DECEMBER 8, YEREVAN: A broad range of American companies doing
business in Armenia, including Microsoft, FedEx, and NASDAQ, have, in
letters shared with the U.S. Embassy, called upon the Obama
Administration to take concrete action prioritizing the growth of
U.S.-Armenia economic relations through the negotiation of a bilateral
Trade and Investment Framework Agreement (TIFA). As The Armenian
National Committee of America informed ”Armenpress”, ANCA, in the
interest of job-creation in both America and Armenia, is actively
engaged with the White House, the U.S. Trade Representative, the
Congress, and the Departments of State, Treasury and Commerce in
support of a broad array of practical steps and policies to promote
U.S.-Armenia economic and commercial relations.

The Armenian government has long been on record requesting that its
U.S. partners join with them in negotiating a TIFA, as well as a
much-needed Double Tax Treaty. President Obama promised, during his
2008 campaign, to foster expanded trade with Armenia. U.S. Ambassador
to Armenia, John Heffern, for his part, during his confirmation
process, also spoke of his interest in expanding the U.S.-Armenia
trade relationship.

Copies of the letters, addressed to President Obama, were handed to
Ambassador Heffern today during his meetings with Armenian American
organizations and community members in the Los Angeles area.

These firms employ thousands in Armenia and world-wide, generate tens
of millions of dollars in revenues, and are engines of progress,
friendship, and cooperation for both nations. Among those joining
with Microsoft, FedEx, and NASDAQ in petitioning for a TIFA were:
Marriott, Ameria Banking Group, Grant Thornton, Tufenkian Heritage
Hotels, Altacode, Levon Travel, Unicomp, Synopsys, Megerian Carpet,

The U.S. Secretary Clinton who will soon leave her office has
announced that the American government intends to thwart the new
version of the Soviet Union in the form of economic integration.

According to the Financial Times, the next USSR may be named Customs
Union or Eurasian Union. `But let’s make no mistake about it. We know
what the goal is and we are trying to figure out effective ways to
slow down or prevent it.’

The official press releases on the CIS summit in Ashgabat on December
5 contained general statements without pointing to specific
activities. However, backstage agreements may have been reached which
made Clinton make this statement.

A lot of people say, including Russia’s experts, that the new USSR is
Putin’s personal ambition which he declared on the eve of the
presidential election. With Russia’s complicated political and
economic issues it is Putin’s main pre-election trump card in the
absence of other arguments.

It is apparent that no CIS member wishes to participate in the new
USSR because Putin’s proposal presupposes certain limitation of the
sovereignty of countries. Even Belarus and Kazakhstan which are
members of the Customs Union do not hurry to politicize the economic
integration. Moreover, these two countries aspire to a similarly
significant role which the president of Kazakhstan Nazarbayev has
stated bluntly.

The other big state, Ukraine, also has reservations regarding the idea
of the USSR under the name of economic integration. By joining the
Customs Union Ukraine may collapse as a state considering its Western
and Russian sections.

Strange though it may seem, the role of Armenia is big. Not so big
that the destiny of the USSR depends on the position of Armenia, but
this position is important both in terms of history and new
challenges.

Armenia has appeared at the front line of geopolitical developments
where it may play an essential role. The great powers are fighting for
Armenia.

In this situation, on the one hand, the Armenian government gets a
chance for maneuver, and on the other hand, the country is exposed to
dangers stemming from this government and the structure of the
political and economic system of Armenia. In the meantime, the limit
of the system’s interest is not known, neither is known the limit of
the Armenian state. Will this system walk towards the Armenian
interest or towards its own interest?

Meanwhile, such concerns are reasonable, considering the pre-election
period and the circumstance that Russia has an immense influence on
the political and economic interest of Armenia. Moscow may use the
so-called main actors of Armenia, finally involving Armenia in the
next USSR.

The Armenian press has reported that on December 3 the RPA joined the
document initiated by Russia’s ruling party during the forum on
Eurasian Integration in the 21st century in Saint Petersburg. It will
be followed by ratification of the memorandum in January 2013 which
will mark the start of Armenia’s accession to the new USSR.

