Congressman Frank Pallone challenges barriers to U.S.-Artsakh travel and communication

Congressional Armenian Caucus Co-Chair Frank Pallone (D-NJ) took to the U.S. House floor Wednesday for a dialogue with House Appropriations Committee Chairwoman Nita Lowey (D-NY) in support of his legislative efforts – via the U.S.-Artsakh Travel and Communication Resolution (H.Res.190) – to end arbitrary and outdated State Department restrictions on U.S. engagement with the Republic of Artsakh (Nagorno Karabakh), Asbarez reported, citing the Armenian National Committee of America (ANCA).

“We must remain committed to strengthening the ceasefire in Nagorno-Karabakh, removing barriers to dialogue, and resolving status and security issues that have hindered discussions in the past,” said Rep. Pallone. “Allowing direct and open dialogue and allowing our diplomats to have a presence on the ground as necessary and when safe is the only way for the United States to help bring this conflict to a resolution.”

As part of the colloquy (a scripted exchange between legislators) Chairwoman Lowey committed to work with Congressman Pallone on this matter.

“We want to thank Congressman Pallone for his principled leadership in breaking down artificial barriers to the direct and open dialogue among all stakeholders that surely represent our best hope for a durable and democratic Artsakh peace,” said ANCA Executive Director Aram Hamparian. “It’s time to give diplomacy a chance, to promote broad-based government-to-government engagement, and to deepen civil society contact and communication at all levels. It’s time to pass H.Res.190.”

Late last week, Rep. Pallone had filed a proposed amendment to the FY2020 foreign aid bill stating: “none of the funds made available in this Act may be used to enforce U.S. government restrictions or prohibitions on visits, travel, contacts, or communications with Nagorno Karabakh.” The Rules Committee, which screens amendments prior to their consideration by the full House, ruled Rep. Pallone’s amendment “not in order.” Joining Rep. Pallone in supporting this proposed amendment were fellow Congressional Armenian Caucus leaders Gus Bilirakis (R-FL), Peter King (R-NY), Adam Schiff (D-CA) and Jackie Speier (D-CA).

During a March, 2019, interview with then-ANCA Government Affairs Director Raffi Karakashian, Rep. Pallone, who holds the record for number of Congressional visits to Artsakh, drew attention to the obstacles Members of Congress typically face when considering this trip.

Armenian ministry of justice to unveil draft law on confiscation of ill-earned assets

YEREVAN, June 13,  /ARKA/. Armenian Ministry of Justice  will soon unveil a draft law on confiscation of ill-earned assets, Deputy Justice Minister Anna Vardapetyan told reporters on Thursday.

Earlier, Armenian Prime Minister Nikol Pashinyan said that in the context of the fight against money laundering and terrorism financing, the commitment to introduce the institution of non-conviction based asset forfeiture is established by the 4th recommendation of the Financial Action Task Force on Money Laundering (FATF).

He also recalled that in 2015, the MONEYVAL Committee of the Council of Europe approved the evaluation report for the 5th stage of implementation of the FATF recommendations, which states that the Republic of Armenia should consider introducing the institution of non-conviction based asset forfeiture in order to improve the practice of confiscating ill-earned assets.

He then said that in 2018, the Organization for Economic Cooperation and Development approved the fourth stage of the report on the compliance of the Republic of Armenia with the UN Convention against Corruption, which states that the institution of non-conviction based asset forfeiture has not been as of yet introduced in Armenia. The report calls on the Republic of Armenia to introduce the new tools provided for by the Convention, including the aforementioned institution in a bid to improve the effectiveness of criminal investigations.

Vardapetyan said the draft law has already been sent for consideration by international experts, who will return it for revision with their suggestions and comments. She said  the bill does not provide for criminal liability and will be presented as a statement of claim against ill-earned assets. 

According to Pashinyan,  this mechanism is an element of transitional justice. In his words, there are cases when a citizen must explain the source of acquisition of  assets, and in this case, it is not the presumption of innocence that  acts, but the presumption of guilt. If a person cannot prove that he/she acquired assets  legally, then the acquisition of this asset is considered illegal. – 0—

Member of ARFD: Decision of French courts on abolition declarations of friendship with Artsakh – violation of Paris neutrality

ArmInfo.Decisions of the French courts on the abolition of the declarations of friendship between the French and Artsakh cities are reprehensible. Representative of the “Hay Dat” offices of ARF Dashnaktsutyun Kiro Manoyan expressed such an opinion in an interview with ArmInfo correspondent.

In his opinion, the number of similar verdicts of the French courts will increase over time. Dashnaktsakan stated that this is due to the fact that the French authorities believe that the French local governments do not have the right to conduct their own foreign policy. “The French authorities believe that representatives of the local governments deviate from the official foreign policy of the country by such steps, since official Paris does not recognize Artsakh’s independence. However, I believe this approach is erroneous, as the local governments have the right to communicate with local self-government units,” Manoyan said, in this context, he added that in February of this year, French President Emmanuel Macron at the annual dinner of the Coordination Council of Armenian organizations of the country tried to touch on this issue. At the same time, the Member of ARFD is convinced that no matter how the French side tried to argue their actions, this step proceeds from the interests of one of the parties, namely Azerbaijan.

