Azerbaijan to release Armenian POW

Azerbaijan has repatriated POW Vartan Martikovich Saakyan to the
Armenian side, Commission for work with the prisoners of war, lost in
action and hostages told Trend.

V. Saakyan, born 1986, was detained on February 2, 2006, next to the
Azerbaijani-Armenian front line near Gasangay village of Terter
district. In the course of investigation, it was discovered that he
was serving on contract in the military forces of Armenia at the
occupied territory of Nagorno-Karabakh.

POW release was conducted on the base of reports of the Azerbaijani
and Armenian governments to the International Committee of the Red
Cross (ICRC). ICRC delegates visited the prisoner of war before the
operation to ensure he was returning home of his own free will.

NEWLY DECLASSIFIED STATE DEPARTMENT FILES REVEAL EARLY OPPOSITION
TO ARMENIAN GENOCIDE RECOGNITION BY THE UNITED NATIONS

— Confidential Cables from 1970s Provide Insight into
U.S.-Turkish Cooperation in Seeking to Prevent the World
Body’s Recognition of Crime against Armenian Nation

WASHINGTON, DC – A series of formerly classified State Department
cables, recently made available through the National Archives and
Records Administration, provide first-hand insights into the
cooperation during the early 1970s between the U.S. and Turkish
governments seeking to block the recognition of the Armenian
Genocide by the United Nations.

“These files provide new insights into the depths to which our own
government has sunk in its complicity with Turkey’s denial of the
Armenian Genocide,” said ANCA Executive Director Aram Hamparian.
“Knowing that sunshine truly is the best disinfectant, we welcome
the release of these documents and value the growing public
awareness of the internal mechanics of our government’s immoral and
short-sighted policy of denial – an increasingly untenable policy
that is destined to collapse under the growing weight of its own
lies.”

Commenting on Turkey’s efforts to delete reference to the Genocide
in a Human Rights Subcommission report, the Secretary of State
wrote in a March 1974 cable to the U.S. Mission to the U.N. that:

“Dept [State Department] appreciates Turkish concerns
on Armenian Question and agrees that subject should be
handled even-handedly. Para [paragraph] objected to by
Turkish del [delegation] reads as follows: Quote: Passing
to the modern era, one may note the existence of
relatively full documentation dealing with the massacres
of the Armenians, which has been described as “the first
case of genocide in the twentieth century” unquote.

Apparently seeking to avoid the international criticism it would
face for openly supporting Turkey’s outright efforts to delete this
passage, the State Department advised the U.N. Mission to present
its opposition on procedural grounds:

“We would like to support the Turks and Dept [State
Department] therefore concurs in USDEL [U.S. Delegation
to the U.N.] suggestion that we inform Turks we willing
to speak in support of procedural proposal to urge
rapporteur to assure evenhandedness in study. We do
not think it would be appropriate to request the
rapporteur simply to delete the offending para
[paragraph], although we would not oppose deletion if
other dels [country delegations] indicate support for
Turkish position.”

In March of 1974, the U.S. Embassy in Ankara wrote to the State
Department outlining its rationale for opposing the U.N.’s
recognition of the Armenian Genocide. Among the reasons cited
were:

“[…] Another reason is that the Turks are apprehensive
that this year’s commemoration of the Armenian massacres
by Armenian communities throughout the world will be on
a more impressive scale than in the last few years.”

“[…] In addition, at a time when we are trying to
persuade the Turks to exhibit some appreciation of our
position on the opium issue, we would like to be able
to show some understanding for a position on which
Turkish emotions have characteristically run high.”

In a March 1974 note following the support expressed by the U.S.
for the Turkish position, the U.S. Mission informed the Secretary
of State that:

“Turk del [delegation] warmly thanked U.S. del [delegation]
for support following our intervention.”

These files also provide insight into the early efforts by the
Turkish Government to obstruct U.S. legislation and prevent other
constitutionally-protected efforts by American citizens to work
toward the recognition of the Armenian Genocide. In an April 1973
cable, the State Department wrote to the U.S. Embassy in Ankara
that:

“It clear GOT [Government of Turkey] would like USG
[U.S. Government] to halt all Armenian demonstrations,
and indeed other Armenian activities which are hostile
or offensive to a close ally.”

In a second cable, also from April of 1973, the State Department
reports that it has responded to Turkish concerns in the following
manner:

“We pointed out that peaceful demonstrations could probably
not be prevented, but expressed belief that with adequate
policing, they could be stopped from getting out of hand.”