Hillary Clinton’s tough statement is not a caprice of the departing
secretary. Obviously, it is a warning to the leaders of the countries
and it is not ruled out that they had been told about it before
Ashgabat. By the way, Susan Rice who will replace Clinton has
inherited Clinton’s foreign political line and will continue her
policy. Armenia does not have a great possibility to maneuver between
different integration projects but it is there. But is the current
political system able to conduct such a policy?

The residents of Getahovit are against the project to build a
Khachaghbyur 2 small water power plant in their community.

One of them Ghazar Yengibaryan told journalists on Friday that they
are going to campaign against the project. “If our opinion is left
unheard, we will block the road leading to the site,” the protester
said.

Well-known green activist Mariam Sukhudyan said that the greens are
ready to help. “We are ready to organize a campaign similar to the one
organized against the Trchkan project,” she said.

The plant is being built by Megaenergy CJSC. The greens say that the
contractor has cut down lots of trees in the territory of the Ijevan
and Turkish Hazel Alley nature reserves and has diverted the Agstev
river leaving the residents of Getahovit with almost no drinking
water.

The Armenian government has long been on record requesting that its
U.S. partners join with them in negotiating a TIFA, as well as a
much-needed Double Tax Treaty. The American Chamber of Commerce in
Armenia, through the active leadership of its Chairman, Edward
Mouradian and professional support from its Executive Director Diana
Gaziyan, has played a vital role in giving voice to the public policy
priorities of the U.S. business community in Armenia. Many members of
the U.S. Congress have expressed their support for a U.S.-Armenia
TIFA, as has the Armenian National Committee of America. President
Obama, for his part, promised, during his 2008 campaign, to foster
expanded trade with Armenia. U.S. Ambassador to Armenia, John
Heffern, during his confirmation process, also spoke of his interest
in expanding the U.S.-Armenia trade relationship.

Beyond reinforcing the strong cultural bonds between the American and
Armenian peoples, these corporations, in their letters, pointed out
that the creation of a TIFA platform for ongoing bilateral economic
dialogue would help facilitate a broad range of benefits to both the
United States and Armenia, including:

– Improving the investment climate, identifying priority areas for
growth, and building trade capacity

– Addressing regional trade issues, including the special hardships
faced by Armenia due to the blockades imposed on its borders by Turkey
and Azerbaija

– Streamlining customs systems, and increasing the transparency of
governmental processes related to imports and exports

– Discussing the effectiveness of current programs in Armenia of the
U.S. Export-Import Bank, Overseas Private Investment Corporation, and
U.S. Trade and Development Agency

– Expanding agricultural trade and investment

– Growing the level of trade in services, including banking,
insurance, and tourism

– Promoting Diasporan trade and investment, with a special focus on
expanding Armenian American trade and investment partnerships with
Armenia

– Improving Armenia’s use of U.S. Generalized System of Preferences benefits

– Addressing any outstanding problems in the area of intellectual
property rights

– Exploring ways to deepen future U.S.-Armenia trade and investment

In their letters, these firms stressed their interest in building upon
a TIFA platform through additional bilateral accords, notably a Double
Tax Treaty, a Social Security Agreement, and, ultimately, a Free Trade
Agreement.

Copies of the letters, addressed to President Obama, were handed to
Ambassador Heffern today during his meetings with Armenian American
organizations and community members in the Los Angeles area.
Ambassador Heffern is participating in a series of community outreach
meetings and town halls in San Francisco, Los Angeles, Boston and New
York.

Cyber-crimes against the Armenian websites have been increasing in
number in the past months, according to recent findings.

Speaking at the ArmNet 2012 conference on Saturday, President of the
Internet Society of Armenia Grigory Saghyan said the cyber-attacks by
Turkish and Azerbaijani hackers have increased from 11,000 in 2011 to
1,250 in 2012.

