EU WELCOMES 301 AMENDMENT BUT CALLS FOR MORE

The European Commission has welcomed the Turkish Parliament’s amendment
of a disputed law used to prosecute writers for insulting Turkishness,
but said it seeks more changes to ensure that such prosecutions come
to an end.

In the early morning hours on Wednesday Parliament approved the
long-awaited amendment to a penal code article criticized by
rights groups, activists and the European Union for limiting free
speech. However, intellectuals, journalists and writers say the
amendment is not sufficient.

"This amendment is, of course, a welcome step forward and the
commission now looks forward to further moves that change similar
articles in the penal code, because this article was not the only one
addressed … in order to ensure in fact that unwarranted prosecutions
stop," European Commission spokesman Amadeu Altafaj Tardio said
on Wednesday.

"Now the Turkish authorities need to focus on implementation of
the reform to guarantee full freedom of expression for all Turkish
citizens," he told a news conference. The EU has said easing
restrictions on free speech is a test of Turkey’s commitment to
political reform as Ankara looks to advance slow-moving membership
talks which began in 2005.

While Enlargement Commissioner Olli Rehn has welcomed the amendment of
301, labeling it "a step forward," Joost Lagendjik, the co-chairman
of the Turkey-EU Joint Parliamentary Commission, said, "It was
an acceptable compromise." Cautious in his positive reaction to
the amendment, Rehn drew attention to other articles in the penal
code curbing freedom of expression that should be changed. "This
amendment is a welcome step forward, and the commission looks forward
to further moves to change similar articles in order to ensure that
ungrounded prosecutions stop," Rehn said, signaling that he would
like to see the implementation before a full assessment. "Now the
Turkish authorities should focus on implementation of the reform
to guarantee full freedom of expression for Turkish citizens," the
enlargement commissioner added.

A strong critic of 301 since 2004, Lagendijk said the amendment was
an acceptable compromise in the face of fierce polarization within
the Turkish community. Expressing his hope that 301 would not be used
again, as the new version requires the permission of the minister of
justice, Lagendijk said, "The new version has now come, to a great
extent, to be parallel with other penal codes of EU members. There
are similar laws in the Polish and Italian penal codes." However,
Lagendijk made it clear that he was for the abolition of the article
once and for all. "This will not win the beauty contest of the legal
reforms. But I think the immediate effect will be that there won’t
be any more cases opened on the basis of 301," he added. Similar to
the words of the enlargement commissioner, he voiced his concern over
the other articles that could be used with the same purpose.

In its 2007 progress report on Turkey, the European Commission had also
cited certain other articles of the penal code that need to be amended.

Changes the amendment introduces

The change to Article 301 of the penal code was approved with 250
votes for and 65 against amid fierce criticism from the nationalist
opposition. The ruling Justice and Development Party (AK Party),
which dominates the 550-seat Parliament with 340 lawmakers, was the
only party that voted in favor of the amendment, while opposition
parties voted against it. The amendment has to be approved by the
president before it can go into effect.

The article has been used to prosecute hundreds of writers, including
Nobel Laureate Orhan Pamuk, for insulting Turkishness.

After the reform goes into effect, it will be a crime to insult the
Turkish nation, rather than Turkishness, and the justice minister’s
permission will be required to open a case under 301. The maximum
sentence will be cut to two years from three.

Although no one has ever been sent to jail on a 301-related charge,
the publicity of such cases has done great damage to individuals who
were suspects in these trials. Some, such as Armenian-Turkish editor
Hrant Dink, have paid dearly. Dink, who was tried for insulting Turkish
identity in 2006, was shot dead by a militant nationalist in January
of last year.

Defending the reform against criticism from the opposition, Justice
Minister Mehmet Ali Å~^ahit said there would still be restrictions
on insulting Turkey. This change will not allow people to insult
Turkishness freely, he told Parliament.

Critics say Prime Minister Recep Tayyip Erdogan, whose AK Party is
facing possible closure for allegedly violating secular principles,
is now keen to be seen as advancing Turkey’s EU bid.

Opponents of Article 301, meanwhile, say the government-proposed
changes are only cosmetic and will have little impact on Turkey’s
EU bid. They also state that there are other freedom-curbing laws in
Turkey’s penal code that need to be changed.

Parliamentary opposition to 301 reform

The bill, passed after eight hours of mostly late-night debate,
had been delayed several times amid stiff opposition from nationalists.

Turkey’s far-right Nationalist Movement Party (MHP) accused the
government of betraying the country’s identity and instead pandering
to EU demands that it reform laws prohibiting Turks from insulting
their nation.

