The Iraqi Armenian community observed April 24th memorial on Saturday,
April 21st in Baghdad.

The Primate of the Iraqi Armenian Diocese, H.E. Archbishop Avak
Asadourian celebrated the divine literagy during which the faithful
were asked to observe a minute of silence in commemoration of the
Armenian Genocide victims in 1915.

A special program followed the literagy. It consisted of proper poems
and songs in the participation of the Armenian Primary School students,
Church Youth Group students and Zvartnots Choir group.

At the conclusion of the program H.E. Archbishop Avak Asadourian
addressed the faithful on the occasion. Afterwards, the faithful
headed for the memorial dedicated to the Armenian martyrs in the
courtyard of the diocesean complex.

H.E. Archbishop Asadourian inaugurated an exhibition for oil paintings
dedicated to the Armenian Genocide in the Gulbenkian Hall in the
Armenian Primary School which lasts for three days.

Mysterious deaths mount in high security prison.

International organisations have condemned the horrendous conditions
in Azerbaijan’s most notorious prison, whose former governor is about
to go on trial.

Sadagat Agayev, governor of Azerbaijan’s Gobustan high security prison,
was sacked from the job last November, accused of having abused his
powers. His trial is due to start soon.

The Gobustan prison is situated around 40 kilometres west of Baku. It
houses dangerous criminals, most of them on life-sentences and
is famous for its tough regime and riots by prisoners. Currently,
a large number of them are on hunger strike.

Several suspicious deaths have occurred at the prison over the past
year. The issue was highlighted in a report by Parliamentary Assembly
on Council of Europe co-rapporteur for Azerbaijan Andreas Herkel that
was submitted to the assembly on April 16.

"A group of Azerbaijani human rights activists have given me documents
with evidence that inmates of the Gobustan prison are subjected to
physical and psychological violence. This grieves me deeply, and I
think that a country aspiring to become part of Europe should not
allow such things to happen," Herkel said in his report.

The US Department of State’s most recent report on human rights
says that the last year saw three people die in police custody in
Azerbaijan due to abuse and mistreatment, but that no policemen or
officials were prosecuted for these deaths.

Last May, two lifers Magomed Bagirov and Elchin Aliev were found
hanged in Gobustan. A criminal investigation was inconclusive.

"The investigation identified no persons, through whose fault the
prisoners might have committed suicides," chief of staff of the justice
ministry’s central department Musa Gumbatov told IWPR. "That is why
the criminal case was closed down quickly."

In August, another life-term prisoner Kamandar Aslanov was said to
have killed himself. However, one of the Gobustan jail’s inmates
sent a message to Aslanov’s family, saying the man had been beaten
to death by jailers.

Prosecutor Tariel Gurbanov, who handled the case, told IWPR that
no evidence supporting the allegation had been found during the
investigation, "It appeared that Kamandar was an unbalanced person,
and his life sentence drove him into despair. We had no way other
than closing up the case."

On September 27, yet another Gobustan prisoner Yury Safaraliev was
found hanged in the prison’s baths.

His relatives blame the then governor Sadagat Agayev for the
death. They allege that Agayev disliked Yury for refusing to "render
tribute" – pay a bribe – to him.

"That is why the guards – upon orders from Sadagat Agayev – frequently
beat him [Safaraliev] and locked him up in solitary confinement,"
said Safaraliev’s mother. "Unable to endure the torture and bullying
any longer, Yura made several attempts to kill himself by cutting
his veins last January. Each time, he was saved. However, the last
time no one happened to be near to save him again."

Investigator from the Garadag district prosecutor’s office Vusal
Muslimov told IWPR that no traces of violence had been found
on Safaraliev’s body. "There’s no doubt that it was suicide,"
he said. "At first, a criminal case under article 125 (assisted
suicide) was initiated, however later it was dropped, since no persons
responsible for Safaraliev’s suicide had been identified."