`Armenia is facing a serious problem in terms of the internet
development, which is a cybercrime. Surveys reveal that the internet
domain security is much lower in Armenia, and we often see breaches by
the Azeris and Turks,’ he said, noting that 3 billion people on the
planet are currently internet users.

`The pan-Armenian survey launched will help find what percentage of
the population is involved in online communities. But [many] in
Armenia – starting from young children – use the Internet,’ Saghyan
said, adding that Armenia is a leading country in terms of its
internet users whose number grows rapidly by every year.

The Conference organized by the “European Union – Turkey Civic Commission”
(EUTCC) and the “European United Left – Nordic Green Left Group of the
European Parliament” (GUE/NGL) on December 5-6, 2012, in the European
Parliament has adopted the following final resolution on “European Union,
Turkey and the Kurds”:

The 9th Annual EUTCC International Conference met on 5-6 December 2012 at
the European Parliament in Brussels. All of the presentations elaborated on
the findings of the European Commission’s most recent (2012) Progress
Report on Turkey’s EU accession process that unfortunately: “The Kurdish
issue and . . . the 2009 democratic opening aimed at addressing amongst
others the Kurdish issue were not followed through. . . . Overall, there
was no progress towards a solution as regards the Kurdish issue.”

What is going on in Turkey today appears to be an attempt to stifle Kurdish
voices and impose on the Kurds a unilateral solution to fundamental issues
of security and the future of the country. The KCK arrests and trials have
been intensified. There has been a recent escalation in violence, arrests,
oppression of the political sphere and media, violations of freedom of
thought and the overall lack of progress in the EU accession process. The
current threat to lift the parliamentary immunities of BDP MPs and the
failure to implicate those responsible for the Roboski massacre of 34
civilians on 28 December 2011 are specific examples of this situation.

The current Turkish debate over whether to institute a presidential system
of government or maintain a parliamentary system ignores the basic issue,
namely writing a new democratic and civilian constitution to replace the
authoritarian statist one imposed by the military in the eighties. The 9th
EUTCC Conference notes that the Constitutional Reconciliation Committee in
Turkey should have successfully finished its work in drawing up such a
democratic and civilian constitution by the end of 2012.

Furthermore, the Conference notes that the Turkish government’s approach to
the civil war in Syria seeks to reduce the recent achievements of its local
Kurdish population and is thus shaped around an anti-Kurdish axis. Instead,
Turkey and all other involved should encourage a non-violent dialogue among
all the political, religious, ethnic, and other groups in Syria with the
view of helping to create a democratic and pluralist state that is
inclusive of all its many different peoples.

Most importantly, however, the 9th EUTCC Conference notes that still
lacking is the willingness to negotiate genuinely with the Kurds and
continue the credible talks with Mr. Abdullah Öcalan. In other words, until
the Turkish government truly accepts the PKK as a negotiating partner–along
the lines of what Britain successfully did with Sinn Fein and the Irish
Republican Army (IRA), the African National Congress and South Africa, and
recently FARC and Colombia–it is doubtful whether a political solution to
this continuing crisis can be reached.

Mr. Öcalan’s recent 16 months of solitary confinement and the illegal
arrest of his attorneys are a clear violation of international law. This
solitary confinement is self-defeating for Turkey because it prevents Mr.
Öcalan from being able to prepare the basis for peace and reconciliation
with the Turkish state. The EUTCC Conference further takes note that the
recent hunger strike by more than 684 imprisoned non-violent Kurdish
dissidents (the so-called KCK arrests and trials) was only successfully
concluded when the Turkish government finally turned to negotiating with
Mr. Abdullah Öcalan.

The EUTCC calls for the immediate resumption, without preconditions, of the
Oslo Process of direct talks between Turkey and the PKK with the intention
of instituting Turkey’s full respect for the fundamental democratic rights
of all its citizens. The Conference warmly endorses the recent call by
Nobel Peace Prize Laureate Archbishop Emeritus Desmond Tutu for the
Resumption of Dialogue between the Turkish Government and the PKK leader
Mr. Abdullah Öcalan.

