The POWs of Nagorno-Karabakh conflict are exchanged at the mediation
of the International Red Cross Committee, Trend Special Correspondent
in Moscow reports quoting Anastasiya Isyuk, PR manager with Moscow
Delegation of Red Cross Committee, answering the questions as to
the reason why the public were not aware of the capture nearly 5,000
Azerbaijanis in Armenia.

"Red Cross works with the Government in both the Countries, compiling
reports and discussing these issues. These discussions are confidential
and I am not able to comment on this figure, perhaps we have different
figures to use", said Isyuk.

She also said the Committee does its best to remain unbiased and
independent. "Naturally, the fact that we can work in 185 countries
world-wide, even in hot spots and hold discussions with conflicting
parties, proves that we are impartial. We work based on these
principles as these are our fundamentals", said Isyuk.

first time that the Azerbaijani side puts obstacles for an observer
muission to visit Nakhijevan, the acting head of the RA MFA Press
and Information Department Vladimir Karapetian said. "Azerbaijan
does everything possible to conceal the traces of its vandalism and
to distract the international community’s attention from an attempt
(unfortunately, a successful one) to destroy the spiritual and cultural
samples of the Armenians," he pointed out, while commenting, at the
request of Public Television’s Haylur information program, on the
fact that Azerbaijan did not allow the Europarliament’s monitoring
delegation to go to Nakhijevan in order to examine the reasons for the
destruction of Armenian monuments in Hin Jugha. In his opinion, the
absurd accusations regarding the fires pursue one purpose: to conceal
the barbarian actions committed in Nakhijevan under an atificial
uproar. He reminded that many foreign experts and international
reporters confirmed that the Azerbaijani government artitrarily
destroyed over 2,000 gravestones. "Those guilty for this crime must
be held accountable," he stated. "This terrible action, as well as the
recent anti-Armenian propaganda of Azerbaijan show that Azerbaijan has
not changed neither its methods nor its intention. In such a situation,
it is not surprising that the Azerbaijani side creates obstacles in
connection with the visit of Europarliament’s fact-finding mission,"
V. Karapetian stated. Nevertheless, he expressed confidence that the
international community will be consistent in its actions to register
and condemn the destruction of Armenian cultural values in Nakhijevan.

Moscow, 31 August: A senior Iranian oil ministry official said
Wednesday evening [30 August] in Yerevan that Iran-Armenia gas pipeline
will become operational by year-end.

The announcement was made by Iran’s Deputy Oil Minister for
International Affairs Hadi Nezhad-Hoseynian in a meeting with Armenian
Energy Minister Armen Movsisyan.

Nezhad-Hoseynian, heading a delegation of experts from oil, energy
and foreign affairs ministries arrived in Yerevan yesterday.

According to an agreement reached between the two sides, the 160-km
gas pipeline will transfer some 36bn cubic meter of Iran’s gas to
Armenia in the next 20 years.

Justice Denied In Three Acts: Heritage Headquarters Break-In Confirmed, But
Criminal Case Refused

Yerevan–On August 29, 2006, the Heritage Party received official
notification from Colonel Hovik Tamamyan of Yerevan’s Central Police
Department that laboratory examinations confirmed that unknown persons broke
into Heritage’s office and attached a "flash" copying mechanism and external
monitor to its computer system on the night of March 8, four days after the
Paronian Theater’s management had illegally locked Raffi Hovannisian and his
colleagues out of their place of work. This finding notwithstanding, the
police department concluded on August 24 that no criminal charges would be
brought on the premise, clearly contrived, that there was no positive
evidence, only assumptions, that any information was actually taken from the
computer system and thus that any illegality had occurred. In an amazing
display of Armenia’s "presidential justice," the police apparently carried
out their "instruction from above" to close down the case without
questioning the management of the theater or any other possible suspects, in
places high and low, of the criminal break-in.

