FIDH AND CSI DEMAND FAIR TRIAL AND INDEPENDENT INVESTIGATION IN THE STEPAN HOVAKIMYAN AND VAHRAM KEROBYAN CASE

Paris – Yerevan, 22 February, 2012. Two years have passed since
Stepan Hovakimyan was charged on 6 February 2010 with organizing and
committing theft at the “Moskva” cinema house on 10 January 2010.

On 6 February 2010, Hovakimyan was charged with violations of Article
177(3)(1) of the Criminal Code of the Republic of Armenia and detained
after spending 72 hours in police custody. To this day Hovakimyan
and Kerobyan (also later arrested) remain in detention at Nubarashen
penitentiary institution. Their trials continue to be unduly delayed
and no independent and fair investigation has yet been conducted.

Despite two years to further corroborate the charges in his case, the
principal evidence against Hovakimyan remains a confession statement
obtained by police using duress and psychological violence on 6
February 2010.

Hovakimyan had already attended Yerevan police station on 11 and
14 January 2010, where he remained in custody for over 10 hours and
was allegedly subjected to violent treatment, before being released
without confessing.

On 6 February 2010 Stepan Hovakimyan again attended Yerevan police
department where he was subjected to torture and inhumane and degrading
treatment. In the course of this treatment Hovakimyan was beaten on the
head, undressed, had his shoes removed and the soles of his feet beaten
with a rubber baton until he confessed to theft. He claims to have been
invited to the Yerevan police department on that occasion without a
proper summons and before any complaint had been lodged by the victim
or criminal proceedings instituted. Only after signing the confession
statement was S. Hovakimyan permitted to inform his relatives of his
custody, and given access to a lawyer for the first time.

Having been implicated in conniving in the theft in S. Hovakimyan’s
confession statement, V. Kerobyan was arrested on 12 March 2010. He
remains detained and charged with theft to date.

Hovakimyan’s complaint concerning torture on 6 February 2010, lodged
with the Special Investigation Service (SIS), proved unsuccessful. SIS
decided not to institute criminal proceedings against those
responsible, relying instead on the police officers’ explanations of
events and declining to investigate the torture allegations further.

This decision was appealed in the Court of General Jurisdiction
of the Kentron and Nork-Marash districts, but rejected on 2 August
2011. A subsequent appeal to the Court of Appeals culminated in the
first instance judgment being upheld on 26 December 2011 – a ruling
is currently lodged for appeal before the Court of Cassation. An
admissibility decision on this latest appeal is currently pending.

FIDH and the Civil Society Institute call upon the Armenian authorities
to:

Immediately release S.Hovakimyan and V. Kerobyan on bail; Ensure
both accused receive a fair trial within a reasonable time, including
by confirming the inadmissibility of evidence obtained by coercion;
Conduct an independent, effective and thorough investigation into the
torture allegations to identify the perpetrators and bring them to
justice; Fully conform with the provisions of the European Convention
on Human Rights, as well as the European Convention on the Prevention
of Torture and the UN Convention against Torture and other Cruel,
Inhuman or Degrading Treatment or Punishment. These texts impose a
clear obligation on Armenia to investigate and prosecute allegations
of torture and stop the practice of using confessions obtained under
duress to prosecute suspects.

SCANDALOUS REVELATIONS EXPECTED IN MINISTRY OF TRANSPORT

The Control Chamber of Armenia carries out monitoring in the Armenian
Ministry of Transport and Communication. According to Zhoghovurd
daily, scandalous revelations can be made in the Ministry, as member
of Orinats Yerkir Party Manuk Vardanyan did “some suspicious business”
with his former colleague Eduard Madatyan.

The daily enquired from Minister of Transport Manuk Vardanyan whether
the Control Chamber carries out monitoring in the Ministry. “Yes,”
unwillingly answered the Minister.

“Do you have the apprehension that corruption revelations can be made
in the competitions announced by the Ministry?” asked the daily.

“No, certainly not. I am confident,” answered the Minister briefly.

GENOCIDE ARMENIEN – KEITH DAVID WATENPAUGH POURSUIVI AUX ETATS-UNIS

Un historien a l’Universite de Californie a Davis est devenu la
dernière cible des groupes turco-americains. Refusant de revenir
sur une declaration a l’origine de ce conflit le chercheur a dit
que l’universite le soutien contre ce que lui et d’autres chercheurs
voient comme une attaque sur la liberte d’enseignement.

