Prosecutors To Appeal Against Kocharian Trial Suspension

Armenian prosecutors have decided to appeal against a judge’s controversial 
decision to suspend former President Robert Kocharian’s trial and request an 
important clarification from the Constitutional Court.
In his decision publicized on Tuesday, the district court judge presiding over 
the trial, Davit Grigorian, cited a “suspicion of discrepancy” between the 
Armenian constitution and coup charges brought against Kocharian. He also 
suggested that the constitution gives the ex-president immunity from 
prosecution in connection with the 2008 post-election violence in Yerevan.
The decision was condemned by lawyers representing relatives of protesters 
killed in the March 2008 clashes with security forces. One of them said the 
Constitutional Court must not take up the case because he is legally unable to 
appeal against the judge’s decision.
The Office of the Prosecutor-General clarified later on Tuesday, however, that 
Armenia’s Code of Procedural Justice allows it to file such an appeal. A 
spokesman for the office said it will therefore ask the Court of Appeals to 
annul the trial’s suspension.
One of Kocharian’s lawyers, Aram Orbelian, insisted on Wednesday that while the 
prosecutors can challenge the judge’s decision, the Court of Appeals is not in 
a position to overturn it.
“Under the existing legislation, the Court of Appeals has no right to look into 
the justifications for the [judge’s] appeal to the Constitutional Court,” 
Orbelian told RFE/RL’s Armenian service.
He predicted that the Court of Appeals will therefore rebuff the prosecutors. 
“It cannot say in place of the Constitutional Court whether a particular law 
conforms to the constitution,” he said.
Armenian law gives the Constitutional has one month to decide whether to hold 
hearings and rule on the appeal.
Orbelian confirmed reports that the court chairman, Hrayr Tovmasian, is his 
godfather. He said this fact does not represent a conflict of interest.
“I am simply one of the lawyers in this case,” added Orbelian. “I am not the 
defendant or prosecutor. The case does not apply to me.”
The prosecutors are also planning to appeal against Judge Grigorian’s separate 
decision on Saturday to release Kocharian from custody pending the outcome of 
the trial.
The decision angered many political allies and supporters of Prime Minister 
Nikol Pashinian, who hold Kocharian responsible for the 2008 bloodshed. At 
Pashinian’s urging, they blocked the entrances to court buildings across the 
country on Monday.The premier also called for a mandatory “vetting” of all 
judges and said many of them should quit even before the start of such a 
process.

Council of Europe Secretary General Thorbjorn Jagland and Prime Minister Nikol 
Pashinian discussed recent days’ developments in Armenia in a phone call on 
Wednesday.
“They agreed that the reform process, including the fight against corruption 
and the reform of the judiciary, should proceed in conformity with the 
Constitution, the relevant international standards and Armenia's obligations as 
a member state of the Council of Europe,” the Strasbourg-based human rights 
organization said in a statement.
“Secretary General Jagland confirmed the organization’s support to Armenia’s 
reform agenda,” it said. “A delegation of Council of Europe experts will travel 
to Yerevan in the next days to offer advice and assistance with the necessary 
reforms.”
Pashinian’s press office released an identical readout of the conversation.
The two men spoke by phone one day after two representatives of the Council of 
Europe’s Parliamentary Assembly (PACE) expressed concern at Pashinian’s weekend 
calls for his supporters to block the entrances to all court buildings in 
Armenia. They at the same time welcomed Pashinian’s declared efforts to reform 
the Armenian judiciary.
“Political stakeholders must refrain from actions and statements that could be 
perceived as exerting pressure on the judiciary,” read a joint statement 
released by Yuliya Lovochkina and Andrej Sircelj, the PACE co-rapporteurs 
monitoring Armenia’s compliance with its membership obligations.

