for several years
since the lawsuit was first filed.

In his letter to Judge Morrow, Amb. Sensoy wrote: "I am deeply
concerned that the plaintiffs have asked you to sit in judgment on
Turkey’s sovereign acts carried out within its territory, from which I
would request that you refrain. Specifically, the plaintiffs have made
allegations that require this court to delve into whether there was
a governmental plan to commit crimes against Armenians living in the
late Ottoman Empire, including the looting of property. The plaintiffs
have made clear that they wish their allegations to span the demise
of the Ottoman Empire and carry over into modern Turkey. For example,
the plaintiffs allege that the Armenian tragedy extended from 1915 to
1923, insinuating that any wrongful acts that contributed to it are not
only the responsibility of the Ottoman Empire, the predecessor state,
but also its successor, Republic of Turkey, which was founded in 1923."

The Turkish ambassador then unabashedly offered the Judge his
embassy’s services as an unimpeachable source for documentation on
the Armenian Genocide! "My embassy places itself at your disposal to
provide references to scholarly works that disagree with the current
orthodoxy that the Armenian tragedy ought to be termed genocide,"
the letter said.

Amb. Sensoy then chastised Judge Morrow by instructing her that her
"use of the term ‘Armenian Genocide,’ is inappropriate." He said he
was unhappy that in her September 11 opinion, the Judge had made a
reference to the "Historical Background of the Armenian Genocide." He
also accused the Judge of "being an advocate of one side in a genuine
historic controversy…."

In response to this unwarranted intrusion into the affairs of the
court, the attorneys for the Armenian side — the plaintiffs —
filed an affidavit with the court on March 7, 2007, that stated:
"The letter from the Turkish Ambassador is replete with inaccuracies
and erroneous suppositions…. The Republic of Turkey is not a party
to this lawsuit, nor has it appeared in any capacity in such a way to
allow it any voice in this process…. There is no legal justification
for this Court to consider any position presented by the Republic
of Turkey in this case. Accordingly, Plaintiffs recommend that the
Court disregard the Turkish Ambassador’s letter."

On the other hand, the attorneys for the German banks — the defendants
– claimed in their affidavit that the Turkish ambassador’s letter
was "relevant evidence." Not surprisingly, the defendants used that
letter to buttress their allegation that the lawsuit could have to
"negative implications" on U.S.

relations with Turkey. They claimed that the Turkish ambassador’s
letter demonstrates that the court’s consideration of "the degree of
Turkey’s culpability for its treatment of Armenians during the WWI
period implicate[s] sensitive foreign policy concerns between the
United States and Turkey even to this date."

While the Turkish government’s intent in sending such a letter to the
Judge may have been to defend its interests, it may actually result
in the following unintended and detrimental consequences for Turkey:

1) The Ambassador’s unwarranted interference in the affairs of a
U.S. Federal Court could result in the Judge not only rejecting his
unsolicited intervention but also negatively disposing her towards
the German banks for their possible role in orchestrating that letter;

2) Should the judge reject the letter, her ruling would imply that a
straightforward case of seeking the return of Armenian assets held by
German banks, would become, as the Turkish ambassador himself stated,
a legal case with far reaching consequences for the Turkish side,
including the reaffirmation of the Armenian Genocide by a U.S. Federal
Court and holding today’s Republic of Turkey responsible for the
losses suffered by genocide victims.

Once again, by its emotional over-reaction to all issues dealing with
the Armenian Genocide, the Turkish government may have shot itself
in the foot!

President Robert Kocharyan signed a decree on appointing Serge Sargsyan
the Prime Minister of the Republic of Armenia, dismissing him from
the position of RA Defense Minister.

According to another presidential decree, Serge Sargsyan was dismissed
from the position of the Secretary of the Presidential Council of
National Security.

Major US companies continue to distance themselves from two corporate
coalitions that are publicly backing the Turkish government’s campaign
against the Armenian Genocide Resolution, according to documents
released today by the Armenian National Committee of America.

The American Turkish Council (ATC) and the American Business Forum in
Turkey (ABFT), both coalitions claiming to represent US corporations
doing business in Turkey, have each publicly – and aggressively –
opposed the adoption by Congress of legislation recognizing the
Armenian Genocide.

In response to these efforts, the ANCA sent formal letters last
month to each member of the two coalitions, requesting that they
clarify their position on the Armenian Genocide Resolution. To date,
the ANCA has received written confirmation from a number of these
companies that they are not opposed to the adoption of the Armenian
Genocide Resolution. Among these are several major multinationals,
such as Microsoft, Xerox, American Express, Altria, Johnson & Johnson,
FedEx, and Cargill.

Leonard W. Condon, Vice President of Altria’s International Business
Relations, explained in a letter to the ANCA that: "Our international
tobacco company, Philip Morris International (PMI) is a member of
the Turkish American Council. However, neither PMI nor Altria have
taken a position – and neither company plans to take a position –
on the proposed Resolution." Altria is ranked 20th on the Fortune
500 and had revenues last year of $101.4 billion.

Thomas Schick, the Executive Vice President for American Express
Corporate Affairs and Communications, in a letter to ANCA, wrote:
"Please be assured that, as a matter of company policy, American
Express does not take a position on issues before any legislative
body that do not directly affect our company." American Express is
ranked 69th on the Fortune 500 and brought in revenues during 2006
of $30.08 billion.

