FREED ARMENIAN SOLDIERS AGAIN RISK IMPRISONMENT

The three former Armenian soldiers who were sensationally set free
in a high-profile army murder case last December are facing renewed
interrogations by military prosecutors and the possibility of again
finding themselves behind bars.

The conscripts, who spent nearly three years in jail on extremely
controversial murder charges, were summoned to the Military
Prosecutor’s Office on Wednesday for their second joint questioning
in ten days.

During the first interrogation they had to sign a written pledge not
to leave in Armenia pending investigation. Summonses sent to Razmik
Sargsian, Arayik Zalian, and Musa Serobian this month make it clear
that they continue to be accused of murdering two other soldiers of
their unit in Nagorno-Karabakh more than three years ago.

The bodies of Roman Yeghiazarian and Hovsep Mkrtumian bearing traces
of violence were recovered from a reservoir in the north of Karabakh
in January 2004. The military prosecutors maintain that they were
beaten to death by the three young men in a violent dispute over a
food parcel delivered to one of them.

The accusations are essentially based on Sargsian’s April 2004
videotaped testimony in which he confessed to the official version of
events. Sargsian retracted the testimony shortly afterwards, saying
that he was tortured into incriminating himself and his two comrades.

Serobian and Zalian also claim to have been badly mistreated in
custody.

The torture claims were deemed credible by Armenian and international
human rights groups. However, a court in Stepanakert refused to
investigate them, sentencing all three men to 15 years in prison
in 2005. Armenia’s Court of Appeals toughened the sentence to life
imprisonment in May 2006.

In a huge blow to Armenian law-enforcement authorities, the higher
Court of Cassation unexpectedly annulled both verdicts on December 22,
ordering the immediate release of the suspects and an "additional
investigation" into the mysterious killings. But while describing
the criminal case as deeply flawed and lacking evidence, the panel of
six judges stopped short of formally acquitting the former conscripts.

According to Armenia’s Office of the Prosecutor-General, this means
the accusations leveled against Sargsian, Serobian and Zalian still
stand. "If the Court of Cassation believed they are innocent, it would
have acquitted them," said a spokeswoman for the law-enforcement body,
Sona Truzian.

Truzian could not say whether the investigators, all of them replaced
after the December 22 judgment, will be seeking to again put the
freed soldiers on trial. "The decision will be made only after the
additional inquiry is over," she told RFE/RL. "It could take a few
more months. Again, they were not acquitted by the court."

One of the suspects, Arayik Zalian, was separately questioned
on Tuesday by Vartan Smbatian, a military prosecutor leading the
inquiry. Zalian said that the conversation was rather friendly as
Smbatian did not demand that he admit to the charges and instead
asked him about his alleged mistreatment by other interrogators.

"I’m not scared of anything," Zalian told RFE/RL before heading to
Smbatian’s office with the two other young men. "Let them interrogate
me as long as they want, but they are wasting their time. They
interrogated me for three years. What else do they want to know?"

The accused trio’s main lawyer, Zaruhi Postanjian, appears confident
that her clients will not end up in the dock. "I don’t think they will
again throw the boys into jail," she told RFE/RL. "They just want us to
stop demanding punishment of the real murderers that remain at large."

Postanjian and two other defense attorneys have repeatedly suggested
that the real perpetrator of killings is Captain Ivan Grigorian,
a Karabakh Armenian officer who commanded the army unit where the
accused and dead soldiers served. The commander of the Karabakh army,
Lieutenant-General Seyran Ohanian, only reinforced these suspicions
in early 2004 when he asked military prosecutors not to bring charges
against Grigorian in view of the latter’s contribution to the Armenian
military victor over Azerbaijan.

The defense lawyers are also demanding criminal proceedings against
military prosecutors and other law-enforcement officers that
allegedly tortured their clients and committed other violations of
due process. The European Court for Human Rights in Strasbourg is
now considering taking up a relevant case filed by them.

