YEREVAN (YERKIR) – Armenian Foreign Ministry has released a statement
over the presidential election in the Nagorno Karabakh Republic. The
statement reads, in part.

We welcome the presidential election held in the Nagorno Karabakh
Republic on July 19 with a 80 per cent turnout. The elections are
one of the pillars of the Artsakh population to ensure democracy
and rule of law. The legally-elected authorities are successfully
ensuring the security and stability in the region even when a final
settlement has not been reached.

In some OSCE and international documents it is clearly mention that
not only Nagorno Karabakh should be part to the conflict settlement
talks but also that it should be represented by a leadership elected
by the Karabakh people.

The people of Artsakh are adamant to sttle the conflict through talks
to reach peace and final settlement.

Unlike other conflict, Nagorno Karabakh population has been always
forced to ensure its security by its own means and without the
international community’s help. They reached democratic developments
and internal stability in the same way.

TAKE PLACE ON AUGUST 6

YEREVAN, JULY 20, NOYAN TAPAN. The first sitting of the RA
newly-composed Central Electoral Commission will take place on August
6 and the Chairman, the Deputy Chairman and the Secretary of the
Commission will be elected during this sitting.

The Central Electoral Commission will be composed of one member from
each of the following parties: the Republican Party of Armenia (RPA),
the "Bargavatch Hayastan" (Prosperous Armenia), the ARF Dashnaktsutiun,
the "Orinats Yerkir" (Country of Law), and the "Zharangutiun"
(Heritage) parties, as well as one person appointed by the RA
President. In addition to this, two members from the staff of judicial
servants will be appointed by the Council of the Chairmen of the RA
Courts and included in the staff of the Central Electoral Commission.

According to the information provided to a Noyan Tapan correspondent
by Hovsep Khurshudian, the Spokesperson of the "Zharangutiun" party,
this party will be represented in the Central Electoral Commission by
Zoya Tadevosian, a Doctor of Economics and an assistant professor in
the State University of Economics of Armenia. Abram Bakhchagulian,
the Deputy Chairman of the acting commission, will represent the
RPA party in the Central Electoral Commission by the decision of
the RPA Board. Irrespective of the fact that the "Orinats Yerkir"
party has not made an official decision as yet, Sona Sargsian, the
current member of the Central Electoral Commission, is most likely
to continue the fulfilment of her obligations, according to Susanna
Abrahamian, the Spekeswoman of the party.

The names of the other members to be appointed in the Central
Electoral Commission will be published in the near future as soon as
the corresponding bodies make their decisions.

Hit-And-Run Suspect Charged With Second-Degree Murder

HIT-AND-RUN SUSPECT CHARGED WITH SECOND-DEGREE MURDER

A Glendale man suspected of a hit-and-run crash that killed
a 24-year-old Glendale woman was charged today with second-degree
murder, the Los Angeles County District Attorney’s office announced.

Ara Grigoryan, 21, was expected to answer to the charge in Pasadena
Superior Court today, said Deputy District Attorney Robert Knowles.

The D.A.’s office will ask that Grigoryan be held without bail.

Grigoryan is suspected of driving a black Mercedes-Benz on July 10 that
struck and killed Elizabeth Sandoval as she was walking on Glendale
Avenue near Windsor Road. The driver did not stop. The vehicle was
found last Saturday near a Van Nuys body shop. Grigoryan was arrested
in Mexico City this week by U.S. Marshals as he was allegedly going
to take a flight to Europe and possibly his home country of Armenia,
police said.

The Mexican government deemed him undesireable and turned him over to
U.S. custody. If convicted, he’s facing 15 years to life in prison,
officials said.

Cet intellectuel se presente, sans etiquette, aux elections
legislatives du 22 juillet. Pourfendeur du nationalisme, il entend
ressusciter la gauche democratique en Turquie

Le portrait de Hrant Dink est accroche au mur, dans un coin du salon
du pied-a-terre stambouliote de Baskin Oran. Le visage doux et franc
de son ami journaliste d’origine armenienne, assassine de trois balles
dans la tete, en janvier, sur un trottoir d’Istanbul, le suit comme
une ombre douloureuse, forcement omnipresente.

" S’il etait encore en vie, c’est peut-etre lui qui se trouverait
aujourd’hui candidat a ma place ", soupire le professeur. Derrière
ses fines lunettes, son regard bleu percant se trouble. D’un geste
du doigt, il reprime une larme. " J’aurais aime qu’il puisse voir ca.

