KOCHARIAN FIXED COURT RULING AGAINST TER-PETROSSIAN: CONSTITUTIONAL COURT JUSTICE TO US OFFICIALS

In yet another US cable (this one dated Mar. 7, 2008) released by
whistle-blowing website WikiLeaks on Aug. 30, 2011, then US Deputy
Chief of Mission (DCM) to Armenia Joseph Pennington notes embassy
officials were approached by Valery Poghossian (pictured), one of
Armenia’s nine Constitutional Court justices, on Mar. 6, 2008, for
a secret meeting in which he declared that then president of Armenia
Robert Kocharian fixed the court’s upcoming Mar. 8 decision to decide
against the complaint by ex-president Levon Ter-Petrossian (LTP)
alleging vote fraud in the disputed February 19 presidential election.

“Poghossian said he personally had been pressured by the Presidency,
and alleged some of his colleagues had as well. The justice said
‘absolute tyranny’ now prevailed in Armenia, and fretted the fixed
decision could have ‘unpredictable consequences’ for the country. He
warned that if the international community allowed the authorities
off the hook after the fixed decision, it would do irreversible
damage to Armenia, and doom any fading hopes the country still has
for democracy,” Pennington wrote.

Poghossian approached US embassy staff and, according to the cable,
alleged that Kocharian fixed the upcoming Mar. 8 decision of the
Constitutional Court that will rule against LTP’s election result
complaint.

“Late on Mar. 4, on the eve of the court’s hearing of LTP’s
complaint, Poghossian said he was contacted by phone and summoned
to the Presidency by someone speaking on behalf of the president’s
chief of staff. Initially taken back by the call, he said he laughed
at the caller before refusing the summoning. He then ignored repeated
calls placed to his office that evening.

“Poghossian alleged that at least three of his colleagues answered
similar summons to the presidency earlier on Mar. 4, though he cannot
prove it. He said he obtained this information from reliable sources
who saw the justices inside presidential offices that day. He also
told Emboffs [embassy officials] that the presidency threatened to
fire his brother who works there if he could not convince Poghossian
to answer the summoning. Poghossian, who has been absent from the
court’s hearing of the complaint the last three days, and as a result
cannot participate in the final decision, said illness prevented him
from being present. But he confided that even if he were healthy,
he would not appear at the hearings.

“When Poghossian said he raised the issue of presidential pressure with
his justice colleagues, his concerns were ‘rejected.’ He also alleged
that one of the judges, Justice Kim Balayan, has been co-opted by the
authorities via the recent appointment of his son Tigran Balayan as
the new spokesman at the Ministry of Foreign Affairs.

(Note: The former spokesman, Vladimir Karapetian, was fired with
five other diplomats in late February after publicly criticizing the
authorities’ handling of the election. End note.) Poghossian said his
stance on the case, and absence from the hearing, could have personal
consequences for him after the hearing, though he did not specify what
those were. He confided, however, that he had ‘grounds to be scared.’
He also noted that if not for the pressure they were being subjected
to, almost all of the justices would decide in LTP’s favor.

“Poghossian averred that the court’s fixed decision could be
‘catalytic’ in escalating existing tensions and fomenting new
violence. He said ‘absolute tyranny’ now prevailed in Armenia, where
it was impossible to solve issues by legal means. He said the current
‘moral and psychological’ atmosphere created by the ruling regime,
in addition to the declaration of the state of emergency and its
very harsh restrictions, placed the Constitutional Court under great
pressure to hew the directives of the authorities.

“Despite the climate of fear the authorities seek to create,
Poghossian said it was conceivable that LTP could attract hundreds
of thousands of supporters in the street after the lifting of the
state of emergency. In this case, Poghossian said he did not rule out
a scenario where the authorities would extend, or reimpose emergency
control if they felt their grip on power was being challenged. He also
said the authorities were brazen enough to follow through on their
threat to arrest LTP, even though they had no legal right to do so.

But ‘they can do anything they want to’ lamented Poghossian.

“During the meeting, Poghossian shared that at various points in
the 1990s he headed the KGB and national police in Armenia. Emboffs
proceeded to quiz him on post-violence reports of unreported dead,
and allegations that army units from Nagorno-Karabakh were brought
in to quell the violence. He said information made available to him
‘by virtue of who I used to be’ suggests the reports are not entirely
baseless.