Mysterious deaths continued after the prison authorities had
changed. Lifer Makhir Mustafayev died in his cell under strange
circumstances shortly after Agayev’s dismissal.

According to the justice ministry, Mustafayev was alone in his cell,
lost consciousness for some unknown reason and was burnt alive by a
fire sparked by a cigarette he’d been smoking.

Criminal expert Mahmud Gajiev said this version of events was absurd.

"If Mustafayev were alive and had just fainted, he would have been
brought round by the pain from being burnt in a cigarette-caused fire,"
he told IWPR.

Ayaz Imanov also met a mysterious death in the jail.

Acting prison governor Shahkishi Bagirov said the 27-year-old
Imanov had met his mother and two sisters the day he died, February
17. "[Imanov] had problems with his stomach," said Bagirov. "He
underwent treatment twice in the prison hospital. Maybe, this was
the cause of his death."

The Garadag district prosecutor Tariel Gurbanov told IWPR that
an investigation into the death was under way. "According to the
preliminary version, the prisoner died of heart failure," he said. "He
had stomach cramps on the day he met his family members for the last
time. The forensic expertise will establish the precise cause of
his death."

However, Imanov’s mother says her son had no problems with his health.

The Gobustan jail has also seen murders. On March 5, Bairam Ragimov,
sentenced to 15 years’ imprisonment, was killed by his cellmates Isa
Aliev and Tarlan Aliev, who have now been charged with his murder.

"The cellmates demanded that Ragimov give them some of the money he’d
received from his family," said Gurbanov. "A quarrel followed that
resulted in their killing him."

"The deaths in detention facilities are a cause of great concern for
us," Nazim Alekberov, who heads central department of the justice
ministry, told IWPR.

"That is why we undertake internal office investigations in parallel
with investigations conducted by the prosecutor’s office."

But former prisoners and human rights activists say the real picture of
life in the jail may be even worse, as inmates are afraid to speak out.

"After visits by commissions, jailers beat prisoners, who have
complained to representatives of human rights organisations, within an
inch of their lives," said former prisoner Polad Gajiev. "That is why,
however intolerable the prison life, most prisoners dare not complain
to anyone, preferring to kill themselves.

"In Gobustan, they placed a lunatic named Babek in my cell. The man
almost never slept, he screamed and knocked his head against the wall
all the time.

Finally, I asked the prison authorities to get him out of my
cell. Because of my complaint, the jailers started beating me. This
lasted for several days. I had to cut my veins to get them to leave
me alone.

Fortunately, doctors of the prison hospital managed to save me."

There are also complaints of serious abuses in other prisons.

"My son was tortured for a long time in Colony No. 8," said Sekhergyul,
mother of prisoner Idris Abdullayev.

"He had to write a letter to president Ilham Aliev, using his blood
for ink. But he has never received a reply.

"Idris was beaten for refusing to share the content of parcels from
home with the authorities and jailers. I guess he will be subjected
to more tortures because of my complaints."

"Violations of law and mistreatment of prisoners happen in other jails
too," said Sahib Mamedov, a member of a public organisation that
monitors the prison system. "But suicides of prisoners and murders
by jailers are particularly frequent in the Gobustan prison."

Psychologist Azad Isazade said there were two types of suicide –
demonstrative gestures and real attempts to die. "Prisons have a
greater incidence of demonstrative suicides," he told IWPR. "A wish to
die is not the cause of the suicides, it’s just a way for prisoners
to express their protest against horrible prison conditions, against
violence, injustice and lawlessness."

He said prisoners harmed themselves to further their demands or get
themselves placed in the prison’s hospital, where conditions are more
tolerable. But, he added, suicidal gestures result in deaths too.

Director of the Human Rights Centre of Azerbaijan Eldar Zeinalov said
the prison authorities were directly responsible for what happened
in their prisons.