Mais peut-etre aussi que, si Hrant etait encore la, ce moment ne
pourrait pas exister. " Les obsèques du redacteur en chef du journal
Agos, auquel Baskin Oran collabore depuis 2000, cette " Marche des
100 000 " où des Turcs de toutes origines scandaient " nous sommes
tous Armeniens ", ont ouvert une brèche. " Je me suis dit qu’il etait
possible de reunir tous les gens de conscience. "

C’est dans ce but que ce petit homme calme et poli a la barbe et
aux cheveux blancs, s’est lance, un peu malgre lui, dans la campagne
des elections legislatives qui se tiendront en Turquie dimanche 22
juillet. Comme candidat sans etiquette dans la 2e circonscription
d’Istanbul, " voix de la gauche " et porte-parole autoproclame "
des exclus et des opprimes ", il propose d’entrer au Parlement " pour
que – leurs – fils et petits-fils ne soient pas tues dans le Sud-Est
", où s’affrontent l’armee turque et les separatistes du Parti des
travailleurs kurdes (PKK).

Jeune retraite de l’universite d’Ankara où il enseignait la science
politique et les relations internationales depuis 1969, il envisageait
de couler des jours paisibles loin de toute agitation, dans sa maison
de Bodrum, au bord de la mer Egee. " Je n’avais jamais pense me lancer
dans la politique, dit-il. Je n’ai jamais ete membre d’un parti ou
d’une association etudiante, ni meme delegue de classe.

Et je n’aime pas tellement aller demarcher les gens, ce n’est pas
dans ma nature. "

La decision, ce sont ses amis, une poignee d’intellectuels liberaux des
beaux quartiers d’Istanbul, qui l’ont prise pour lui. Tout est parti
d’un manifeste publie en mars dans le quotidien Radikal, où Ahmet Insel
et Seyfettin Gursel, professeurs a l’universite Galatasaray, appelaient
a soutenir des candidats independants, representants de la societe
civile et d’une troisième voie a la turque, laïque et democratique.

" Ce projet est ne d’un constat, explique Ahmet Insel. On se demandait
tous pour qui on allait bien pouvoir voter. Le barrage de 10 % des voix
necessaire pour etre represente au Parlement exclut de facto la gauche
et l’efface de la memoire des citoyens. " Le mouvement s’organise,
sonde la population, dresse un portrait-robot du porte-voix ideal.

" Il y a eu une convergence sur son nom, poursuit Ahmet Insel. C’est
une figure connue du droit des minorites et il a le punch pour contrer
l’ideologie nationaliste. " D’abord effraye, le candidat se laisse
convaincre : " C’est comme un deuxième service national. "

Franc-tireur, peu a l’aise dans les seances de serrage de mains,
Baskin Oran s’est plie sans broncher a cette mission. Il porte tous
les espoirs des Turcs liberaux, decus par le gouvernement de Recep
Tayyip Erdogan et veut promouvoir la societe arc-en-ciel a la turque.

" Baskin, c’est la baguette magique, s’enthousiasme Cengiz Aktar,
professeur a l’universite Bahcesehir. Il sera la veritable opposition,
celui qui va remuer la merde. " Un trublion qui, grâce a l’immunite
parlementaire, pourrait demultiplier sa liberte de parole.

Le candidat evoque deja " les quatre cadavres enfermes dans le placard
: le Kurde, l’Armenien, Chypre et l’islam, qui commencent a puer. "
Baskin Oran veut faire voler en eclats " tout ce qui a ete appris
par coeur ", les reflexes identitaires, les tabous historiques, " le
kemalisme fige depuis les annees 1930 " et " la paranoïa de Sèvres
", cette peur vivace nee du traite signe en 1920 qui prevoyait le
depecage de l’Empire ottoman entre les puissances occidentales,
mais qui ne fut jamais mis en application.

