ECHR drops lawsuit of ex-President Ter-Petrosian against Armenian govt

The European Court of Human Rights (ECHR) has found unjustified the
lawsuit of former Armenian president and leader of the opposition
Armenian National Congress Levon Ter-Petrosian against the Armenian
government, Armenia’s representative at ECHR Gevork Kostanian has
said.

“After studying the motion, the ECHR passed a ruling saying that
Ter-Petrosian’s claims concerning several assumed offenses are
groundless. The court found the claim unacceptable,” Kostanian told
Interfax on Friday.

The ECHR accepted Levon Ter-Petrosian’s claim to the Republic of
Armenia on May 15, 2012.

Earlier Ter-Petrosian’s representative at the ECHR Vage Grigorian said
to Interfax that the claim is related to the violation of the right to
free elections, abuses during the 2008 presidential election, the
violation of the freedom of rallies and processions, an expressly
negative attitude of the government and media to the opposition, the
violation of the right to free travel – the actual house arrest of
Ter-Petrosian, the violation of conventions of the freedom of speech
and the right to inviolability.

“The court found Ter-Petrosian’s lawsuit unacceptable with the
exception of the claim of his house arrest and the absence of
effective means of protecting his rights. The court has not made any
decisions on these two issues but neither is there any judgment on
their acceptability. The court believes that so far Ter-Petrosian’s
claims related to the issues are groundless and require additional
discussion with the government that will take place before November
7,” Kostanian said.

He said the court also found groundless Ter-Petrosian’s claims
concerning the process and outcome of the 2008 presidential election.

Armenian photographer from America Ara Oshakan, who is from Beirut by
birth, was in Artsakh within the framework of `Shushi Art Project’
festival. In his interview to Karabakh-open. info the grandchild of
famous Diaspora Armenian writer Hakob Oshakan explained how he, a
descendant of a writers’ family, took up photography.

– You are a descendant of the Oshakans’ famous family, how did you
happen to choose photography.

– My grandfather was a novelist, my father also became a writer but I
think as he also wrote in Armenian he became a poet in order to be
different from my grandfather. I also decided to continue my
grandfather’s and father’s work but in order to differ from them in
some way I began to write in English. I was born in Beirut but later
my family moved to such USA cities where there were few Armenians or
no Armenians at all, so my English is much better developed than my
Armenian. I had been writing for a long time and had quite successful
works, I just could not possibly finish any of them. Then I happened
to engage in photography, it occurred to me to write short reviews and
attach corresponding photos to them. I applied to some of my friends
but I did not like the photos they took. And I acted like a real
Armenian, I began to photograph myself. I thought there was nothing
difficult in photography, I could easily do it myself. And little by
little I learned it. I took two lessons of photography, both of them
quite unsuccessful, later I learned everything myself.

Gradually I understood that photography was dearer to me and better
corresponded to my temper. The fact that I am always in action and
constantly communicate with people makes me pleased. A writer’s life
is specified, you have to sit at work for 6 hours to write something
valuable, that was not for me.
All in all, not the means of doing the work but the work itself is
important. It took me years to understand this simple truth.

– What was your first photo project?

– In 1998 I took up photography and in 1999 I decided to come to
Karabakh with my father to take some photos. During those years my
father taught at Artsakh State University and we decided to compile a
book together. After our visit I began to come to Karabakh quite
frequently and here I developed `my eye of a photographer’. After our
first visit with my father we again came to Karabakh together the next
September and stayed here for three weeks. When we returned to America
the text for my book was ready.

My father suffered a heart disease and in 2000, being unable to stand
the operation, he died. I had enough photos and with the text my
father had written I could already publish the book. But I was a
beginner, my work was not completed yet, it should have deepened and
expanded. I decided to return to Karabakh. Thus until 2007 I
occasionally came to Karabakh, visited different villages and took
photos.

In 2010 I found a publisher in New York who was interested in my book
and soon published it with my photos and the Armenian and English
variants of my father’s text under the headline `Fatherland’.

– Will you tell us a bit about the book `Fatherland’?

– The given photos represent documentary photography. I photographed
the process of life such as situations, places, human relations. In
these photos I tried to show the place and the people’s way of living.
This composition is very important for me. In some way my life is a
part of this book.

– Besides the `Fatherland’ what other projects have you had so far?

– In parallel I carried out a project connected with the Armenians of
Los Angeles that is directly related to me and the identity of the
Armenian Diaspora. Besides I photographed juveniles in one of the
American prisons and presented their reviews and biographies attached
to these photos. Another project is being prepared now. There is a
village near Los Angeles, I visit the local inhabitants there and take
photos of them. Besides, within the framework of `Shoushi art project’
I made a photo-installation for the first time that I had never done
before. Though I thought a lot and spent many sleepless nights but the
result was a success. Probably I will continue doing such
installations.

