On April 25 Armenia’s Human Rights Ombudsman Armen Harutiunian
released a report on the Presidential election of February 19,
2008, and the events following the election. The Ombudsman says he
prepared and released the report because the Presidential election
and the post-election events had a major influence on the state of
human rights, the protection of the personal, political, social and
economic rights of a human and a citizen.

The report notes that the pre-election and post-election situations
were affected by some problems which were not addressed. The
descriptive part of the report on human rights states that the
report is based on the fact that during the presidential election
the dissatisfaction of a major part of the society got a direction
and acquired new qualities. The report of the human rights defender
says a major part of the society had a demand of extremity, which
shaped support and aggravated the lack of confidence and hatred.

The report of the human rights defender states that "constitutionality
is the limitation of power which excludes such situations when the
winner gets all the political, economic, social levers, and the loser
loses every possibility for normal existence."

"These very situations push the sides into a struggle for life and
death and provide a fertile soil for the emergence of authoritarian
and totalitarian regimes," the report holds.

Its author notes that "the new president and the emergent government
got a very heavy heritage from their predecessor." The ombudsman
thinks it would be desirable if this heritage was not so heavy,
but it is, and it is necessary to find a way out. The ombudsman
recommends 7 steps: to guarantee public control over the government
and strong opposition, reform the election legislation, guarantee
freedom of speech and plurality of the Internet media, rule out laws
which impose groundless constraints on human rights and freedoms,
guarantee constitutional equity and eliminate economic monopolies,
not to battle with the consequence but to eradicate causes. Armen
Harutiunian says it is important to set up an independent commission
for investigating the events of March 1.

AD HOC REPORT

The 2008 Presidential elections and post-electoral developments have
immensely influenced on the entire system of protection of human
rights. The main objective of this Ad-hoc Report /hereinafter report/
is a comprehensive analysis of pre- and post-electoral developments.

The first part of the report illustrates dynamics of transformation
of socio-psychological environment and main causes of its formation
whereas receiving objective information on electoral processes was
impossible.

The second part of the report is devoted to the election day
environment and analysis of legislative grounds leading to its
formation. The third part reveals peculiarities of post-electoral
developments.

Part four presents activities of the Human Rights Defender in regard
with reinstituting of human rights during the post-electoral period.

In the course of examining presidential election developments,
the report, indeed, specifies many objective problems leading
to the formation of pre- and post-electoral situation in the
country, particularly rising resentment in a considerable part of
the society. In fact, many of these problems were described in
the Defender’s Annual Report of 2006, the conclusions of which,
regrettably, remained out of attention of authorities.

The cornerstone of the report is qualitative modification of resentment
of a considerable part of society through biased form. Particularly,
the noticeable social and economic polarization, mistrust towards
public and law enforcement bodies, overcentralization of power,
ineffective mechanism of checks and balances between three branches
of power, insufficient guarantees for human rights, formation of a
tightly closed system of privileged group drove a significant part
of society to seek critical and dramatic changes to solve these
issues. Eventually, a demand of extremist activities was formed in a
considerable part of society. In this situation a number of political
forces have provided an adequate offer, which intensified intolerance
and polarization in the society.

The report refers to the aforementioned issues from the perspective
of human rights, freedom of speech and freedom of information. The
objective of the report is firstly to emphasize restriction of freedom
of speech for one part of the society /the opposition/, existence
of unrestricted opportunities for the other part /the government/
including unlawful use of different power tools resulting itself
in restriction of human rights, and secondly that it may offer "ill
services" to the users themselves on the rebound.

Spiritual and material values in the society should be balanced and
coexist in harmony. From this point of view one does not consider
the opposition strategy being mostly focused on social concerns of
a considerable part of population, deplorable human rights records,
shortcomings in public administration, etc., instead of prioritizing
economic development-related issues, such as construction of tunnels,
highways, elite buildings. A number of state representatives were
more enthusiastic in terms of material values while the opposition
rearranged the strategy within political and intellectual values
(civil freedoms, dignity, justice, equal rights).