Des lettres envoyees aux differentes instances a Davis ont affirme que
Keith David Watenpaugh, un professeur en charge des etudes religieuses,
doit faire des excuses sur une reponse qu’il a ecrite dans le magazine
des etudiants de Davis a une lettre commentant un article sur sa
recherche. Les travaux de Watenpaugh relient le genocide armenien
aux grands mouvements humanitaires internationaux au 20 ème siècle.

Watenpaugh – comme la quasi-totalite des historiens – se refère au
genocide comme a un fait.

Après que le magazine Davis ait fait part de la recherche de
Watenpaugh, Gunay Evinch, ancien de l’universite et qui est un avocat
de Washington et un ancien president de l’Assemblee des Associations
Turco-americaines, a envoye une lettre au redacteur soutenant que les
chercheurs doivent examiner la souffrance qui a eu lieu dans l’Empire
Ottoman de facon large et reconnaître que beaucoup de groupes ont
ete touchees et non juste les armeniens.

Watenpaugh a repondu dans la meme publication, soutenant que si la
souffrance etait repandue, le genocide ne l’etait pas – et a ete limite
en ce temps-la aux armeniens. Il a alors dans le paragraphe qui est
le sujet de la contreverse ecrit la chose suivante : ” ce qui est le
plus important est de comprendre que l’Assemblee des Associations
Turco- Americaines a ete au premier rang d’un effort patronne par
le gouvernement turc aux Etats-Unis en vue de nier que ce qui est
arrive aux armeniens etait un genocide. L’attaque de mon travail
dans la lettre de M. Evinch fait partie de ce projet et doit etre
comprise a cette lumière. À UC Davis, nous apprenons a nos etudiants
que l’histoire est plus qu’une juste collection de faits, mais est
plutôt le point de depart pour un rapport moral avec le passe “.

Le president de l’Assemblee des Associations turco-Americaines,
Ergun Kirlikovali, a ensuite ecrit au redacteur du magazine de
Davis et au chef du programme de Watenpaugh a Davis, disant que sa
declaration avait ete ” insouciante ” et ” extraordinairement nuisible
“. Plus loin, la lettre a compare la declaration a a celle faite
par le Southern Poverty Law Center qui a abouti a une retraction de
l’article publie.

La declaration Watenpaugh etait ” diffamatoire ” a ecrit M.Kirlikovali
parce qu’il a suggere que son organisation etait un agent du
gouvernement Turc ce qu’il n’est pas. (on exige des Agents des
gouvernements etrangers de s’enregistrer et manquer de s’enregistrer
serait un crime note la lettre.)

Watenpaugh affirme pour sa part qu’il est accuse de quelque chose qu’il
n’a pas dit. Tandis qu’il accuse le gouvernement Turc a encourage
l’effort general pour nier le genocide armenien, Watenpaugh n’a pas
dit que le groupe turco-americain etait un agent du gouvernement
Turc. La prochaine publication du magazine Davis fera une declaration
dans ce but.

Watenpaugh : ” ces individus ont mal interprete ma declaration comme
la suggestion que l’ATAA fasse partie du gouvernement Turc, ou soit
financièrement soutenu par le gouvernement Turc. Je n’ai fait aucune
affirmation d’une facon ou d’une autre a cet egard. Pour etre clair,
que j’ai voulu dire est que l’ATAA est au premier rang de l’effort
de nier aux Etats-Unis que ce qui est arrive aux armeniens comme le
resultat d’une politique du gouvernement Ottoman etait un genocide,
ce qui est parallèle aux actions du gouvernement Turc dans notre pays
pour faire de meme “.

Watenpaugh a dit qu’il a percu les lettres comme une tentative de
limiter sa liberte d’enseignement et a dit qu’il etait heureux que
son universite ait defendu ses droits et ne se soit pas retractee.

Kirlikovali, via un courrier electronique, a dit que son groupe ”
veut un debat ouvert, libre et complet pour savoir si le cas armenien
constitue le genocide et sur les options pour la reconciliation
“. Et il a dit qu’il espere que le magazine Davis ” fera toutes les
corrections exigees pour se disculper de cette fausse declaration et
nous esperons que M. Watenpaugh fera des excuses “.

Après Barack Obama, c’est au tour des candidats a la presidentielle
francaise de devoiler les titres qui rythmeront leur campagne. Au
programme : des chansons ” made in France ” et populaires.