A June 1974 cable reports on protests raised with the State
Department by Turkey’s Ambassador, Selcuk Esenbel, over a recently
introduced Armenian Genocide Resolution. Under-Secretary of State
Joseph Sisco dismissed the legislation, according to the cable,
explaining to Ambassador Esenbel that the “resolution must be seen
as part of normal domestic electoral politics.”

Despite Turkey’s efforts, the United Nation has established a
record of recognizing the Armenian Genocide:

* In 1948, the United Nations War Crimes Commission invoked the
Armenian Genocide “precisely . . . one of the types of acts which
the modern term ‘crimes against humanity’ is intended to cover” as
a precedent for the Nuremberg tribunals. The Commission stated
that “[t]he provisions of Article 230 of the Peace Treaty of Sevres
were obviously intended to cover, in conformity with the Allied
note of 1915 . . ., offenses which had been committed on Turkish
territory against persons of Turkish citizenship, though of
Armenian or Greek race. This article constitutes therefore a
precedent for Article 6c and 5c of the Nuremberg and Tokyo
Charters, and offers an example of one of the categories of ‘crimes
against humanity’ as understood by these enactments.”

* In August 1985, after extensive study and deliberation, the
United Nations SubCommission on Prevention of Discrimination and
Protection of Minorities voted 14 to 1 to accept a report entitled
“Study of the Question of the Prevention and Punishment of the
Crime of Genocide,” which stated “[t]he Nazi aberration has
unfortunately not been the only case of genocide in the 20th
century. Among other examples which can be cited as qualifying are
. . . the Ottoman massacre of Armenians in 1915-1916.” This report
also explained that “[a]t least 1,000,000, and possibly well over
half of the Armenian population, are reliably estimated to have
been killed or death marched by independent authorities and eye-
witnesses. This is corroborated by reports in United States, German
and British archives and of contemporary diplomats in the Ottoman
Empire, including those of its ally Germany.”

khachkars in Old Julfa cemetery in Nakhichevan, Azerbaijan,
is in comprehensible, Armenian NA Vice-Speaker, Co-Chair of the
Armenian-Russian Interparliamentary Commission Vahan Hovhannisyan
said. In his words, the silence is odd taking into account that the
Russian State Duma adopted a resolution on recognition of the Armenian
Genocide. The Russian delegation could not adduce distinct arguments
over its stance, an Armenian MP said.

The owners of elite blocks of apartments get 300 per cent profit from
sales, said MP Manuk Gasparyan on March 21. He denied the concerns that
the increase of the price of cement will affect the rates of building.

“Two or three years ago the price of reinforced concrete grew by
200-300 per cent. Who learned about it? No one, and the rate of
construction did become slow,” says Manuk Gasparyan. According to
him, there was no need to set a low price on the natural gas supplied
to industry not to allow the growth of the price of cement. “Cement
is required for building, and building is done by rich people. Why
are we reducing the price of gas for industry at the expense of the
population,” says the member of parliament.

Manuk Gasparyan thinks this is a big bluff. Armrusgasard sets the
price of gas for industry in dollars, but sells gas to people in drams.

US Assistant Secretary of State Daniel Fried organized a reception at
Armenia Marriott Hotel in Yerevan yesterday [16 March]. The Armenian
political elite was invited to it as well. At the beginning of the
reception, Fried asked the participants to keep their conversation
confidential. But in reality he said nothing secret.

This is what one of the participants said [in an interview with the
newspaper]: “He spoke about a meeting with Azerbaijani President Ilham
Aliyev, and said that he was sure Aliyev will not resume hostilities
because he is the most balanced politician unlike other Azerbaijani
politicians. Fried said that Aliyev’s bellicose statements were aimed
at domestic use. What Aliyev says during meetings with co-chairmen
[of the OSCE Minsk Group] is different from the statements he makes
in Azerbaijan, Fried pointed out.”

However, both Fried and [US co-chairmen of the OSCE Minsk Group] Steven
Mann were trying to explain to the participants that the preservation
of a status-quo is not favourable for Armenia because of the growth
of Azerbaijan’s economy and budget, our interlocutor said.

Asked by [former head of the Armenian presidential administration]
Artashes Tumanyan whether Nagornyy Karabakh’s subordination [presumably
to the USA] is possible in the light of problems existing between
the USA and Iran, i.e. whether it is possible that the USA deploy
peacekeepers in close proximity to the Iranian border, Fried was
confused and said that it would be good, if Armenia had a good
neighbour [as published].