Division of society into privileged "insiders" and the rest formed
tightly closed system in the country, where democratic principles of
governance were of artificial nature. These hampered the course of
political struggle under the rule of law. Meanwhile, the opposition
adopted the same extremist policy aimed at polarizing the society
into "us" and "them"- "beguiled". The extremist policy of one part
of government and a part of opposition generated March 1-2 events
inflicting the society to suffer. Thus, the society shall enjoy
the right to demand political elite (government and opposition) to
ensure absolute respect for human rights and tolerance shall prevail
in the society.

The change of ruling political forces through elections, the exchange
of roles between ruling and opposition forces is a key indicator of
democratic development and an effective safeguard of socio-political
stability. If the opposition forces are deprived of possibilities to
replace the incumbent authorities through free and fair elections, and
the authorities are democratic insofar as it secures their "normal"
reproduction, then extremism in the political struggle cannot be
avoided.

Constitutionalism is a limitation of the power, which precludes
situations in the political struggle, when the winner assumes all
political, economic, and social control, while the defeated side
loses any possibility of survival. This is the type of situation that
pushes sides into a "life-or-death" struggle, laying the ground for
the emergence of authoritarian and totalitarian political regimes.

The newly-elected President and the new system of government inherited
a heavy burden from their predecessors. It would have been preferable
to avoid it, but it could not be done, and now, everyone must now
come together to overcome this situation.

The following issues have to be resolved in order to address this
situation:

1. To ensure that the authorities function in a framework of public
accountability, and to secure a strong opposition: this is the only
case in which the authorities will no longer be able to subordinate
society to their will. As a result, the opposition will not have to
go to the streets, because they will be able to voice their concerns
through legal and political means.

2. To reform the electoral legislation: in particular, it is necessary
to revise the Electoral Code provisions on the formation of electoral
commissions, the recount procedures, etc.

3. To safeguard the freedom of expression and to put in place
conditions for pluralism and impartiality in the electronic
media. Without pluralism, society cannot be free, and the authorities
will not exercise self-restraint. To this end, it will be essential
to reform the legislation on television and the radio. It is also
necessary to ensure equal participation of the representatives of
the power and the opposition in the formation of television and radio
regulatory and supervisory bodies.

4. To rule out laws groundlessly restricting human rights and freedoms
(such as the recent amendments to the Republic of Armenia Law on
Conducting Meetings, Assemblies, Rallies, and Demonstrations).

5. To safeguard the constitutional principle of equality of rights
and to eliminate existing economic monopolies, which will help to
overcome the oligarchic system of governance. This is the only way
to enable people to realize their creative potential. As a result,
society will no longer demand political extremism, and political
forces will no longer generate such supply. Extremist ideas are born
out of an extremely polarized society. If society is not polarized,
no extremist idea can activate the broad masses.

6. To fight against causes, rather than consequences.

To this end, it is vital to create an independent commission to
inquire into the March 1 events.

7. At this point, it would be most dangerous and useless to imitate
reforms.

Thousands March In Los Angeles Area To Mark Armenian Killings

Thousands marched in Hollywood to commemorate what they call the
Armenian genocide at the hands of the Turks at the end of World War
I. Turkey has denied there was a genocide.

Los Angeles (myfoxla.com) — About 5,000 people marched in Hollywood
on Thursday to observe the 93rd anniversary of what they call the
Armenian genocide.

Protesters want the Turkish government to admit responsibility for
the slaughter of about 1.5 million people.

Turkey questions the number of deaths and denies it was a genocide.

Accompanied by police officers who blocked streets, the peaceful march,
organized by the Armenian Youth Federation, traversed Sunset Boulevard,
Western Avenue, Hollywood Boulevard and Normandie Avenue.

Later in the afternoon, a rally was held in front of the the Turkish
Consulate in the 6300 block of Wilshire Boulevard.

