Armenia and Turkey Edge Closer to Reconciliation in New Round of Peace
Talks

Armenian foreign minister Eduard Nabaldian held a meeting with his
Turkish counterpart Ali Babacan in Istanbul yesterday. The questions
on the table encompassed all the substantial issues in Armenia-Turkey
relations, such as the creation of a joint commission on the events of
1915 which Armenia treats as genocide, the withdrawal of Armenian
troops from Nagorno-Karabakh, the opening of the border between two
countries, a visit to Turkey by the Armenian president Serzh Sargsyan,
and the Black Sea Security Platform. The Turkish side reportedly also
offered to send a permanent envoy of the rank of an ambassador to
Yerevan and to open an air connection between the two countries.

Significance:Armenia is coming under external pressure for regulating
its relations with Turkey and Azerbaijan, from both the neighbouring
states, Russia and indirectly the European Union (EU) which is
interested in improving security in the Caucasus region, for the sake
of more stable energy supplies and also to thwart the growth of
U.S. influence. Russia and Turkey have apparently reached an
understanding on a joint action to create a security platform in the
region in which they will both cooperate. Armenia suffers from the
closed borders and absence of trade with its neighbours but this only
strengthens the country’s resolve to dig its heels in on what it deems
"matters of principle" such as the recognition of the Armenian
genocide and the status of Nagorno-Karabakh. The more the Armenian
position is taken into account during the negotiations, the more
likely is their success and stability of the eventual agreements.

YEREVAN – The acceleration of diplomatic traffic between Turkey and
Armenia has brought the Nagorno-Karabakh problem onto national agendas
again, with one Armenian political expert saying some Nagorno-Karabakh
efforts are merely symbolic while real progress is slow in coming.

The presidents of Armenia and Azerbaijan met with Russian mediators
this month and signed a declaration for a peaceful resolution to
the problem.

According to Alexander Iskandarian, director of the Caucasus Institute,
one should not attribute great meaning to the declaration.

"No great improvement should be expected in Nagorno-Karabakh in the
short term," he said.

"The Russia-Georgia conflict disturbed Azerbaijan, it understood that
it cannot not solve this problem militarily. In this sense Georgia
set an example," Iskandarian said.

Azerbaijani President Ilham Aliyev attaches importance to the
declaration signed recently in Moscow between Azerbaijan, Armenia
and Russia.

"There are hope-giving moments in the settlement of the conflict",
mentioned Aliyev during a meeting with the participants of an
international round-table under heading "Azerbaijan in the 21st
century; the strategy of the success".

He announced that peace could be achieved in the region only after
"liberation" of the "Azerbaijani territories". At the same time,
Aliyev mentioned, "The issue needs deeper analysis".

YEREVAN, NOVEMBER 25, NOYAN TAPAN. "If the world indeed wishes to
solve the Nagorno Karabakh problem on the basis of the norms of
international law, it should take into account a number of decisions
made before," independent expert Ara Papian stated at the November 25
press conference. He reminded that the tripartite Declaration signed
in Moscow contains a principle, according to which Nagorno Karabakh
settlement is considered on the basis of norms and principles
of international law and decisions and documents adopted within
that framework." According to A. Papian, among those decisions
and documents the international community should also take into
consideration several Soviet documents, according to which Nagorno
Karabakh and Nakhichevan were within the administrative jurisdiction
of Azerbaijan, and not part of it.

Besides, the international community should admit that according to the
report (February 24, 1920) of the respective commission of UN’s legal
predecessor, League of Nations, it was envisaged doing demarcation
in the South Caucasus by the principle of national distribution.

According to A. Papian, one should also take into account the
circumstance that according to the USSR laws, autonomous bodies such
as NKR had the right of being the masters of their own fate through
an individual referendum, which was violated by Azerbaijan.

The expert said that in consideration of all that, he has worked out
a written document intended for the RA National Assembly (NA). The
document, in particular, read: "RA NA acting within its jurisdiction
applies to the RA President as the guarantor of the RA territorial
integrity: to take a step in the direction of restoring the RA
territorial integrity, to restore RA sovereignty in the whole territory
controlled by NKR and to declare NKR as RA Nagorno Karabakh region."