Des paroles et des chroniques qui claquent et piquent au vif les
nationalistes. Comme en 2004, lorsque Baskin Oran et Ibrahim Kaboglu
presentent, a la demande du gouvernement, un rapport sans concession
sur les droits des minorites en Turquie. Ce document officiel leur
vaut d’etre poursuivis par un procureur, au titre de l’article 301
du code penal qui punit " l’insulte a l’identite nationale turque
". Les invectives ont suivi, comme celle du depute de centre droit,
Suleyman Saribas, qui lance depuis la tribune du Parlement : " Demandez
donc a leurs mères qui sont leurs pères ! Ils en ressortiront plus
instruits. "

Puis les menaces de mort. Depuis l’assassinat de Hrant Dink,
Baskin Oran est protege par un garde du corps. Mais, pour ses
ennemis, l’universitaire, reconnu comme l’un des plus brillants de sa
generation, n’est qu’un " aristokrat " deconnecte, un " fils de George
Soros " a la solde des puissances etrangères et soutenu par les Kurdes
du PKK. Il a pourtant denonce sans ambiguïte le terrorisme kurde et
l’ethnonationalisme, cette " maladie infantile " dont souffrent les
Kurdes autant que les Turcs. Une condamnation qui lui a meme valu
les foudres d’une frange du DTP, parti legal proche du PKK.

Pur produit de la gauche kemaliste, fils d’un juge republicain
elu depute d’Izmir sous les couleurs du CHP (Parti republicain du
peuple), Baskin Oran n’etait pas predispose a remettre en cause sa
propre education. Ce sont ses premières recherches de jeunesse, sur le
nationalisme africain et sur les droits de la minorite turque de Grèce,
qui l’eclairent sur son propre pays. " Je veux rassembler les alevis,
les feministes, les ecologistes, les homosexuels… Les minorites au
sens large. La gauche traditionnelle n’a pas ete capable d’embrasser
ces forces sociales et ne connaît que les Kurdes et les ouvriers. "

Et puis, il y a sa rencontre fondamentale avec Hrant Dink. Un jour
de 1993, quelqu’un l’avait appele a l’universite. " Mon nom est Dink.

The International Foundation of Electoral Services (IFES) in Azerbaijan
organized a Gallup poll among 1400 citizens. As a result, 52 %
of the questioned are satisfied with the situation in the country,
while in 2003 it was only 31 %.

60% of the questioned positively evaluate the economic state of
their country, 66% are interested in politics and the works of the
government, according to the Gallup poll organized by the US Agency
of International Development, Azerbaijani media informs.

The most interesting thing is that 60% of the questioned
trust President Ilham Aliyev overall and 25% of them trusts him
partially. 38% of the questioned Azerbaijanis trust to their army
totally and 37% – partially.

The Turkish Foreign Ministry publicized a report in Ankara on 17 July
condemning the presidential elections in Nagorno-Karabakh scheduled
for 19 July, Trend reports.

The document stated, "As it was known, after an illegal constitutional
referendum held in Azerbaijani Nagorno-Karabakh territories occupied by
Armenia on 10 December 2006, the so-called presidential elections are
planned to be held in the area on 19 July 2007." The report says that
"the illegal elections are considered in Ankara to be a component of
efforts and unilateral steps intended to legalize the situation in
Nagorno-Karabakh which does not correspond to the standards of the
international law, as well as to violate the decisions made by the
UN Security Council and OSCE."

The report emphasises that during the period when talks on the
settlement of Armenian-Azerbaijani Nagorno-Karabakh conflict
are in progress within the framework of the OSCE Minsk Group,
"holding the so-called presidential elections in occupied
Azerbaijani Nagorno-Karabakh should be viewed as a challenge to the
peace process. In this connection, the Turkish Foreign Ministry,
condemning the elections as another effort to break political unity,
sovereignty, and territorial integrity of Azerbaijan, believes them
to be incompetent from the standpoint of the international law and
does not recognize the results of the elections."

YEREVAN, JULY 16, NOYAN TAPAN. The tariffs of services provided by
ArmenTel by the exclusive right will be rebalanced and the telephone
communication market will be liberalized by October. Robert Nazarian,
the Chairman of the RA Public Services Regulatory Commission, stated
this on July 13.

However, according to Oleg Bliznyuk, ArmenTel’s Director General, no
such agreement has been reached officially yet. He said that changes
of tariffs is inevitable for market liberalization, and unless the
sides come to an agreement on tariffs, ArmenTel will not renounce
the monopoly in the term announced in advance.

O. Bliznyuk said that ArmenTel plans to use different tariffs for
three categories of subscribers, budget organizations physical and
juridical persons.

The ArmenTel Director said that by the end of the year the company
is going to install fixed and mobile telephone communication new
equipment of last generation. The company is also promising to continue
digitalization of Yerevan’s fixed telephone network. In O. Bliznyuk’s
words, in the coming six months Yerevan’s 400 analogous stations will
be turned into digital ones. He said that laying of new telephone
lines is a more complicated issue, which is also being done.

