REFORMS FOR IMPROVING MINORITY RIGHTS PICKED UP PACE AFTER 2010

Despite claims that reforms came to a halt after 2010, efforts to
improve minority and religious rights, while still incomplete, tackled
long-ignored issues key to progress

ISTANBUL — Over the past few years, Turkey has reinvigorated its
reformist image through amendments that set a precedent for the
country by reinstating the rights of ethnic minorities and religious
groups not only to improve the country’s democracy but also to heal
past wounds. Turkey’s history is marked by certain painful issues,
including the Armenian incident of 1915 in which Armenian people lost
their lives, the independent tribunals established soon after the
founding of the republic to prosecute certain religious authorities
and those against the system, and the long-standing Alevi sorrow over
the Dersim incident in 1938 in which a Turkish military campaign
crushed the Alevi uprising in response to the 1934 Resettlement law
that aimed to assimilate ethnic minorities. Despite a void waiting to
be filled in terms of rights and freedoms in the country, there are
fears that the democratization process that started expeditiously may
slow down. The years following 2010 were a period in which prospective
reforms and amendments to uphold the rights of minorities enhanced the
country’s image.

As part of the democratization process, a reform package adopted in
2013 was a major step to speed up the reform process and reinstate the
rights of minorities. The most significant outcome of the
democratization process was the reconciliation initiative that started
in 2013 between Ankara and the Kurds. The Kurdish issue has long been
considered the country’s open wound after the illegal terrorist
organization the PKK took up arms against Turkey with the aim of
carving out a separate state in the southeast.

To reinstate the rights of ethnic groups such as the Kurds, the
democratization package allows for education in mother tongue at
private schools and the use of languages other than Turkish for
political campaigning. According to the package, private schools are
allowed to teach in languages other than Turkish, enabling local
communities to have access to education in their mother tongue.

The law also allows former non-Turkish names of villages and
neighborhoods to be reinstated. The new legislation stipulates that
Turkish citizens can open private education institutions to provide
education in languages and dialects they traditionally use in their
daily lives on the condition that the schools are subject to the
provisions of the Private Educational Institutions Act and are
inspected by the Ministry of National Education.

Political parties and candidates will be able to campaign in languages
other than Turkish. Citizens will be also able to use the letters “q,”
“x” and “w” which do not appear in the Turkish alphabet. Land
belonging to the Mor Gabriel Monastery was reinstated to Assyrian
citizens as part of the new legislation. The hijab ban was abolished
to end discrimination against women who wear the headscarf and choose
to work in governmental bodies. This is an important step for the
protection of individual rights and freedoms in the spheres of freedom
of religion and conscience and anti-discrimination within the
framework of norms of the European Convention on Human Rights.

The 2014 democratization package that is accepted as a continuation of
the 2013 democratization process abolished the Specially Authorized
Courts (ÖYM) that were established in line with Article 10 of the
Counterterrorism Law. Binding rules in relation to audio and video
recordings have been applied to avoid audio files of third parties or
suspects being illegally leaked to news outlets. These amendments
against illegal recordings are expected to tackle the growing issue of
cyberbullying in Turkey where illegal recordings of political figures
are deliberately leaked to the media to tarnish both the image of the
government and specific authorities.
Another reform clause adopted by the Parliamentary Justice Commission
is the right to demand compensation to emphasize and secure the
confidentiality of procedures.

Those who violate the confidentiality of an investigation or a
person’s private life could face compensation charges in line with the
adopted amendments. In addition, as part of the efforts to prevent a
lengthy pre-trial detention, the maximum detention period was reduced
to five years from 10 years.

Amendments on primary and secondary education adopted in 2012
stipulate the adoption of the 12-year gradual compulsory education
system instead of the eight-year uninterrupted compulsory education
system.

In addition, the 12-year period was divided into three phases and high
school education was covered within the compulsory education period.

As part of the 2010 Turkish Constitutional Referendum in which a
number of amendments were approved by popular vote, significant
changes were made to the constitution. The Human Rights Committee was
established in 2010 to work on the improvement and protection of human
rights, to prevent violation thereof, to fight against torture and
maltreatment, to analyze complaints and applications and to follow up
on their results and take initiative regarding the solution of
problems.

On women’s rights, the referendum stipulated that measures for
positive discrimination in favor of women are not contrary to the
principle of equality. The law regarding the protection of families
and the prevention of violence against women was also enacted in 2012.
The purpose of the law is to regulate procedures and principles
regarding measures to protect women, children and family members who
are, or likely to be, exposed to violence, and individuals who are
exposed to incessant stalking and to prevent any attempts of violence
toward them.

As of 2012, local reverends (mele) in southern and southeastern Turkey
who received religious education are to be employed by the government
as religious officials.