Nicolas Sarkozy et Francois Hollande ont devoile leur liste de
chansons preferees. L’un l’a publie sur Deezer et les reseaux sociaux,
l’autre l’a revele au blog Skeuds. Meme si les goûts musicaux des deux
candidats sont radicalement differents, quelques points de convergence
sont a noter. Les playlists sont majoritairement composees de variete
francaise, ce sont des chansons populaires qui cherchent a faire
passer des valeurs propres a chaque candidat. Ces morceaux donnent
une idee du ton de la suite de la campagne et devoile la personnalite
du candidat ainsi que ses intentions.

La playlist de Sarkozy mise sur la tradition et le populaire

Intitulee Mes Classiques, la playlist de Nicolas Sarkozy est
essentiellement alimentee de chansons parfois assez vieilles et
proches du peuple. ” Ce sont des chansons que j’apprecie et qui
m’accompagnent souvent la où je vais “, a explique le candidat sur
son profil Facebook.

George Brassens, L’Auvergnat est un classique de la chanson francaise.

À travers ce titre, l’artiste lance un appel a la solidarite et a
la generosite. Il denonce une societe egoïste où l’exclusion est
omnipresente. Avec ce morceau, Sarkozy pose ses valeurs phares que
sont la solidarite et l’entraide dans la difficulte.

Le president est un grand fan de Johnny Hallyday. Il est donc tout
naturel de voir le Taulier apparaître sur cette playlist. Johnny est
considere comme le chanteur prefere des Francais . À travers cette
figure, Sarkozy ancre sa proximite avec le peuple. Quelque chose en
nous de Tenessee avait deja ete recupere politiquement par Jacques
Chirac en 1988 lors d’un meeting de campagne. Johnny y avait chante
” on a tous quelque chose en nous de Jacques Chirac. ”

Calogero est aussi de la partie avec son titre C’est Dit. C’est la
seule touche ” jeune ” dans une playlist de vieux tubes. La chanson
porte les valeurs de la simplicite et de la fidelite. Tous ce que
souhaite incarner le candidat a sa reelection.

Autre pillier de la chanson francaise sur la playlist du candidat,
Charles Aznavour. Nicolas Sarkozy n’a pas choisi n’importe quel titre
du chanteur mais a selectionne Ils sont tombes. Le morceau evoque le
genocide armenien dont la negation vient d’etre condamnee par une
loi très critiquee. Un moyen pour Sarkozy d’affirmer ses positions
et de toucher l’electorat d’origine armenienne.

Carla Bruni aurait sans doute ete vexee de ne pas faire partie des
chansons favorites de son mari. Le president est un grand fan de la
musique de sa femme et a choisi L’Amoureuse, une jolie declaration
d’amour, pour adoucir sa playlist de campagne.

Une seule chanson internationale apparaît parmi les morceaux preferes
de Nicolas Sarkozy. Il s’agit de Love Me Tender d’Elvis Presley. Avec
ce morceau, le president montre une autre facette de la personnalite
et joue la carte de la sensibilite.

Dans sa playlist, Sarkozy mise sur la tradition, le populaire et le
” made in France “. La playlist de Francois Hollande est legèrement
differente : moins classique, plus jeune et denonciatrice.

Le candidat n’a pas encore devoile de playlist officielle de campagne
mais a fait part des chansons qu’il ecoute en boucle au blog Skeuds.

Hollande avoue adorer Adele et ecoute en boucle Rolling in the Deep.

Une facon de montrer qu’il suit la tendance. Avec Jean-Louis Aubert et
son tube Temps a Nouveau, le candidat socialiste fait par de son envie
de changement. Francois Hollande s’appuie aussi sur des classiques
comme Leo Ferre et Jolie Môme.

Bien sûr, le candidat PS a integre ses soutiens officiels Yannick
Noah et Benjamin Biolay, deux grands habitues des meetings socialistes.

Nettement plus jeune, la playlist comprend les tubes de deux anciennes
participantes de l’emission de telerealite Star Academy. Ainsi,
Hollande ecoute en boucle Ohwo de Nolwenn Leroy et Elle Panique
d’Olivia Ruiz

Le candidat socialiste fait preuve de patriotisme avec Le Chant des
Partisans repris par Les Motives. Le titre appelle a la rebellion
et incarne parfaitement l’esprit de revolte qui habite le candidat
socialiste. Le morceau commence par ces lignes : ” Specialement
dedicace a ceux qui sont motives, a ceux qui ont resiste par le passe.