"Firstly, if conditions in prisons meet human norms, no one will resort
to suicide," he said. "Secondly, in order to prevent suicidal attempts,
prisoners should not be allowed to use piercing and cutting objects,
cords and so on. If prisoners have access to these things, it means
the authorities and staff of the prison are inefficient."

international institutions, RA President Robert Kocharian said during
a visit to Egypt. He also voiced hope for soonest resolution of the
conflicts in the Middle East. When representing Armenia’s position
on the Iraqi problem, President Kocharian noted that activities
should be carried out in three main directions: gradual reduction of
foreign military contingent, establishment of dialogue between local
ethnic groups, engagement of interested states into establishment
of stability. Armenia is also interested in soonest settlement of

YEREVAN, APRIL 18, ARMENPRESS: Head of a public opinion survey center
in Yerevan has unveiled today the results of another public opinion
poll, that has found that the governing Republican Party and the
Prosperous Armenia of a millionaire businessman Gagik Tsarukian,
established only last year, enjoy the highest popularity rate and
are expected to win 30 percent of votes each in May 12 parliamentary
elections.

Aharon Adibekian, head of Sociometer pollster center, said to a news
conference that according to the results of the survey, the Orinats
Yerkir of ex-parliament chairman Arthur Baghdasarian is the third
most popular political party, followed by the Armenian Revolutionary
Federation (ARF), the Zharangutyun (Heritage) and the National Unity.

According to the poll, the five percent barrier will be overcome
also by the People’s Party of Armenia, the United Labor Party and
the Dashink (Alliance).

Adibekian said the survey embraced 1,500 Armenians in Yerevan and 29
urban settlements. It emerged also that one third of respondents had
no interest in political developments and news.

He said the sudden death of former prime minister Andranik Margarian,
who was chairman of the Republican Party, has added to its popularity
and now the share of Armenians who recognize this party is 20 percent
higher.

Mr. Adibekian, a frequent target of opposition’s criticism, who charge
that the findings of his surveys are paid by pro-government factions,
pointed out a glaring discrepancy, in terms of being recognizable,
between heads of political parties and the parties themselves.

He said also half of respondents believe that the May 12 elections
will be free and clean, which Adibekian said is an indication that
the army of Armenian voters ‘who will never sold their vote, no matter
what they are offered in return" is growing.

Adibekian also said two thirds of Yerevan residents in Kentron (Center)
district did not open their apartment doors to answer his employees’
questions.

George W. Bush has sent a message to new Prime Minister of Armenia
Serzh Sarkisian to congratulate him on taking up his new tenure.

"We share your grief over the untimely death of your good friend and
partner Andranik Margarian,’ the message says.

The message also says that the U.S. government expects authorities
in Yerevan to hold free and just parliamentary elections on May 12
in conformity with international standards. Bush says free elections
would become a serious boost to furthering US-Armenian relations.

YEREVAN, April 16. /ARKA/. The recognition of the Armenian Genocide
should not be a precondition for opening the Armenian-Turkish border,
the Chairman of Christian-Democratic Union of Armenia (CDUA) Khosrov
Harutiunian told a press-conference. According to him, the genocide
problem should not impede establishment of diplomatic relations
with Turkey.

"Armenian-Turkish relations have a strategic orientation: opening the
Armenian-Turkish border not only opens up economic opportunities to us,
but creates a real chance for global integration," Harutiunian said.

According to Harutiunian, after the border is opened, Armenia
will become a renewed country and will be perceived in the world
differently.

Armenia and Turkey do not have diplomatic relations and the
Armenian-Turkish border has been closed since 1993 initiated by
official Ankara.

Turkey puts a number of preconditions for establishing bilateral
relations, particularly Armenia’s resignation of the policy of
international recognition of the Armenian Genocide in Ottoman Empire
and concessions on Karabakh issue.

According to international experts, as a result of the Turkey’s
blockade against Armenia, the Armenian economy suffers $500 mln damage
every year.