Lovochkina and Sircelj noted that Pashinian urged the court blockade following 
a Yerevan court’s controversial decision to order former President Robert 
Kocharian released from prison pending the outcome of his trial on coup charges 
denied by him.
“Without prejudice to the merits of this decision, we wish to emphasise that 
the independence of the judiciary is a pre-requisite for the rule of law, and 
that the rule of law is therefore best served by the absence of any 
interference from political actors,” they said. “There are clear legal 
procedures, such as appeals to a higher court, to challenge a court decision 
that seems questionable.”
The PACE co-rapporteurs at the same time acknowledged “the still low level of 
public trust in the judiciary” in Armenia. “Judicial reforms remain a priority 
and we welcome Prime Minister Nikol Pashinian's stated desire for far-reaching 
reform of the judicial system, particularly with regard to the fight against 
corruption, as well as his wish to associate the Council of Europe with it,” 
they added.
The court blockade, condemned by the Armenian opposition as illegal, began on 
Monday morning. It ended a several hours later, shortly after Pashinian held an 
emergency meeting with senior state officials to announce a “surgical 
intervention” in the judicial system.
He said Armenian courts remains closely linked to the country’s “corrupt” 
former leaders. The premier announced plans for a mandatory “vetting” of all 
judges and said many of them should quit even before the start of such a 
process.

“Haykakan Zhamanak” says that former President Robert Kocharian has been the 
sole beneficiary of recent days’ dramatic developments triggered by his release 
from detention. The pro-government paper says Armenia and Karabakh “have paid 
the price” for his release. “The most terrible thing has happened: the 
administration of justice has turned into an Armenians-Karabakhis discourse and 
the two sides, so to speak, have gone over the top in some cases,” it says. 
“Robert Kocharian personally provoked that, and he did so skillfully.” This is 
why, it says, supporters of Kocharian waved Karabakh flags outside the Yerevan 
court that ordered his release.
“Zhamanak” reports that the two Armenia rapporteurs of the Council of Europe’s 
Parliamentary Assembly (PACE) issued a statement on Tuesday regarding Prime 
Minister Nikol Pashinian’s actions targeting the Armenian judiciary. “They 
welcomed Pashinian’s will and readiness to carry out judicial reforms, 
including with the Council of Europe’s assistance,” writes the paper. “But most 
of the statement was devoted to criticism of his calls for blockading the court 
buildings. In other words, the PACE co-rapporteurs focused their attention on 
an issue which served as a political background for ongoing realities, rather 
than their essence.” That essence, according to the paper, is “the immunity of 
the Armenian velvet revolution and political guarantees of the prospect of a 
democratic Armenia.” “The PACE co-rapporteurs have thus turned a blind eye to 
this extremely important political circumstance,” it says.
“Zhoghovurd” hits out at Vazgen Manukian, a veteran politician heading 
Armenia’s Public Council. Pashinian reappointed Manukian as chairman of the 
advisory state body recently. “Many criticized Nikol Pashinian [for doing 
that,] and with his actions in recent days Vazgen Manukian is consistently 
proving that they were right to criticize the prime minister for being so kind 
towards Manukian,” writes the paper. “At yesterday’s emergency meeting of the 
Public Council he rushed to criticize Nikol Pashinian’s statements made the 
previous day. And most importantly, he found dangerous and damaging the 
authorities’ intention to set up an ad hoc parliamentary commission that will 
investigate the April 2016 war [in Karabakh.]”

Sports: The Warm-Up: Football is an Equal Game… unless you’re Armenian

The Warm-Up isn’t all sunshine and rainbows. Today, it tackles the sad case of Henrikh Mkhitaryan.

It’s 2030. There’s serious unrest in Olivenza, a town planted on the disputed Spain-Portugal border. Relations between the countries have soured and citizens are being advised to avoid the other country due to safety concerns.

Meanwhile, a 45-year-old Cristiano Ronaldo has fired Juventus into the Champions League final. The trophy has eluded him for the last 11 years – but not this time.

There’s one problem. The final is scheduled to be played in Madrid, leaving Ronaldo with a difficult decision. Should he risk his safety for a game of football? Sure, it’ll probably be fine, but is it worth the gamble? Fortunately, UEFA realise the ridiculousness of the situation and move the final to another country. Ronaldo plays and proves the difference. Juve’s 34-year wait for European glory is over.

