YEREVAN, OCTOBER 26, NOYAN TAPAN. The RA National Assembly on
October 26 finished discussing the bill of amendments and additions
to the Criminal Procedure Code. The bill was presented at the
previous four-day session. In the words of Hovhannes Margarian –
the main speaker, the bill’s author, member of "Orinats Yerkir"
parliamentary faction, the purpose of the bill is to protect the
rights of journalists.

Under the current law, those carrying out journalistic activities and
reporters are not obliged to reveal the source of information, except
in cases when, in particular, the court orders the reporter to do so
for the purpose of disclosing a grave or particularly grave crime in
a criminal case when the necessity of penal protection of society’s
interests outweighs the society’s concernment of not revealing the
source of information and all other means of social interests have
been exhausted.

H. Margarian said the bill aims to ensure the implementation of the
above mentioned provision in criminal procedure and the most efficient
protection of the rights of those carrying out journalistic activities
and reporters. In the indicated cases, the bill envisages conducting
a closed-door court examination by the mediation of reporters.

Under the current law, a closed-door court sitting is held in case
of crimes related to personal or family life, a person’s honor and
dignity, crimes againts sexual immunity and sexual freedom, in case
of state and officials secrets, also when there is a necessity to
protect the persons participating in a trial or their close relatives.

The Co-Chairs of the OSCE Minsk Group, Ambassadors Yury Merzlyakov of
Russia, Bernard Fassier of France, and Robert Bradtke of the United
States, released the following statement today:

"The OSCE Minsk Group Co-Chairs (Ambassador Yuri Merzlyakov, the
Russian Federation; Ambassador Bernard Fassier, France; Ambassador
Robert Bradtke, United States) attended a "Retreat on OSCE Mediation
Activities" hosted October 22-23 by the OSCE Conflict Prevention
Center in Vienna, Austria. After the retreat, the Co-Chairs provided
a quarterly briefing to the OSCE Minsk Group.

On the margins of the retreat, each Ambassador individually
participated in different bilateral meetings with a variety of
interlocutors, including, among others, Greek Ambassador Marinaki,
representing the OSCE Chairman-in-Office; OSCE Secretary General
Perrin de Brichambaut; Armenian Ambassador Hovakimian; Azerbaijani
Ambassador Ismayilov; Kazakh Ambassador Abdrakhmanov; Swedish
Ambassador Bard-Bringeus, representing the EU presidency; and Turkish
Deputy Undersecretary Cevikoz.

The Co-Chairs will also travel to Luxembourg October 25-27 to
meet Armenian Foreign Minister Nalbandian and Azerbaijani Foreign
Minister Mammadyarov. They will address plans for their next trip
to Baku and Yerevan in November and preparation for discussion of
the Nagorno-Karabakh settlement at the OSCE Ministerial Council in
December 2009."

Sargsyan participated in the presentation of the system of "Datalex"
public information shops.

Governmental press service told Armenpress that greeting the
participants of the event, the prime minister pointed out that it is
an important event as it is a serious contribution to the process of
reforms in the justice sphere.

Applying of "Datalex", aims at implementing a public oversight toward
judicial system as it ensures procedural and content transparency over
any trial passing in judicial system. Particularly through the system
an opportunity will be provided to follow any processes – get informed
about the status of the case and its history, study the timeframes,
decisions, complete texts of final judicial acts.

The 30 shops and monitors are already installed in courts and buildings
of state management bodies. This system has been developed within
the framework of "Judicial reforms" program with the financial and
technical assistance of government of Netherlands, World Bank and
Armenian government.

While in Nagorno Karabakh President Serzh Sargsyan gave an interview
to the Artsakh Public Television, President’s Press Office reported.

– Mr. President, considering the frequency and regularity of your
visits, do you see any changes from visit to visit? What is your
assessment of army’s combat readiness?

– Visits such as this one, are intended to follow the progress on the
defense positions and in the army units, to follow the implementation
of the current tasks or those that the army was assigned with during
the previous visits. I do not believe it is possible to speak about the
combat readiness of the troops, or about the morals and the existing
psychological atmosphere while strolling on the carpet floors of a
study room. I attach utmost importance to these visits. This visit
differs from the others by the fact that it was made right after
the random check up conducted by the Military Inspection in one of
the army units. The check up revealed that that particular unit was
combat ready; it comprises a number of subunits which know their job
perfectly well. There are units which got excellent marks; there were
also those which got good marks.

It testifies to the fact that we have well-trained soldiers,
knowledgeable commanding staff and our troops are combat ready. I
believe, right now our armed forces are going through the development
phase. They established themselves long ago and we do have combat
ready troops, unlike some countries of the region which have just
groups of armed men. These are two different things. State of our
combat units, their equipment, combat spirit and the existing moral
and psychological environment allow to state unequivocally that at
this time our troops are ready to carry out any task assigned to them.

My visits are months apart while changes in the armed forces take
place every day, every month, and it is of course very pleasing.

– Mr. President, some time ago the President of Azerbaijan declared
again that the agreement has been reached on the return of the
territories adjacent to Nagorno Karabakh. He claims that such agreement
had been reached years ago and accused Armenia of protracting the
negotiations. Could you please comment on these statements?

– I have already commented on that issue and have nothing to
add. Just would like to stress once again that we take the entire
process of negotiations responsibly and seriously. There is no more
interested part in all this than Nagorno Karabakh, the people of
Nagorno Karabakh. And they want this conflict to be resolved as soon
as possible.

