The model draft about “Bankruptcy of Banks” has been in the processing
phase for the last two years and it is supposed to be adopted
on November 18 in the CIS Inter Parliamentary Assembly plenary
session. Today it was discussed during the international seminar in NA.

The deputy head of the RF Higher Court Experience Investigation
Administration Andrey Egorov represented the revised draft to the
participants of the seminar. He mentioned that the model laws give an
overall regulation but they give the opportunity to take into account
the peculiarities of national legislation. That is the draft has an
advise-giving character and it does not suppose direct application.

According to the RA Central Bank Advocatory administration head Pirouz
Sargsyan, the Law on Bankruptcy of Banks has been adopted in 1996 and
amended in 2004. According to her, the Armenian law is much better
than the model one as it has been tested. In her words, the model law
creates basis for improving the existing law. The Central Bank intends
to represent an offer to amend to law to the Parliament in 2006.

THE EUROPEAN Union opened membership negotiations with Turkey this
week, but the upshot was not to ensure that Turkey will quickly become
a member. That may, in fact, take 10 to 15 years, if it happens at all.

Rather, the chief outcome was to ensure that the rest of southeastern
Europe will come into the EU – and probably well before Turkey.

There’s a nice historical irony here. Turkey, which in its earlier,
Ottoman form occupied much of the Balkans, and therefore cut them off
from what was then the Christian club of Europe, is now the European
door-opener for its former colonies.

Bulgaria and Romania are joining the EU in 2007 anyway. What was
Austria’s price for finally agreeing to the opening of negotiations
with Turkey? A similar promise for Croatia! One thing leads to
another. When those Balkan countries are in, they will immediately
start agitating for their neighbors, just as Poland is now agitating
for a promise to Ukraine. No matter that those neighbors are former
enemies, with bitter memories of recent wars and ethnic cleansing.

The mysterious alchemy of enlargement is that it turns former enemies
into advocates. Germany was the great promoter of Polish membership;
Greece remains one of the strongest supporters of Turkish membership.

When Serbia or Macedonia come knocking at Brussels’ door, they will
exclaim: “What? You have said yes to Turkey, but you say no to us,
who are closer to you and obviously more European than Turkey?”

Because these countries are for the most part small, and because the
EU already takes responsibility for much of southeastern Europe’s
security and reconstruction as a quasi-colonial post-conflict power,
the reluctant older members of the EU will sigh: “Oh, what the hell,
one or two more small countries won’t make that much difference anyway
– our big headaches are Turkey and Ukraine.” So they’ll slip in.

The result is that, whether or not Turkey achieves membership over
the next decade, by 2015 the European Union will cover most of
what has historically been considered to constitute the territory
of Europe. And it will have 32 to 37 member states, for Switzerland,
Norway and Iceland may eventually choose to come in too. The frontline
cases will then be Turkey and Ukraine.

I don’t want you to think I’m ducking the question of Turkish
membership. If we were starting from scratch, I would say that the EU
should have a special partnership (Angela Merkel’s term) with Turkey
(rather than offering full-fledged membership). Why? Because at its
eastern and southeastern borders, Europe does not end, it merely
fades away. It fades away across the great expanses of Turkey and
Russia. Somewhere between Moscow and Vladivostok, somewhere between
Istanbul and Hakkari, you find yourself more in Asia than in Europe.

This partly European character suggests that a special partnership
is in order, because the sense of belonging to a geographical and
historical unity is important for any political community of Europe.

However, we are not starting from scratch. We have promises to keep.

For more than 40 years we have assured Turkey that it will belong to
our European community. We have repeated, strengthened, made concrete
these promises over the last decade.

Besides, the example of Turkey, which must reconcile a mainly Islamic
society with a secular state, is vital for the rest of the Islamic
world – and not insignificant for the 15 million to 20 million Muslims
living in Europe. When I was recently in Iran, a dissident mullah
told me: “There are two models, Turkey and Iran.”

Which should we support? The answer is what Americans call a
“no-brainer.”

Before it happens, however, we have to ensure two things. First,
that Turkey really does meet the EU’s famous “Copenhagen Criteria”
– having a stable liberal democracy, the rule of law (with full
equality for men and women), a free-market economy, free speech
(even for intellectuals who say there was a Turkish genocide against
the Armenians) and respect for minority rights (notably those of the
Kurds). On those, Turkey still has a long way to go.

Second, and just as demanding, public opinion in existing member
states, such as France and Austria, must be prepared to accept
Turkish membership.

Between those two requirements, we have at least 10 years’ work ahead.

4 Million USD Against AIDS

The Global Fund of combat against AIDS, tuberculosis and malaria
allotted 4 million USD to RA to support the national program of
combating AIDS for the coming 3 years. This is the second phase of
the 7.2 million USD grant. The first phase finished in September 2005.

By the way, the speed of spreading of the AIDS/HIV virus is the
highest in our region. According to official data, there are 2800-3000
HIV bacilli carriers in Armenia. 78.3% of them are men, and 21.7%
are women.

Not The Authorities Are Strong, But The Oppoistion Is Weak

“Once Robert Kocharyan said that not the opposition is weak, but
the authorities are strong. I will say just the vice versa – not the
authorities are strong but the opposition is weak today”, announced
Vagharshak Haroutyunyan during the meeting with the members of the
party “National Renaissance”.

