“Kocharyan was not afraid of enemy bullets at the time, and now he is unlikely to be afraid of the investigation, so the hasty intention to arrest him is not clear for me,” the Spokesman said, while agreeing to some extent with Kocharyan’s opinion that the recent processes around him may pursue the goal of preventing the possible participation of the second president in the forthcoming political processes, in particular, early parliamentary elections.

Sharmazanov did not exclude manifestations of personal and political motives in the case on the events of March 1, 2008. “However, if this is so, then such manifestations can have extremely negative consequences for the state,” he said. The Deputy Speaker also stressed that there are many questions in the legal process, which, at the very least, cause misunderstanding. “Thus, Article 140 of the Constitution of Armenia envisages that the head of state can not be prosecuted during his/her tenure and after that for actions arising from his office.” Now the question is whether the announcement of the state of emergency during the March 2008 events was within the limits of Kocharyan’s authority? In addition, he was charged with overthrowing the Constitutional order, which he himself was the guarantor of when he was president. How could a person who was a guarantor of the constitutional order, to overthrow it himself? There is another point that causes a legal casus – Kocharyan is charged under an article that was adopted a year after his resignation. I think that all these dubious points should be solved by the investigation, which hopefully will be fair and objective, “Sharmazanov summed up.

Touching upon the accusation against the CSTO Secretary General Yuri Khachaturov, who in 2008 occupied the post of the head of the Yerevan garrison, Sharmazanov noted that it could cast a shadow on Armenia’s image in the CSTO, and at other international platforms.

The second Armenian President Robert Kocharyan was charged under March 1, 2008 events. As reported by the press service of the Special Investigative Committee, Kocharyan is charged under the first part of Article 301.1 of the RA Criminal Code for violating the constitutional order in the country during the events of March 1, 2008, having a preliminary agreement with other persons. The SIS decided to send a petition to the court to detain Kocharyan.

Former Defense Minister Mikael Harutyunyan is also being accused of the case, however he is wanted. The former head of the General Staff of the RA Armed Forces, and incumbent CSTO Secretary General Yury Khachturov was also summoned for questioning on the case.

To recall, after the presidential elections of 2008, in which Serzh Sargsyan won, clashes occurred between supporters of the opposition candidate Levon Ter-Petrosyan and the law enforcers as a result of which 10 people were killed, 200 were injured.

In an interview to Yerkir Media, Kocharyan called this action “legal surrealism” and a dangerous phenomenon, considering the attempt to reconsider the decision of the Constitutional Court a real bomb placed under the statehood. If such practice continues, the March 1 case will be a real “curse” for the country. He believes that this is dangerous for the army and its reputation.

Kocharyan believes that the case is completely politicized and lacks evidence. He stated that on March 1-2, the question was whether the Yerkrapah Volunteer Union would join the protesters or not. Therefore, Kocharyan instructed by no means allowing that, to prevent the army from interfering in politics and everything was connected only with Yerkrapah. He informed that Armenia was then under attack on the contact line of the troops and Azerbaijan tried to take advantage of the moment. Therefore, the Defense Ministry strengthened its role.

He considers that under the announced State of Emergency on March 1-2, he had the right to mobilize the army to protect important state facilities and he does not know what the army was doing in those days, it was not in his authority, but the responsibility of the Defense Ministry. For Kocharyan, the intervention of the army was “unexpected” and in the future the commissions investigating these events, including the parliamentary one, testified to the non- interference of the army. Moreover, he was accused of late indtroduction of the emergency situation in the country.

He accused the new authorities of revising history, extreme nihilism, in an attempt to turn everything upside down. He expressed the supposition that this criminal case is related to the fears that he – Kocharyan may return to politics. “I announced that I was not going to return to politics, but now I’m being dragged into it,” he said. Kocharyan confirmed that he sometimes made statements against the regime of Serzh Sargsyan, criticized his policies, the Armenian– Turkish protocols, and pension reform. But he had hardly communicated with him over the years.

Kocharyan confirmed that the SIS decided to apply to the court for his detention and arrest. ”I imagine how happy the Azerbaijanis will be when they see that President of Armenia and the first president of Karabakh is detained, a person who increased Armenia’s GDP 5-fold. He compared the situation with the developments in 1937 in Armenia. He noted that he is obliged to struggle and he will struggle, however he does not know what actions the court will take. In early June, Armenian Prime Minister Nikol Pashinyan posted on his Facebook page an account of the funds that he donated during the “velvet revolution”. The “pre-full” list consists of 48 pages of A4 format. The minimum amount contributed to the revolution was 5 drams. The largest transfer was the amount of 1 million 955 thousand drams (4135 dollars). As a result, the organizers of the change of power donated 73 million 589 thousand 894 drams (about 152 thousand 559 dollars), 51 910 dollars (about 25 million 20 thousand 620 drams), 14 thousand 344 euros (about 8 million 91 thousand 357 drams), 2 million 48 thousand 408 rubles (16 million 141 thousand 455 drams). In total, the amount amounted to 122 million 843 thousand 326 drams (about 254 thousand 861 dollars).

Pashinyan confirms: Armenia ready to establish relations with Turkey without preconditions

Expert: Sabotage against Lydian Armenia poses investment risks

Lydian Armenia’s Social Sustainability Manager Nara Ghazaryan expressed this opinion in a conversation with ArmInfo when asked to comment on the situation related to blockade of the road to the field, undertaken by a number of green activists.