Daily Sabah spoke to legal experts including academics and a
Parliament deputy about Turkey’s ongoing democratization process.
The main opposition Republican People’s Party (CHP) deputy, Aykan
Erdemir, echoed European Commissioner for Enlargement Stefan Fule’s
sentiments that Turkey’s democratization process has appeared to
regress.

Erdemir stated that the reason behind the regression is Turkey’s
backward steps, not apathy or a slowdown. He further pointed out that
the sustainability of the democratization process can only be ensured
through public accord and negotiations. Ali Murat Yel, an academic at
Marmara University, praised the country’s democratization process but
also touched on the deficiency of the process. Yel said the reform
package is brought to the table from time to time, but the main
necessity is not a package but a constitution, including reforms. “I
observed a deficiency in terms of adaptation of EU acquis. Turkey
needs to put EU acquis into practice without waiting for EU
membership,” said Yel, adding that the AK Party is the only party that
is able to take major steps toward democracy in Turkey but it needs to
accelerate this process.

Former Representative of the Turkish Minority Foundations Laki Vingas
commented on the democratization package in light of minority rights.
Vingas stated that packaging mentality while proposing reforms is a
deficiency in the process. Highlighting that covering required reforms
with a new constitution will be more useful, Vingas said, “Minorities
are satisfied with the packages to a certain extent, but there are
still expectations.

For example, hate speech was expected to be considered as a crime in
the package, but it was not. Religious freedom and freedom of
association are other issues waiting to be amended.” He further noted
that even though these amendments are made theoretically, they remain
insufficient in practice.

CONGRATULATORY ADDRESS BY PRESIDENT SERZH SARGSYAN ON VICTORY AND PEACE DAY

11:06 09.05.2014

Dear compatriots,

I cordially congratulate you on the occasion of Victory and Peace Day.

For the Armenian people, May 9 holds great significance because it
heralded the beginning of a new and peaceful life. During World War II,
hundreds of thousands of Armenians fought in the trenches of justice
and freedom and came out with credit.

For us, this is first of all a holiday of peace which afforded us a
historic opportunity to give the fatherland a new start in life with
our honest work.

The destiny gave us one more historic opportunity – one more May
victory. On May 9 of 1992, we were once again in the trenches of
justice and freedom fighting against national discrimination and
genocide.

With the liberation of Shushi, not only Stepanakert avoided physical
annihilation, but also Artsakh, as well as Armenia and Armenians’
future in the broad sense.

Today, we bow with gratitude to the memory of all the brave fighters
who paid for peace by their own lives.

Long live the peace – the mother of all blessings of the world!

Glory to our heroes!

Modern-day martyrdom seed of Christian unity, pontiff says

Vatican City – Pope Francis on Thursday recalled the Armenian genocide
in the early 20th century during an audience with Karekin II, head of
the Catholicate of Etchmiadzin of the Armenian Apostolic Church. “The
number of disciples who shed their blood for Christ in the tragic
events of the last century is certainly higher than that of the early
martyrs,” Francis told Karekin II, elected 132nd Supreme Patriarch
and Catholicos of All Armenians in 1999. “In this martyrology the
children of the Armenian nation have a place of honour,” continued
the Argentinian pontiff. “Their tragic and noble testimony must not
be forgotten,” he said. “Just as in the early Church the blood of
the martyrs sowed the seed of new Christians, so in modern times
the blood of many Christians has become the seed of unity” among
Christian churches, continued the pope. An estimated 1.5 million
Armenians were systematically exterminated under the Ottoman Empire
during the First World War in what is said to be the second most
studied act of genocide after the Jewish Holocaust three decades later.

President Barack Obama was recognized for his global efforts to
protect human rights at a gala event hosted by director Steven
Spielberg Wednesday night.

The USC Shoah Foundation, founded by Spielberg, honored President
Obama with the Ambassador for Humanity Award at the 20th Anniversary
Ambassadors for Humanity Gala at the Century Plaza Hotel in Century
City.

Fundraisers, Speech on President’s CA Itinerary

“I think about young girls in Nigeria, or children caught up in the
conflict in Syria,” President Obama said during his speech. “I think
drop by drop by drop, that we can erode and wear down these forces
that are so destructive, that tell a different story.”

The USC Shoah Foundation documents and archives the video testimonies
of survivors and witnesses to the Holocaust and other genocides,
such as the one in Armenia and Rwanda. Some of those survivors were
in attendance at Wednesday night’s gala.

“Every day that you have lived, every child and grandchild that your
families have brought into this world, have served as the ultimate
rebuke to evil and the ultimate expression of love and hope,” President
Obama said.

The USC Shoah Foundation was founded by Spielberg after he completed
the the film, “Schindler’s List.” Since it’s founding, more than
50,000 personal accounts of survival have been documented.

“As long as we fail to learn, our work will be urgent work,” Spielberg
said at the event.

The star-studded evening opened up with remarks by Liam Neeson, the
actor who portrayed Oskar Schindler in the film. Bruce Springsteen
performed and the event itself was hosted by Conan O’Brien.

