Karabakh conflict resolution, a NATO official said in Baku.

"The Alliance supports the endeavors of the OSCE Minsk Group Co-chairs
to resolve the conflict," Mr Diego Ruiz-Palmer said.

"Although not a participant in the process, NATO watches and backs
the OSCE and UN efforts," he said, Trend Azeri news agency reports.

YEREVAN, JUNE 16, NOYAN TAPAN. On June 17 Eduard Nalbandian, the
Minister of Foreign Affairs of the Republic of Armenia, will leave
for Brussels on a three-day working visit. His meetings with Javier
Solana, the Secretary General of the Council of the European Union,
and Benita Ferrero-Waldner, the European commissioner responsible
for the External Relations and the European Neighbourhood Policy,
are scheduled in Brussels.

Eduard Nalbandian will also have meetings with Armand de Decker,
the Belgian Senate President, and his colleague Minister of Foreign
Affairs Karel de Gucht.

According to the information provided to Noyan Tapan by the Press and
Information Department of the RA Ministry of Foreign Affairs, during
his stay in Brussels the Minister of Foreign Affairs will also meet
with the heads of the pan-European and Belgian Armenian organizations.

Dubai: Prison Assault Case Verdict On June 29

DUBAI — The hearing in the Central Prison assault case concluded
yesterday with several defence counsel making their points in support
of their respective clients. The Dubai Criminal Court of First Instance
is expected to give its verdict on June 29.

However, the court could not view the second video recording of the
incident of August 1, 2007 because the tape was not available.

Twenty-five prison officers, including the former director of the
Men’s Prison, Lt-Col. T.Q. and three other high-ranking officers,
have been charged with assault and abuse of power.

In the assault by the jail wardens, an Armenian inmate, S.K., had
reportedly suffered 10 per cent permanent disability as a result of
a spinal injury. He was, however, deported from the UAE recently.

Khalifa Salman, the defence counsel of Lt-Col. T.Q., said his client
gave instructions to the jail wardens to search the cells for possible
presence of drugs apparently smuggled into the prison.

"He did not tell them to use force or violence when ordering the
inmates out of the cells. If the jailers pushed the prisoners around in
a hurry, that does not amount to assault," the defence argued. Another
defence counsel, Ali Mousabeh, pointed out the contradictions in the
statements of S.K.’s friend. On one occasion the witness claimed that
S.K. was kicked and at other times he said that S.K. fell down the
stairs after being pushed by the policemen. At the same time, he also
said that there were no jail wardens on the stairs, the lawyer argued.

Mousabeh stressed that the incitement by the inmates to give false
testimonies in order to incriminate the jail wardens ought to be
taken into consideration.

Defence lawyer Kawthar Ibrahim said the medical report of S.K. showed
that he suffered permanent disability in the spinal column. "If the
allegation that he was beaten by 15 policemen and anti-riot officers
was true, he would have suffered bruises and injuries in various
parts of his body, not just one."

"That proves that S.K. was a victim of an accident, not physical
assault. The medical report supports that argument," he pointed out.

Defence lawyer Samir Jaafar stressed that the evidence available in
support of the 25 defendants indicates that they did nothing wrong
on August 1.

"When the inmates carried the injured S.K. to the Central Prison clinic
the first thing they told the physician was that he had fallen from
the stairs, and that is the truth," Jaafar pointed out, adding that
the officers only acted sternly in order to scare the inmates into
obeying the instructions.

Defence lawyer Abdel Karim Maky said the accusation of the Iraqi
prisoner on which the case rests, was false and unreliable.

"That inmate is one of the most dangerous prisoners in the Central
Prison and he had a major involvement in the incitement. He held some
grudge against the prison officers," he alleged.

Defence lawyer Nabih Badr said that some of the police officers on
trial have been in service for more than 20 years. "The anti-riot
police officers are well trained and know how to quell violence
without causing any injury," he maintained.

The defence lawyers also noted that the Iraqi prisoner, who alleged
manhandling by the jailers, had resisted the wardens, insulted them
and the system and tried to escape. "That is why he was overpowered
and handcuffed," they said.

The lawyers also argued that whatever the jail officers did was part
of their duties, otherwise they would have been held responsible for
dereliction of duty.

The PR officer of the U.S. embassy to Azerbaijan Jonathan Henick said
in an interview with the Azerbaijani media: "Mediation of influential
countries having interests in the region may help increase the level
of confidence between the sides. However, I think neither Azerbaijan
nor Armenia will accept peacekeeping forces from Turkey and Russia
only. The co-chair countries bring opportunities to mobilize the
international community. It is necessary for humanitarian assistance,
for organization of peacekeeping forces, etc. Certainly, the most
influential countries in this process are the conflicting parties."

It follows from the words of the U.S. diplomat that the issues of
deployment of peacekeeping forces and humanitarian assistance have
been solved, and it is only necessary to decide who will be in charge
of the mission.

It follows from Jonathan Henick’s words that Azerbaijan insists on
the Turkish forces, while Armenia ostensibly on the Russian forces. It
is clear on which forces the mediators insist.

In Armenia they remember that after the first report of the
International Crisis Group a group of OSCE experts arrived in the
area of the Karabakh conflict for "reconnaissance" of the line of
contact. In other words, they studied where the peacekeeping force
could be deployed. On the same days, the representative of Russia
arrived in Karabakh secretly, who also visited the border.

At that time they said in Karabakh that if the West suddenly deploys
forces in the area of the Karabakh conflict, Russia may repeat the
Serbian scenario, and deploy forces on the border with Iran.