“ARMENIA” TV COMPANY IMPLEMENTS DENATIONALIZED PROPAGANDA, YOUNG
POLITICIANS’ CLUB MEMBERS STATE

YEREVAN, MARCH 17, NOYAN TAPAN. “Armenia” TV company programs
starting from their names up to their contents have denatiolized
orientation. Marine Hovian, the Deputy Chief of the RA State Language
Department made such a statement at the March 16 discussion titled
“Youth Against Denationalized Propaganda.”

According to her, a committee should be created only after conclusion
of which some programs may be broadcast. In the opinion of members of
the Young Policians’ Club initiated the discussion as well, “Armenia”
TV company implements today denationalized propaganda during its
broadcast.” According to Arman Vardanian, the Chairman of the club,
they were made indignant by the video material recently showed during
the “Exclusive” TV program where “a homosexual played his buffoons
and make every effort to look like foreign singer Shakira” and then
spoke of national ideas. According to A.Vardanian, after that the club
held an action-awarding and few TV companies, including “Armenia”
were awarded “Golden Dustbins” for broadcasting such programs. But,
“Armenia” broadcast that video material twice more. “We call on all
the TV-radio companies to be more attentive and impartial as well as
to review their broadcast policy,” A.Vardanian mentioned.

Yerevan, 16 March: Armenian Defence Minister Serzh Sarkisyan suggested
today that monitoring be carried out on the contact line between the
Armenian and Azerbaijani armed forces more often and that the results
be made public.

The defence minister said this at a meeting with US Assistant Secretary
of State for European and Eurasian Affairs Daniel Fried and the US
co-chairman of the OSCE Minsk Group, Steven Mann, the spokesman for the
Armenian Defence Ministry, Col Seyran Shakhsuvaryan, has told Mediamax.

The defence minister said that these measures would help prevent
truce violations.

Serzh Sarkisyan thanked the USA for efforts in the settlement of the
Nagornyy Karabakh conflict, undertaken within the framework of the
OSCE Minsk Group, noting that he was an optimist and believed that
they would achieve success.

Relations between Armenia and NATO “are developing rapidly”, the
Armenian defence minister said at a meeting with the representative
of the US European Command, Col Mike Anderson, who accompanies US
Assistant Secretary of State Daniel Fried.

On behalf of the European Command, Mike Anderson thanked the Armenian
defence minister for the service of the Armenian peacekeepers in Iraq,
stressing their professionalism. He also thanked the Armenian military
leadership for cooperation and openness exhibited during the work of
the US Defence Assessment Team in Yerevan.

Speaking about reforms in the Armenian army, Serzh Sarkisyan said that
within 10 years the republic would have armed forces more compatible
with international standards.

The Orange Democratic Movement (ODM) yesterday linked a Narc politician
to a press conference by two former Soviet bloc foreigners Langata
MP Raila Odinga describes as mercenaries.

And the movement accused the Government of providing state security
to Mr Artur Sargsyan and Mr Artur Margaryan, who they claimed were
“international criminals.”

Mr Odinga claimed he had information that arrangements for the Press
conference at the Jomo Kenyatta International Airport were carried
out by the politician’s personal assistant.

In a move that added more mystery to the saga behind the two Armenians,
the former Roads minister claimed Mr Sargsyan, who had been said to
have flown into the country a few minutes before the Press conference,
was in fact in the country.

Vehicles guarded

He claimed Mr Sargsyan and Mr Margaryan were chauffeured to JKIA in
two GK vehicles guarded by two outriders to conduct “a stage-managed
press conference.”

On reaching JKIA, Mr Odinga alleged that they were sneaked in through
Gate 1 and later disguised to appear as if they had just landed in
the country before addressing the Press conference.

The Langata MP claimed journalists were locked in a room as
arrangements for the stage-managing the press conference were going
on. All media houses, except the Nation Media Group, were invited to
the event.

“Even if you have flown in a jet, you must have small luggage. You
cannot just walk as if you are from a bar,” he said and asked:
“Why this shadowy way of doing things?” “Even the statement that Mr
Sargsyan read was prepared in the office of Kenya Airports Authority
deputy managing director Naomi Sidi.

But Ms Sidi denied the claims that she was the one who had organised
for the two Armenians to use the VIP lounge for the news conference.

During the news conference, the Armenians insisted they were simply
businessmen who came to Kenya to work with the hotel industry and in
general trade.

They had interests in Pakistan, India, Sri Lanka and the Democratic
Republic of Congo and said they had invested Sh360 million ($5
million) in Kenya in housing and metal industries, with the approval
of President Kibaki.