This telling decision was issued in response to Raffi Hovannisian’s May 29
affidavit testifying that on March 8, exactly four days after Heritage party
headquarters had been forcibly shut down without a legal warrant and further
access to it had been blocked, one or more people had gained entry into the
office’s main computer, where all information regarding the party, its
membership, and its activities is maintained. In the words of Heritage
attorney Zaruhi Postanjian: "After having examined the computer, experts
from the National Bureau of Investigation affirmed that on that night, when
the office was deemed vacant by a later court ruling, the computer was put
in operational mode for 22-24 minutes and, what is more, was hooked up to a
monitor. The results of the investigation demanded, therefore, that a
criminal case be launched. In a flagrant disregard of law and justice,
however, the police department refused to authorize such a probe, making
dubious references to ‘corpus delicti.’ We will appeal this sham
determination to the courts of law and public opinion."

On August 24, the same day as the police department’s cover-up of justice,
Judge Narine Barseghyan of Yerevan’s Davtashen-Ajapniak Court of First
Instance heard Raffi Hovannisian’s complaint against the marshals of the
Service for Mandatory Execution of Judicial Acts (SMEJA). Hovannisian had
disputed their unlawful sealing of the Heritage office on May 30, only one
day after it reopened pursuant to the injunction issued in the underlying
case by Judge Edward Avetisyan. The SMEJA officers had forced Hovannisian
and the office staff to leave the premises.

Reflecting on the illegal actions taken by the marshals, Judge Barseghyan
seemed to pose a series of irrelevant questions with the intent to divert
the proceedings from the subject matter of the complaint. In response to the
judge’s query into Raffi Hovannisian’s current entitlement to the space,
Zaruhi Postanjian noted: "This matter is subject to clarification and is
currently being considered by the Court of Appeals. As for today’s petition,
submitted by us to your jurisdiction, we are seeking a legal assessment of
the activities carried out by SMEJA officials."

Even though the hearing had resonated with the public at large and the
courtroom was at full capacity, representatives of neither SMEJA nor the
Paronian Theater were present. In all probability, they had advance
confidence that they would not be brought to justice. Despite the absence of
the defendants, Judge Barseghyan went forward with the trial and, in
predictable conformity with the tide of Armenian "jurisprudence," denied
Hovannisian’s petition.

And finally on the next day, August 25, the Court of Appeals, composed of
Judges Artashes Tumanyan, Karine Hakobyan, and Astghik Kharatyan, rejected
Raffi Hovannisian’s demand for clarification of the judgment issued on June
26 by Judge Avetisian of the Central and Nork-Marash Court. According to
that judgment, the forcible closure of Heritage’s office was deemed illegal.
Separately, Hovannisian was instructed to pay certain rental installments
for a period when he was not actually making use of the premises. Hence, the
Court in effect validated the five-year real-estate lease entered into in
2002, but was silent on whether Hovannisian still could use the leased space
until 2007.

Once again, nothing out of the ordinary took place. Abusing its prerogative
to execute justice, the appeals panel carried out "in the name of the
Republic of Armenia," yet another special directive coming from the
"presidential above." And once again Raffi Hovannisian’s request, this time
for a simple clarification, was rejected. "We have become permanent
eyewitnesses to the successive stagings of ‘justice’ and the finale of the
show is nothing more than an ‘old song,’ but we will appeal all the way up,"
commented Heritage board chairman Vardan Khachatrian.

Armenian Banks Buy Controlling Share In Equity Of ACRA Credit

ARMENIAN BANKS BUY CONTROLLING SHARE IN EQUITY OF ACRA CREDIT

YEREVAN, August 30. /ARKA/. Over 52% of ACRA credit bureau’s shares
belong to Armenian commercial banks today.

ACRA Credit Reporting CJSC told ARKA News Agency on Wednesday that as
a result of lengthy negotiations, 11 Armenian commercial banks – ACBA,
Anelik Bank, ArmSwissBank, Armenian Development Bank, Artsakhbank,
BTA InvestBank, HSBC Bank Armenia, InecoBank, Melat Bank, Prometei
Bank and VTB Bank-Armenia – jointly have bought 50.1% of shares in
equity AQCRA Credit reporting CJSC.

Earlier Converse Bank (in June 2005) and ArmEconomBank (in May 2006)
became shareholders of ACRA each owning 1% of ACRA’s equity.