I am confident that there are solutions, realistic solutions. Those
solutions can be found only if the parties are realistic in their
approaches, if their expectations are realistic. We are seeking long
term solutions, solutions which will bring peace and which will be
durable. I don’t think it would be right to come to conclusions,
solutions which will work for some time only but will not be able to
support a durable peace. Of course in any negotiations parties are
working toward getting the best possible option. However I don’t get
it when one of the parties is trying to obtain everything, when is
guided by "everything for me only" motto. In that case, negotiations
for that particular party could be rather unpleasant, the results of
negotiations will be objectionable but this is not our fault. We are
living in the 21st century when hardly anything can be concealed and
the situation is obvious for many, not only for us or the negotiating
parties. When our partners in negotiations arrive at the conclusion
that there should be a logical solution, the decision will be found
easily. If they approach the problem from realistic positions, and
along with making statements will really strive to solve the problem,
the decision will come. Displeasure expressed after the negotiations
or grumbling will not bring solution closer. On the contrary, it
derails the process of negotiations and adds to uncertainty.

I would like to repeat that it is not proper to pluck something off
the context of the negotiations – previous or current – and speak
about that particular part, especially when reservations are made
regarding that very statement. If they admit that not everything has
been negotiated yet, that not all points have been agreed upon yet,
it speaks volumes. I trust it would be appropriate for us and for
the Azeris to concentrate on the current stage of the negotiations
rather that separate a part of prior negotiations and present it for
domestic consumption.

leaving for the Ukraine on a two-day working visit on October 22 at
the invitation of Chairman of the Ukrainian Party of Regions Viktor
Yanukovich.

According to a report by the BH party press office, G. Tsarukian will
be present at the congress of the Ukrainian Party of Regions. It is
mentioned that the Chairmen of Bargavach Hayastan and Ukrainian Party
of Regions signed an interparty cooperation agreement in 2008.

are also our lands," Turkish ambassador to Azerbaijan Hulusi Kilic
told journalists, APA reports.

The ambassador called on the Azerbaijani public to believe the
statements of Turkish President, Prime Minister and Foreign Minister
"Turkey will not reopen the borders with Armenia unless the Azerbaijani
territories are released".

"Believe it! We have said several times that these are our native
lands. We are a whole. Don’t give an opportunity to those who try to
stir up discord between us, separate us! Confide in Turkey! Turkish
people are always with Azerbaijan. The feeling of the Turkish people
will be seen in the parliament," he said.

Hulusi Kilic said Turkey will not take a step contradicting Azerbaijan.

"The borders will not be reopened unless Azerbaijan wants it. We
closed the borders for those lands and will not reopen them unless
the lands are released. The whole world knows it. Turkey took the
necessary step by signing the protocols. Now it is the turn of the
opposite side. We want peace in the whole Caucasus. We do not want
a door to remain closed, we want everybody to make profit from this
development," he said.

met with Tina Kaidanow, Deputy Assistant Secretary of State for
European and Eurasian Affairs on October 20. The interlocutors
discussed the development prospects of bilateral relations. E.

Nalbandian said that Armenia attaches importance to deepening of
relations with the United States in various spheres and strengthening
of friendly partnership and cooperation.

They also exchanged thoughts over the normalization process of
Armenian-Turkish relations. E. Nalbandian thanked the U.S. for its
assistance to the process of establishment of relations between
Armenia and Turkey and for its efforts made in that process.

According to a report by the RA Foreign Ministry Press and Information
Department, the sides also touched upon the last developments in the

SESSION OF THE INTER-REPUBLIC ASSOCIATION’S COUNCIL OF GAS COMPANIES BUSINESS AND SCIENTIFIC-TECHNICAL COOPERATION KICKS OFF IN YEREVAN

YEREVAN, OCTOBER 20, ARMENPRESS: Session of the inter-republic
association’s council of gas companies business and
scientific-technical cooperation kicked off today in Yerevan and will
last until October 22. The sessions of this establishment created
about 20 years ago are called twice each year. The selection of
Yerevan as a place for conduction of the session is agreed with
the recent positive indexes registered in Armenia’s gas sphere,
implemented reforms and innovations. With the visit to Yerevan an
aim was put to get acquainted with the activity of "ArmRusgasprom"
and develop mechanisms of exchange of experience. The association
includes European, CIS and Baltic countries’ gas services and
gas-transport companies.

In the Yerevan session Russian, Estonian, Czech, German, Ukrainian,
Lithuanian, Belarus, Finn and Moldovan companies take part.

Among the discussed issues will be the activity of members of the
association, development prospects, exploitation of gas-transport
systems, security issues and a number of other issues relating to
the sphere.

General director of "ArmRusgasprom" Karen Karapetyan presented the
activity of the company, issues aroused as a result of the crisis and
steps directed toward their solution, development programs implemented
in the Armenia’s gas sphere.

Karapetyan said the company is one of the leading investors in
Armenia. He said construction of the Iran-Armenia gas pipeline was one
of the most serious steps directed toward increase of level of energy
security in Armenia. Last year the preparatory round of reconstruction
and upgrading of the 5th unit of Hrazdan Thermo Power Plant have been
fully finished and the main works have already launched.

The general director said that the company continues expanding its
positions in financial market and undertakes steps toward increase
of the efficiency of management.

"The last 2008 and the first half of this year were difficult but at
the same time full and effective," he said.