MHP leader Devlet Bahceli told a meeting of his party ahead of the
vote the reform would be a historical mistake. Slandering Turkey’s
honorable history, insulting the Turkish nation and the values of
Turkishness has become a habit in the AK Party’s political thinking,
which lacks a sense of identity, he said.

MHP Secretary General Faruk Bal, in a meeting of the MHP’s
parliamentary group on Monday, said the problem with 301 was its
image outside Turkey. He said 301 was introduced in the West as an
article that incited the murders of journalists, referring to the
death of Dink, who had been tried under Article 301. "Article 301 has
been accepted as the only obstacle to EU admission, which is a lie,"
Bal said.

The main opposition Republican People’s Party (CHP) also opposed the
reform. The pro-Kurdish Democratic Society Party (DTP), whose members
often end up in court for expressing views on the Kurdish issue,
wanted to abolish the article.

Article 301 has notably been used against writers such as Pamuk
for comments on the killings of Armenians by Ottoman Turks in
1915-16. Turkey denies Armenian claims that the killings constituted
genocide.

Azerbaijan’s Defense Minister Safar Abiyev received commander of
Turkish air forces general Aydoghan Babaoghlu.

The due information was provided by the press service for the Defense
Ministry of Azerbaijan.

Safar Abiyev noted that Azerbaijan also felt Turkey’s support in hard
times and this country was the first to recognize the independence
of Azerbaijan.

He noted that successful cooperation has been established in the
military and all other spheres and there is a need for their further
development.

Azerbaijan’s Minister of Defense informed the visitor about the great
progress in the national army, conduction of military trainings and
education, meeting modern standards. He noted that the Turkish armed
forces have always supported Azerbaijani army in this issue.

"Azerbaijan and Turkey have many common factors, including the demand
from Armenia to release the occupied lands of Azerbaijan", said Abiyev.

In turn, Babaoghlu noted that Turkey will always remain loyal to the
principle "One nation-two states".

The meeting was attended by Turkish ambassador to Azerbaijan Khulusi
Kilich and military attache of Turkey to Azerbaijan Fahri Kyr.

Armenians gathered at the Hartford State Capitol for a commemorative
service in recognition of the Armenian Genocide, reported the Armenian
National Committee of America, Eastern Region.

The program included an invocation from the local Armenian Churches;
recognition of Armenian Genocide survivors in the Connecticut
area; remarks by Rep. John Geragosian (D-25); and presentation of a
proclamation by the Governor; as well as remarks and singing by the
youth and requiem service. Greg Kuo from the Genocide Intervention
Network gave an informative update on the actions GI-Net is taking
to have the teachings of genocide in the school system.

Keynote speaker ANCA Eastern Region Director Karine Birazian talked
about taking action and being part of the solution. During her
comments she said, "As Samantha Power, Pulizer Prize winner, for
her book a Problem from Hell has discussed on several occasions,
you can either be a bystander or an upstander. I implore all of you
to become upstanders. And not watch another survivor pass without
proper recognition or watch another Darfurian die. We must continue,
as Armenian Americans, to raise our voices about the truth and ensure
that our children will not have to bear witness to similar atrocities."

Following the special requiem service a "Madagh" was donated by the
St. Stephen’s Armenian Apostolic Church, the Armenian Church of the
Holy Resurrection, and St. George Armenian Apostolic Church where
gatherers met with Birazian.

Earlier that week on April 24 community members gathered at the State
Capitol for an annual Armenian flag raising ceremony. Following the
events Geragosian commented: "For years we have been told that it is
‘not a good time’ to press for such a resolution". Enough is enough;
it’s time for us to come to grips with what many nations the world
over have already recognized–the 1915 massacre of Armenian–Turks
was a genocide."

To note, as Majority Caucus Chair, Geragosian was elected to the
Connecticut House of Representatives in 1994. Representing the 25th
district located in New Britain he serves on the Appropriations,
Insurance & Real Estate, and Judiciary Committees.

TEHRAN, APRIL 28, NOYAN TAPAN – ARMENIANS TODAY. A holy liturgy was
served on April 24 in the Saint Sargis Church in the capital city of
Iran, Tehran.

At the end of the liturgy representatives of the local Armenian
community laid flowers to the memorial of victims of Armenian Genocide
of 1915 in the church yard.

As the Zaman daily reports, this year, either, representatives of
Iranian Armenian community were not permitted to organize a procession
towards the Embassy of Turkey in Iran.

It should be mentioned that on April 24, 2007 the Iranian Armenian
community was not allowed to organize a procession, either.