UNSC mission departs for Kosovo `to adopt solution on Ahtisaari plan

UN Security Council’s mission departed for Kosovo `to
adopt a solution on `Ahtisaari’s plan’

/PanARMENIAN.Net/ The UN Security Council approved Russia’s initiative
on sending a mission to Kosovo and Belgrade before continuing
consultations around Kosovo future status. Brussels will become the
first destination of Security Council’s representatives, where the
ambassadors will be hosted by NATO supreme leadership. The mission
will allow the UN Security Council to one more time make clear the
real situation in the region for adoption of an objective solution on
`Ahtisaari’s plan’.

In his part Russia’s Permanent Representative to the United Nations
Vitali Churkin said it is necessary to one more time make clear the
real situation in the region, in order to find a compromise between
Serbs and Albanians.

`By sending the mission we do not mean to express our distrust to
Ahtisaari, who is an old friend of Russian diplomacy. But it is
necessary to fill in the many empty cells of this crossword. Probably
the issue of Kosovo status is the most complicated one for the UN
Security Council during the last decade,’ the Russian diplomat
underlined, RIA `Novosti’ reports.

UN Secretary General’s Special Envoy Marti Ahtisaari worked out a plan
for the Kosovo problem settlement. The document was introduced to the
Security Council March 27. The same day Russia’s Permanent
Representative to the UN informed Russia has offered the Security
Council to form an international group of observers and send them to
Belgrade and Pristina, in order to carry out an all-sided analyze on
the spot how Resolution 1244 adopted in 1999 is being fulfilled.

Armenia Does Everything Possible To Return IDPs to their places

YEREVAN, APRIL 14, NOYAN TAPAN. The Armenian Prime Minister Serge
Sargsian on April 13 received the Special Representative of the UN
Secretary-General on the Human Rights of Internally Displaced Persons
Walter Kalin.

Regarding W. Kalin’s visit to Armenia is a manifestation of attention
to the internally displaced persons and refugees living in Armenia,
the prime minister noted that despite the large number of such
persons, it is necessary to find some solutions to the problems of
displaced persons with joint efforts of Armenia and international
organizations. According to him, the further plans of the Armenian
government include certain approaches aimed at solving the problems of
nearly 8.5 thousand internally displaced persons who live in our
country. W. Kalin said that although the number of internally
displaced persons in Armenia is smaller than in other countries, he
considered as its duty to come and see personally what has been done
after his visit to Armenia in 2000 – based on new proposals,
especially as these proposals were welcome at the time by the Armenian
authorities. He underlined that in his opinion, a great deal has been
done indeed, many displaced persons have returned to border villages
or other settlements of Armenia.

At the same time, in the words of W. Kalin, considerable part of
displaced persons still live in bad conditions. He said that he and
the RA minister of territorial governance have already discussed a
program developed in 2005, which proposes that displaced persons
should return to villages, at the same time, new houses should be
built or the old ones – repaired, as well as nteworks of good roads
and infrastructures should be created in places of return. "This is a
good program worth discussing," W. Kalin noted, adding that,
nevertheless, it is not sufficient. According to him, at least another
two conditions are needed for the final and stable solution of the
problem of internally displaced persons: the opportunity to resume
economic activity in place of residence and ensuring their security in
areas of return, which, in his opinion, are problems in need of
solution. Admitting that previously the international community paid
little attention to this problem, W. Kalin assured S. Sargsian that
he will make every effort to bring it to attention of international
donors.

During the meeting, Walter Kalin addressed problems of about 3
thousand families that suffered as a result of the 1988 earthquake,
adding that these people also have status of internally displaced
persons to some extent as they were displaced not of their own free
will. He said that previously the UN mainly focused its attention on
those displaced as a result of military operations but he is convinced
that people, who suffered from natural disasters and are displaced not
of their free will, deserve the same attention. Noting that he is glad
to hear that programs are being developed to help persons displaced
because of the earthquake, Mr Kalin expressed his willingness to
provide his assistance in this issue by attracting donors. He
expressed a hope that these programs will be implemented in the coming
years, and Armenia will no longer be a country having internally
displaced persons.