Protesters called on the Turkish government to take responsibility
for the deaths.

Los Angeles police said there were no arrests or citations during
the march.

More Armenians live in the Hollywood and Glendale areas than in
Yerevan, the capital of Armenia.

Armenia, Azerbaijan To Hold Talks On Nagorno-Karabakh

The foreign ministers of Armenia and Azerbaijan are due to meet on
May 7 for talks on the settlement of the conflict between the two
countries over Azerbaijan’s disputed Armenian- speaking enclave of
Nagorno-Karabakh, the Armenian Foreign Ministry said on Wednesday.

Armenia’s Edvard Nalbandian and Azerbaijan’s Elmar Mammadyarov will
hold talks in Strasbourg, where they will attend a meeting of the
Council of Europe Committee of Ministers, Armenian Foreign Ministry
spokesman Tigran Balayan told Interfax.

"The events of 1915 are a reason for drawing lessons," Chief of RA
Military Police Vladimir Gasparyan said after paying tribute to the
victims of the Armenian Genocide at Tsitsernakaberd Memorial.

According to him, the Armenian people should be united to be able to
resist the enemies and to avoid the reoccurrence of what happened 93
years ago.

Armenian wine-makers need the state support, said Avag Harutyunyan,
the head of the Armenian Wine-makers’ Alliance, in a meeting with
the journalists today.

According to him when Russia forbid to import Georgian wine, Armenian
wine-makers tried to get use of the situation and export much wine to
Russia by the support of the government. "But we failed nevertheless
the alliance has applied to different bodies several times," said
A. Harutyunyan.

According to Harutyunyan Georgia made some attempts and improved the
quality of its product and today they export their wine to Russian
market again. He reminded that Georgian authorities provided serious
support to their wine-makers.

Harutyunyan reminded that 80% of Armenian grapes are used to get
brandy, and this is the business of richer people who do not need
state support.

Armenian Genocide observance

A part of the 93rd commemoration ceremony of the Armenian Genocide,
"The Georgetown Boys" will be performed on Sunday, April 20, 3 p.m. at
the North Andover Middle School, Main Street.

The musical, written and directed by noted Armenian playwright
Dr. Herand Makarian, tells the story of 109 genocide orphans from
Western Armenia who were brought to Georgetown, Canada, to be trained
as farmers. Ranging in age from 8 to 12, they worked in the Toronto
suburb until they were able to open farms of their own.

The musical, performed by the New Jersey Youth Theater Group, will
be in both English and Armenian.

The overall theme of Sunday’s commemoration will be "One and Half
Million Reasons to Remember," reflecting the 1.5 million lives lost
during the genocidal years under the Ottoman Turkish empire from
1915 to 1923. Survivors in the Merrimack Valley will be present at
the event.

A joint requiem service will precede the play, conducted by area clergy
and there will be hymns from the Armenian Choral Group of Merrimack
Valley. Winners of an annual essay contest will also be announced.

Admission is $20 for adults and $10 for students. For advance tickets,

"Along with the Coalition Agreement the resolution passed at the spring
session of the Parliamentary Assembly of the Council of Europe (PACE)
outlines the major steps which will enable Armenia to come out of
the current awkward situation. It will serve a serious precedent to
avoid such situations in future," HHK MP and member of the Armenian
delegation to the PACE, Hermine Naghdalian, told A1+.

Hermine Naghdalian says the activity of the Azeri side at the PACE
session was unprecedented though expected.

Every time Armenia weakens its position with regard to some issue,
Azerbaijan employs all methods-militarist, diplomatic, and uses every
rostrum to degrade Armenia.

The HHK MP thinks Armenia’s authorities and opposition should join
efforts "to solve the major problems in the country in a fair way
and to raise Armenia’s reputation overseas."