`First the prices of food went up, now the gas bill. You don’t know to
buy food first or to pay the bills on the monthly retirement benefit
that the government pays us. Hard though you may try, the pension is
hardly enough for bread and the bills. How are we supposed to live?’
said an elderly woman to us.

The rise in price of gas is now the most frequently discussed topic.
From May 1 the users will pay 84 drams instead of 65. Prime Minister
Ara Harutiunyan says the government cannot afford to subsidize the
difference. The citizens of Armenia who used to pay 59 drams because
the government of Armenia subsidized the price will not get a subsidy
any more.

`So what, says Lyudmila, 58 years, who has not been working for 5-6
years, why is subsidy impossible? They used to raise the money so why
is it a problem now? The government promises to raise the pension and
benefits, while the prices of food grow day by day. We can hardly make
both ends meet.’

`We are lucky that they raised the bill now and not in winter, thanks
God we survived the winter. God knows what we will be doing next
winter. We will have to count what is cheaper, gas, wood or
electricity. Our government won’t let us get bored,’ Sergey, 46, says.

taken at the April 25 session of the Center of Nationwide Movement,

Levon Ter-Petrosyan’s candidacy during the election. A decision was
taken to start preparing the relevant claim. A working group of experts
was set up to prepare the claim. It unifies Armenian and foreign

mine and the processing activities will start, said the minister of
Environmental Protection in a conference, today.

According to the minister the cooperation with Russian "Rosatom"
company will give a chance to finish the work even before it is
scheduled.

According to the minister the Russian side disposed 3mln dollars. And
the increase of the sum depends on the activities. After the uranium is
found the company will dispose even more money and start implementing
its functions.

According to Nikolay Spasski, the executive director of the "Rosatom"
corporation they discussed the question with the minister and ensured
that the activities should be seriously treated. According to the
experts in 3-4 years serious results will be found.

Turkey (AP) – Turkey’s foreign minister said Monday he was seeking
a dialogue with Armenia’s new government to try to normalize ties
between two neighbors that have no diplomatic relations.

Ali Babacan told reporters he had written to his Armenian counterpart
saying that Turkey "is open to dialogue with the aim of normalizing
Turkish-Armenian ties in the new era.

A historical dispute has prevented the two nations from having
diplomatic relations.

Armenia says Turks killed up to 1.5 million Armenians around the time
of World War I, toward the end of the Ottoman Empire, in what it says
should be labeled genocide. Turkey says the killings occurred at a
time of civil conflict and that the casualty figures are inflated.

Turkey also closed its border with Armenia in 1993 during a war
between Armenia and Azerbaijan _ a Muslim ally of Ankara. The move
hurt the economy of tiny, landlocked Armenia.

"Admittedly we have problems, some of which date back 100 years,"
Babacan said, when he was asked about Turkey-Armenia relations
during a news conference with visiting Austrian Foreign Minister
Ursula Plassnik.

"But the only way of overcoming these problems is through dialogue. Our
doors are open to dialogue in this new period," Babacan said.

There was no immediate reaction to Babacan’s comments in Armenia.

But the Armenian Foreign Ministry referred The Associated Press to a
recent interview by newly appointed Foreign Minister Edvard Nalbandian
in which he said: "With regard to our relations to Turkey, we have,
on various occasions, expressed our readiness to normalize them
without any precondition.

"The genocide is a dark page of our common history and together we
have to turn this page and together must build a secure future,"
Nalbandian said.

As the result of Armenia’s February election, Serge Sarkisian, a
former prime minister, was sworn earlier this month as the country’s
third president since the collapse of the Soviet Union.

Supporters of Sarkisian’s challenger, former President Levon
Ter-Petrosian, and other opposition activists staged mass protests
in the capital, Yerevan, alleging fraud. Clashes later broke out with
police, prompting authorities to declare a 20-day state of emergency,
which was lifted last month.

An independent Azerbaijani newspaper has said that the West wants to
resolve the Nagornyy Karabakh conflict in its own interests.

"The West does not want to fight instead of us," the Baku-based Zerkalo
newspaper reported on 17 April. "They want to sign a Karabakh agreement
as soon as possible in order to continue pumping Azerbaijan’s energy
resources under stable conditions and use its territories for strategic
aims. They are ready to support any unfair peace accord for the sake
of this."

Zerkalo said US Secretary of State Condoleezza Rice’s recent call
on Armenia and Azerbaijan to resolve the conflict over the disputed
territory was "a call on the Baku government for compromises".