The Armenian Court of Cassation likewise faulted the lower courts
for refusing to investigate the torture claims. Though not a
full acquittal, its 29-page ruling is a damning indictment of the
military prosecutors’ handling of a murder case highlighting dozens
of out-of-combat deaths that occur in the Armenian army each year. The
full text of the verdict was released only a month ago.

It was the first known case of an Armenian judicial body rebuffing the
prosecutors. Human rights campaigners hope that it set an important
precedent for judicial independence in the country.

"The Court of Cassation concludes that this case has seen such
violations of the law on procedural justice that precluded an
objective, comprehensive and full investigation and can not be
eliminated during a judicial process," read the verdict. It said both
the investigators and lower courts violated provisions of Armenian laws
stipulating that criminal accusations must only stem from sufficient
factual evidence. "A guilty verdict can not be based on presumptions,"
the court said.

Anahit Yeghiazarian, the trial prosecutor who pressed charges against
Sargsian, Serobian and Zalian, will not necessarily agree. Making her
case in the Court of Appeals in April last year, Yeghiazarian said:
"I am guided not only by evidence but also by my internal conviction."

Azeri-Americans joined Turkey’s efforts in opposing the adoption of
the Armenian allegations resolution by the U.S. Congress.

Asked, "how the Azeri Diaspora of the U.S.A. can assist in opposing
the adoption of the Armenian Genocide resolution by the U.S.

Congress", President of Azerbaijan Society of America Tomris
Azeri said that the Armenian Diaspora in the United States is well
organized. "They have a firm agenda and everyone in their Diaspora
community believes and follows this agenda.

The Armenian Diaspora communities and businesses see it as their duty
and obligation to finance and support their organizations. The Armenian
experts says the ‘genocide claims’ is the only thing cementing the
Armenians in the Diaspora. Armenian lobbying groups argue that the
1915 events was genocide while Turkey claims the reverse. According to
the Turkish Archive Documents, more than 520.000 Turkish people were
massacred by the armed Armenians during the First World War. There
is no court verdict on the issue. Turkey has called Yerevan to go
to the international courts yet Arsmenia rejects all the calls from
Turkey and other countries.

Dual citizens should have all the rights and responsibilities the
common citizens have. At today’s press conference RA Foreign Minister
Vartan Oskanian spoke for the dual citizen’s right to vote.

"By granting dual citizenship, we should not create new categories. We
must not give advantages or restrict the opportunities of anyone. An
equal field should be created for everyone in the framework of laws
and Constitution in regard to rights and responsibilities," said
Vartan Oskanian.

YEREVAN (YERKIR) – With 66 pro, 5 con votes and 1 abstention, Armenian
National Assembly adopted the amendments to the Law on dual citizenship
at second reading. The United Labor party voted against. The opposition
did not participate in the voting.

Let us remind that this amendment establishes the institute of dual
citizenship in the republic and our compatriots residing in different
sites of the world gain the right to elect and be elected.

Dual citizens cannot run for president and parliament, they will not
be allowed to be members of the Constitutional Court.

According to Justice Minister David Harutyunyan, political
agreement has been reached on the following issue: "Dual citizens
who have no place of registration in Armenia will not participate
in elections. Correspondingly, dual citizens having a place of
registration in Armenia attain franchise. In fact, no additional
precincts will be opened for citizens not registered in Armenia.

A group of Turkish activists will initiate a political disobediences
campaign against Article 301 of the Penal Code.

10 members of the `Strong Turkey’ Party intend to gather in one of
public places of Istanbul and repeat the statements made by
editor-in-chief of the Agos daily Hrant Dink, which were characterized
as `insulting’ Turkishness’ under Article 301. Later they will
surrender to the Office of Public Prosecutor. Next week another 10
activists will repeat their actions.

`The campaign will continue until Article 301 is expelled,’ leader of
the Party Tuna Beklevic told the Associated Press.