ACRA credit bureau was set up in 2004 by the U.S. Credential Inc.and
with the assistance and involvement of Dun&BradStreet Inc.

As of today, 14 of 21 Armenian banks, i.e. the banks representing
76% of banking assets and 75% of all the loans in banking sector,
have become either ACRA’s shareholders or its members.

Besides, 9 largest credit organizations – Aregak, Finka, First
Mortgage Company, Cascade Credit, Horizon, Kamurj, SEF International,
Shen Aniv and Washington Capital – working in Armenia are also the
members of ACRA.

According to preliminary agreement with the Central Bank of Armenia
and Union of Banks of Armenia, it is expected that the Central Bank
will become one of the largest shareholders of ACRA soon.

(RFE/RL) August 30, 2006 — A Kyrgyz archaeologist believes he may
have located the burial place of the Apostle Matthew.

Vladimir Ploskikh told a news briefing in Bishkek today that his team
this summer uncovered on the northeastern shore of Lake Issyk-Kul
what he believes are the remains of the Christian monastery that
a 14th-century map indicates is the site where the Apostle Matthew
was buried.

According to legends, Apostle Matthew died on his way to India and
established several Christian communities during the course of his
journey.

The document, which is kept in Venice and is known as the Catalan map,
mentions a place named "Issicol," where it says there is "a cloister
of the Armenian Brothers where the body of the Apostle and Evangelist
Saint Matthew is."

Ploskikh, however, cautioned that further investigation is needed.

Four years ago, a Russian-born U.S. photographer, Sergei Melnikoff,
said he had found Apostle Matthew’s grave near Issyk-Kul. Kyrgyz
scientists dismissed his claims.

SACRAMENTO – Lawyers seeking to recover millions of dollars in bank deposits
for Armenian genocide victims are getting some help this week from state
lawmakers.
A class-action lawsuit filed against two German banks seeks the return of
cash, bonds, gold jewelry and other assets that lawyers believe are owed to
an estimated 2,000 heirs of genocide victims, including some possibly living
in the San Joaquin Valley, home of thousands of Armenian-Americans.
Senate Bill 1524 by Sen. Chuck Poochigian, R-Fresno, and Sen. Jackie Speier,
D-Hillsborough – both of Armenian decent – would extend the statute of
limitations for such claims until 2016. It passed the Assembly on Monday on
a 77-0 vote and will likely pass the Senate before the session ends
Thursday.
Gov. Schwarzenegger supports the bill, according to his office.

The lawsuit was filed earlier this year on behalf of several Armenians
living in Southern California. Lawyers have argued that the plaintiffs are
free to sue under current law, but attorneys for the defendants have replied
that the statute of limitations prohibits the action, said Vartkes
Yeghiayan, a Los Angeles-area attorney representing the Armenians.

If the bill were to become law, it "would certainly fortify our position,"
Yeghiayan said.

Deutsche Bank A.G., one of the two banks sued, did not return a call for
comment. The other bank sued is Dresdner Bank A.G.
The bill has already cleared the Legislature once this year. But it was tied
to another bill that would have allowed Mexican-American victims of a 1930s
deportation campaign to seek damages for being forcibly sent back to Mexico.
The repatriation was sometimes violent, as immigrants were taken across the
border on trucks, buses and trains, according to the Mexican American Legal
Defense and Educational Fund, which backed the bill.

Schwarzenegger vetoed the Mexican deportation bill last week, arguing that
it would have allowed "private litigation of potentially thousands of claims
against the state, local governments and private citizens."

The governor did not act on the Armenian bill, allowing lawmakers to pull it
back and remove the hook to the Mexican bill. Sen. Joe Dunn, D-Santa Ana,
who led the effort to link the two bills, criticized Republicans for
supporting the Armenian bill but rejecting the Mexican bill.
"I have been consistently concerned about the hypocrisy that has shown up on
the Senate floor from my Republican colleagues on these two bills," said
Dunn, who supports the Armenian bill. "The unfortunate continuing injustice
here is that the handful of surviving victims of the illegal deportation of
the 1930s still do not have an opportunity for their day in court."