Back in 2019 and it’s a different story. Henrikh Mkhitaryan will miss Arsenal‘s Europa League final against Chelsea after deciding it’s unsafe to make the trip to Baku. The Warm-Up won’t pretend to know the complexities of Armenia’s relationship (or lack of) with Azerbaijan – a conflict centring around the disputed Nagorno-Karabakh region – and will only comment that it’s desperately sad that a footballer feels trapped by politics.

Of course, Mkhitaryan’s status as an above-average-but-not-outstanding player means UEFA will not entertain the idea of moving the game. So much for their Equal Game campaign: “Everyone should be able to enjoy football. No matter who you are, where you’re from or how you play.”

Still, we could just about understand their logic if this was an isolated incident. But this final has been a disaster for a long, long time.

The airport? Can’t cope with people. The location? More than 2,000 miles away from any club with a realistic shot of reaching the final – and nearly 3,000 from the two that did. The government? Chalking up “an appalling human rights record” according to the Human Rights Watch, while numerous critics have been wrongfully imprisoned.

“I struggle to find the words about how strongly I feel,” said Arsenal’s managing director Vinai Venkatesham. “We have a situation that is completely unacceptable. It is not our decision or Henrikh’s but one we made together. We don’t feel he can travel to a major European final and that’s extraordinarily sad. He has had that opportunity taken away from him, one that is a rare opportunity for any player.

“We’re losing the opportunity of having him to help us win a major trophy,” he added. “It’s an extraordinary shame. All we can really do is make our point very clearly to UEFA. After the final we will explain to them why it’s unacceptable and must avoid it happening to Arsenal or any other club ever again.”

Anyone who thinks UEFA: Defending Baku is disappointing won’t be pleased to hear that a sequel has been commissioned, with Euro 2020 set to descend on Azerbaijan for four games next summer.

So is there any ray of light to come out of this furore? Sort of. At least it’s got Piers Morgan into a tizzy.

Armenia, Azerbaijan are in decades-long territorial conflict
 
Armenia criticized neighboring Azerbaijan for refusing visas to soccer fans of Armenian origin “irrespective of their nationality” to attend the UEFA Europa League final between Arsenal and Chelsea.
 
The denial of visas raises “serious concerns” and is evidence of “deep-rooted intolerance,” Armenian Foreign Ministry spokeswoman Anna Naghdalyan said Wednesday in a statement. Arsenal’s decision not to include Armenian player Henrikh Mkhitaryan in its squad for the May 29 final showed the “incapacity of Azerbaijan to provide a credible security environment,” she said.
 
The Azeri Foreign Ministry rejected the criticisms as “baseless” in a website statement that said it had committed to ensure the security of Mkhitaryan “as well as all the fans” attending the final in the capital, Baku, of European club soccer’s second-most important competition. Armenian athletes have been involved in past sports events in the country, it said.
 
The two nations are embroiled in a decades-long conflict over the territory of Nagorno-Karabakh. The dispute flared into a brief war in 2016, the worst outbreak of violence since Armenians took over the enclave and seven adjacent districts from Azerbaijan in fighting after the Soviet Union’s collapse in 1991. While major hostilities ended in 1994, years of attempts by international mediators to resolve the conflict have failed to produce a peace agreement between the two sides, who have no diplomatic relations.
 
The soccer dispute took place even as Armenian Prime Minister Nikol Pashinyan and Azeri President Ilham Aliyev agreed at March talks in Vienna to seek to establish contacts between their citizens as part of new efforts to resolve the conflict.

The 30-year-old has pulled out of the squad because he is worried about his safety.
 
The game is being played in the capital of Azerbaijan, Baku.
 
There have been long standing political tensions between Azerbaijan and Mkhitaryan’s country of birth, Armenia.
 
“It hurts a lot to miss it”, said Mkhitaryan.

Armenia and Azerbaijan don’t talk to each other because of a long standing dispute over who owns the Nagorno-Karabakh region.

As a result of this conflict, Azerbaijan usually doesn’t allow people from Armenia to enter the country.

Mhkitaryan is the Armenia captain and has concerns over his safety if he goes into Azerbaijan.

In October, he missed Arsenal’s game against Azerbaijan champions, FK Qarabag.