"We do not have methods against the superpowers which openly protect
Armenia’s interests," the daily said. "Even if the Azerbaijani
leadership manages to refuse to sign a disgraceful peace agreement
soon, the issue about compromises will be on the agenda for a long
time."

In the same report, the paper quoted Azerbaijani Deputy Foreign
Minister Araz Azimov as saying that Russia should state its support
for the Nagornyy Karabakh conflict resolution on the basis of
Azerbaijan’s territorial integrity and within its internationally
recognized borders.

"The resolution of the conflict on the basis of territorial integrity
should be supported in practice," Zerkalo quoted Azimov as saying.

Zerkalo also quoted Voice of America as saying that in its recent
report, the US Department of State said that the US government did
not recognize Nagornyy Karabakh as an independent state and supported
Azerbaijan’s territorial integrity, adding that Karabakh’s status
should be defined through talks. The US State Department report
described as perfect the efforts of the OSCE Minsk Group, which
mediates a solution to the Nagornyy Karabakh conflict, Zerkalo said.

Funding for Stem Cell Harvesting Center in Armenia Exceeds Halfway Mark

(BURBANK, CA). While many Southern Californians were relaxing at home
Sunday evening, a group of dedicated volunteers was busy answering
phone calls from across the globe. During the Armenian Bone Marrow
Registry’s first telethon, thousands of people from USA, Canada and
Middle East pledged more than $300,000 toward a campaign to establish
a Stem Cell Harvesting Center in Yerevan, Republic of Armenia.
"This outpouring of support is phenomenal," exclaimed Registry
President Dr. Frieda Jordan. "Not only has it exceeded our
expectations as far as monetary goals, it has set a precedent in
rallying the entire community – regardless of race, region, or
political affiliation – behind a cause that will save lives throughout
the world for many years to come." The telethon is part of the
Registry’s "Be An Angel, Save A Life" Campaign to raise a total of
$850,000 to fully fund the Center which, when established, will bring
the life-saving procedure of stem cell transplantation within the
reach of many more patients with leukemia and other life-threatening
blood diseases, and will play a vital role in the treatment of other
diseases such as cancers, diabetes, and heart ailments. The Center
will be the only one of its kind in the Caucasian region.
The telethon, which was broadcasted on Horizon, High Vision, ATV, ISN
and LA View television channels and webcasted on the Registry’s
website, was directed by Emmy Award-winning Director Mark Mardoyan and
hosted by Dr. Evelyn Baghdasarian, Paul Chaderjian, Arayik Ghazarian,
and Manoug Seyradariyan. Notable among the "Angels" who responded to
the appeal were the Kazarians Family, who made a donation in memory of
Mariana Kazarians, a founding board member of the Registry; the Owens
and Devorris Families; the Titizian Family, in memory of Arlene
Titizian; the Atikian Family; and Mr. and Mrs. Stepan and Linda
Vartanian. Several businesses and organizations made significant
contributions, including the American Development and Investment,
Inc.; the Armenian Relief Society’s Family of 12 chapters; St Mary’s
Armenian Apostolic Church of Glendale; Holy Martyr’s ARS Ashkhen
Pilavjian Pre-school; Lakeside Medical Group, through former
Assemblymember Keith Richman; Executive Council of the Prelacy of the
Armenian Church of Northern Iran; and Glendale Memorial Hospital, a
long-time supporter of the Registry.
Many of these major contributors to the project will be recognized by
having a room at the Center named after them. Additionally, 400
donors who pledged $250 each will be honored on the "Wall of Angels."
The overall success of the telethon would not have been possible
without the thousands of donors from around the world who pledged
donations below $500. Registry Executive Director Dr. Sevak Avagyan,
who made a special visit from Yerevan for the event, emphasized this
stating, "Every dollar contributed is a step closer to saving a life
in the future; we are grateful to each and every Angel tonight."
The success of the telethon moves the organization within $350,000 of
reaching its goal to establish the Center. Initial funds for the
project totaling just over $200,000 were donated by the Lincy
Foundation, private individuals, and Registry Board member Carolann
Najarian. The Registry hopes to raise the remaining funds in the next
five months. A key part of completing the campaign is the Third
Annual Walk-A-Thon on Saturday, June 21 at Griffith Park in Los
Angeles.
"We are extremely grateful to all who have pledged their support; days
after the telethon we continue to receive donations through phone
calls to our offices, on our website, and even personal visits," Dr.
Jordan noted. "But we still have a big challenge ahead of us. We are
hopeful that there are many more Angels out there who will see the
opportunity to make a significant difference – to help save lives."