In a press conference held Saturday evening, CoE Commissioner for
Human Rights Thomas Hammarberg said that during the meetings with
the Armenian officials he had introduced his negative assessments
with regard to the people accused or arrested within the frameworks
of the March 1 case.

"In the report I am going to prepare in the near future, I will have
to express a negative attitude towards the developments or rather the
absence of any developments in the sphere. My assessments with regard
to the lawsuits which have already finished and the ones (the case
of the 7 chief culprits) which are going to start very soon will be
negative. I don’t think the inquest and the preparation of the case
were sufficiently professional," the Commissioner mentioned.

As to the fact that the verdicts were returned based exclusively
upon the police testimonies, Thomas Hammarberg considered it
unacceptable. "I don’t at all insist that it is not absolutely allowed
to rely on the police testimonies in all the cases. However, in this
particular case, the tension and even the clashes were between the
public and the Police. In such circumstances, the testimonies of the
policemen against the demonstrators should always be furnished with
additional proofs and evidence.

In some cases, very20mild or very strict verdicts are returned for
similar offences. I am definitely disappointed by this situation."

The CoE Commissioner for Human Rights said that he would naturally
prepare his report on the case of the 7 individuals after the verdict
was returned.

However, continuing his speech, he announced, "I haven’t yet obtained
the substantial evidence that may serve as a basis for the court to
determine that the attempt to violate the constitutional order by using
force was made by those people. We will closely follow the proceeding.

When we get familiarized with the indictment, we will also express
our assessment as to whether there are sufficient grounds for sending
the case to the court. It is the seventh and even eighth month that
those people have been in detention; however, there are no proofs
confirming their responsibility for the crime. When I express my
attitude about all this, I will definitely be critical."

Th. Hammarberg said that it is still early to consider the people
accused of the March incidents as political prisoners; however,
he didn’t conceal his concerns over this issue either. "I hoped the
European countries’ mutual agreement and its reflection in the state
laws would make the issue of touching upon the political prisoners
unnecessary. The thing is that the term ‘political prisoner’ is
not even characterized or defined in the European Conven tion on
Human Rights.

Unfortunately, the situation here may create a necessity for defining
the meaning of the term ‘political prisoner’. There was such necessity
when, several years ago, Azerbaijan needed to clarify the situation
with some political prisoners."

Th. Hammarberg did not actually attach importance to the pro-opposition
activists’ speculations over the constitutionality of the initiative of
setting up a fact-finding group by the initiative of the President and
acting under the supervision of the NA interim committee. "I believe
all the doubts in this regard will be dissipated when the group
expresses willingness to work, as well as realizes the necessity of
cooperation in the process of conducting an impartial inquiry. The
activity of the fact-finding group will not really be easy in such
a polarized atmosphere. Some people are not even sure whether they
will be able to accomplish their tasks.

However, the three factors that the members of the group are
professionals, they are appointed by different political forces and
are independent creates a great likelihood that the group can work
effectively, as well as enjoy the assistance and trust of society. As
to the problem over the workplace of the fact-finding group, it can
easily be solved. I hope the option of meeting the eyewitness in some
other place is admissible if those people are reluctant to disclose
their identity. The succ essful activity of the group is conditioned
by the good will of its members."

With regard to the presence of the sniper in the centre of the
events, Th.

Hammarberg considered it quite natural. "The sniper’s participation
in the activities of the law enforcement agencies was not absolutely
an extraordinary phenomenon. If there are grounded concerns over
the possibility of acts of violence, the presence of the sniper
is justified.

The issue here is in what way and with what purpose his service is
used. In such situations, the activity of the sniper always attracts
special attention.

And as a summary result of his regular visit, the CoE Commissioner
presented his assessment on Armenia’s implementation of Resolutions #
1609 and 1620 prior to the January summit of the Council of Europe,
"Armenia’s issue has already been included in the agenda. Before
the summit, I have two concerns. First, whether there will really
start an impartial inquiry into the March events, and second, what’s
the situation with the people arrested on charges of organizing the
March events and how they are treated in the places of detention. I
am independent of the summit as much as the summit is independent of
me. However, whatever I report or present as an evidence, that will
have a significant impact on the conclusions of the summit.