In response to the question of journalists, Bliznyuk said that
ArmeTel’s brand is a national value and its change into BiLine is
not appropriate.

WHAT THEY ARE AFRAID OF IN KARABAKH;
Separatists are panic-stricken

AZERBAIJANI ANALYSTS REGISTER PANIC IN NAGORNO-KARABAKH; Azerbaijani
analysts perceive panic in the self-proclaimed Republic of
Nagorno-Karabakh.

Separatist media outlets keep discussing the return of the
Armenian-occupied territories to Azerbaijan. They are clearly upset
by the lack of certainty concerning the future status of the
so-called Republic of Nagorno-Karabakh. These speculations strike the
reader with the unmistakable absence of the feeling of security,
hopelessness, fear, and panic caused by the shortage of personnel and
finance and by the grave economic crisis affecting Karabakh
separatists.

This is the only conclusion that leaps to mind upon reading a piece
by analyst Vagan Arzumanjan posted on the pro-separatist Karabakh
Open website last night. Here are some experts from it with comments.

"It is common knowledge that the conflict settlement plan stipulates
a delay with definition of the status of the Republic of
Nagorno-Karabakh in return for: 1) return of jurisdiction over seven
districts apart from the Lachin corridor whose size and status is to
be discussed separately; 2) Azerbaijani refugees’ return to their
homes; 3) deployment of international peacekeepers on the
Azerbaijani-Armenian front-line." The first two conditions are viewed
as fundamental and Armenian politicians add "in return for
sovereignty only" essentially second them.

Let us consider the consequences of these concessions for the
Armenian side. The front-line will become almost twice as long as it
currently is. The new positions will be much more vulnerable. It will
take much more in terms of personnel and military and engineering
resources to fortify the extended "border" and the particularly
exposed positions on it. Renewal of the hostilities will make control
over the Lachin corridor, wide open to attacks on both sides,
extremely difficult to retain. The enemy in the meantime does not
even need to retake it. Using artillery pieces, aviation, and raiding
parties, the enemy may make the Lachin Corridor impassable and
Karabakh will be essentially in a siege. A sudden mass bombardment of
settlements will kill a lot of noncombatants causing panic,
demoralization, and undeniably a stampede of civilians. Foreign
contingents along the front-line will merely permit third world
countries to promote their own interests in the region instead of
trying to resolve the crisis. Any "buffer" zone along the front-line
will be purely symbolic. Located as it is on the plains, a forced
march across it will take the Azerbaijani regular army less than half
an hour.

"Restoration of Azerbaijani jurisdiction over the Zangilan, Jebrail,
and Fizuli districts will move the front-line closer to the Megri
district. This district of Armenia only 40 kilometer wide will be
made extremely vulnerable by this development. The return of
Kjalbajar in the meantime will allow for Azerbaijani control over
Karabakh’s water resources. The water supply of the enclave will be
in jeopardy, and the threat of acts of sabotage at water-flow control
objects will become imminent.

The railroad connecting Goradiz, Megri, and Nahchyvan enormously
benefits Azerbaijan and Turkey. Using it, Azerbaijan will be able to
bring whatever it needs from Nahchyvan and Turkey with insignificant
transportation costs. As for Armenia, it is not going to benefit much
and Nagorno-Karabakh not at all. The use of the railroad between
Hankendi, Agdam and Yevlah is unlikely for several reasons: being a
dead-end, Hankendi is not what Azerbaijan desperately needs. And
Nagorno-Karabakh does not produce anything the Azerbaijanis would
want to buy but flatcars and echelons."

The piece asserts as well that "Azerbaijanis alone will benefit from
the use of highways since they themselves will control them. Their
high birth rate, coupled with the deliberate policy of settlement in
new territories, will tip the Armenian-Azerbaijani population ratio
in favor of the latter."

Colonel (retired) Ildrym Mamedov, ex-commander of an army brigade, is
convinced in the meantime that the separatists are panic-stricken.
"Noncombatants have nothing to fear as long as their hands are not
smeared with the blood of peaceful Azerbaijanis from Shusha, Hojala,
and other cities and districts," Mamedov said. "It is Kocharjans,
Gukasjans, Sarkisjans, and other war-mongers who murdered Azerbaijani
who should be afraid. I reckon that there will be a special panel one
fine day, a structure established under the UN or a Council of Europe
aegis. Whoever broke the law will be brought to justice to prevent
something like that from happening again."