Apparently, nobody wants such developments, and they have decided
to postpone the entry of the peacekeeping forces to Artsakh. Nobody
has inquired why Karabakhis need to be surrounded by forces of other
countries.

Ararat Yerevan is in the lead of the championship tournament table with
21 points. Mika Ashtarak is in the second place with 19 points. And
Pyunik Yerevan is in the third place with 16 points.

Novruz Mammadov: Azerbaijan may negotiate with its Armenian community
after Armenia withdraws from the occupied lands

Baku. Elnur Mammadli-APA. `The involvement of Armenian community of
Nagorno Karabakh in the negotiations is possible only after a document
is signed between Azerbaijan and Armenia.

After that, it is possible to start negotiations on the condition of
the Armenian community, the return of internally displaced persons
(IDP and rehabilitation work,’ said Novruz Mammadov, head of the
international relations department of the President’s Executive Office
of Azerbaijan.

He noted that Azeri lands were occupied by Armenian Armed Forces and
Nagorno Karabakh’s Armenians didn’t have such strength.

`Armenia should withdraw from the occupied lands and shouldn’t
interfere in Azerbaijan’s interior affairs. After that, Azerbaijan may
conduct certain negotiations with Armenian community in its
territory,’ he underlined.

As we know, the PACE is to hold a hearing devoted to Armenia in its
summer session which is going to be convened in a couple of days. Not
only our country’s post-electoral situation but also the situation
with democracy in general will become a subject of discussion. In
other words, a discussion will be held around the issue whether
Armenia can be considered a democratic state.

Contradictory assessments are being made on the current state of
the native political system. The radical opposition considers our
political regime anti-democratic; moreover, it insists that the
regime existing in our country is tyranny. The activists who are at
the helm of state or are close to those circles assure us that certain
national peculiarities in the development of the native statehood do
not absolutely rule out its general democratic trend.

On the one hand, it is impossible to deny that our citizens have
incomparably more rights and liberties than do the residents of
classical authoritarian states.

On the other hand, we can’t fail to notice the problems related to
the same rights and liberties, the political rivalry, the separation
of the branches of power and other issues.

However, the fact that our country’s current political system is not
by any way democratic (with a "plus" or "minus", depending on the
viewpoints) cannot give way to doubts for a person who is more or
less objective.

One may often hear the opinion that democracy in our reality is
controllable. In the meantime, it is often forgotten that democracy,
as a form of state, cannot be uncontrollable at all. What is different
are the means, styles and methods of governing the democratic processes
by bureaucracy – the inevitable product of any statehood. Therefore,
in order to characterize our country’s present-day political regime
in an equivalent manner, it is necessary to concretize the type and
level of such governance.

It may seem at first sight, especially in view the existence of the
coalition, that power in our reality belongs to the political parties.

However, it does not quite correspond to the reality. As a matter of
fact, the monopoly of state government belongs to bureaucracy which
consistently strengthens its own positions. And that happens for
several reasons:

First: The feeling of tiredness of the 1990’s reforms is still
maintained in society, and a demand for stability is being
observed. And the guarantor of stability has always been bureaucracy
in any place of the world.

Second: The consolidation of bureaucracy. This condition is of utmost
importance for overcoming rivalry and establishing monopoly over
the authorities. The internal conflicts are naturally maintained,
but they are pushed to the background.

Third: The weakness and disruption of the liberal political forces (the
"movement" of the neobolsheviks has nothing in common with the liberal
movement). And the weaker society’s resistance against bureaucracy,
the more it becomes prevalent.

As was already mentioned, the existing system of bureaucratic power
should, nonetheless, be considered as a variety of the democratic
regime. At least because such bureaucracy is established through the
expression of the people’s will vs. the use of force (regardless the
fact what the revolutionaries say in that connection).

We can’t say that bureaucracy reflects the radical interests
of society, but the democratic elite demonstrates an extremely
sensitive attitude towards the moods existing there. For classical
authoritarianism our state government system is like a velvet regime
in which the bureaucratic class strives to safeguard itself against
instabilities. The aggressive state ideology comes to be replaced by
the massive psychology of "enrichment and consummation".

If there’s something negative, it is the absence of traditions of
such political rivalry that does not produce an undermining effect on
the foundations of the state. Whoever wins in our reality, receives
everything, and whoever turns out a loser becomes an exile. That’s
why the political struggle begins with "battles without rules" and
ends with the scenes of the March 1 events.

So, in order to fill the existing gaps and build a real democratic
state, we need time. Even the United States which is truly considered
the lighthouse of democracy had to pass a long way to achieve that. And
the liberties were formed from the bottom layers of society. Only
in the 6th decade of the XX century did the human rights movement
achieve a true equality of rights for the black under the leadership
of Martin Luther King.

In other word, democracy is a process, a struggle which requires a
great patience. There are neither licensed solutions nor prescriptions
of drugs with a speedy effect.

Baghdasarian received Marina Dolgopolova, Belarus’ ambassador to
Armenia.

The presidential press office told Armenpress that during the meeting
both sides stressed deepening of cooperation within the frameworks
of the Collective Security Treaty Organization (CSTO) and boosting
bilateral ties.

The ambassador conveyed to Baghdasarian the secretary of Belarus’
Security Council, Viktor Sheiman’s good wishes and the desire to
cooperate actively with Armenian National Security Council.

The press service said the sides reached a set of agreements on
Armenian-Belarus cooperation.