Specifically we call for civic rather than ethnic Turkish citizenship,
mother-tongue education in the schools and defense in the courts, and
meaningful decentralization, among other necessary reforms, that as already
noted, can be best implemented by writing and ratifying a new civilian and
democratic constitution.

Pursuant to the presentations of the Conference attendants and
contributions made by its delegates, the EUTCC resolves to adopt the
following declarations and calls for action to be undertaken by all the
relevant parties to the conflict:

1.) The Conference notes positively Turkey’s recent reforms, but finds
that more reform is needed to meet Turkey’s requirements for EU accession.

2.) Specifically, the Conference calls on the EC Committee for the
Prevention of Torture (CPT) and the EU to urgently alleviate Mr. Abdullah
Öcalan’s current conditions of solitary confinement. In contravention of
the ECHR, Öcalan’s attorneys have had no visits allowed during this time.
All core conditions must be met in order that Mr. Abdullah Öcalan can play
a full part in the negotiation process and also freely communicate with his
organization.

3.) The EUTCC calls for the direct negotiations between Turkey and the
Kurds to be re-established immediately and without preconditions. It also
calls on the EU to play a role in these negotiations by providing political
and official support for the creation of a democratic platform for dialogue
between Turkey and the Kurdish representatives. The basis for a general
political amnesty must be prepared as part of a wider negotiated peace
process. In order to facilitate these negotiations, the Conference urges
all countries to remove the PKK from their terrorist lists

4.) The EUTCC Conference resolves to periodically make recommendations
regarding measures for the Turkish accession process, the protection of
human rights and the situation of the Kurds. Focusing on the unfair trials
and grave violations of human rights in the KCK cases and many others, the
Conference calls upon the EU Presidency and Commission to open new chapters
in the process of EU-Turkey accession, especially in the field of judiciary
and fundamental rights. In parallel with this requirement, the Conference
also calls upon the Turkish Government to speed up the legal and judicial
reform package by enlarging their contents so that thousands of Kurdish
political activists can be released from prisons.

5.) The Conference calls upon the Turkish authorities to seriously write
and ratify the promised new democratic and civil constitution along with
resuming a new approach of dialogue and negotiation in all fundamental
problematic issues.

Second and final day of the Conference

Democratic Union Party (PYD) co-chair Saleh Muslim, journalists Cengiz
Çandar and Serdar Akinan, Dutch academic Joost Jongerden, Israeli academic
Ofra Benngo and Democratic Society Congress (DTK) co-chair Aysel Tuðluk
were among the speakers of the second day of the 9th international
conference on “The European Union, Turkey and Kurds”.

PYD co-chair Saleh Muslim said the followings in his speech on Thursday
morning; “We Kurds want to be the soldiers of ourselves, not others’. The
autonomy project consists of not only Kurds but also Arabs, Armenians,
Assyrians, Alewis and all other belief groups. Democratic autonomy is the
only model of solution for the West Kurdistan territory.”

Speaking after, Prof. Ofra Bengo of Moshe Dayan Center at Tel Aviv
University said that; “I would like to make a comparison between the Arab
and Kurdish spring in consideration of the fact that Kurds have carried out
a silent revolution behind which the Arab spring has served as a driving
force. While the Middle East region was dominated by the mentality of
nation state so far, we now see that this policy has been leveled to the
ground.The developments in Arab countries have also paved the way for
Political Islam but the progress in the Kurdish territory didn’t progress
in the same way. The Arab Spring has also influenced the Kurds in Turkey in
many ways and the PKK (Kurdistan Workers Party) has become much stronger.
It is now time for a new beginning as Kurds have gained a strategical role
and self-confidence in the region. The more the states in the region lose
their importance, the brighter future Kurds will have.”

Turkish journalist Cengiz Çavdar said that; “The recent developments
concerning Kurds is not something new in consideration of the time when
they first took to the stage in the history. The presence of a “semi
independent” Kurdish self-government will be a significant step in the
history of Kurds as we now witness that an irrepressible process has been
started under the leadership of the those in Syria.” (ANF, 6 December 2012)

EU: BDP deputies should not be ‘excluded’ from politics

During one of Justice Minister Sadullah Ergin’s rare visits to Brussels,
the European Union made it clear that pro-Kurdish Peace and Democracy Party
(BDP) deputies should not be “excluded” from politics, referring to the
raging debate on whether or not the immunity of those deputies should be
lifted, leaving them open to prosecution.