Reminder: the resolution lists a number of conditions for a dialogue
between the conflicting sides in Armenia. Notably, the immediate
opening of an independent inquiry into the events of 1 March (which
resulted in 10 people killed and 200 injured), the urgent release
of the persons detained on seemingly artificial and politically
motivated charges and the revocation of the amendments recently
adopted by the National Assembly to the Law on conducting meetings,
assemblies, rallies and demonstrations, with immediate effect.

YEREVAN, April 17. /ARKA/. Yerevan Djur company is to implement
zoning of Yerevan to improve water supply in the capital, the General
Director of Yerevan Djur closed joint stock company Serge Popoff
told journalists.

11 zones to be outlined will cover area with total population of
161,000 people. The zoning will be completed by October 2008 and
will allow creating mini-networks in communities that are at similar
altitudes which will enable pressure control and loss reduction in the
network, Popoff said. This will also give an opportunity to detect
the most vulnerable sections of the pipeline and make replacements,
he said.

140 booster pumps are to be replaced and water supply in villages is
to be repaired in the scope of the zoning program, Popoff said.

Yerevan Djur CJSC holds Yerevan water systems under lease for ten
years and is to provide drinking water supply and wastewater services
to the capital, as well as to Ararat, Aragatsotn and Kotayk regions
of Armenia.

The Yerevan Djur Company, Armenia’ resident, was founded by the
Veolia Generale des Eaux (France), which won a WB-announced tender for
management of the Yerevan Water and Sewerage Company in 2005. During
the lease period, the Veolia Generale des Eaux is to invest $20mln
for repair of the water supply network under the WB loan program,
17.6mln Euro gained from collection after water prices are approved
and 6.4mln Euro as the company’s own investments.

"GUAM countries should join efforts for the settlement of the conflicts
in their territories. These conflicts should be solved basing on the
principles of international law recognized by the world community. This
is the approach of GUAM countries to the settlement of the conflicts
and this position was coordinated at the summit of GUAM heads of state
two years ago," Azerbaijani Deputy Foreign Minister Araz Azimov said
at the international conference "Basic principles of settlement of
the conflicts in GUAM countries" in Baku, Today.az reported.

Araz Azimov said GUAM countries should mobilize their forces to solve
the conflicts in their territories. He dismissed the misconception of
"frozen conflicts".

"By "frozen conflict", we mean the frozen situation, not the frozen
solution," he said.

"Armenia’s position consists of delaying the settlement of Nagorno
Karabakh conflict. Ways of solution of this problem should be
found. These ways are political pressure, basing on the principles of
international law and unique position of the international community,"
he said.

Araz Azimov said Azerbaijan is ready to continue the negotiations
on the settlement of Nagorno Karabakh conflict and did not refuse
dialogue.

Former Presidential Candidate, Chairman of "National Democratic Union"
Vazgen Manukian met with journalists for the first time after the
elections. He accounted his silence for the oversensitivity of the
political situation.

According to him the opposition had every chance to win if it used
another format. Regarding the legitimacy of elections Vazgen Manukian
said: "They were more legitimate than those of 2003."

"We have had no legitimate elections since 1995. But as compared to
the Presidential Elections of 2003 we had fewer violations. I cannot
accept the post-election demands of the opposition. Back in 1996
we demanded that one ballot-box from each polling station be opened
and the ballots counted. I cannot accept the demand of 2008. Levon
Ter-Petrossian declares he has won 65% of votes and he is eager to
sit in his palace. It is a unique claim but not quite real."

With regard to March 1 victims Vazgen Manukian says: "For the first
time in Armenia’s history we had victims during political unease. Who
is responsible?

Who is to blame? Usually, the state is responsible for the blood
shed at the time of demonstrations. But it is the court’s duty to
find out those guilty. We should distinguish political prisoners from
transgressors and punish the guilty ones."

"We are on the wrong way. We shouldn’t go over 1988 or 1996
again. People are displeased with the government but they do not
want to be engaged in politics. They simply wait until a fairy comes
and takes away the evil spirits. In such circumstances someone will
always be a loser and people will suffer."