“The President’s recent appointment of the first special envoy for
Holocaust Survivor Services in United States history demonstrates
his staunch commitment to honoring the past while building a better
future,” Spielberg said in the a statement.

Before speaking at the USC Shoah Foundation gala Wednesday night,
President Obama attended a campaign fundraiser at the Bel Air home
of Disney Studios Chairman Alan Horn.

The President was expected to stay overnight on the Westside before
traveling to San Diego for another Congressional fundraiser Thursday.

Wednesday’s visit was President Obama’s 17th visit to Los Angeles
since taking office in 2009.

Arman Navasardyan about John Heffern’s statement, `This is a
diplomatic rope-dancing’

May 10 2014

`I do not find any acceptable point, or any objective point in this
statement for me,’ such opinion was expressed by RA former Foreign
Deputy Minister, also RA Ambassador Extraordinary and Plenipotentiary
Arman Navasardyan, in the conversation with Aravot.am, assessing the
statement of the U.S. Ambassador to Armenia John Heffern regarding the
Minsk Group American Co-Chair James Warlick’s statements. Recall that
earlier today, John Heffern noted that Warlick’s statement was not an
announcement of a new policy on the Nagorno-Karabakh issue and
stressed. `He believed that it would be useful to once again repeat
the principles, the six elements that are mentioned in the documents
of the OSCE Minsk Group to refresh it for the people of Armenia and
Azerbaijan and to start a discussion on this issue. The goal was not
announcing about a new policy. The goal was to start a discussion on
the clauses of the peace agreement, so that the peoples of the two
countries would be ready for the moment, when the moment of the peace
agreement will come.’ Arman Navasardyan noted, `One could find some
rational points in Warlick’s statement on making reference to the
Helsinki Final Act, and Heffern is making a general statement within
the context of peace. Who is against peace? This is a diplomatic
statement, just a diplomatic rope-dancing.’ With regard to Warlick’s
statement, `we do not recognize Nagorno-Karabakh Republic, and I
believe people will interpret my posts correctly. There are two
sovereign countries in the region, Armenia and Azerbaijan’, Mr.
Navasardyan expressed the following opinion, `Well, what’s the matter
then¦ this is a wrong statement, we are also guilty that 10 years ago,
we somehow threw the NKR from the negotiation side to another side, we
placed it into the margin.’ Director of the Armenian Center for
Political and International Relations’, Aghasi Yenokyan, said the
following regarding the U.S. Ambassador’s statement, `I think John
Heffern’s words were one of the objectives of Warlick’s statement. The
other objective of Warlick’s statement was that they think that now
Russia will start leading discussion to its benefit and create some
kind of a condition, which they are trying to prevent.’

The civic activist protesting against the controversial pension reforms
conducted Thursday evening a march in downtown Yerevan, calling for
government efforts to allow for voluntary choice in pension contributions.

The young members of the group I am Against! carried flags and banners to
the protest site as part of their awareness-raising campaign.

In an interview with Tert.am earlier today, an activist of the group, David
Manukyan, said they intend to continue the active campaign.

Addressing the protesting crowd during the march, the activist said he
doesn’t think that the government has taken any real steps to abide by the
Constitutional Court’s April 2 ruling. `Dear campaigners, have you so far
heard anything else apart from beautiful statements and promises? No. If
the authorities are not ready to realize the essence of the country’s top
constitutional tribunal, I am Against! will commit itself to that,’ he said.

The protesting activists were conducting the march singing rock songs and
chanting slogans time and again.

MOSCOW, May 8 (RIA Novosti) ` Russia’s strategic missile forces test
launched an intercontinental ballistic missile (ICBM) during a
training exercise on Thursday under the leadership of President
Vladimir Putin.

The RS-12M Topol ICBM was launched from the country’s northern
Plesetsk space center.

Prelaunch operations and the launch and flight of the missile followed
a strictly planned procedure. The Russian Ministry of Defense said the
missile struck the practice target at the Kura ballistic range in the
country’s Far East within the prescribed accuracy.

On Thursday, President Putin as Russia’s commander-in-chief held a
planned training exercise of the armed forces. The presidents of
Collective Security Treaty Organization (CSTO) member countries `
Belarus, Armenia, Tajikistan and Kyrgyzstan ` observed the training
process at the national defense control center.

The practice event included maneuvers of individual formations and
units of the missile troops, artillery, aircraft and air defense
systems to destroy ground forces and counter massive missile and air
strikes of a hypothetical opponent.

Another part of training focused on nuclear deterrence and countering
the opponent’s ballistic attack using the missile defense system of
the city of Moscow.

The training involved strategic bombers, ballistic submarines,
strategic purpose mobile missile systems and other aerospace defense
equipment. In addition, the training included the artillery and rocket
forces of the Southern and Central Military Districts.