” Des paroles qui collent plutôt bien a la situation du chef de
l’opposition.

Enfin, le titre de Zaz, Je Veux, pourrait très bien etre l’hymne
de campagne du candidat PS vu le message que la chanteuse delivre a
travers son titre. ” Donnez moi une suite au Ritz, je n’en veux pas !

Des bijoux de chez Chanel, je n’en veux pas !…Ce n’est pas votre
argent qui fera mon bonheur, moi j’veux crever la main sur le c~ur.

Allons ensemble, decouvrir ma liberte, oubliez donc tous vos cliches,
bienvenue dans ma realite. ” Le titre concentre toutes les attaques
du candidat socialiste contre l’attitude de Nicolas Sarkozy, son côte
bling bling et sa langue de bois . Un morceau emblematique pour une
campagne placee sous le signe de l’anti-sarkozysme.

LES JOURNALISTES REPRIMES EN TURQUIE

Le journalisme reste une profession a hauts risques en Turquie, en
depit des professions de foi democratiques des islamistes moderes
au pouvoir a Ankara. Dressant un etat des lieux sur la situation
des journalistes dans le monde, le rapport annuel du Committee to
Protect Journalists (CPJ), intitule “Attaques sur la Presse 2011”
pointe du doigt la Turquie. Le directeur adjoint du CPJ Robert Mahoney
souligne qu’en Turquie “la presse travaille sous la menace d’un système
judiciaire repressif et d’une legislation aussi obsolete qu’imprecise
que les responsables politiques de tous bords utilisent comme une arme
contre tous journalistes critiques”. “La Turquie utilise la loi pour
reprimer”, souligne Mahoney dans son rapport, très critique aussi a
l’encontre des Etats-Unis, qu’il accuse de ne pas intervenir sur les
violations de la liberte de la presse en Turquie. “Les Etats-Unis
hesitent a interpeler la Turquie sur les droits de l’homme et la
liberte de la presse. Washington se convainct que la Turquie, membre
cle de l’Otan et allie crucial des Etats-Unis dans la region, est
une democratie progressiste et laïque, et un modèle pour la liberte
d’expression compare a ses voisins, l’Iran, l’Irak ou la Syrie”,
indique M.Mahoney en mettant les man~uvres diplomatiques d’Ankara
en perspective avec le Printemps arabe.

TURKEY LAUNCHES MANEUVERS NEAR BORDER WITH ARMENIA

exercise in Turkey’s Kars Province near the border with Armenia.

Commander of the third field army General Ahmet Turmus monitors
the maneuvers that have brought together about 2,000 people, CNN
Turk reports.

It is noteworthy that Turkish President Abdullah Gul for the first
time observes “Winter 2012” military exercise.

ARMENIA HAS A UNIQUE CHANCE

The crisis of the global governance threatens to escalate into a
serious conflict, and the leaders of the great powers are trying to
find a solution.

The informal summit of the foreign ministers of G 20 is underway in
the Mexican town of Los Cabos. The main issue is global governance.

Nothing is known about the results of the discussion but it is evident
that the world is trying to review a number of key issues. One of these
issues is 1% population which owns 30-50% of world goods. The global
politics is based on the needs of this 1%, they have concentrated in
their hands almost all the financial resource, keeping the remaining
99% in captivity. It has been possible to sustain the world population
at a tolerable social level for several decades, but now that the
world population is growing, and the shortage of food and fuel is
becoming an issue, the population demands social justice.

This issue is especially urgent in the U.S. while the election
campaign is underway. Representative Ron Paul who is running in the
primaries made a sensational statement: “We’ve slipped away from a
true Republic. Now we’re slipping into a fascist system where it’s a
combination of government and big business and authoritarian rule and
the suppression of the individual rights of each and every American
citizen.”

Such statements by possible U.S. presidential candidates evidence
that the era of “democratic majority” is coming to end. The world has
so far been artificially divided into two large parties which shared
their stances, and decisions were taken proceeding from the opinion
of the majority even if it was 51%.

This system is exhausted and now the world needs to take into
account the opinion of the 99% of the population. The concept of
public interest is becoming dominant, and people more often wonder
whose interests the government defends, 1% or the major part of
the population.

These issues are highly relevant in Armenia where now civic engagement
is awakening, where the government is asked questions about whether
it should protect the interests of the business or the public.