– Where were your works shown, were they private exhibitions?

– The `Fatherland’ was presented in a private exhibition in Los
Angeles and in New York. The other works were exhibited only in Los
Angeles. I was in Yerevan this summer and I decided to exhibit it in
Armenia as well, and then I am going to bring it to Stepanakert or to
Shoushi.

It is very important for me to return the work where it was
photographed and not just to come and take photos like a tourist and
then to enjoy and exhibit it abroad.

– How profitable is the photographer’s work?

– I am a physicist by profession and up to now I continue working for
private companies and earn my family’s living in this way, some part
of this money I invest into my favourite occupation. In parallel I
conduct classes for young photographers.

– For the first time you visited Artsakh during the post-war years,
after that you frequently came to Artsakh, I wonder what changes have
you noticed?

– In Diaspora we knew little of Karabakh but when the movement began
we all went out into the streets with claims «Karabakh is ours». When
Gorbachov came to San Francisco we all organized an action of
complaint. My father also told me about his visits to Karabakh but I
tried not to get under the influence of impressions, I decided to come
and to see everything with my own eyes. In December, 1999, I paid my
first visit to Artsakh. First I was shocked at what I saw, there were
destroyed buildings everywhere. I had seen nothing like that in
America. In order to understand people better I began to seek
similarities more than differences.

During each of my visits Artsakh was changed, the ruined buildings
were reconstructed, today there are hardly any of these buildings. But
as for the people’s welfare I think little has changed.

Prosperous Armenia party faction is going to convene a sitting before
the coming four-day sittings of the parliament launching on Monday,
faction’s secretary Naira Zohrabyan told Tert.am.

She said because of party’s leader Gagik Tsarukyan’s busy schedule he
is not going to participate in the parliament’s works.
Asked whether Tsarukyan will be present at the next sitting, Naira
Zohrabyan said, `Mr Tsarukyan’s coming working schedule is much
overloaded, thus I cannot tell about it as of the moment.’

Gagik Tsarukyan was not here during the hearing of prosecutor
general’s motion to deprive PAP MP Vartan Osanian as well.

The agenda of the coming sitting includes elections of head of
Agriculture and Nature Protection Issues Standing Committee. Instead
of the former head, currently newly elected mayor of Gyumri, the PAP
will nominate Martun Grigoryan from Gyumri. The PAP will also nominate
Vahe Enfiajyan for the European Integration Committee’s deputy head’s
office.

Prosperous Armenia Party’s supply base in the town of Gavar,
Gegharkunik region, was blown up for the second time already, a
Yerevan-based Hraparak newspaper reports.

Referring to its own sources, the paper writes that for the first time
the Police tried to hush up the case and persuaded the employees of
the base not to complain.

In a week, the supply base was blown up again causing tangible
financial damage to the Party’s regional office. Representatives of
Prosperous Armenia Party’s regional office complained to the newspaper
for the police efforts to hush up the case again.

American-Armenian philanthropists Sam and Sylva Simonian.

Issues related to the foundation of “Tumo” Center for Creative
Technologies in capital Stepanakert were discussed during the meeting.

According to President Sahakyan, the existence of such a center will
be among the best patterns of investment into the intellectual sphere,
which will give a serious impetus to the development of information
technologies in the republic and intellectual capabilities of the
younger generation.

The Head of the State underlined that this project was among the
best manifestations of the Motherland-Diaspora cooperation, Central
Information Department of the Office of the NKR President reported.

Mme Valerie Boyer attire l’attention de M. le ministre des affaires
etrangères sur les relations diplomatiques qu’entretient la France
avec l’Azerbaïdjan au regard des evènements recents qui ont provoque
une vive emotion non seulement auprès de la communaute armenienne
mais egalement dans l’ensemble des pays occidentaux. Le 31 août
2012, l’Azerbaïdjan obtenait l’extradition de Hongrie de Ramil
Safarov condamne a une peine de prison a perpetuite pour le meurtre
particulièrement barbare de l’officier armenien Gourguen Markarian.

Alors qu’il avait ete garanti a la Hongrie que Ramil Safarov purgerait
sa peine en Azerbaïdjan, c’est en heros qu’il a ete accueilli dans son
pays. Immediatement gracie par le president Aliev, promu au rang de
major, dote d’une maison et paye de son salaire pour les huit annees
passees en Hongrie, le criminel Safarov a en realite ete remercie et
glorifie par l’Azerbaïdjan pour avoir assassine un armenien.