“He said he had information that the death toll had been reduced
by the authorities, and that some families had been forced to sign
fabricated death certificates before they were allowed to recover
relatives’ remains. He said he ruled nothing out, given the nature
of the regime,” reads the cable.

In his commentary at the end of the cable, Pennington writes:

“We have no way of confirming Justice Poghossian’s allegations, but
the fact that one of Armenia’s highest-ranking public servants reached
out the way he did is revealing in itself. Poghossian was appointed
Justice during the LTP administration, and while he didn’t hide his
political sympathies, it’s possible that recent political events have
jaundiced his views. That said, his apprehension appeared bona fide,
and Emboffs had the sense he was acting out of a feeling of patriotism
for his country.”

Les deputes de la commission des affaires etrangères ont exprime de
profondes inquietudes face aux recents developpements en Turquie
concernant les allegations de corruption de haut niveau, dans une
resolution adoptee lundi sur les progrès realises par la Turquie
en 2013 en vue de son adhesion a l’EU. Ils ajoutent qu’une reforme
constitutionnelle doit etre une priorite absolue pour la modernisation
et la democratisation du pays.

La resolution regrette la suppression des procureurs et des officiers
de police en charge des enquetes sur l’origine de la corruption et
appelle les autorites a assurer le bon fonctionnement de la Cour des
comptes, soulignant l’importance vitale d’une justice independante
et de la separation des pouvoirs.

Les deputes insistent sur l’importance de la Turquie en tant que
partenaire strategique de l’Union europeenne. Ils s’inquiètent du
manque de progrès concernant la reforme constitutionnelle, notamment
la suspension des travaux du comite de conciliation du parlement turc
sur les amendements constitutionnels.

Ils mettent en avant l’importance d’un dialogue renforce et d’une
cooperation etroite entre l’UE et la Turquie sur le processus de
reforme pour que les negociations continuent de fournir a la Turquie
des points de references clairs et credibles. Ils souhaitent que le
Conseil fasse des efforts pour l’ouverture des chapitres de negociation
23 et 24, qui portent sur la justice et les droits fondamentaux,
et sur la justice et les affaires interieures.

Restriction des libertes

La commission parlementaire fait part de ses profondes inquietudes
concernant les nouvelles lois sur internet, qui introduisent des
contrôles et une surveillance excessifs de l’accès a internet, et
concernant les nouvelles lois judiciaires, qui pourraient empecher la
Turquie de repondre aux critères de Copenhague pour l’adhesion a l’UE.

Par ailleurs, le texte appelle les autorites a repondre aux
manifestations publiques avec plus de retenue et a fournir un cadre
juridique pour restaurer les droits de propriete de toutes les
communautes religieuses.

La question kurde et la reunification de Chypre

Dans leur resolution, les deputes encouragent les autorites turques a
mettre en place les reformes necessaires pour promouvoir les droits
sociaux, economiques et culturels de la communaute kurde, notamment
par l’education dans les ecoles publiques kurdes. Concernant Chypre,
ils saluent la declaration commune des dirigeants des deux communautes
de relancer les discussions sur la reunification de l’île, soulignant
l’importance de cette reunification.

If true, it would be the first reported case of Americans fighting
for Assad

A video posted online and shared Saturday by the media monitoring
group Middle East Media Research Institute purports to show two Los
Angeles gangsters fighting alongside the forces of President Bashar
al-Assad in Syria’s civil war.

In the video, rife with cursing and gunfire, the two men claim to
be on the “front lines” of the fighting. One brandishes a tattoo at
the camera, and both fire guns at a supposed enemy off camera. It’s
impossible to confirm the authenticity of the video or the claims
made by the supposed gangsters, or to know whether the two men are U.S.

citizens.

One man identifies himself as Creeper from the Surenos, a collection
of affiliated California gangs linked to the Mexican mafia, the
Washington Post reports. The other calls himself Wino and says he
is part of the Westside Armenian Power, an L.A. gang. The Armenian
minority in Syria is a major supporter of Assad.