I consider the application of sanctions possible. Depriving Armenia
of the right to vote may be one of such sanctions.

However, we still have some time, and that period is quite enough
for recording a certain progress. Today, I positively estimate the
initiative of setting up a fact-finding group. However, it is very
fragile. There is a need for assistance for ensuring the independence
and impartiality of the group. The bad news is that I am concerned
about the condition of the detainees and the level of the preparation
of the proceedings."

knew that it will be rejected because Yerevan doesn’t question the
fact of the Armenian Genocide.

"Ankara just wanted the international community to see that Yerevan
refuses to discuss this tragedy. It was nothing but an information
challenge," Hayk Demoyan, director of the Armenian Genocide museum
told a news conference in Yerevan.

In 2005, then-President of Armenia Robert Kocharian rejected Turkish
Prime Minister Recep Tayyip Erdogan’s proposal to form a commission
of historians to study the fact of the Armenian Genocide.

"If Turkey really wanted a fair study it would not persecute
historians, journalists and writers under the article 301," Demoyan
said.

YEREVAN, November 21. /ARKA/. Armenia would not be able to achieve
economic success without IMF assistance, RA President Serzh Sargsyan
said today during his meeting with IMF Deputy Managing Director
Murilo Portugal.

Sargsyan thanked the fund for its contribution to Armenia’s economic
progress and stability, the RA President’s Press Service reports.

The president greatly appreciated the IMF Poverty Reduction and Growth
Facility program (PRGF). The Executive Board of the International
Monetary Fund (IMF) approved on November 17 a three-year SDR 9.2
million (about US$13.6 million) arrangement under PRGF for the Republic
of Armenia to support the government’s economic programs by 2011.

In his turn, Portugual pointed out Armenia’s economic achievements
for the past 15 years, saying IMF is eager to cooperate with Armenia
and help the country achieve success.

The IMF deputy managing director and the RA president touched upon
the impact of the global financial challenges and shared views on
precautions to limit the effects of the financial crisis and possible
attraction of extra investments.

Sargsyan said the current hardship could increase the effectiveness
of tax reforms and boost the management system.

the President’s initiative of inviting the party leaders to serious
discussions over the Karabakh issue.

"If the President invites the party leaders to discuss the issue,
they should participate in them. There, everyone may express his
opinion. Let someone strand and say, ‘Mr. President, I don’t like
the political course you pursue.’ The President has made a right
decision. No one should solve the Karabakh issue on his own. This is
a good progressive step," the Commander finds.

The Committee for the Protection of Armenian Political Prisoners
issued a statement today, which runs in part:

"The political prisoners held in Armenian prisons as hostages for
more than eight months will go on a one-day hunger-strike on November
20 as a protest against the duality and inconsistency of the Council
of Europe.

We, the undersigned, will also stage a round-the-clock hunger-strike
at 12 a.m. November 20 in support of our jailed friends struggling
for a free and democratic Armenia.

Azerbaijani Foreign Minister Elmar Mamedyarov received Commander of
the United States Transportation Command (USTRANSCOM) General Duncan
J. McNabb and his accompanying delegation, said the press service
for the Foreign Ministry of Azerbaijan.

The sides, stressing the intensiveness of visits of senior officials of
the United States and Azerbaijan, stressed that this is an indicator
of the growing level of bilateral cooperation. Moreover, it was noted
that there are great opportunities for cooperation in the military
sphere and there is a need to raise the number of direct contacts.

The US general highly appreciated the role of Azerbaijani peacekeepers
in provision of stability in Afghanistan and Iraq and voiced US
satisfaction with cooperation with Azerbaijan in this sphere.

In turn, Mamedyarov noted that Azerbaijan is always ready to contribute
to ensuring peace and security in the world.

Focusing on the activity of Azerbaijani peacekeeping forces, the
Minister noted that we are implementing projects, aimed at restoration
of the civil infrastructure, construction of schools and hospitals.

As for the Karabakh conflict, Mamedyarov said that this conflict is
dangerous for the entire region.