L’Azerbaïdjan a une nouvelle fois demontre que ses intentions a l’egard
de la Republique d’Armenie ne sont pas a l’apaisement mais bien a la
provocation. Dans ce contexte, elle le remercie de bien vouloir lui
faire connaître les intentions du Gouvernement quant a l’avenir de
ses relations diplomatiques avec l’Azerbaïdjan et particulièrement en
ce qui concerne l’accueil sur notre territoire de dignitaires azeris
tels que le ministre des affaires etrangères Elmar Mamedyarov invite
par la diplomatie francaise le 3 septembre 2012, soit quelques jours
après le retour triomphal de Ramil Safarov dans son pays.

La France a reagi dès le 3 septembre a la decision azerbaïdjanaise
de gracier Ramil Safarov. Le porte-parole du ministère des Affaires
etrangères a fait part publiquement de la preoccupation que suscitait
cette decision et de notre inquietude quant aux possibles consequences
de cette decision sur le processus de paix sur le Haut-Karabagh. Les
trois co-presidents francais, americain et russe du Groupe de Minsk, en
charge dans le cadre de l’OSCE de la recherche d’un règlement negocie
du conflit du Haut-Karabagh, ont egalement publie dès le 3 septembre
une declaration conjointe exprimant leur profonde preoccupation et
leur regret face a la decision azerbaïdjanaise. Dans ce contexte de
tensions accrues entre l’Azerbaïdjan et l’Armenie, il est important
que le processus de negociation ne soit pas interrompu.

L’invitation a Paris des ministres des Affaires etrangères armenien
et azerbaïdjanais a Paris les 2 et 3 septembre par les copresidents
du Groupe de Minsk, les ambassadeurs Jacques Faure (France), Robertt
Bradtke (Etats-Unis) et Igor Popov (Russie), decidee avant cet
evènement, s’est ainsi revelee utile pour permettre aux co-presidents,
qui se sont entretenus separement avec chacun des deux ministres,
de faire part de leur preoccupation au ministre azerbaïdjanais et
pour appeler les deux ministres a poursuivre leurs efforts en faveur
d’une solution negociee au conflit du Haut-Karabagh. La France entend
poursuivre ses efforts pour contribuer a une solution pacifique du
conflit du Haut-Karabagh et assumer toutes ses responsabilites dans
le cadre de la mediation du Groupe de Minsk. A ce titre, elle aura
des contacts au plus haut niveau dans les jours et les semaines qui
viennent avec les deux pays.

WASHINGTON-State Department sources confirmed Thursday that Secretary
of State Hillary Clinton relayed the U.S. Government’s “strong
disappointment” over Hungary’s extradition of convicted Azerbaijani
axe-murderer Ramil Safarov during a state visit by Hungarian Foreign
Minister Janos Martonyi to Washington this week.

In response to a question by H1 Armenian Television Washington DC
correspondent Haykaram Nahapetyan, a State Department Spokesperson
noted that, “Secretary Clinton reiterated our strong disappointment
that Hungary transferred convicted murderer Ramil Safarov to
Azerbaijan, where he was immediately pardoned. This decision was
harmful to the peace process between Armenia and Azerbaijan, and to
trust between the sides.”

“We welcome Secretary Clinton’s continued efforts to impress
upon Hungary’s leaders how their reckless release and transfer of
unrepentant axe-murder Ramil Safarov to Azerbaijan has undermined the
peace process,” commented Armenian National Committee of America
Executive Director Aram Hamparian. “In the interest of peace,
we encourage the Secretary to translate her words of criticism –
toward both Hungary and Azerbaijan – into reality by putting in place
a ban on U.S. arms sale to Baku and ending all military aid to the
Azerbaijani armed forces.”

The U.S. was among the first to express concern about Hungary’s
extradition and President Ilham Aliyev’s subsequent pardon, promotion
and praise for Azerbaijani army lieutenant Ramil Safarov, who was
convicted of brutally axing to death Armenian soldier Gurgen Margaryan
in his sleep, during a 2004 NATO English-language training course. In
a statement issued by the White House in the name of National Security
Council Spokesman Tommy Vietor, underscoring the President’s view
that, “This action is contrary to ongoing efforts to reduce regional
tensions and promote reconciliation.” Vietor went on to note that,
“The United States is also requesting an explanation from Hungary
regarding its decision to transfer Safarov to Azerbaijan.”