 

”There is a law in accordance with which we carry out our activities. And now, when we are at the final stage, when 70-80% of the work has been done, we face such kind of sabotage, and the authorities are not taking concrete steps to resolve the problem. I’m not an expert, and I can not operate with indicators, but I believe that the situation related to Amulsar will affect the country’s investment rating. Such an attitude to investors is unacceptable, “she stressed.

 

In this regard, the expert referred to the recent statement made by US Ambassador Extraordinary and Plenipotentiary to Armenia Richard Mills, who stressed that US investors are not ready to implement major projects in Armenia until they are assured that the incumbent government will find solutions also in the situation with Amulsar.

 

The expert continued that for the international community participation in the Amulsar project of such authoritative structures as the European Bank for Reconstruction and Development (EBRD) and IFC, participating in the project at the initial stage, indicates that Lydian Armenia is guided in its work by the best world standards. “Considering the abovementioned, and the fact that Lydian Armenia carries out its activities within the law, it is unacceptable that operation of other fields continues uninterruptedly. For any investor it becomes obvious that unequal rules of the game are applied to the company, ” Ghazaryan stated.

 

Returning to the issue of economic indicators, the expert noted that the company loses about $ 500,000 daily because of  idle period at the field not considering the wages: “If the government does not take concrete steps to stop this sabotage, the company will have  to dismiss certain local employees whose average salary is about 300 thousand drams. ” In particular, Ghazaryan noted that 32% of the total number of employees, which at the time of the blockade of roads made 1,313 people, are residents of local communities – Jermuk, Gndevaz, Saravan and Gorayk. And in case people lose their jobs, influx of financing into families will stop, which in turn will lead to a new migration wave. “The situation has a significant multiplier effect. This should be a serious alarm for the government to take certain steps in time to avoid deterioration of economic figures. “

 

Concerning purchases Ghazaryan informed that in the period from March 2017 until May 2018  contractor companies in local communities alone, mainly from Jermuk and Gndevaz, made purchases amounting $ 2.1 million. ”The main consumable items of contractors are fuel, food, housing and transport services.  Considering that the population of the communities total 6.5 thousand – 7 thousand citizens, these are quite good indicators, “she stressed.

According to the expert, the situation has reached a critical point, as the government has not yet proposed concrete plans for resolving the situation, although several letters have already been sent to the government by the company and community residents. Moreover, according to Ghazaryan, delaying the decision of the issue by the government is causing concerns of the residents as well.

 

“The situation becomes critical in terms of perception as well. People are very concerned, because there is no order. They call us, asking how they can help. A group of citizens who blocked the roads, intends to act aggressively, anarchy reigns. This makes negative impact not only on the company, but the state as a whole. We even proposed that the National Security Service be involved in this matter, let it conduct appropriate checks. I do not remember any company that would have made such a statement, “she stressed.  In conclusion, Ghazaryan expressed hope that the authorities realize the seriousness of the issue and will take the necessary steps. To recall, Lydian Armenia is a subsidiary of the British Lydian International, whose shareholders are also large international institutional  investors from the United States, Great Britain and a   number of  European countries, including IFC and EBRD. The Amulsar   project is  the largest industrial project in Armenia for the   development of the  Amulsar gold deposit at a total cost of $ 370   million.  In August  2016, a project for the construction and   development of the field was launched. Preliminary work has been   carried out since 2006.  The life  of the Amulsar deposit will be 10   years and 4 months, an annual  average of 200,000 ounces of gold   (about 10 million tons of ore) is  planned. The company’s shares are   quoted on the Toronto Stock  Exchange.  Amulsar deposit is the second  largest in Armenia.

YEREVAN, JULY 27, ARMENPRESS. If the government were not to declare a state of emergency on March 1, 2008 it could’ve led to additional victims, according to former minister of justice Davit Harutyunyan.

“The situation in those days in downtown Yerevan was such that not declaring state of emergency could have led to additional victims. I am saying this as a citizen whose house was nearby the very actions,” Harutyunyan told reporters today in parliament.

Harutyunyan said the declaring state of emergency is part of the tools of the president granted to him by the Consitutiokn, and a president must not answer for his actions during his tenure after his term in office ends.

“The president’s duties obliges him to ensure the security of Armenia. And these very powers, which are granted to the president for solving tasks, any action stemming from this, cannot imply responsibility in the future for these steps. Otherwise any president at the most decisive moment when the latter has to declare martial law, right up to war, can be constrained, thinking what will happen after a regime change,” argues Harutyunyan.

Speaking about the charges against former President Robert Kocharyan, Harutyunyan says he doesn’t see a legal language in the statement of the Special Investigative Service.

“I don’t see a legal part here,” he said, adding that he voiced the same opinion about the SIS’s statement concerning Michael Harutyunyan.

The former justice minister says criminal prosecution of the second president of Armenia is extremely concerning. He said that a state of emergency regime implies the use of the military during state of emergency.

“The law was adopted in 2012, and the bill passed the expertise of the Venice commission, and there was no objection in this regard, because similar approach is adopted in numerous countries,” he said.

Harutyunyan says the Republican Party of Armenia (HHK), his party, will soon present its political assessment over the issue.

The March 1 case is an ongoing investigation into the deadly 2008 post-election unrest in Yerevan. Kocharyan was the outgoing president at the time, as Serzh Sargsyan was named winner of the presidential election. Mass protests erupted in Yerevan, which led to fatal clashes between security forces and demonstrators.

Earlier criminal charges were pressed against Kocharyan over the March 1 case, and prosecutors requested a court to issue an arrest warrant.

Kocharyan is charged with paragraph 1 of Article 300.1 of the Criminal Code (breaching Constitutional order).