On April 24 a commemoration evening dedicated to the 92nd anniversary
of the Armenian Genocide will be held on Capitol Hill. For several
years the anniversary of the Armenian Genocide has been marked in
the US Congress at the initiative of the Armenian Caucus Co-Chairs
Frank Pallone and Joe Knollenberg.

Armenpress was told from the Press Office of the Armenian Assembly of
America that this pan-Armenian event will be held in conjunction with
the Armenian Embassy in the US and will feature former US Ambassador
to Armenia John M. Evans as the keynote speaker.

The presidential election is drawing nearer, but the country is
strangely calm. Whereas, this is thought to be a crucial period in
the life of the country. However, no political party said to support
one candidate or another.

Although, no candidates are being considered yet. Of course, we may
say that there is some time, and the situation may change before
April 20. However, it would not be so quiet three months before the
election in any other country. Is it calm before a storm or is it
another political trick?

Vox Pop in the streets of Stepanakert

"The country is ruled by a dictatorship. Evidence to this is the
recent parliamentary election. People are afraid of expressing their
opinion for they may lose their jobs," says Narine Beglaryan from
Stepanakert. "During the election the government will use every means
of falsification. Therefore, people are still silent. They are fed up
with disappointment. Once the opposition used to express its opinion,
not it is also silent. As if this situation is favorable for them."

"Why should the officials disturb themselves to comment on
anything? People are already speaking instead of them. Everyone knows
the name of the next president. And it is not important whether we
agree or not. And not only the president. People already know who
will be prime minister, ministers," says Anna Barseghyan, housewife.

Most people to whom we talked continue to think that the president
will run a third term, therefore, everyone is silent. It appears that
the innumerable statements of the president about the third term were
not convincing.

On April 4 Member of Parliament Janna Galstyan raised the question of
the workers of the mill who went on strike a few days ago. She asked
the government how the problem of the workers who have not received
salary for 6 months would be solved.

Prime Minister Anushavan Danielyan said he had talked to the owner
of the company, who blames the managers of the company. "I told him
if the salaries are not paid, they will be sued," the prime minister
said. He also said the owner has left for Yerevan and promised to
solve the problem over the next week.

On April 4 Prosecutor General Armen Zalinyan was also asked the
question about the strikers. The prosecutor general underlined that
no complaints have been lodged with the Office of Prosecutor General
related to the delay of payment of salaries. "If the workers lodge a
complaint with us, which will include facts of breaches, the office
of public prosecutor will institute charges and start investigation,"
Armen Zalinyan said, adding that earlier the Bread Factory and the
Mill had been owned by a group of people. "The audit of the company
under the former board of managers revealed financial misuse and
tax avoidance. The audit is over, and there are grounds for bringing
charges against the managers. As to the mill, which is privately-owned,
the Office of Prosecutor General can administer supervision only in
case the national interests are concerned, that is tax avoidance,
crimes committed by the workers of the company," the prosecutor
general said.

On April 4 Armenian President Robert Kocharian singed an order on
dismissing Serzh Sargsyan from the post of RA Defense Minister and
appointing him on the post of RA Prime Minister. By another order Serzh
Sargsyan was dismissed from the post of Acting Secretary, National
Security Council under the President of the Republic of Armenia.

on Lermontov street of Stavropol city, Armenians from Baku lived in
the house for a long time, Armenian newspaper "Erkramas" reports. The
murder was committed April 1 between 7:30 pm and 21:30 pm. At half
past seven daughter of the slain businessman went for a walk. She
was absent two hours, prosecutor of Leninski district of Stavropol
city Andrey Vlasov told. When Marina returned nobody answered the
doorbell. It was rather strange, the family used to spend Sunday
evenings at home. The girl opened the gates with her own key. She saw
bodies of her 45-year-old mother, 50-year-old father and 78-year-old
grandmother near the entrance. Murderers were armed with knives,
investigators found a lot of stab-wounds on their bodies. There was
a mess in the rooms, obviously murderers were looking for something.

The 24-year-old girl summoned her strength and called ambulance
and police.

Later investigators found out that jewelry and home equipment was
stolen from the house. The total sum of damage is still under
specification. Currently investigation studies all contacts of
slain businessman. Inquiry group at the head of Stavropol Territory
prosecutor Sergey Golovanev arrived at the crime scene. A criminal
case has been brought in action on Article 105 part 2 (murder of two
or more persons). Prosecutor’s Office of Stavropol Territory deals
with the investigation. "It is hardly an ordered murder, most likely
they have been killed for robbery, and may be the matter concerns
personal hostility.

After all the businessman might cross somebody’s way," prosecutor of
Leninski district stated.

We know him by his previous work and have personal contacts with
him," Sec. Gen. of CIS Executive Committee Vladimir Rushaylo stated

He expressed hope the new Prime Minister will work effectively
in future.

"We accepted the news about late Prime Minister Andranik Margaryan’s
death with sorrow, we worked with him a rather long time and considered
his work effective," Rushaylo noted. He said, appointment of the new
Prime Minister is reality and great expectation are connected with it,