MEMRI, a Washington D.C.-based organization that is considered
pro-Israel, identified Wino as Nerses Kilajyan. A Facebook page linked
to that name shows images of Wino dating back to Dec. 2012, some in the
garb of Hezbollah, the Lebanese group that has backed Assad in Syria.

Countries in Europe and the Middle East have seen waves of young
men join the fighting in Syria, and about 50 Americans are believed
to have traveled to Syria to fight for the rebels, according to
congressional testimony by Director of National Intelligence James
Clapper last month, the Post reports. If real, the video would be
the first reported evidence of Americans fighting for Assad.

“I’m pretty sure that they’re in Syria; I have no reason to believe
they’re lying,” MEMRI researcher Rafael Green told FoxNews.com. “The
pictures show [Wino] with guns and grenades and he’s even photographed
in the Hezbollah uniform. It seems as authentic as it gets.”

40-year psychiatric nursing veteran at IMH has seen it all

FOR many of her patients, the woman they call “Sister Gali” is closer
than family. She tends to their daily needs, listens to their woes,
puts up with their unpredictable ways and – when she can – sees them
off on their final journeys.

With nearly 40 years at the Institute of Mental Health (IMH), Ms
Therese Ann Galistan, 62, is one of the longest-serving nurses at
the hospital, which recently held a media tour.

Ms Galistan, who is single, is one of a rare breed, for psychiatric
nursing is not popular among young nurses because of its many
challenges.

It is not unknown for patients to get into fights, injuring staff or
one another.

Once, a patient climbed onto the hospital’s roof. Ms Galistan and
her colleagues spent more than an hour coaxing the man to come down.

“Sometimes, there are aggressive or violent patients, and you need
to recognise the early signs and take preventive action,” she said.

She has had to restrain patients but has never put one in a
straitjacket – it has not been used here since the 1930s.

Like most people, Ms Galistan initially felt fearful about working
at the mental hospital, but learnt to take it in her stride.

Ms Galistan, one of six children in a family with traces of Armenian
ancestry, is driven by the desire to help others, like her mother
and grandmother, who were teachers.

“I always admired people serving the community – people wearing
uniforms,” she said. “I wanted to be a policewoman at first, but I
didn’t meet the height requirement,” she said.

Her mother suggested that she try nursing and she was posted to IMH,
then Woodbridge Hospital, as a student nurse back in the 1970s.

Her encounter with a depressed woman there made her choose a career
in psychiatric nursing.

“Every day, I would spend time talking to her and telling her she
could trust me. But she was totally unresponsive – no eye contact,”
said Ms Galistan. “All my other colleagues were making progress.”

But the trainee nurse did not give up and was rewarded when the patient
improved after therapy. The next time the patient saw Ms Galistan,
she ran to her and gave her a kiss.

“She knew I was trying to help, and I knew that I had an impact
on her.”

Ms Galistan returned to IMH as a psychiatric nurse in 1975 and has
been there ever since. As a junior nurse, her daily routine involved
feeding, bathing and helping patients change.

Now, as a senior nurse clinician with the hospital, she has a more
supervisory role although she also takes care of elderly patients.

Many of them have a mixed bag of ailments – dementia, for instance,
coupled with schizophrenia or bipolar disorder.

Dementia patients are sometimes taken to a garden with a special
looping path at IMH’s new dementia ward. The path allows dementia
patients to satisfy their urge to wander and yet ensures that they
do not get lost, as they walk but do not end up going anywhere.

Sadly, many patients do have nowhere to go to, as their families have
effectively abandoned them and left them in long-stay wards.

Even for the short-stay patients, being admitted can be harrowing.

This is why Ms Galistan feels it is important to make the environment
as homely and comfortable as possible.

“We are family to them, because they can’t go home,” she said.

Despite the occasional violent patient, Ms Galistan has never thought
of quitting.

And her job has its “cute and funny” moments – like the time she
slipped and a male patient stopped her from falling.

“He thought he had saved my life,” she said. “He asked: ‘Do you think
we should get married””

Ms Galistan remembers the days when IMH was still Woodbridge Hospital –
spread out over 145ha instead of its current 25.

“We went gardening with the patients, we flew kites, we played games
like rounders and badminton,” she said. “At night, you could hear
owls hooting.”