Fund ODM

The two said they had been introduced to both Mr Odinga and Mr Kalonzo
Musyoka by another businessman, and had been asked by Mr Odinga and
Mr Musyoka to fund the ODM’s no-vote campaign in the last year’s
November 21 referendum on the proposed Constitution.

They said they refused to do this, saying they never helped to fund
political work, but said that instead they agreed to a request by Mr
Odinga to lend him $1.5 million (about Sh108 million).

Mr Odinga and Mr Musyoka have denied the claims and accused the
Government of being behind the allegations “to tarnish the integrity
of ODM leaders”.

Mr Musyoka has admitted meeting the two Armenians at the Grand Regency
Hotel in Nairobi but insisted that no business was transacted.

Flanked by ODM leaders William Ruto, Mutula Kilonzo and Reuben Ndolo
among others, Mr Odinga added to the mercenary twist when he claimed
that Mr Sargsyan was still in the country contrary to reports that
he has flown back to Dubai in a private jet. “They never went anywhere.

They are still in the country,” he said.

Reading ODM’s statement, Mr Kilonzo claimed the presence of Mr Sargsyan
and Mr Margaryan in the country was known to high people in Government.

“It is clear to us that the presence in Kenya of the two persons of
questionable character and integrity is with the express knowledge of
the Government at a very high level,” he said at Parliament Buildings
in Nairobi.

The leaders also queried the source of huge sums of money for the
Armenians’ investment and the bank through which the transactions
were carried out.

They told Kenyans to be wary of serious international criminals who
were present in the country. “Serious international criminals are on
the loose in the country, Kenyans beware,” they said.

But Tourism assistant minister Kalembe Ndile and Mwea MP Alfred
Nderitu asked the Government to take legal action against Mr Odinga
and Mr Musyoka for allegedly engaging in espionage.

Mr Nderitu stated that Mr Musyoka, Mr Odinga and the two Armenians
should be locked up and grilled to provide information into the
mercenaries claims.

of the 17th issue of the “Accord” monthly took place in Stepanakert
on March 3.

This was dedicated to the Karabakh conflict settlement. Representatives
of the “Conciliation Resources” international non-governmental
organization, owing to the financial aid of which the monthly is
published, the NKR Parliament deputies, representatives of the
Foreign Ministry and the non-governmental sectrum, scientists and
journalists, guests from Armenia, Georgia, Abkhazia and Azerbaijan were
present at the presentation. As “Conciliation Resources” Caucasian
Programme Co-Director Jonathan Cohen mentioned, publication of the
given issue of the magazine is an attempt to analyze reaons of the
impasse situation created in the negotiation process. Its goal is
to create conditions for wide discussions. “Accord” Editor Laurence
Broers stated that the presentation of the monthly issue coincided the
difficult period of time for the negotiation process directed to the
Karabakh conflict settlement and the society’s disappointment after
the Rambouillet negotiations. At the same time, he emphasized, that
it’s impossible to get peace without using resources of wide strate
of the society. According to him, today Nagorno Karabakh practically
is out of the negotiation process, and the negotiations were moved
in the Armenia-Azerbaijan format, field of clearing up international
relations. As Noyan Tapan was informed by the NKR Foreign Ministry’s
Information-Analytical Department, attempts of creating false
parallels of the type of “Armenian community of Nagorno Karabakh”
and “Azerbaijani community of Nagorno Karabakh,” speculations on
historic facts, moving the conlfict on the Armenia-Azerbaijan field
were particularly mentioned during the discussions. The necessity of
the Nagorno Karabakh participation in negotiations was particularly
emphasized. The monthly’s presentations and wide discussions took
place and are envisaged in Yerevan, Baku, Tbilisi, London, Washington.

Parties Of NK Conflict Close To Agreement, Matthew Bryza Says

PARTIES OF NK CONFLICT CLOSE TO AGREEMENT, MATTHEW BRYZA SAYS

The parties to the Nagorno-Karabakh conflict are close to an agreement,
Matthew Bryza, Deputy Assistant Secretary of State for European and
Eurasian Affairs, told reporters in Yerevan.

The most important steps remain, he added. The issues that have to be
settled are the most difficult ones, and the leaders of the states
must have clear positions, Bryza said. The leaders of the states
must determine the terms of settlement themselves, and “we will do
our best for the decision to be made as soon as possible.”

The US diplomat disagreed with the opinion that the negotiations for
the Nagorno-Karabakh settlement are in the deadlock.

He disagrees with those claiming that the Rambouillet negotiations
failed, and the OSCE Minsk Group has exhausted its potential.

The Presidents did not arrive at a decision in Rambouillet, but it
does not mean that the negotiations failed.