The Department of State, through a formal announcement issued by
Acting Deputy Spokesman Patrick Ventrell, also took a stand against
Hungary’s extradition and Azerbaijan’s pardon, explaining that: “The
United States is extremely troubled by the news that the President
of Azerbaijan pardoned Azerbaijani army officer Ramil Safarov, who
returned to Baku today following his transfer from Hungary. . . . We
are expressing our deep concern to Azerbaijan regarding this action
and seeking an explanation. We are also seeking further details from
Hungary regarding the decision to transfer Mr. Safarov to Azerbaijan.”

During the Center for European Policy Analysis’ U.S.-Central Europe
Strategy Forum on September 20, U.S. Assistant Secretary of State
Philip Gordon told RFE/RL that Washington continues to express
“dismay and disappointment” to Budapest about its decision to release
Ramil Safarov to Baku. “We were appalled by the glorification that
we heard in some quarters of somebody who was convicted of murder,”
Gordon said. He called the case “a real provocation in the region.”

Members of Congress who have condemned Azerbaijan’s release of Safarov
to date include, Senate Foreign Relations Committee Chairman John Kerry
(D-MA), Sen. Boxer, Sen. Robert Menendez (D-NJ), Congressional Armenian
Caucus Co-Chair Frank Pallone (D-NJ), House Foreign Affairs Committee
Ranking Democrat Howard Berman (D-CA), House Energy and Commerce
Committee Ranking Democrat Henry Waxman (D-CA), and Representatives
Jim Costa (D-CA), Jeff Denham (R-CA), Robert Dold (R-IL), Anna Eshoo
(D-CA), David Cicilline (D-RI), Devin Nunes (R-CA), John Sarbanes
(D-MD), Adam Schiff (D-CA) and Brad Sherman (D-CA).

Hungary Knew Consequences of Safarov Release Worldwide suspicions that
the Hungarian Government knew full well of Azerbaijan’s intention
to pardon Safarov were confirmed soon after the axe-murderer’s
extradition. Reuters reported that Hungarian Prime Minister Viktor
Orban stated, “The foreign ministry had forecast precisely what
types of consequences this or the other decision [extradition or
non-extradition] may have. Nothing happened after our decision that
we would not have reckoned with in advance.”

Orban’s statements came as speculation continued about the connection
between the Safarov’s extradition and talks between the Orban
Administration and Aliyev regarding a possible Azerbaijani buy-out
of Hungarian loans valuing over $2-3 Billion Euros. International
financial news outlets reported the possible deal just days prior to
the August 31st release of Safarov.

The Hungarian opposition condemned Prime Minister Orban’s actions as
‘morally bankrupt,’ and called for his resignation. Thousands of
Hungarians protested the Orban decision during demonstrations in
Budapest just days after the August 31st extradition of Safarov.

Despite international criticism from the U.S., France, Russia, and
NATO, Azerbaijani President Ilham Aliyev remains defiant about his
decision to pardon, promote and financially reward axe-murderer Ramil
Safarov for the ethnically motivated murder of Lt. Gurgen Margaryan.

Safarov’s repatriation “was carried out in accordance with European
conventions, and his release in accordance with Azerbaijan’s
constitution,” Reuters quoted Aliyev as stating during a joint press
conference with NATO Secretary General Anders Fogh Rasmussen.

una polemica internacional al exhibir frente al público la bandera
colombiana, pero por descuido la mostro al reves, lo que provoco
ira en la concurrencia, ya que pensaron que se trataba de la bandera
de Armenia, república que mantiene un conflicto etnico y religioso
historico con la nacion anfitriona.

Las críticas no se hicieron esperar y en redes sociales se menciono
constantemente el error de la colombiana. Por otra parte, fue la
primera aparicion de la interprete del ‘Waka Waka’ mostrandose
embarazada en el escenario.

La imagen de Shakira con la tricolor armenia recorrio los medios
televisivos y digitales azeríes. Algunos comentarios en la prensa
local especularon que la bandera de Armenia era parte del “espectaculo
excepcional de Shakira”.

La sortie du dernier ouvrage du journaliste Hasan Cemal – prononcez
Hassan Djemal – est un pave dans la mare du negationnisme en
Turquie : 1915, le genocide armenien (Everest Yayinlari, en turc, 230
p.) ecorne le tabou des tabous d’un pays qui refuse toujours d’admettre
l’extermination planifiee de plus de un million d’Armeniens ottomans
par le gouvernement nationaliste jeune-turc, a partir de 1915. Il y
a quelques annees, le titre de ce livre aurait suffi a envoyer son
auteur en prison. Aujourd’hui, publie par un editeur a large audience,
il occupe les vitrines et les presentoirs de la plupart des librairies
du pays, ce qui constitue une veritable avancee.