The increased administrative workload has meant that she now has less
time with her patients. Her heart for them, however, remains unchanged.

“Knowing I can make a difference to their lives and having them affirm
me – it’s very gratifying,” she said.

Armenian Analyst:There Will Be No War In Ukraine

YEREVAN. – Armenian analyst Alexander Iskandaryan is confident there
will be no war in Ukraine, and there is no real need to seize Crimea.

Commenting on possible involvement of Armenian armed forces’ as a
party to CSTO, Iskandaryan said there hardly can be a situation when
“poor” Russia needs the help of Kyrgyz, Kazakh and Armenian forces
in order to, for example, attack Simferopol.

Another participant of a press conference Davit Shahnazaryan noted that
CSTO member states are obliged to interfere if any of the countries
is attacked.

“I do not think that Russia will be attacked by any state, and the CSTO
help will be needed. Let’s hope that it will never happen and Armenian
authorities will be able to preserve existing silence,” he added.

Armenian National Congress Leader Not Cooperating With Prosperous Ar

In an interview with Tert.am, Political Secretary of the Heritage party
Styopa Safaryan spoke of Armenian ex-president Levon Ter-Petrosyan’s
expectations about Prosperous Armenia Party (PAP) Chairman Gagik
Tsarukyan’s political ambitions.

Safaryan does not believe that “a political force not seeking power
could suddenly come to power.”

With respect to Ter-Petrosyan’s comparing Gagik Tsarukyan with Georgian
ex-premier Bidzina Ivanishvili, Safaryan said:

“I think it is not a problem of being superior or inferior. Each of
them has strong points the other does not. But Ivanishvili clearly
stated the government – Mikheil Saakashvili -was his opponent.”

It is for the first time over the past five years that, at the Armenian
National Congress (ANC) party’s rally on March 1, Ter-Petrosyan did
not call then President of Armenia Robert Kocharyan “responsible for
the massacre” on March 1, 2008.

“I think Levon Ter-Petrosyan is a reasonable and intelligent person.

He cannot have forgotten Robert Kocharyan. Another question is why
he does not consider Robert Kocharyan responsible for March 1. The
answer is cooperation between the PAP and ANC.

“I have for all my life hated the motto ‘the end justifies the means’.

The problem is not at all cooperation with Prosperous Armenia.

Cooperating with the PAP is aimed at solving the country’s numerous
problems, and we are doing it in the Parliament and in the Yerevan
Municipality. To be frank, I cannot understand when something is
placed in a false light. I am for different problems to be settled
in cooperation with all the political forces. But I cannot believe
Ter-Petrosyan’s words – that the aim of the cooperation is a change
of power.”

With respect to the statement by the ruling Republican Party of Armenia
(RPA) that Ter-Petrosyan could now seek the post of Gagik Tsarukyan’s
Spokesman, Safaryan said:

“If Gagik Tsarukyan and the PAP state they are not an opposition
force, I cannot take the ANC’s statement they are an opposition
force seriously.”

Kathy Leach replaced her husband, Jonathan Aves, in the post, with

This time, Kathy Leach will remain as Ambassador till the end of

YEREVAN. – There will be no combat actions and military conflict in
the territory of Ukraine in coming days, says Polish analyst Mateusz
Piskorski.

Piskorski, Director of the European Center of Geopolitical Analysis,
said one must hope there will be no hostilities following Vlaidmir
Putin’s statements.

“The Russian side seems to prefer compromise decisions based on legal
principles, that are in compliance with Ukraine’s Constitution and
based on generally accepted standards,” he said.

If West agrees to partial return to the arrangements signed on February
21, then there can be peaceful settlement of the conflict and certain
dialogue. Piskorski recalled that the guarantors of the February 21
agreement were Polish FM Radoslaw Sikorski and his German counterpart
Frank-Walter Steinmeier.

told Haykakan Zhamanak that all Armenian tour operators are against
the construction of a cafe near the Temple of Garni.

She said that the Culture Ministry’s decision to build a cafe near the
Temple also caused bewilderment among foreign partners of Armenian
tour operators so they are likely to demand removing the Temple of
Garni from tourist packages.