Armenia is the witness of the crisis of the current economic management
in transitional countries but it is moving by inertia towards the
collapse of the system. We keep borrowing money from international
organizations, becoming the hostage of capital trying, to build the
democratic system of majority which is no longer trusted in the West.

It is noteworthy that Russia is walking against the stream. Putin
stated that strategic control will continue until it enables the world
capital fill Russia. Pro-Putin experts note as his positive feature
that he does not want to be part of the global power of capital,
imperialism. But what does he propose in return? What new system of
values does he propose? Is it only restoration of Soviet socialism
and military state?

Armenia may work out its own approach to reforms of global governance,
insisting on the reduction of financial dependence on the West and
weakening of Russian bondage regarding security issues. And most
importantly, Armenia may form a government, proceeding from the
interests of 100% and not 1% of the population. This may seem utopia
but all the other ways lead to a catastrophe, like in the case of
Greece, which is deciding now to be or not to be part of global
financial management.

LA CONSTRUCTION DES MAGASINS EST SUSPENDUE A EREVAN

Les autorites d’Erevan ont decide de suspendre la construction
de magasins dans un parc municipal mercredi 22 fevrier 2012, après
presque deux semaines de manifestations organisees par la protection de
l’environnement et d’autres groupes civiques. Un officier superieur
de la police a annonce que ” [la construction] a tout simplement
ete arretee pour que les choses soient faites de manière legale. ”
Les manifestants ont bloque a plusieurs reprises la construction des
magasins pour preserver l’espace vert, ce qui oblige les constructeurs
a travailler la nuit et ce qui demande la protection de la police.

Nombreux policiers protegeaient les lieux mardi. Les organisateurs
des manifestations se mefient de l’annonce de la suspension de la
construction annoncee par la police.

JAVELIN THROWER JANOYAN AIMING TO PUT ARMENIAN ATHLETICS ON THE MAP IN HELSINKI

Armenian javelin thrower Melik Janoyan has been setting a plethora
of national records for the last six years, adding almost 20 metres
to the country’s best mark since he first threw over 60 metres in 2005.

His first national record was 61.22m, produced when winning at the
2005 Armenian national championships, and now he stands on the verge
of breaking through the elite 80- metre barrier after going into new
territory again with 79.71m at the Lunev Memorial Meeting, the Russian
Winter Throwing Cup, at the Black Sea venue of Adler on Saturday.

~SI don’t feel 80 metres is far away. I would like to do it at the
European Cup Winter Throwing in Montenegro next month,~T said Janoyan,
who finished second in Adler behind the Russia’s evergreen 2003 world
champion Sergey Makarov.

The 2012 European Cup Winter Throwing will be in the Montenegrin town
of Bar on 17-18 March.

Janoyan also wants to redeem himself in Bar after he travelled to
last year’s event in the Bulgarian capital of Sofia and failed to
register a valid mark. However, he did finish third in the under 23
competition back in 2007 when he rose to the occasion and set the
first of four national records within the space of 10 weeks.

He also hopes to make his mark at this summer’s European Athletics
Championships in Helsinki and making the final, after not getting
beyond the qualifying competition at the 2008 Olympic Games and 2009
World Championships.

~SI’m looking forward to Helsinki as I have never been to a European
Athletics Championships and I expect to achieve new successes there,~T
he added.

If Janoyan can be counted among the top 12 javelin throwers in
Helsinki, it would be a milestone for Armenian athletics as no athlete
from the country has made a European Athletics Championships final
since independence was recognised in 1991.

However, there were a number of European Athletics Championships
successes when Armenian athletes wore the vest of the former Soviet
Union, notably the memorable long jump victory of Robert Emmiyan
in 1986.

Emmiyan remains the European long jump record holder with the 8.86m
that he jumped in Tsakhkadzor in 1987 and today he is the president
of the Armenian athletics federation.

IRAN MAY TAKE PREVENTIVE MEASURES IF ITS INTERESTS ARE AT RISK

The recent announcement of Iran’s representative of the General Staff
may be considered as a warning to all those countries that secretly
or openly support anti-Iranian actions, orientalist Vardan Voskanyan
told the reporter of Armenian News-NEWS.am.

To note, earlier Deputy Head of the General Staff of the Iranian Armed
Forces for Logistic and Industrial Research Mohammad Hejazi announced
that if threats against Iran’s national interests were to arise Iran
might take preventive measures.

The expert announced that it is not probable that the announcement
will cause provocations.

According to him, Iran conducts a well-planned policy.