Peter Stano, spokesman for Stefan Füle, the commissioner for enlargement
and neighborhood policy, a function of the EU’s executive European
Commission, said parliamentary immunity should apply to all deputies on a
non-discriminatory basis. Referring to the commissioner’s line that the
Kurdish issue and problems in Turkey’s Southeast could only be overcome
through the contribution of all democratic forces, Stano said the EU was
not in favor of exclusion of some deputies from Parliament or politics.

Stano’s remarks came on the heels of a heated debate in Turkey over whether
to deprive 10 BDP deputies, who are accused of maintaining ties to the
terrorist Kurdistan Workers’ Party (PKK), of their parliamentary immunity.
The issue intensified after the release of a video showing BDP deputies and
terrorists from the PKK chatting and hugging one another along a highway in
Þemdinli, a district of the southeastern province of Hakkari.

An investigation was launched into the incident by prosecutors, who said
the meeting appeared to have been a prescheduled one, contrary to the BDP’s
claims that it happened spontaneously when the terrorists blocked a road
along their route. BDP deputies are the subject of frequent investigations
by prosecutors but are immune from prosecution while they are in office,
unless the assembly votes in favor of lifting their immunity. A motion was
prepared by the Prime Ministry to lift the immunity of the 10 BDP deputies
and was submitted to Parliament for discussion.

“The European Commission recalls that its consistent line has always been
that the solution to the Kurdish issue and to all the problems in the
Southeast can only be attained through the widest possible contribution of
all democratic forces, and not through their exclusion. The issue of
parliamentary immunity is currently being discussed in the Constitutional
Reconciliation Committee working on a new constitution. Clearly, immunities
must apply to all on a non-discriminatory basis,” read the full text of
Stano’s statement.

In the meantime, sources claimed that Ergin and Füle discussed a judicial
reform package under preparation in Turkey during their meeting on
Thursday. The commission has been insistent on advancing the fourth
package, which it thinks will help to bring progress to issues of freedom

Representatives Adam Schiff has met with Karen Mirzoyan, “foreign
minister” of the so-called separatist regime functioning in the
occupied territories of Azerbaijan.

APA reports quoting “Novosti Armenia” that the further role of the US
in the development of Nagorno Karabakh has been discussed at the
meeting.

“I updated the minister on the status of my efforts to get economic
assistance boosted from $2 million to $5 million in the 2013 budget
that will be finalized in the coming weeks” – said Adam Schiff.

Note that the pro-Armenian congressman sent a letter to the members of
Congress and called the US cut aid to Azerbaijan

Proposal to strengthen parliament may be a way of finding an issue the
various opposition groups can all agree on.

Prosperous Armenia, a political party which recently switched to
the opposition, is proposing far-reaching constitutional changes, in
what analysts say is a bid to unite the anti-government camp around
a single issue.

Under the plan, Armenia would adopt a system similar to reforms in
neighbouring Georgia, where the prime minister and parliament are
becoming more powerful than the president.

Naira Zohrabyan, secretary of Prosperous Armenia’s parliamentary
group, says, “One way of solving the country’s problems, eliminating
the political monopoly, and implementing essential reforms, is to
change over to a parliamentary system of government. That would
lead to a significant increase in the role and responsibility of
political parties.”

The idea has long been favoured by other Armenian opposition parties,
which believe it would give them more of a say in governing a country
currently dominated by President Serzh Sargsyan’s Republican Party.

They have proposed not only shifting to a parliamentary model but
also introducing fully proportional elections. At present, half the
seats in parliament are elected by the first-past-the-post system,
which tends to favour larger parties.

On February 29, the Heritage and Dashnaktsutyun parties introduced a
bill to change the voting system, but legislators rejected it by 54
to 30.