Poochigian said the bills never should have been linked because "they are
completely different issues." The Armenian bill, he said, deals with
breaches of contract by private entities, rather than claims against the
state of California.

The Armenian genocide refers to the period between 1915 and 1923, when
Armenians were driven from their homeland in the Ottoman Empire by means of
torture, starvation and murder. The Armenian community says that 1.5 million
people died.

The effort to recover bank deposits comes on the heels of a successful drive
to secure millions of dollars in unpaid insurance claims owed to genocide
victims. New York Life Insurance Co. and heirs of about 2,400 policy holders
agreed on a $20 million settlement in 2004, followed by a $17 million
settlement between French life insurance company AXA and about 5,000 people
and charities, according to published reports.

The deals were made possible as a result of Poochigian-authored legislation
that extended the statute of limitations for insurance claims until 2010.
The current bill allows genocide victims or heirs living in the state to go
beyond insurance policies and seek bank deposit claims until 2016.
"It rights a terrible wrong dating back to the beginning of the last
century," Speier said.

There are no firm estimates on how much money and assets could be recovered,
but "all indications are it’s enormous," said lead attorney Mark Geragos in
a phone interview last week.

Geragos – an Armenian-American whose family name is Geragosian – has
emotional ties to the case. His grandparents fled the genocide and settled
in Fresno, where they ran a grocery store on Belmont Street, he said.

The famed Los Angeles attorney has handled a number of high-profile cases
and his client list has included the likes of Michael Jackson, Scott
Petersen and, most recently, the trainer for Barry Bonds.

But the Armenian case, Geragos said, has the "greatest personal significance
of any of the cases I’ve ever been associated with."

of the Aspindza-Akhalkalak road is envisaged to finish till late
October. According to builders repairing the road, if bad weather does
not hamper, they will finish works within the envisaged term. According
to the "A-Info" agency, works started still from this May has been
done by now by the envisaged schedule and without destructions. To
recap, the road construction is implemented by the Georgian branch
of the Russian "Tekhnokomspetsstroy" company, the German "Witgan"
company as well participates in the construction works To recap, the
Government of Georgia allocated 11.300.000 laris (about 7 mln dollars)
for reconstruction of the road.

"The European Union will uphold its role in the establishment of peace
in the South Caucasian region. The European New Neighborhood Policy
will serve as a tool in this direction," UN Commissioner for Foreign
Relations and European Neighborhood Policy Benita Ferero-Waldner
said at the "Caspian Prospects 2008" forum in the Slovenian city of
Bled. The Commissioner expressed the hope that it would be possible to
adopt the Actions Plans in the framework of the European neighborhood
Policy early October during the visit of representatives of the EU
Finnish Chairmanship and herself.

According to Benita Ferero-Waldner, the last weeks and months
have caused worrisome trends in the South Caucasus. Three negative
directions are noticeable, the combination of which is alarming. In
her words, the first one is the lack of progress in the settlement
of the frozen conflicts in Nagorno Karabakh, Abkhazia and South
Ossetia. The second is the increase of military expenses. The third
one, she considers, is the growth of militant statements. "We saw
during the past several months that the militant statements distort
the attention of the society. The political and military logics should
prevail," the Commissioner declared.

"This region has a huge economic potential, but peace is necessary
for the utilization of it. The natural resources are restricted here,
but it is impermisssable to waste the new opportunities for the
development of the region. I call on the leaders of the countries of
te region to comprehend the responsibility not only for their people
but for the region as a whole," Benita Ferero-Waldner declared.

The fire in the Babakyar mountain located in Marneul region densely
settled by Azerbaijanis has reached outskirts of Sadakhli village,
Azerbaijani ambassador to Georgia Namik Aliyev exclusively told Trend.

The ambassador asserted the fact that pasture and forests have burnt,
and noted that the fires are still continuing. According to Aliyev,
the fires have reached Sadahli village. "The village is located 30
km from the fires. At the moment, measures are being taken to prevent
the fires," Aliyev stressed.

It should be mentioned that Babakyar mountain and near villages are
border with Armenia. It is supposed that the fires have been committed
by Armenians.