He noted that the opposition has made mistakes that in order to achieve
success it must accept its mistakes. Vagharshak Haroutyunyan announced
that unity alone is not enough to be successful in the opposition
field, as a plan of joint actions is also needed.

In this respect Albert Bazeyan said that for making decisions one
must be able to evaluation the situation in order not to give empty
promises.

As for the Constitutional referendum Vagharshak Haroutyunyan said that
Armenia took up the commitment of amending the existing constitution 4
years ago and there were no obstacles to processing a good constitution
during all those years and put it to referendum.

“National Renaissance” Does Not Give Promises

Today the Armavir regional organization of the “National Renaissance”
party founded by the ex-members of the Republican party Albert
Bazeyan and Vagharshak Haroutyunyan was opened. This one too, like
the other in Shirak region was founded in the basis of the Republican
party; moreover, 265 of the 270 members wished to join the “National
Renaissance”, another 10 people became members of the newly founded
party.

Today during the meeting with the members of the regional organization
in Echmiadzin Bazeyan and Haroutyunyan thanked the party members and
explained the importance of their step. Albert Bazeyan announced that
they were against the promises of revolution which were not kept,
while “people counted on them and were disappointed”. Besides, he
was also discontent with the tendency of leaning on outer powers.

One of the members of the party complained that the Republican Party
did not count with their opinion and asked what the new party will do
in this respect. “No document will be created without your agreement”,
announced Vagharshak Haroutyunyan. He also said that when they ask
when the change of authorities will take place, the people and not
single persons must answer this question.

It was also announced that in the coming weeks the other regional
structure of the “National Renaissance” will be founded, and on
November 11 the founding conference will take place.

Golden Chance?

“There is a golden chance for both Armenia and Azerbaijan to settle
the conflict”, said the OSCE Parliamentary Assembly President’s
special representative on Nagorno Karabakh affairs Goran Lenmarker
during the meeting with the NA President. And it was not by chance
that his report represented in Washington was called “Golden Chance”.

The NA President Arthur Baghdasaryan mentioned that Armenia has always
been for the peaceful settlement of the conflict and voiced hope that
the conflict will be solved peacefully and fairly.

Today the RA Ombudsman Larissa Alaverdyan met the UNESCO Moscow office
Human Rights and Social Affairs coordinator Sergey Smirnov.

The aim of the meeting was to discuss the possibilities of cooperation
of the organization and the National Institution of human rights.

The Ombudsman’s institution has applied to UNESCO to organize
a regional conference in Yerevan in 2006 titled “Integration of
approaches of human rights and ethics in political and educational
systems” expecting the organization’s support.

By the way, on October 7 the joint session of the UNESCO Moscow office
and CIS member-countries Ethics Committees will take place under the
support of the RA Ombudsman.

“Whatever the results of the referendum may be, it will be a turning
point in our history”, leader of the Heritage party Raffi Hovhannisian
said during the briefing with the journalists.

Two weeks ago the Heritage party had made an announcement about the
constitutional referendum. After that the Forum of Intellectuals
decided to unite the opposition, but the Heritage did not sign under
the joint announcement about the referendum. Why?

“We want our style to be different”, said Raffi Hovhannisian and
added that on Sunday Heritage will start its regional visits, during
which the party will refer to issues not only about the referendum,
but also about other problems. “As for the cooperation, no agreement
has been reached”, Raffi Hovhannisyan said.

And what has the party done in the margins of the transformational
process announced? “Transformation is not an achievement, it is a
process which will allow us to be able to compete with the civilized
world, which we are not now”, Raffi Hovhannisian said.

By the way, as for the information about Heritage creating a bloc
together with the Republican party, Raffi Hovhannisian announced,
“We have never negotiated about forming a bloc”.

Aid Sent By United Armenian Fund Amounts To $1.8 Million

A press release from California informed that the humanitarian aid send
by the United Armenian Fund reached Armenia on September 30. The aid
amounts to $1,8 million. It includes medicines and medical equipment
amounting to $712.000 given by the Catholic Medical Mission Board. The
Mkhitarist Congregation donated $684.000, Nork-Marash Medical Center
$86.000, Union of Shushi Conservatoire $43 thousand, Cultural Union of
American Armenians $43 million, “Semra” foundation $33.000 and Fund
for Armenian Relief $32.000 of humanitarian aid. Howard Karagozian
Memory Foundation, American Armenian Evangelical Union, AGBU,
Western Diocese of Armenian Church in North America and “Americers”
organization also participated in donations.

Since 1989, the United Armenian Fund has sent humanitarian aid
amounting to $415 million through 315 flights and 237 marine
transpirations.

The press release of World Vision Armenia informed that the “Global
Foundation” against AIDS, tuberculosis and malaria allocated $4 million
to Armenia for the AIDS prevention program. This is the second part of
the grant received in 2003. The first part amounted to $3,2 million and
expired in 2005. The financial agreement of the second stage is signed
by Valery Chernyawski, manager of the Latin America and Eastern Europe
portfolio, and David Thomson, national head of World Vision Armenia.