He wants to play with the team, but he spoke with his family and decided not to go. It’s a very, very personal decision and we need to respect him. I don’t understand the political problems but I must respect his decision.

In response to Mhkitaryan and Arsenal’s decision, Uefa said: “Uefa sought and received assurances regarding the player’s safety in Azerbaijan from the highest authorities in the country.”

“As a result of these guarantees, a comprehensive security plan was developed and given to the club.”

“While the club acknowledges the efforts that Uefa and the Azeri government have gone to in this matter, we respect the personal decision not to travel with the player.”

Arsenal fans are claiming that Eden Hazard and N’Golo Kante are both Armenian as they are keen to stop the Chelsea stars from featuring in the Europa League final in Baku.
Chelsea tackle London rivals Arsenal in the Europa League final next week, with the Gunners travelling without Armenian playmaker Henrikh Mkhitaryan.
Arsenal eggheads decided not to make the trip without the Armenian over safety concerns in Azerbaijan.
And without Mkhitaryan on the pitch, Arsenal fans took to the social media ‘claiming’ that Chelsea stars, including the pair of Hazard and Kante as Armenian Citizens’.
One said: “The sad thing is Armenia is a great country.
“I was once there on holiday, I met Eden Hazard and N’Golo Kantè they were both there to visit their grandparents.”
Another fan stressed: “Heard Kepa actually took one of those DNA test packages and came back 62 per cent Armenian.”
And another responded: “Kim Kardashian is Kante god mother apparently? Any truth in this?”
Earlier, Legit.ng reported that N’Golo Kante has handed Chelsea a massive injury boost after returning to training ahead of their Europa League final.

Arsenal fans have taken to social media to joke that a number of Chelsea players are Armenian so they cannot play in next week’s Europa League final.

The eagerly anticipated all-English final in Baku descended into farce on Tuesday when Arsenal announced they would not be taking Henrikh Mkhitaryan to the Azerbaijani capital due to safety concerns.

The Armenian’s safety was a concern because of the dispute between his country and the host nation and, despite receiving assurances aimed at allaying those fears, Mkhitaryan has chosen not to travel to Baku following discussions with the club and his family.

Arsenal fans sought revenge on social media in the aftermath of the news, joking that a number of Chelsea players were Armenian so they also would not travel.

In the State Interests Protection Department of the RA Military Central Prosecutor’s Office, compliance of the purchase of material resources for the needs of the RA Ministry of Defense in previous years with the requirements of the legislation is studied, including from the point of view of the necessity and applicability of the resources acquired. This was informed by the Public Relations Department of the General Prosecutor’s Office of RA.


“As a result of the studies, it was found that the Ministry of Defense of the Republic of Armenia, based on the reports of the relevant officials of the Armed Forces of the Republic of Armenia, that the acquired material resources are very necessary for the needs of the army, in 2010 with 2 contracts signed on December 16, purchased material means of military medical significance with a total value of AMD 557.587.600. Meanwhile, as a result of studies carried out for the protection of state interests, it was found and substantiated that these acquired material means are primarily of high value, are not intended for RA climatic conditions, have no military-medical significance and therefore cannot be used in the RA Armed Forces, because their use requires a large number of human and technical resources.


This is also evidenced by the fact that according to the results of the study, after being acquired, the mentioned products never served their intended purpose, suffered certain damages over the years, and after 8 years, a decision was made to re-evaluate and disassemble them. As a result of this, as accumulated depreciation, the initial value of the common property was reduced by AMD 103,075,700, and individual components included in the composition of the common property were distributed to different units of the RA Armed Forces.


Based on the above, the need to purchase similar material resources for the needs of the RA Defense Ministry, the effectiveness and justification of the use of state financial resources, as a result of which the state suffered a loss of 557,587,600 AMD.


Bearing in mind that the factual circumstances described above may apparently contain data indicating abuse of official position, abuse of power or abuse of official authority, as well as waste of state funds by officials with official powers of the Ministry of Defense of the Republic of Armenia due to selfish or other personal interest or group interest, the study documents were sent to the Main Military Investigation Department of the RA KP to find out the scope of the guilty persons, the latter the further process of preparing materials for the legal evaluation of the acts to solve.