According to the RA Government Information and PR Department, at the
request of W. Kalin, Serge Sargsian presented his views on settlement
of the Karabakh conflict and the situation on internally displaced
persons and refugees in Azerbaijan. Noting that since the beginning of
the conflict, the Armenian side’s actions have been aimed at helping
the internally displaced persons, solving their problems and assisting
them with intergation into the society, S. Sargsian added that he
will be glad when Armenia is no longer among countries having
population with such status. In his words, the Armenian side is doing
everything so that internally displaced persons will return to their
places of residence and have appropriate living conditions.

In response to W. Kalin’s question, the prime minister said that
recently Azerbaijan has changed its policy and instead of considering
the problem of refugees and internally displaced persons, it is
engaged in issues aimed at their solution. Considerable funds of
international assistance have also been spent for this purpose.

Serge Sargsian pointed out that Armenia is favor of a peaceful and
prompt solution of the conflict in order to prevent similar clashes
and displacement in the future. The prime minister expressed
confidence that there is no version of the conflict’s resolution by
force, and the sooner Azerbaijan realizes it, the closer the parties
will be to the final solution of this problem. Admitting the right of
Azerbaijani refugees to return to thier former places of residence,
the prime minister at the same time noted that it requires a careful
and comprehensive approach and is possible only in case of the
positive end of negotiations around the conflict so that their return
will not result in new clashes and these people will not suffer once
again.

YEREVAN, APRIL 13, NOYAN TAPAN. A festival of silent films will take
place on April 14-15 in the cinema hall of the National Gallery of
Armenia on the occasion of world cinematography legend Charles Spencer
Chaplin’s birthday on April 16. Silent films created in the countries
of the region will be shown at the festival. Show of films dedicated
to Chaplin will be organized at the "Moskva" (Moscow) cinema as well.

As Melik Karapetian, an employee of the education department of the
National Gallery of Armenia mentioned in the interview to the Noyan
Tapan correspondent, show of films dedicated to Chaplin’s birthday is
already for the 5th time organized in Yerevan. Those were held during
the first two years in the Yerevan Khnko Aper Children’s Library
and were entitled "Chaplin Marathon" but already in the last year a
regional festival of silent films was for the first time organized
at the National Gallery.

Newly Constructed Building Of Shengavit Community’s Court Of First I

NEWLY CONSTRUCTED BUILDING OF SHENGAVIT COMMUNITY’S COURT OF FIRST INSTANCE PUT INTO OPERATION

YEREVAN, APRIL 13, NOYAN TAPAN. The new building of the court of
first instance of Yerevan’s Shengavit community was delivered for
operation on April 12.

According to the RA Minister of Justice David Harutyunian, the
putting of this building into operation completed the first stage of
construction or reconstruction of the buildings of 14 courts under
the credit program on court and legal reforms.

The building’s main entrance, which is meant for court visitors,
also has a ramp for wheelchairs of disabled persons with
movement problems. The building is provided with all the necessary
communications: a new power substation, a autonomous boiler-house, gas
supply and water supply systems, as well as sewerage pipes. There is
an air circulation system in the court building. The air circulation
in halls is done by a channel method, which ensures re-circulation
and outflow of the air.

Air circulation of accused persons’ cells is done by the split
system. All offices have air conditioners on their windows.

The court building is designed for 7 judges and has 6 furnished
courtrooms, one of which – the courtroom for holding sittings on
civil cases has additional equipment to ensure safety of judges and
court case participants. The public section and the sitting section
of this courtroom are separated from each other by a staned-glass
window to ensure acoustic insulation. Direct audio reports about
sittings are transmitted by loudspeakers to the public section of
the courtroom. According to the justice minister, other courts may
make use of this courtroom in case of necessity.

The cost of the court building’s construction made 410, 854.2 thousand
drams. Financing was done with World Bank credit resources (90%)
and funds of the RA state budget (10%).