Sur la couverture, une photo d’Hasan Cemal le montre agenouille devant
le memorial du genocide a Erevan, en Armenie, deposant un bouquet
de roses blanches au pied de la flamme du souvenir. “Je ne peux
pas oublier ce matin a Erevan, en septembre 2008, raconte-t-il. Aux
premières lueurs du jour, le mont Ararat emergeait et s’evanouissait
dans la brume. La main de l’Histoire, ai-je ecrit ce matin-la,
montrera la voie a ceux qui veulent voir.”

Ce recueil intimiste d’articles et de notes retrace le cheminement
personnel d’un personnage de cette histoire malgre lui. Hasan Cemal
est l’un des journalistes les plus reputes de Turquie. A 68 ans,
il est editorialiste au quotidien Milliyet, après avoir dirige, dans
les annees 1980, le quotidien de gauche Cumhuriyet. Il a les portes
ouvertes dans les cercles du pouvoir a Ankara. Hasan Cemal est surtout
le petit-fils de Djemal Pacha, haut responsable du Comite union et
progrès (CUP), l’un des trois generaux qui dirigeaient l’Empire ottoman
durant la première guerre mondiale. A ce titre, il est considere
comme l’un des responsables du genocide de 1915. Condamne a mort par
contumace par la cour martiale d’Istanbul, refugie en Allemagne puis
en Suisse, Djemal Pacha fut assassine en 1922, a Tbilissi, par un
commando de justiciers armeniens.

“Enfermes dans la penombre”

Le recit du petit-fils du genocidaire debute en 2006. Un froid
matin d’hiver, il se rend au tribunal d’Istanbul dans un 4 × 4
blinde. Avec quatre autres chroniqueurs en vue, il est juge pour
“insulte a l’identite nationale turque” et accueilli au cri de
“traître a la patrie” par une foule enragee. Leur delit : avoir soutenu
l’organisation, dans une universite d’Istanbul, d’une conference sur
“Les Armeniens a la fin de l’Empire ottoman”. Ce colloque, annule puis
deplace, qui rassemble des intellectuels de haut vol, a finalement
lieu, mais dans une ambiance deletère, sous la pression de militants
nationalistes, et après que le ministre de la justice l’eut qualifie de
“coup de poignard dans le dos”.

Hasan Cemal a ensuite ete traumatise par l’assassinat, en 2007, de son
ami Hrant Dink, journaliste et porte-parole des Armeniens de Turquie.

Et puis il a fait ce voyage a Erevan. Jeune, il ne connaissait pas
vraiment l’histoire de ce grand-père ottoman dont il conserve quelques
photos dans son bureau. “On n’apprend que l’histoire officielle, nous
avons ete enfermes dans la penombre.” Lentement, il a fait son chemin.

“Hrant Dink m’a aide a comprendre le sens des souffrances du passe. Il
est important de les affronter sans detour.” Comme il le fera en
allant a la rencontre du petit-fils du meurtrier de son grand-père
qui vit en Armenie.

“Utiliser le mot “genocide” ou pas” est le dilemme de nombreux
intellectuels turcs. Le mot reste inaudible pour beaucoup, et les
euphemismes – “tragedie”, “catastrophe” – portent des revendications
plus douces, estiment certains. Mais a Los Angeles, où il est invite
a debattre avec la petite-fille de l’ambassadeur americain Henry

it modeled several strikes on Azerbaijan’s oil and gas facilities,
a top Armenian general has told local media.

The two-week “strategic” exercises took place in undisclosed locations
in Armenia and Nagorno-Karabakh between Oct. 1 and 13, utilizing a
mostly “command-and-staff” format, according to Armenian Azatutyun
radio.

“In particular, I can stress that we modeled several strikes on oil and
gas infrastructures, energy carriers that would affect the economy,”
Major-Gen. Artak Davtian, head of the operational department at the
Armenian army’s General Staff, said. “We simulated strikes against
both army units and military facilities of the probable enemy and
… economic facilities that influence, in one way or another, the
military capacity of its armed forces.” “There would be no strikes on
the civilian population, we are not planning or playing out such a war
scenario,” Davtian said at a press conference after the conclusion of
the exercises. “We do not plan any strikes on cities. Our targets are
military and economic facilities that are essential to a particular
state.”

According to the Armenian military, 40,000 troops and thousands
of pieces of military hardware were involved in the exercise. The
participating personnel included a record-high number of army
reservists.

300-km range missiles

Davtian avoided naming the weapons used in the exercise, but said that
the country’s missiles had a firing range of more than 300 kilometers,
putting virtually all strategic facilities in Azerbaijan within
their reach. The Armenian Defense Ministry has said that the latest
“unprecedented” war exercises were planned in advance.