According to Mamedov, thousands of Armenians live beyond the
territories occupied by Armenia these days. "Everyone knows where
they live but has anyone harmed them in any way?" he said.

peuvent prétendre à des prestations d’assurance auprès du groupe Axa.

Les héritiers des victimes des massacres d’Arméniens sous l’Empire
ottoman pendant la Première Guerre mondiale peuvent prétendre à des
prestations d’assurance auprès du groupe français Axa jusqu’en
octobre, ont annoncé mardi des avocats. AXA est en effet parvenu à un
accord d’un montant de 17,5 millions de dollars (12,7 millions
d’euros) en faveur des héritiers de porteurs de polices d’assurance
auprès de filiales de cette compagnie, notamment l’Union-Vie, qui
exerçaient alors leur activité dans l’Empire ottoman.

Il y a deux semaines, Axa a diffusé la liste de 7 000 victimes dont
les héritiers peuvent demander le paiement d’une prestation
d’assurance.

Les candidats doivent présenter des documents prouvant leurs liens
avec les victimes, a précisé le cabinet d’avocats qui s’est chargé de
la plainte. Barseg Gardalian, un avocat de ce cabinet américain, a
précisé que les candidatures étaient acceptées depuis le 1er avril
jusqu’au 1er octobre.

Le cabinet de l’avocat californien d’origine arménienne Vartkes
Yeghyayan avait déjà entrepris une démarche similaire il y a quatre
ans auprès de la compagnie d’assurances New York Life aux États-Unis.
En janvier dernier, New York Life a commencé à verser des prestations
aux héritiers de ses assurés arméniens qui vivaient dans l’Empire
ottoman en 1915.

Forts de ce succès, les avocats étaient parvenus fin 2005 à un accord
équivalent avec Axa. Le groupe ne souhaite pas faire de déclarations
complémentaires, considérant aujourd’hui que la procédure a suivi son
cours normalement.

Dès 1922, le directeur de l’Union-Vie avait informé les autorités
françaises que la compagnie détenait un portefeuille de plus de 10
000 contrats d’assurance-vie souscrits principalement par la
population d’origine arménienne, mais l’affaire était tombée dans
l’oubli.

Depuis, c’est le principe de la prescription qui empêchait les
héritiers de récupérer les sommes investies par leurs aïeux. Un
facteur que le cabinet d’avocats en charge de l’affaire a réussi à
faire invalider par un tribunal de Los Angeles, en s’appuyant sur la
législation californienne qui reporte à 2010 la prescription pour les
crimes commis lors des massacres en Arménie.

Les indemnités reversées par Axa seront réparties en deux volets :
l’un pour les descendants des victimes, l’autre pour les associations
et organisations arméniennes de France, qui effectuent un travail de
mémoire depuis les massacres. Ainsi, sur les 17 millions de dollars
qui correspondent à la somme des contrats datant de 1915, 3 millions
devraient être reversés à des associations.

« Pour entrer dans le cadre des décisions du jugement, les projets
présentés devront être à caractère éducatif ou humanitaire »,
explique Alexis Govciyan, qui préside le Conseil de coordination des
organisations arméniennes de France (CCAF) et qui a été chargé par le
cabinet Vartkes Yeghyayan de collecter les projets des associations
demandeuses de fonds. Ils seront ensuite transmis à la fondation qui
sera créée par le cabinet d’avocats américain, en liaison avec Axa.

Au-delà de l’aspect financier, la décision d’indemniser les héritiers
des anciens assurés a une portée politique. « C’est un événement très
important en termes de reconnaissance des faits qui se sont déroulés
à partir de 1915, ajoute Alexis Govciyan. Cette décision est
essentielle dans un contexte où nous essayons de lutter contre la
négation du génocide arménien. » En effet, les autorités turques
continuent de nier le génocide de la population arménienne entre 1915
et 1917, des massacres qui ont fait plus de 1,5 million de morts
selon les Arméniens, 250 000 à 500 000 selon les autorités turques.

« On observe aujourd’hui un grand activisme des associations turques
qui nient le génocide, ajoute Alexis Govciyan. Le comité Talaat
Pacha, du nom de l’instigateur du génocide arménien, est
particulièrement actif. L’accord avec le groupe Axa est fondamental
pour lutter contre cette vision négationniste. »

Début 2006, des plaintes en nom collectif demandant la restitution de
dépôts saisis par l’Empire ottoman et transférés en Europe ont été
déposées contre de grandes banques occidentales, notamment la
Deutsche Bank et la Dresdner Bank.