“This is a violation of neutrality, which France has so far adhered to,” said Manoyan. According to him, it would be more correct if the French authorities, as before, did not interfere in the activities of the local governments and maintained their neutrality. “We condemn this step by the French authorities. The “Hay Dat” office in Europe is already discussing how to respond and counteract this. We are deeply convinced that this decision was biased,” Manoyan said. The representative of ARFD also categorically disagreed with the rumors circulating that the decisions of the French courts were due to the inaction of Hay Dat due to the attitude of the current authorities of Armenia to “Dashnaktsutyun”. “There are issues that are fundamental for Hay Dat, among which Artsakh and the Bureau are doing everything possible to advance the interests of the unrecognized republic. However, this does not mean that the Armenian authorities should be inactive,” Manoyan said, adding that these decisions became possible after the Azerbaijani side filed a lawsuit in a French court. According to him, the Armenian authorities did not adequately counteract these steps of Azerbaijan. At the same time, Dashnaktsakan pointed out that Armenia has enough leverage to initiate similar declarations of friendship between Artsakh and other units in the same United States or Australia, or other countries where there are no legislative regulations of similar in France and prohibiting direct interaction, however nothing is done in this direction. To recall, court of Cergy-Pontoise of the French Val-d’Oise department to declare invalid a declaration of friendship between the French municipality of Arnuville and Artsakh’s community of Shekher .On the eve it also became known that the administrative court of the city of Grenoble decided to abolish four more charters of friendship signed by representatives of Nagorno-Karabakh with French settlements – the departments of Valence, Bourg-les-Valence, Bourg-de-Perange. The administrative court abolished the charter, guided by the arguments that they do not respect the international obligations of France and are contrary to the foreign policy of the country, which is the exclusive competence of the state.

Pashinyan demanded 650 thousand drams from Kocharyan as compensation

Bako Sahakyan and Caroline Cox discussed settlement of Azerbaijani-Karabakh conflict

ArmInfo. My nomination as a judge of  the Constitutional Court was clearly a political decision. Vahe  Grigoryan, a lawyer and candidate for the position of a judge of the  Constitutional Court, said this on June 13 after meeting with the MPs   of the My Step faction.  

Grigorian said that if he is elected, he  will be able to cooperate successfully both with the authorities and  with the opposition. “We were acquainted with representatives of the  ruling bloc long before they became power. We helped each other on  many issues, so it’s logical that they would like to see me in this  position. I think they will vote in favor,” he stressed.  As for the  Prime Minister’s appeal to block the entrances and exits of the  buildings of the courts, Grigoryan said that he sees nothing illegal  in this. “This is not my workstyle, but everything is within the law.  If at the call of a government representative it is possible to exert  pressure on the judiciary, then there are serious concerns about the  competence of this authority. It’s necessary to focus on this,” he  stressed.

The head coach of Armenia’s National Soccer Team, Armen Gyulbudaghyants, said that Tuesday’s 3 to 2 victory over the Greek National team in the Euro 2020 qualifier was “tough.”

“The boys did a great job, they played in a disciplined manner,” he told reporters during a post-match press conference. He said the team “lost focus only in a single moment.”

“This was a very difficult victory for us,” added Gyulbudaghyants, who added that during these types of matches what matters is the mood, setting and the desire to win.

“First of all you can’t use any U.S. vehicles or transportation to go to Artsakh, but beyond that, they [U.S. State Department] constantly tell you it’s not safe; there’s going to be consequences; you’re going to be put on the Azerbaijan blacklist,” explained Rep. Pallone. “They essentially try to scare people from going – and obviously, if they are trying to scare me and other Members of Congress, that’s certainly going to discourage private individuals and businesses as well.”

Pallone went on to note that “Artsakh is a functioning democracy, a market economy – very much like the United States and the rest of the West. I want people to know that. And, if it’s going to be successful, there has to be not only political cooperation but economic cooperation. None of that [economic and political cooperation] is helpful if you have a restriction on communications and travel.”

The Artsakh Travel and Communication Resolution (H.Res.190) currently has 20 cosponsors, including Rep. Pallone and Representatives Gus Bilirakis (R-FL), Salud Carbajal (D-CA), Judy Chu (D-CA), David Cicilline (D-RI), Katherine Clark (D-MA), Jim Costa (D-CA), Anna Eshoo (D-CA), Tulsi Gabbard (D-HI), Peter King (R-NY), Raja Krishnamoorthi (D-IL), Zoe Lofgren (D-CA), Alan Lowenthal (D-CA), James McGovern (D-MA), Grace Napolitano (D-CA), Janice Schakowsky (D-IL), Adam Schiff (D-CA), Brad Sherman (D-CA), Jackie Speier (D-CA), and Peter Visclosky (D-IN).

The ANCA, as part of its ANCA 360 legislative agenda, strongly supports the efforts of Rep. Pallone to lift outdated and arbitrary U.S.-Artsakh travel and communication restrictions.