`We do not want a Turkey stuck into darkness. We shall tell the Public
Prosecutor: we have committed a crime, come and judge us,’ he
declared.

The Party that was established only four month ago has several
thousand members.

(seat in Brussels) handed the copies of his credentials to RA Foreign
Minister Vartan Oskanian.

Greeting the guest, the Foreign Minister wished him success in
carrying out his high mission.

The Minister expressed appreciation for the activation of bilateral
ties between Armenia and Belgium. He noted that Armenia attaches
importance to the establishment of closer cooperation with Belgium
under the Armenia-EU Action Plan through elaboration and
implementation of concrete programs.

The interlocutors touched upon the opportunities for bilateral
cooperation. The Minister highly appreciated the balanced approach of
Belgium towards issues important for our country. The collocutors

YEREVAN, FEBRUARY 20, ARMENPRESS: A recent study shows that breast
cancer remains number one cause of death for Armenian women, followed
by cervical cancer.

Khachanush Hakobian, head of the Armenian-American Health center in
Yerevan, said the risky group are women between 35-50 who must have at
least one thorough examination a year. "Armenian women are different
focusing on taking care of their children and husbands and ignoring
their own health," she said.

According to her, over the ten years of its operation, the Center has
examined 93,000 women of whom 3,100 had breast cancer and cervical
cancer was found with 70 women. The highest mortality rate of breast
cancer among women is in Gegharkunik province.

She said some 400 women lives were saved due to early detection of
the disease.

Mrs. Hakobian said the arguments of women from vulnerable families
that they cannot afford 3,000 drams ($6) annually to pay for the
examination were not convincing. Besides, she said, the Center offers
free of charge services to disabled women and women from families
who lost a man in the Karabakh war.

Istanbul, 21 February: Turkish Prime Minister Recep Tayyip Erdogan and
Jane Harman, a member of the United States House of Representatives,
discussed the Armenian resolution (presented to the US Congress
earlier) in Istanbul today.

According to Prime Minister’s Office sources, Erdogan-Harman meeting
was very fruitful and constructive.

Erdogan and Harman discussed diverse issues, as Iraq, Palestine,
Israel, tragedy in Darfur and Armenian genocide allegations.

Sources said that Harman understood Turkey’s sensitivity towards
a resolution on so-called Armenian genocide better after speaking
with Erdogan.

"In this view, visit of German Foreign Frank-Walter Steinmeier is
important. Germany would like to see the South Caucasus as a unified

YEREVAN, FEBRUARY 20, NOYAN TAPAN. On February 20, a consultation took
part at RA NA Speaker Tigran Torosian’s office with participation of
heads of all NA groups and factions. Issues connected with fulfilment
of Constitutional Court’s February 16 decision were discussed.

To recap, CC had considered as invalid and contradicting to RA
Constitution the provisions of NA Regulations stipulating the
requirement of broadcasting programs covering parliament’s activities
on Public Television.

In response to Noyan Tapan correspondent’s question, Tigran Torosian
said that all participants of discussion hold the same opinion,
according to which not the phenomenon – the issue of covering
parliament’s activities, but the way of its implementation was disputed
at the Constitutional Court. In NA Speaker’s words, in conditions of
presence of CC’s decision the participants of discussion came to a
common denominator that an agreement should be reached with the Public
Television on not stopping programs covering parliament’s work and
a radical solution should be found later for ensuring coverage of
parliament’s activities on the basis of the agreement to be signed
with the TV company.

As NA Speaker affirmed, a solution to this problem will be found
soon with Public or any other TV company, the broadcasts of which
should be transmitted over the whole territory of the country for the
purpose of not depriving the citizens of the possibility to receive
information. In his words, the public should be aware of parliament’s
activities like in all country-members of Council of Europe.

By the way, Tigran Torosian said that Alexan Haroutiunian, Chairman
of Board of Public TV and Radio Company, in the morning of February
20 had already declared that the TV company will continue to broadcast
programs covering NA work, but a problem of changing hours can emerge.