About 12 of Prosperous Armenia’s 36 members of parliament, who were
then part of the ruling coalition, sided with the opposition in the
vote, although the party official opposed it.

Now that the party is in opposition – it announced its withdrawal
from the coalition after the May parliamentary election – it appears
to be aligning itself more closely with the other parties.

Narek Galstyan, of the Centre for European Studies, said constitutional
reform was a neutral issue that could unite all of the parties outside
the governing bloc.

“They are creating a platform for negotiations to link the positions
of the various political groups, which they can then use to discuss
more significant, strategic questions. This is just a pretext to
unite the opposition,” he said.

Under the proposals now being discussed, the next president – an
election is due in 2013 – would serve one year less than before,
so that presidential and parliamentary elections could both take
place in 2017. After those elections, parliament would take charge
of running the country.

The issue could help Prosperous Armenia find common ground with
Dashnaktsutyun, which has included constitutional reforms in its
programme since 1991.

Artsvik Minasyan of Dashnaktsutyun said it was all about
accountability.

“At the moment, the government as a whole bears responsibility for
every matter. If we change to a parliamentary system, then each
minister individually will bear responsibility,” he said.

The Republican Party says there is not enough time between now and
the February presidential election to address the reform proposal
properly. Hovhannes Sahakyan, secretary of the party’s parliamentary
group, said it was really just a publicity stunt to kick-start the
opposition’s campaign.

“Some political groups are trying to use this as a trump card ahead
of the election,” he said.

The central council of the Rule of Law party, the junior partner
in the ruling coalition, discussed the proposal on November 16, and
concluded that introducing a parliamentary system would be unwise in
almost every way.

“It’s such a difficult issue that it needs to be discussed not by
politicians, but by experts and academics, and only after than should
it be put on the agenda,” party spokesman Mher Shahgeldyan said.

Hrant Melik-Shahnazaryan, a analyst at the Mitk think-tank, said the
Armenia’s unique and difficult geopolitical environment meant that
a strong president would be needed if things deteriorated. Armenia
has frosty relations with two of its neighbours, Azerbaijan and Turkey.

While it is in good terms with the other two, Georgia and Iran,
they have their own problems with Russia and the West, respectively.

AZERBAIJAN IMPEDES THE AGREEMENT ON BASIC PRINCIPLES, ARMENIAN FM SAYS

Yerevan/Mediamax/. Armenian Foreign Minister Edward Nalbandian
stated that Azerbaijan poses a threat to the security of the region
by constantly menacing to use force against Nagorno-Karabakh and
Armenia along with daily war-mongering, Mediamax reports.

“The Azerbaijani officials are trying to take the negotiation process
out of this format, to replace the mediators, to denigrate Co-Chairs’
efforts to find a negotiated solution. The Azerbaijani side is also
continuously assaulting the Personal Representative of the OSCE
Chairman-in-Office, in spite of his and his team’s efforts to not
allow the escalation of the situation on the ground”, Armenian FM said.

The Minister said that it became habitual for Azerbaijan to backtrack
on agreements to which it had previously consented to.

“Despite the agreement on the creation of a mechanism to investigate
the ceasefire violations, as you know, Azerbaijan did everything to
prevent its creation, even threatening to veto the entire OSCE budget”,
said the Minister. He also called the attention of those present to
the fact that Azerbaijan by its maximalist approaches is seeking one
sided advantage in the negotiating process.

Yerevan/Mediamax/. Armenian Foreign Minister Edward Nalbandian said
that Armenia is determined to hold the 2013 presidential elections
in line with highest democratic standards.

Speaking at OSCE Ministerial Council in Dublin, Edward Nalbandian
said that Armenia continues cooperating with the OSCE/ODIHR to fulfill
the proposals of the observer missions at elections, Mediamax reports.

“The Armenian government is implementing a large-scale package of
reforms to strengthen democratic structures, supremacy of law even
more, protect and bolster fundamental human rights and freedoms and
improve the election processes”, said Armenian Foreign Minister.
